EAC observation: The EAC, after deliberations and especially in view of the project site in Ib Valley (having CEPI score 66.35) covered under the said orders of NGT, preferred not to take the proposal forward for the present, but to seek advice of the Ministry for appropriate course of action in such cases. The Committee also opined that in case, such proposals are to be considered on merits, environmental conditions and other stringent measures would have to be looked into comprehensively in complete perspective and in consultation with CPCB.

Reply: The project site of Siarmal OCP is located at a distance of 26.4 KM from the Ib Valley - Jharsuguda Critically Polluted Cluster. A letter from the State Pollution Control Board Odisha dt: 10-09-2019 was submitted to Member Secretary, IA-Coal, MoEF&CC, vide our letter dt: 10-09-2019 (Copy enclosed as Enclosure I)

EAC observation: The Committee observed that baseline data for air quality should have been presented in range (Min-Max), rather than average values. Also, air quality modelling and the evaluation of impacts should be based on worst case scenario.

Reply: The baseline data for air has been generated at 10 locations for the period of 4th November 2017 to 3rd February 2018, the details of the same is given in following table:

❖ Baseline data: Baseline data of Siarmal OCP for the year 2017-18 (Nov’17 to Feb’18) has been considered for proposed AQIP. Considering the worst-case scenario modelling was conducted for peak coal and OB i.e. 50.0 Mty coal and 94.62 Mm3 OB respectively.

❖ Modelling Approach The assessment methodology for the air dispersion modelling exercise follows the guidance specified in the US EPA user guide for AERMOD. The model of selection is the commercially available AERMOD View dispersion model, developed by Lakes Environmental. This model is used extensively to assess pollution concentration and deposition from a wide variety of sources. AERMOD View is a true, native Microsoft Windows application and runs in Windows applications. The AMS/EPA Regulatory Model (AERMOD) was specially designed to support the EPA’s regulatory modelling programs. AERMOD is a regulatory steady-state plume modelling system with three separate components:

AERMOD (AERMIC Dispersion Model), AERMAP (AERMOD Terrain Pre- processor), and AERMET (AERMOD Meteorological Pre-processor). The AERMOD model includes a wide range of options for modelling air quality impacts of pollution sources, making it a popular choice among the modelling community for a variety of applications. Some of the modelling capabilities of AERMOD include the following:

➢ The model may be used to analyze primary pollutants and continuous release of toxic and hazardous waste pollutants. ➢ Source emission rates can be treated as constant or may be varied by month, season, hour-of-day, or other optional periods of variation. These variable emission rate factors may be specified for a single source or for a group of sources. For this project all emission rates were treated as constant. ➢ The model can account for the effects of aerodynamic downwash due to buildings that are nearby point source emissions. ➢ Receptor locations can be specified as gridded and/or discrete receptors in a Cartesian or polar coordinate system.

Job No.706124 Page - 2 ➢ For applications involving elevated terrain, the U.S. EPA AERMAP terrain pre- processing program is incorporated into the model to generate hill height scales as well as terrain elevations for all receptor locations. ➢ The model contains algorithms for modelling the effects of settling and removal (through dry and wet deposition) of large particulates and for modelling the effects of precipitation scavenging for gases or particulates. ➢ AERMOD requires two types of meteorological data files, a file containing surface scalar parameters and a file containing vertical profiles. These two files are provided by the U.S. EPA AERMET meteorological pre-processor programme. ❖ Identification of Sources: To assess the impact on air quality different sources of air pollution considered are as follows:

1. Coal cutting and loading. 2. Drilling in OB benches. 3. Blasting in OB benches. 4. Truck loading of coal & OB. 5. Truck unloading of coal & OB 6. Coal and OB transportation 7. Dozing of OB 8. Wind erosion at active OB dumps

❖ Micrometeorological Data

Job No.706124 Page - 3 Micrometeorological and microclimatic parameters were recorded by Ecomen Pvt. Ltd. for the winter period, hourly reading of wind velocity, wind direction, temperature, relative humidity, cloud cover and rainfall data were recorded. The model was run for 3 months data for each day. Considering worst case scenario out of the 90 days data, highest output at each receptor was considered as incremental value.

❖ Emission Rates An S&T study titled, “Development of emission factors for various mining machineries & operations in opencast coal mines (EE-27)” was carried out by CMPDI (HQ) during 2002 to 2008. During this study, emission factors for Suspended Particulate Matter (PM ≤ 100 μm) were developed for Drilling, Loading of coal and OB by Shovel, Unloading of OB, and Transportation on haul roads and Coal sizing. The emission factors data for PM -10 and PM -2.5 have been estimated on the basis of particle size distribution study.

❖ Model Domain, Receptor Network and Terrain Considerations The selected model domain was 12 km in both the east-west and north-south directions, with the centre of the domain being the centre of the proposed project site. For proposed modelling 10 number of discrete cartesian receptor and 441 uniform cartesian receptors have been taken considering the area of extent 12 km buffer zone.

