About the Animal Defenders Office The Animal Defenders Office (ADO) is a non-profit, community law practice that specialises in animal law. The ADO offers information and representation for individuals and groups wishing to take action for animals. The ADO also produces information to raise community awareness about animal protection issues, and works to advance animal interests through law reform. The ADO is a member of Community Legal Centres NSW Inc and the National Association of Community Legal Centres. Our responses to key recommendations and previous questions on the issues of animal welfare in agriculture are set out below. Draft Recommendation 5.1 The ADO strongly supports draft recommendation 5.1, for an independent body to develop standards and guidelines for farm animal welfare. There should also be recommendations to state and territories for comparable bodies to be developed at their level. The body should take the form of an Independent Office for Animal Welfare (IOAW), similar to that previously proposed to Parliament in the Voice for Animals (Independent Office of Animal Welfare) Bill 2015. The body should be located separately from the Department of Agriculture and Water Resources to avoid conflict of interest. It should be federally funded and tasked with developing a uniform set of standards for animal welfare. Further, the IOAW should be empowered to investigate and issue reports and recommendations on current key issues on animal welfare. -

About the Animal Defenders Office The Animal Defenders Office (“ADO”) is a nationally accredited community legal centre that specialises in animal law. The ADO is run by volunteer lawyers and law students. The ADO offers information and representation for individuals and groups wishing to protect animals. The ADO also produces information to raise community awareness about animal protection issues, and works to advance animal interests through law reform. The ADO is based in the Australian Capital Territory (“ACT”) and is a member of Community Legal Centres Australia. Background The Bill is an ‘omnibus’ bill which, according to the Explanatory Memorandum (“EM”), purportedly addresses issues regarding the regulation of matters including agriculture and animal management and welfare (EM1). The main focus of the Bill is ‘[u]nauthorised entry by animal activist protestors to places where animals are kept in Queensland’ (EM1). While the ADO does not in principle support the use of animals for agricultural or other commercial purposes, we acknowledge that such use is currently lawful. We have therefore considered the measures proposed in the Bill and our comments are set out in detail below. General comments The treatment of animals by industries that profit from their use has come under increased scrutiny in Australia in recent times. -

PETER PRIMROSE (10:01:47): I move: (1) That this House notes the resolution of the House of Wednesday 16 September 2020 in which this House recognised the critical importance of manufacturing jobs in Western Sydney and called on the Government to stop sending manufacturing jobs overseas. (2) That this House calls on the Leader of the Government in the Legislative Council to report to the House on the following matters: (a) the specific major manufacturing projects since 2011 for both Western Sydney and New South Wales, that the Government or any of its agencies procured from overseas; (b) the estimated total number of jobs for each major manufacturing project since 2011 that have been exported from New South Wales as a consequence of the decision to undertake procurement from overseas; (c) the specific manufacturing projects over the period of the forward estimates that the Government or any of its agencies propose to procure from overseas; (d) any additional legislative and regulatory frameworks proposed to be introduced by the Government in order to implement the resolution of the House that it stop sending manufacturing jobs overseas; and (e) any immediate and long term additional investments proposed by the Government in TAFE; including how it will expand training, education and employment pathways especially for young people. About the Animal Defenders Office The Animal Defenders Office (“ADO”) is a nationally accredited non-profit community legal centre that specialises in animal law. The ADO offers information and representation for individuals and groups wishing to take action for animals. The ADO also produces information to raise community awareness about animal protection issues, and works to advance animal interests through law reform. The ADO is based in the Australian Capital Territory (“ACT”) and is a member of the National Association of Community Legal Centres. Our submission1 The ADO does not support the keeping of poultry for commercial purposes. However, while it remains legal to do so in Australia, the ADO submits that the poultry standards and guidelines require significant improvement before they can claim to ‘enhance animal welfare arrangements in all Australian states and territories’ for commercially kept poultry (page 6). Our recommended improvements are detailed below. Preface The ADO submits that the draft poultry standards and guidelines cannot purport to ‘enhance animal welfare arrangements in all Australian states and territories’ (page 6) when they do not meet existing legislated standards for poultry in the ACT.2 1 Our submission is focussed on the draft poultry standards and guidelines. It does not refer to the Regulation Impact Statement. -

Manager Conservation Research Environment, Planning and Sustainable Development Directorate PO Box 158 Canberra ACT 2601 Email: [email protected] 24 March 2017 Dear Sir/Madam SUBMISSION—EASTERN GREY KANGAROO: DRAFT CONTROLLED NATIVE SPECIES MANAGEMENT PLAN On 23 February 2017 the Animal Defenders Office (ADO) received an invitation from the Conservator of Flora and Fauna to comment on the Eastern Grey Kangaroo: Draft Controlled Native Species Management Plan (the draft plan). The consultation period closes on 24 March 2017. We note the short timeframe for providing comments on a subject as important and complex as managing a wild animal species. About the Animal Defenders Office The ADO is a non-profit, community law practice that specialises in animal law. The ADO is run by volunteer lawyers and law students. We raise community awareness about animal protection issues, and work to advance animal interests through law reform. The ADO is based in Canberra and services the ACT and NSW. About this submission The ADO has the following concerns about the draft plan and its regulatory context: 1. The lack of consultation and accountability in the declaration of Eastern Grey Kangaroos (EGK) as a controlled native species. 2. The ethical concerns with adopting ongoing lethal and often inhumane measures to ‘control’ a local wild animal species. 3. The lack of consideration of human factors threatening local biodiversity. 4. The overreliance on unsupported assertions and out-of-date or irrelevant information to support the draft plan’s policy positions. 5. The research bias towards studies that support the draft plan’s positions and ignoring areas of research that could lead to non-lethal control measures or review of the need for measures. -
Joint Submission to the NSW Biosecurity Act Proposed Framework
SUBMISSION ON THE FRAMEWORK FOR A NSW BIOSECURITY ACT 27 June 2014 Submission on the Framework for a NSW Biosecurity Act This submission addresses the Proposed Framework for a NSW Biosecurity Act (the Proposed Framework).i We acknowledge the potential for the Proposed Framework to strengthen existing biosecurity protections and, in so doing, have positive implications for the environment and animals in NSW. We are, however, very concerned that the current process will be used as an opportunity to criminalise the dissemination of information about factory farming to the public via the media and other third parties. In June 2014, the NSW Minister for Primary Industries, Katrina Hodgkinson MP and Federal Agriculture Minister, Senator Barnaby Joyce announced that they would use the Proposed Framework to introduce laws to target animal activists that use undercover surveillance to record the operations of intensive commercial facilities and disseminate information derived from such surveillance to the public.ii These statements reveal that the issue of biosecurity has the potential to be used inappropriately as a pretext to introduce US-style ‘ag-gag legislation’ – draconian laws that seek to ‘gag’ animal advocates, employees, whistleblowers and the media from making public evidence of illegal animal cruelty. This type of legislation is not sought to address gaps in the law, but rather to stifle transparency: to prevent evidence of animal cruelty from being distributed to the media and, in turn, the public. It is on this point that we take objection. We wish to acknowledge that it is already unlawful to trespass onto private property and to use undercover surveillance devices.
