TERMS AND CONDITION OF e-AUCTION

1. The Service Provider will also provide demonstration/training on e-Auction, if required to the bidders who have deposited EMD with Authorised Officer.

2. The intending participants of e-auction may download free of cost, copies of the Sale Notice, Terms & Conditions of e-Auction, Help Manual on operational part of e-Auction & Process Compliance Form related to this e-Auction from the above mentioned web site of the Service Provider https://allahabadbank.auctiontiger.net .

3. For the purpose of participation in the e-Auction, the intending bidder must have a valid digital signature (DSC-Class ll & above). Any intending bidder, presently not having digital signature (DSC) may procure it from from any Licensed Certifying Authority authorized under Section 24 of the Indian I.T. 4. Interested bidders may first login on above mentioned e-auction portal of the Service Provider & on line register as one of the participants for e-Auction, download Process Compliance Form (PCF) & after filling it (PCF) properly may submit the same along with EMD with the Authorised Officer as specified above OR intending Bidder may directly approach the Authorized Officer, obtain blank PCF and fill it properly and submit it along with EMD with the Authorized Officer as specified above and then visit /log in on above mentioned e-auction portal of the Service Provider for on line registration as one of the participants for e-Auction.

5. Process Compliance Form should be properly filled in & signed by the authorized person of the bidder only. It must 1) Name 2) Address 3) Valid e-mail ID and Mobile no., Contact no. (Registered/ to be registered with above referred e-Auction website).

6. The Earnest Money Deposit (EMD) for an amount equivalent to 10% of reserve price of the property is required to be deposited within 20/10/2015 upto 5:00 P.M in a closed cover along with above referred Process compliance form for taking part in e-Auction with the Authorized Officer along with Demand Draft/Banker’s Cheque pertaining to above referred EMD. The envelope should be super-scribed “EMD for e-Auction A/c M/s Garg Trading Co.”

7. The EMD amount shall be paid through Banker’s cheque/ Demand Draft issued by a Scheduled Commercial Bank drawn in favour of “The Authorised Officer, Allahabad Bank, Auction A/c M/s Garg Trading Co.”. payable at Delhi. The EMD is refundable, if the bid is not successful. Payment by any other mode such as Cheques/Cash will not be accepted for the aforesaid purpose. Bidders, not depositing the earnest money, will not be allowed to participate in the e-auction.

8. The intending Bidder/ Purchasers are required to participate in the e-Auction Process at e-Auction Service Provider’s website https://allahabadbank.auctiontiger.net & the e-Auction will be conducted on 28/10/2015 from 12:00 Noon to 1:00 P.M . During the e-auction, bidders will be allowed to offer higher bid in inter-se bidding over and above the last bid quoted and the minimum increase in the bid amount (Minimum Increment Value) must be of Rs.25,000.00 to the last higher bid of the bidders. is any bid entered in the system by any bidder before 5 minutes of close of the bid time, then automatically a period of 10 minutes will be extended and the same process will be continued for unlimited period and if no higher bid is offered by any bidder within ten minutes to the last highest bid, the e-auction shall be closed.

9. Intending Bidders are advised to properly read and download the Sale Notice, Terms & conditions of e- Auction. Help Manual on operational part of e-Auction and follow them strictly. 10. To the best of knowledge and information of the Authorised Officer, there is no encumbrance on the property/ies. However, the intending bidders should make their own independent inquiries regarding the encumbrances, and claim/right/dues/affecting the property/ies, prior to submitting their bid. The property is being sold with all the existing and future encumbrances whether known or unknown to the bank. The Authorised Officer/ Secured Creditor shall not be responsible in any way for any third party claims/rights/dues.

11. After finalization of e-Auction by the Authorized Officer, only successful bidder will be informed either by email or SMS on their registered mobile or through registered post.

12. The successful bidder will have to deposit 25% (twenty five percent) of the bid amount; less EMD amount deposited, immediately and remaining amount shall be paid within 15 days from the date of auction. In case of failure to deposit the amount within the time as stipulated, the amount deposited by successful bidder will be forfeited by the Authorized Officer and Authorized Officer shall have the liberty to cancel the auction & conduct a fresh auction.

13. All the above referred payments are required to be made in the form of Banker’s Cheque/Demand Draft issued by Scheduled Commercial Bank drawn in favour of “The Authorized Officer, Allahabad Bank, A/c: M/s Garg Trading Co. ”

14. On receipt of the entire sale consideration, the Authorized Officer shall issue the sale certificate as per rules and the same shall be issued in the name of the bidder(s)/purchaser(s)/applicant(s) only and will not be issued any other name(S).

15. Payment of Sale consideration by the successful bidder to the bank will be subject to TDS under section 194-1(A) of Income Tax Act and TDS is to be made by the successful bidder only at the time of depositing remaining 75% of the bid amount.

16. All expenses relating to stamp duty, registration of sale certificate/conveyance, if any, shall be borne by the successful bidder.

17. The Authorized Officer will not be held responsible for any charge, lien, encumbrance, property tax, or any other dues to the Government or anybody in respect of the property under sale.

18. Due to any administrative exigencies, necessitating charge in date and time of e-Auction sale will be intimated through the service provider at the registered email addresses or through SMS on the mobile number registered with the service provider. The Authorized Officer has the absolute right to accept or reject any bid or adjourn/postpone/cancel the sale without assigning any reason thereof. It may be noted that nothing in this notice constitute or deemed to constitute any commitment or representation on the

part of the bank to sell the property and Bank does not incur any liability whatsoever due to any order passed by any court/DRT at any stage of sale process towards the bidder/borrower or any other person.

19. For inspection of the property/ies, the intending bidders may contact Allahabad Bank, Sector- 21C, Faridabad (Fatehpur) Branch, during office hours on 16th & 17 th October, 2015.

20. Neither Allahabad Bank nor the Service provider will be responsible for any lapses / failure (Internet failure, Power failure, etc.) on the part of the vendor, in such cases. In order to ward off such contingent situation, bidders are requested to make all the necessary arrangements / alternatives such as back-up power supply and whatever else required so that they are able to circumvent such situation and are able to participate in the auction successfully.

21. This is also a notice to the borrower / guarantors/mortgagors of the above said loan about holding of this sale on above mentioned date.