Job No.706124 Page - 4 ❖ Terrain Features: The classification of the land use in the vicinity of the proposed project is needed because dispersion rates differ between urban and rural areas. In general, urban areas cause greater rates of dispersion because of increased turbulent and buoyancy-induced mixing. This is due to the combination of greater surface roughness caused by more buildings and structures and greater amounts of heat released from concrete and similar surfaces. The USEPA guidance provides two procedures to determine whether the character of an area is predominantly urban or rural. One procedure is based on land-use type, and the other is based on population density. Both procedures require an evaluation of characteristics within a 3-km radius from the subject source, but the land-use methodology is considered more accurate. Hence, this method was applied and it was determined that the rural dispersion coefficient be selected for this modelling project. Additionally, the topography in the region of the proposed project is defined as either simple terrain (terrain lying below the stack top elevation) or complex terrain (terrain above the top of the stack). Measurements of the terrain in the area surrounding the proposed project were made using terrain data obtained from SRTM 30 m derived from the WebGiS.

❖ Controlled Measures: The following control measures have been adopted for proposed Siarmal OCP.

In coal mining transportation is major activity of dust generation, which impacts the villages falling in buffer zone, therefore for cumulative impact assessment air quality impact prediction has also been done for incremental coal transportation by nearby mines. From the above table, it can be observed that maximum incremental values has been observed at core zone stations however the predicted concentration will remain under permissible limit as per Coal mine standards with proper control measures. In buffer zone stations due to hilly terrain at northern and southern part of the mine, maximum incremental values observed at stations lying in North and NW direction namely Rampia, Mundelkhet and Ghogharpalli. However absolute values of

PM10 & PM2.5 at all buffer zone locations, is well within permissible of NAAQS, 2009. The baseline data was collected before commissioning of Sardega Siding due to which high values of PM10 was observed.

Since the carrying capacity of the area in terms of air quality is a limiting factor, further precautions are required for air pollution control measures. Since in coal mining areas, about 80% of the dust generation is on account of transportation activities, provision of belt conveyor, first mile connectivity and coal evacuation through railway siding has been proposed for the entire coal area. With commissioning of additional control measures i.e. deployment of Fog Canon, mechanical sweepers etc. the air quality will further improve. The details of such infrastructure along with action plan for its commissioning is as under:

Job No.706124 Page - 15 EAC observation: It was also observed that certain specific conditions of the ToR were not complied with, which inter-alia includes revision of mining plan (condition no.vi), carrying capacity, etc.

Reply: Apart from standard ToR the following specific conditions were also prescribed in ToR. Point wise compliance details of each specific condition is as follows:

Specific point no. 1: Assessment of Carrying capacity of the surrounding ecosystem around the proposed mine.

Reply: Considering the same a detailed Carrying Capacity of Surrounding Ecosystem of Siarmal OCP has been done by CMPDI. The detailed report of the same has also been submitted with Final EIA/EMP as Annexure VI. The salient feature of the proposed study is as follows:

• Carrying capacity of an ecosystem is broadly defined as the size of population that can be supported indefinitely upon the available resources and services of ecosystem.

• Environmental Carrying capacity is the difference between the permissible standard limits and the actual baseline values in respect of three vital components of environment namely Air, Water and Land.

• Carrying Capacity consists of both supportive and assimilative capacity of the study area.

• Study Period has been Six Months and multidisciplinary approach has been used to assess carrying capacity of surrounding ecosystem.

• Surrounding Ecosystem of Study Area comprises:

• The area exhibits acceptable potential in terms of assimilative capacity for noise environment.

• In terms of land use, the NPV will be paid to the Government. In addition, CA charges will also be paid, due to which additional forests will be created over twice the degraded land.

• Aquatic and terrestrial carrying capacity of the study area is good. However, measures proposed to improve the carrying capacity.

• Based on the sampling survey, species distribution was assessed for phytoplankton, zooplankton, macro-invertebrates and fishes for aquatic ecosystem. Sampling investigation has been conducted on different lentic and lotic aquatic systems of Siarmal OCP between August, 2018 & October, 2018.

• Physico-chemical and biological characteristics of all water bodies situated in the study area of Siarmal OCP indicates its healthy and productive nature. Surface water at all the sampling sites located nearby the proposed Siarmal project is suitable for drinking, aquaculture practices, irrigation and other usage of domestic purpose.

• In terrestrial ecosystem, a total of 195 tree species representing 30 species, 25 genus and 17 families were identified from the total area (1600 m2). The average Shannon diversity index value is 1.43, 1.38 and 1.68 in the buffer, core and reserve forest area respectively. The average Simpsons diversity index value is 0.23, 0.22 and 0.08 in the buffer, core and reserve forest area respectively.

In case of any future consideration of mining of dip most coal seams deep seated, a mining plan coupled with geological plan may be proposed with detailing.

Reply: In approved mining plan final land use plan has been prepared considering re-handling of external dump back to the quarry and all efforts has been taken to bring back the land use akin to pre-mining conditions. The final post closure land use as per approved Mining Plan is given in table below.

However, in future, if dip-side block is proposed to be annexed in present property then backfilling and other elements of progressive mine closure will be continued while mining in dip-side block. Final mine closure activities will only be taken up after exhaustion of coal reserve in its dip-side block.

Therefore, for proposed Siarmal OCP no revision of Mining Plan is required.

Specific point no. 3: Details of the Court cases relating to compensation and land acquisition to be presented in the EIA/EMP report.

Reply: This is a new mine. The R&R is being carried out under the direction of “Claims Commission” set up by Hon’ble Supreme Court for the purpose. Detailed

Specific point no. 4: The TOR and other approvals shall be subject to the outcome of the Supreme Court of India.

Reply: Agreed.

Specific point no. 5: Approval of the Chief Wild Life Warden and the State Government to be submitted along with the EIA/EMP report.

Reply: A letter has been obtained from Principal Chief Conservator of Forest (WL) & Chief wildlife Warden (Odisha) vide dtd. 03-06-2015 which states that “no Elephant Corridor passes through Siarmal Coal Block which is in Gopalpur Range of Sundargarh Division”. The copy of the same has also been submitted with Final EIA/EMP as Annexure III and also herewith attached as Enclosure IV.

Specific point no. 6: There shall be no external OB dumps after the mining and that the land shall be brought back up to ground level for use in agricultural purpose.

Reply: As per the approved mining plan there shall be no external dump and maximum efforts has been taken to bring back the land up to ground level for use in agricultural purpose.

Report for the Month of May’20 on Status of Implementation of the Order of the Hon’ble Supreme Court of India in SLP (C) N0- 6933/2007.

The status of implementation of Order of Hon’ble Supreme Court in the above SLP and the Order of the Hon’ble Claims Commission as on 31-05-2020 is summarized as below:-

A. COMPENSATION: -

A.1. Gopalpur and Other seven villages (8 villages)

The implementation status on disbursement of Compensation in respect of Gopalpur and other seven villages which were initially decided is as follows: -

A.1.1 Disbursment of Compensation:-

I. An initial amount of Compensaton of Rs. 687,55,08,688 was sanctioned in phase-I in the Compensation Rolls of 8 villages (Gopalpur, Garjanbahal, Balinga, Bankibahal, Kulda, Karlikachhar, Tikilipara & Sardega) to 4926 awardees. However, additional sanction of interest for an amount of Rs 1,74,021.03 has been received vide civil case No-502 dated 15.07.2015. Further, additional sanction for one awardee of Khata No. 82 of village Balinga for an amount of Rs. 4,10,988.10 has been received vide civil case No. 790 dt-04/08/2016. Further an additional sanction for Khata No. 29 (180/495) of village Gopalpur for an amount of Rs.4,42,801.60 has been received vide civil case No.963 dt- 23.12.2016 and sanction order No. 765 dt-14/11/2018 and an amount of Rs.7,55,416.76 has been received vide civil case No.706 dt-30/03/2016 and sanction order No.753 dt-01/11/2018 for khata No.116 of village Gopalpur. Additional sanction amount of Rs.12719210.84 has been received vide sanction order no-61 Dt: 16.05.2017 for Khata No-180/548 Gopalpur civil case no-382 dt: 20.12.14. Additional amount of Rs.68,449.10 has been received vide sanction order no- MCL/GM/BA/EM/2019-20/100 DT:18.01.2020 village- Balinga Civil Case no- 790 DT:04.08.2016. Additional amount of Rs. 5,10,776.72 has been received vide sanction order no- MCL/GM/BA/EM/2019-20/963 DT:04.11.2019 village- Siarmal khata no-25 vide Civil Case no- 1656/2015 DT:21.11.2016. Khata No-148 of Gopalpur civil case no – 231 dt:08.03.14 added one awadee , Khata No – 184 of Gopalpur civil case no-56 dt:20.05.15 added one awadee, Khata No- 184 of Gopalpur civil case no-121 dt:20.02.15, Khata No- 128 of Gopalpur civil case no-502 dt:15.07.15 and Khata No-48 of Gopalpur civil case No-715 dt:17.07.15. Added four nos awadees inplace of one no awadee Gulu Majhi@Khadia of Gopalpur Khata No- 180/89 vide CC No-970 Dt: 23.08.2017 as per the direction of Claim commission. The total amount sanctioned in respect of 8 villages is Rs 689,00,79,574.94 (Rupees Six Hundred Eighty Nine Crore Seventy Nine Thousand Five Hundred Seventy four and Ninety four Paise) for 4950 awardees. Out of which an amount of Rs.638.86 crores (which includes various payment released in respect of court cases and awardees not turning up, details given below) have been paid to 4532 number of awardees till MAY’20. Balance of Rs.50.14 crore (Rupees Fifty Crore Fourteen lakhs approx.) available for disbursing to 418 leftout awardees whose details are as follows.

II. An amount of Rs. 40.35 crores have been fixed deposited against 303 awardees (88+176+39 = court cases + absent awardees + death cases and their co-awardees respectively) and the balance awardees left to be paid is 109, whose details have been given in page- 4.The details of court cases, absent awardees and awardees in death cases and their co-awardees have been given below at point no-iii, iv and v.

III. An amount of Rs. 52.36 crores which had been deposited in the fixed accounts in the banks of SBI Balinga and UBI Basundhara in respect of 119 awardees whose cases are pending in different Courts.Out of which 31 awardees of village Kulda and Karlikachhar have been paid an amount of Rs. 23.41 crores.Now, only 88 persons compensation against court cases is fixed deposited in the nationalized banks whose amount is Rs. 28.95 crores.

IV. Another Rs. 15.71 crores have been fixed deposited on 08.11.2016 in the banks of SBI Balinga and UBI Basundhara in respect of 309 awardees who have not turned up after serving of three fresh notices. Five awardees added in place of four awardees of Gopalpur Khata no – 131 vide CC No – 681/2017 Dt: 15.01.2019. Another Eight awardees added inplace of one awardee of Gopalpur Khata No-180/197 vide CC No-342/2017 Dt: 06.05.2017. Seven new awardees added inplace of one awardee of Garjanbahal Khata No-87/36 vide CC No-129/2016 Dt: 08.03.19 as per the direction of Claim commission. So the total awardee 309 (Increase due to Khata No- 131 of Gopalpur CC No-681/2017) Out of which, an amount of Rs. 7.83 crores against 133 awardees of village Bankibahal, Tikilipara and Gopalpur have been released. Now, an amount of Rs. 7.88 crores is remaining in respect of 176 awardees against “awardees not turning up”. V. A sum of Rs. 12.51 crores have been fixed deposited on 20.01.2017 in SBI Balinga in respect of 136 awardees which includes 39 death cases and balance are co-awardees. An amount of of Rs. 8.99 crores have been released againsted 97 awardees. So, an amount left in fixed deposit account is Rs. 3.52 crores for 39 awardees.

NOTE:-

VI. Additional 04 nos of awardees were added in khata no-180/112 of village Gopalpur by the Hon’ble Claims Commission in civil case no- 235/17 dated 21.03.2017 and 02 nos of awardees in khata no-65 for the village Tikilipara vide civil case no 805/2016 dated 14.02.2017. Further, additional sanctions for one awardee of Khata No. 82 of village Balinga has been received vide civil case No. 790 dt-04/08/2016. Five awardees added in place of four awardees of Gopalpur Khata no – 131 vide CC No – 681/2017 Dt: 15.01.2019. VII. Therefore, an amount of Rs. 40.35 cores have been fixed deposited in nationalised banks and an amount of Rs. 9.80 crores is remaining to be disbursed among 109 awardees (Details given below). The said amount i.e. 9.80 Crores have already been deposited by MCL in the joint account of ADM (R&R) and Dy. GM (Min) for disbursement of the same to the remaining 109 awardees.

VIII. An amount of Rs. 480,57,40,309.83 (Rupees Four hundred eighty crores fifty seven lakh forty thousand three hundred nine and paise eighty three only ) towards compensation for 1372.895 acres of tenancy land and other interests & structures standing on Govt.land of has been received for village Jhupuranga for 2676 awardees and the same has been credited in the joint account of ADM(R&R) and Dy.GM (Min) Basundhara Area in the month of March 2019. IX. 1St Notices is being served to beneficiaries of Jhupurunga village by both the means through process server as well as registered post (speed post).

X. All the three notices of village Bangurkela have been served to the unpaid awardees. A.1.2. Notices issued to those who did not turn up for the payment of Compensation All the three fresh notices as advised by the Hon’ble Claims Commission have been issued to all the remaining beneficieries whose details have been given in page No-4. Efforts like holding meetings in the above villages are being done on regular intervals, for creating awareness in respect of their claims for an early payment. Payment details of the 11 villages have been given in page No-4.

A.2. SIARMAL AND BANGURKELA VILLAGES:-

A.2.1. Siarmal village: -

i. Total number of awardees in village Siarmal as per compensation roll was 756. Additionally, 39 awardees have been further added by the Hon’ble Commission vide orders issued form time to time. One awardee named Shyamsundar Majhi S/o Jaydeb was deleted from the compensation roll of the village Siarmal. Further, 04 No’s of awardee added in Khata No. 14 village Siarmal vide civil case No. 757/17 dt. 23/06/18 in place of Ghasia Naik, S/o-Dhaniram Naik. Now, the total number of awrdees in the village Siarmal is 797.

ii. The competent authority approved an amount of Rs. 126.83 crores (including leased land and forest land of village Goplapur) in phase-II for disbursement of compensation to village of Siarmal, leased and forest land of village Gopalpur and for other order issued by Hon’ble Claims Commission in different civil cases. Out of the above amount, an amount of Rs. 90.93 crores has been aproved by the Hon’ble Supreme Court of India in the Compensation Roll of village Siarmal for 797 awardees. Out of the 797 awardees, 680 awardees have been paid an amount of Rs. 69.79 crores till MAY’20.

iii. An amount of Rs. 3.22 crores have been fixed deposited on 10.01.2017 in SBI Balinga in respect of 48 disputed structures of village Siarmal for complying the orders of the Hon’ble Commission. I.A. was filed in the Hon’ble Supreme Court but after the order of dtd. 10.07.2017 of Hon’ble Supreme Court the same have been transferred to Hon’ble High Court, Cuttack for needful action.

iv. Remaining amount of Rs. 17.87 crores are to be disbursed amongst 69 awardees for which notices for payment have been issued. This amount is inclusive of Court Cases and 48 disputed structures.

v. The remaining unpaid awardees have been issued 3rd notice during the month of May’2018 both by notice server and registered post (speed post).

A.2.2. Bangurkela village:-

An amount of Rs. 164.00 crores has been aproved by the Hon’ble Supreme Court of India in the Compensation Roll of village Bangurkela against 740 awardees. Approval of sanction of the above compensation amount was conveyed by the MoC, Govt. of India in the month of July, 2016, followed by the sanction on 7th Aug, 2016 for disbursement of compensation to the villagers of Bagurkela. Proclamation notice has been served in the village on 08th Aug 2016. Notices in first phase have been served till September 2016 to the beneficiaries of village Bangurkela for receiving the compensation.

Note: Additional 8 nos of awardees were added in khata no-25 of village Bangurkela by the Hon’ble Claims Commission in civil case no-1170/2015 passed on dated 16.12.2016 and 23.03.2017.Again, another 04 number of awardees have been added in khata no-55 vide civil case number-650/2016. Additional 09 nos of awardees were added in place of Sundarmani Majhi s/o Parag Majhi in khata no- 65/11 vide civil case number-64/2017 dated 24.04.2018. Another 09 nos of awardees were added in place of Sundarmani Majhi s/o Parag Majhi in khata no- 13 vide civil case number-651/2016 Dt: 16.12.2016. And also 02 nos awardees added in place of Bipin Bihari Sa in Khata No-67 vide CC No-236/2018 DT: 19.07.2017. Added 5 nos awadees in place of 01 no awadee Lt. Another 04 number of awardees have been added in khata no-65/39 and khata No-65/1 inplace of 02 nos awardees vide civil case number- 658/2018 Dt: 16.10.2019.Therefore, the total number of awardees in village Bangurkela at the end of MAY’20 is 786.

An amount of 62.05 crores are left to be disbursed among 207 awardees of village Siarmal and Bangurkela, which have already been deposited by MCL in the Joint account of ADM(R&R) & Dy.GM Mining. The disbursement of these two villages is being delayed due to non-availablity of Revenue Officer and ADM(R&R) in the Disbursement Cell camp office.

A.3 JHUPURUNGA

I. Additional 3 nos of awardees were added in khata no-181 of village Jhupurunga by the Hon’ble Claims Commission in civil case no- 132/2019 DT: 31.07.19 MIS NO-47/2018 as per the direction of claim commission. III. Out of the 2679 awardees, 540 awardees have been paid an amount of Rs. 149.97 Crore till MAY’2020.

The payment of compensation of 8 villages and Siarmal and Bangurkela and Jhupurunga is very less during the month of MAY’2020 as because of non-availibility of Revenue Officer and ADM(R&R) in the Disbursement Cell.

Note : To expedite the process of payment of compensation, In absence of Revenue Officer and ADM(R&R) in disbursement cell vehicles such as Jeep/Bolero alongwith the concerned staff and officers are regularly being deployed for the past several months to obtain their signatures for releasing the payment of compensation to the concerned awardees of 11 villages.

B: EMPLOYMENT TO CAT-I PAFs:-

B.1. Gopalpur & other seven Villages: - B.1.1. 1175 Employment CAT-I PAFs have been approved till date in all the 8 villages (Gopalpur, Garjanbahal, Karlikachhar, Tikilipara, Kulda, Balinga, Bankibahal & Sardega ) against which 928 persons have been given employment/Cash in Lieu of Employment and Annuity details of which are as under:-

Balance Employment 247:-

i. 34 PAFs who had been sanctioned employment but now have opted for cash/annuity; they have been advised to approach the Hon’ble Claims Commission for needful action/issuing order. ii. 64 PAF’s have been waiting for approval from the Claims Commission for their nominees. iii. Another 18 PAFs have got approval of Claims Commission and is under process. iv. 49 PAF’s sanctioned cash in lieu of employment but not turning out in spite of serving three fresh notices. v. 05 PAF’s whose employments has been considered and are under going medical examination. vi. 17 PAF’s are minor on cut off date IA- filed. vii. Documents of 34 PAF’s is under verification stage. viii. 15 PAF’s are not responding in spite of serving three fresh notices.

ix. Another 11 new employment cases have been approved by the Hon’ble Claims Commission and action has been initiated in this regard. Balance Employment 146 :-  66 PAFs who had been sanctioned employment option.  04 PAF’s have been waiting for approval from the Claims Commission for their nominees.  03 PAF’s sanctioned cash in lieu of employment but not turning up in spite of serving three fresh notices.  53 PAFs are under recall/civil cases.  01 PAF is death.  16 PAF’s are not responding in spite of serving three fresh notices.  03 PAF’s whose employments has been considered and are under medical examination.

B.1.3: CASH IN LIEU OF EMPLOYMENT IN GOPALPUR AND OTHER SEVEN VILLAGES The total number of awardees opted for cash in lieu of employment in all the eight villages are 263 only.

 An amount of Rs. 26.30 Crores have been sanctioned by the Competent Authority for disbursement to 263 awardees @ Rs. 10.00 lakh each.  Added one awardee PADMINI KALO W/O- Lt. PARAMA KALO village Siarmal vide sanction no- PERS/EMPL & MC/484 DT: 20-02-2020.  Added One awardee DILESWAR DHRUA S/o- Lt. BHASKARA DHRUA village Garjanbahal vide Sanctio No-PERS/EMPL & MC/455 DT. 10-01-2020  Out of the above 264 PAFs, 200 benificiaries have been paid Rs. 20.00 crores till MAY’2020.  Out of the 64 leftout awardees, 15 have already joined in employment, 3 files are under scrutiny for want of documents for which they have been issued letters for submission of the same. Another 15 are at various stages for employment/minor/recall/writ petition filed etc. The remaining 31 awardees have been issued 3 times fresh notices for receiving the cash in lieu of employment.  However, the persons to whom cash in lieu of employment has been sanctioned are turning up in a phased manner. The following 03 person’s payment is under scrutiny, action has already been taken. The details are given below:-

1. Jasa Goud S/o-Nilamber Goud,vill-Gopalpur,PAF No.-83, khata no.-154, she is a daughter but in our records and genealogy it is mentioned as son. Clarification in writing sought from her for declaring her true gender. If found daughter, the matter will be refered to the Hon’ble Claims Commission. Inspite of our best efforts the awardee is not turning up. 2. Haldhar Naik S/o-Lt Gajji Khadia,vill-Garjanbahal, khata no.-73 & 87/33, PAF No.-50, he has filed the documents but some of the documents require correction. He has been informed to attend this office for correction of the document submitted by him. His payment will be released as soon as the correct documents are received. 3. Mahendra Dhanuar S/o-Sapua Dhanuar,vill-Gopalpur,khata no-180/166,180/176 PAF No.- 122, his original name differs with the name submitted in the documents, his name in the voter id card shown as Sahendra Harma. A letter has been issued to him for submitting the correct document. The General Manager Basundhara area has issued a letter (bearing serial number- 1481 dated 22.09.16) that he should approach the Hon’ble Claims Commission for correction of his name.The payment will be realesed subject to the orders of the Hon’ble Claims Commission.

The following 15 persons payment has been stopped for the reasons mentioned against their names:-

1) Khiradhara Bhaisal s/o Naramani Bhaisal of vill Gopalpur,Khata No: 65 and 67,PAF No:41, he has nominated to his daughter Sanjukta Bhaisal for employment, the employment has been approved and she has been sent for medical examination.----- Declared Medical unfit.

2) Buduli Naik W/o-Lt. Ratnakar Naik of vill-Gopalpur Khata No.-150,180/186 & 180/325, PAF No.- 49,civil case No 501 As per the genealogy, Buduli was the wife of Lt Ratnakar Naik.After the death of Ratnakar Naik, Buduli again married to Bira Naik S/o Mitra Naik,RORH. Now, her husband Bira Naik has been paid cash in lieu of employment Rs. 10.00 lakhs on 19.04.2016. Payment of Buduli Naik will be a double rehabilitation benefit to a single family, which is contrary to the R&R policy of Govt of Odisha.------Going for recall petition.

3) Tula Urmal S/o-Purusottam Urmal, vill-Garjanbahal, khata no: 58 PAF No: 43. He has opted cash in lieu of employment which is also sanctioned by MCL but on verification, he is minor on cut off date, his age is 15Y, 07M, 01D on cut off date. IA has been filed in the Hon’ble Supreme Court for a direction to the Hon’ble Claims Commission to hear the grievance of MCL. In the said IA the matter regarding in eligibility of the personsin 26 cases has been described.(IA No: 36/2015 dt. 08.12.2015).After the order of Hon’ble Supreme Court dated 10.07.2017 all IA’s are being refiled as writ petitions in the High Court of Odisha,Cuttack. 4) Sabitri Biswal D/o-Diwakar Biswal of vill- Karlikachhar, Khata No: 17,PAF No: 12, complaint received against her as a married daughter on cut off date from one Kapil Bhitria of village Karlikachhar. On verification by conducting an independent enquiry it was found that Sabitri Biswal is a married daughter on cut off date and she has a son studying in Tumlia High School. As she has cheated the Hon’ble Claims Commission and also MCL, an IA has been filed and the Hon’ble Commission has been informed accordingly.-----Writ petition has been filed in the Hon’ble High Court of Odisha,Cuttack. 5) Bihari Sendh S/o-Chintamani Sendh of village Kulda PAF No: 8, applied for employment.He has been asked to obtain the approval of Hon’ble Claims Commission. 6) Chintamani Kusum S/o-Lt. Bharat Kusum of village Gopalpur, PAF No: 123. It is learnt that he has died on 11.06.2015 and his family members are not available for receiving the cash in lieu of employment as per rule.A committee has been constituted to enquire the matter and submit the report at the earliest.

7) Debanand Ganda S/o-Pramila Ganda (mother) & Pitmangal Ganda (father), village Tikilipara PAF No: 26, as Debanand Ganda is MCL employee in orient area. He has nominated his wife Smti. Puspanjali Mahanandia for employmemnt. He has been suggested to obtain the approval of Hon’ble Claims Commission. 8) Anjali Biswal D/o-Sukhal Biswal of village Gopalpur, PAF No: 39 9) Anjan Biswal D/o-Sukhal Biswal of village Gopalpur, PAF No: 39 10) Sukanti Biswal D/o-Sukhal Biswal of village Gopalpur, PAF No: 39 ,

The age of the above three daughters of Sukhal Biswal is less than 30 years as on cut off date (September 2010). Enquiry completed.Recall petition filed.

11) Surekh Pradhan S/o -Rohita Pradhan of village Gopalpur, PAF No: 42, employment has been approved in Civil Case No. 1721 dt.23.04.2016 by Hon’ble Claims Commission, his employment has been processed.

12) Karamsingh Majhi S/o Anandram Majhi of village Gopalpur, PAF No-46, he has opted for employment, the case has been considered and processed.

13) Judhister Naik S/o Lt Baisnaba Naik of village Gopalpur PAF No-49, he has opted for employment, the case has been considered and processed for medical examination.

14) Hrusikesh Majhi S/o Raghunath Najhi of village Gopalpur PAF No-79, he has opted for employment to his nominee (his son Kamal majhi, awaited for approval of the Hon’ble Claims Commission.

15) Lalit Bariha S/o lt Bidyadhar Bariha of village Balinga PAF No-2, he is non-traceable, his mother has applied for changeof nominee,the matter has been informed to the Hon’ble Commission vide letter no-1348 dt 13.08.2016.

Now, the remaining persons who have not received cash in lieu of employment inspite of serving 3 fresh notices are as under:- Total sanctioned : 264 Number of persons Paid : 200 Files during scrutiny found dispured : 03 Option changed and joined in MCL : 15 Payment stopped due to the reasons mentioned above : 15 Remaining persons to be paid : 31

The remaining 30 unpaid awardees have already been issued three fresh notices as it was informed in the earlier reports.

B.2: Siarmal Village:

B.2.1 127 employments to CAT-I PAFs have been approved in March 2015. Out of these, 84 PAFs have already been employed in MCL.

B.2.2 Out of 35 PAFs balance 23 PAFs have been issued offer and their cases are under verification. 09 PAFs who are interested for Cash in lieu of Employment have been advised to obtain approval from the Hon’ble Claims Commission.

B.2.3 03 persons, who are not interested for employment, have been advised to approach the Hon’ble Claims Commission for necessary approval for their Nominees.

B.2.4 Annuity paid to 01 person of Sirmal in the month of Sep’2019.

B.2.5 Additional sanction of One awardees have been received for the village Siarmal Cash in lieu of Employment vide sanction no-PERS/EMPL & MC/484 DT: 20-02-2020

B.3: Bangurkela Village:

 B.3.1 139 employments to CAT-I PAFs have been approved in September 2015. 30 PAFs have been provided employment in the village Bangurkela till MAY’20.  56 PAFs who had been sanctioned employment option.  50 PAFs are under recall/civil cases.  03 PAF’s whose employments has been considered and are under going medical examination.

D: MONETARY COMPENSATION CAT-I(M.C)-559

D.1. Monetary compensation in CAT-I (both above and below 60 years of age) has been approved for 558 persons for an amount of Rs. 55.80 crores.

D.2. Out of the above, the names of four persons are repeated.

D.3. The following four persons have been stopped payment for the reasons cited against the name. i) Tikeswar Majhi W/o-lt Dhaneswar Majhi of village Gopalpur, Khata No. 152, PAF No: 81 Civil Case filed before the Hon’ble Claims Commission No. 447 of 2016. ii) Jibeswar Patel W/o-Padmalochan Patel of village Gopalpur, Khata No. 180/86, PAF No. 114,Civil Case filed before the Hon’ble Claims Commission, No. 446 of 2016. iii) Droupadi Ganda 2nd wife of Lt. Sukru Ganda of village Tikilipara, Khata No. 78, PAF No. 40 and iv) Sushila Ganda W/o-Chhalu Ganda of village Tikilipara, Khata No. 78, PAF No. 40, and Civil Cases have been filed before the Hon’ble Commission and it is proposed to file IA in the Hon’ble Supreme Court. Since the persons at serial no. iii and iv have been recommended for MC and resettlement benefits by the Hon’ble Commission but the land compensation has not been assessed for holding no. 78 in the compensation roll of Tikilipara. The subject matter has been informed to the Hon’ble Commission by the General Manager, Basundhara Area vide his letter no. 51 dt. 30.04.2015.

D.4. Additional sanction of Rs 2.80 crores for 28 PAFs have been received for the village Siarmal vide sanction order MCL/GM/BA/PERS/09 dated 03.04.17. Additional sanctions of two awardees have been received for the village Balinga and Gopalpur. Additional sanction of One awardees have been received for the village Gopalpur sanction no- PERS/EMPL&MC/370 DT: 01.11.19 .So the total sanction in Monetary Compensantion as on MAY’20 is 559.

D.5. Out of the 559 sanctioned awardees, a total of 453 persons have been paid an amount of Rs. 45.30 crores till MAY’2020. D.6. Three fresh notices have already been issued to the unpaid persons.The details are given below:-

E.1. Initially Cash in lieu of employment / Monetary Compensation (MC) Cat-III has been approved for 162 PAFs by the competent authority @7.00 lakhs for an amount of Rs. 11.34 crores. Further, additional sanctioned for the village Siarmal for 51 awardees has been received on vide letter No. MCL/GM/BA/Pers/1775 Dt.10.01.2017. Again one PAF Sukadeb Naik @ khadia s/o Yayadeb Naik of village Kulda has been received vide Sanction Pers/Empl&MC/829 Dt 25-12-217. Additional sanction of one awardee in the village Bangurkela has been received vide letter no 1098 dated 06.07.2018. Now, the total sanctioned for cash in lieu of employment CAT-III come to Rs. 15.05 crores for 215 PAFs.

E.2. Three notices have already been issued to all the unpaid awardees and fresh notices have been issued to the awardees whose amount has been sanctioned recently.Details are as under:

Out of 92 unpaid awardees :  6 have changed to CAT-I considering their land and house in village Siarmal (Vide Approval Ltr No.148/CC/Dtd.26.03.2015), the approval for same is waited.  05 persons have applied to consider as CAT-I with Land & house in Village Ratansara (Approval from Claims Commission awaited shortly).  One person is under age as on the cutoff date.  One person is under enquiry As per Letter No.725/CC from SEC, Claims Commission.  Therefore 92-(6+5+1+1) = 79.  So the total unpaid awardees under CAT-III are 79 only.

G. RESETTLEMENT (667):

G.1. CASH IN LIEU OF PLOTS:-

Cash in lieu of plot/resettlement benefits has been approved for 665 PAFs by the competent authority. An amount of Rs. 5.78 lakhs is being paid to each of the beneficiary under resettlement benefits and Rs.2.78 lakh is paid to those who have opted for building assistance.

G.1.1. Initially there were 278 sanctioned for three villages, namely Garjanbahal (124 PAFs), Kulda (26 PAFs) and Gopalpur (128 PAFs) in phase-I for an amount of Rs. 16.07 crores.Then saction for some other villages like Tikilipara, Karlikachhar received in phase manner.So,the total saction received for cash in lieu of plot end the end of May’18 were 594. G.1.2. Again additional sanctions of 43 PAFs for cash in lieu of plot have been received in the village Garjanbahal in the month of Jun’18.

G.1.3. One PAF KARUNAKAR PATEL S/O DAITARI PATEL has been paid an amount of Rs 3.00 lakh in the month of July’18 as against the sanction received against REF NO: MCL/GM/BA/EM/680 DT.25.06.2018. Again additional sanction of 06 PAF’s has been received in the month of December 2018. So the total numbers of PAF sactioned in cash in lieu of plot at the end of MAY’2020 is 665, out of which 480+8+1+1=490 PAFs have already been paid.

G.1.4 Additional Two no awardees added of Bankibahal an amount of Rs.278000.00 each vide sanction no- MCL/GM/BA/EM/2017-18/211 Dt: 14.07.2017.

Topography of the Area a) Regional Physiographically the entire district lies with high altitude zone with interspreading inaccessible terrain of hilly ranges and narrow valley tracts. The topography ofthe district is undulating broken up by rugged hill ranges and torrential hill streams and rivers. The district is consisting of widely dissimilar tracts of expansive and fairly open country dotted with tree clad isolated peaks, vast inaccessible forests, extensive river valleys and mountains.
