Community Care Fund “One-off Living Subsidy for Low-income Households Not Living in Public Housing and Not Receiving Comprehensive Social Security Assistance” (2020) Programme Brief

Objective

The Commission on Poverty endorsed the launch of the “One-off Living Subsidy for Low-income Households Not Living in Public Housing1 and Not Receiving CSSA” programme (2020) (the Programme) under the Community Care Fund (CCF) to relieve the financial pressure on low-income households. The Programme is administered by the CCF Secretariat (the Secretariat), and 216 service units (the service units) operated by non-governmental organisations (NGOs) will assist in implementing the Programme. The list of these units is at Annex 1.

Eligibility Criteria

2. Target beneficiaries must meet all the following criteria: (a) (i) renting accommodation on a monthly basis (or for a longer tenure) in private permanent housing2 (private housing), industrial buildings or commercial buildings; or (ii) renting social housing3 operated by NGOs; or (iii) renting bedspaces offered under the Home Affairs Department’s (HAD) Singleton Hostel Programme, or bedspaces in hostels operated by NGOs for rehabilitated offenders; or (iv) residing in temporary housing4; or (v) living on board vessels; or (vi) being homeless persons5;

1 For the purpose of the Programme, households “not living in public housing” refer to those not living in public rental housing or subsidised home ownership housing (including flats under the (HOS) and the (TPS)). 2 Including all private residential flats, rooms (cubicles / solid-partitioned cubicles), subdivided units, bedspaces / cocklofts, villas / bungalows / modern village houses, simple stone structures / traditional village houses, staff quarters, subsidised sale flats with premium paid (including flats under the HOS and the TPS), flats under the T-home “Letting Scheme for Subsidised Sale Developments with Premium Unpaid” and Tai Hang Sai Estate. 3 Social housing refers to transitional social housing projects supported by the relevant bureau(x) and operated by NGOs. 4 Including Temporary Housing Area units, and private temporary housing such as roof-top structures, squatter structures, licensed structures (i.e. domestic structures licensed by the Lands Department), huts, places not intended for residential purpose (such as landings, staircases, corridors, etc.), contractor’s matsheds and nissen huts. 5 Homeless persons include: (a) street sleepers; (b) persons staying in the following emergency / temporary shelters / hostels / short-term hostels operated by NGOs: (i) Caritas – Caritas Hung Hom Hostel; (ii) Sham Shui Po Shelter, Shelter and Wan Chai Shelter operated by the Street Sleepers’ Shelter Society Trustees Incorporated; (iii) Yee On Hostel of The Salvation Army; (iv) Home of Abundant Grace, Home of Blessings, Home of Grace, Esther Lodge and Home of Adullam operated by the Christian Concern For The Homeless Association, and Home of Lily operated by the Castle Baptist Church; (v) Li Chit Street Hostel of the St. James’ Settlement; (vi) Jockey Club Hostel for Single Persons operated by the Neighbourhood Advice-Action Council; (vii) Jockey Club Hostel for Single Persons operated by the Pok Oi Hospital; (viii) Home of Love operated by the Missionaries of Charity; and 1 (b) the average monthly household income in the past three months6 shall not exceed the specified income limit applicable to the relevant household size below:

(c) for persons renting accommodation in private housing, industrial buildings, commercial buildings or social housing, the average monthly rent paid in the past three months7 shall not exceed the specified rent limit applicable to the relevant household size below:

(d) not receiving Comprehensive Social Security Assistance (CSSA)8;

(e) neither the applicant nor his/her household members own a property (including jointly owned properties) in Hong Kong;

(f) Hong Kong permanent residents, or holders of Hong Kong Identity Card who do not belong to

(c) persons staying in the ’s Po Tin Transit Centre in Tuen Mun and Lung Tin Transit Centre in Tai O. 6 The average monthly household income in the past three months refers to the average monthly household income in the three months prior to the submission of an application (i.e. the average of the total monthly income of the applicant and his/her household members), including earnings from employment and other income (including salary, double pay / leave pay, job allowances, bonus/commission/tips, fees for rendering services, profits from business/investment, alimony, contributions from relatives/friends, interest income from fixed deposits, stock, shares, etc., income from rent, monthly pension / widow’s and children’s compensation). Employee’s mandatory contributions to a Mandatory Provident Fund scheme made by the applicant and his/her household members, financial assistance provided by the Government, charitable donations, assistance from other assistance programmes under the CCF, etc. are however not included. When calculating the monthly household income, applicants can refer to the monthly average amount of two irregular income items (i.e. double pay and bonus) accumulated over the respective period of time. 7 It refers to the average monthly rent paid in the three months prior to the submission of an application (calculated according to the amount shown on the rent receipt, but excluding management fees, rates, utility charges for water, electricity and gas, etc.). 8 In case one/more household member(s) of the applicant household does/do not meet this criterion, the application will still be processed. However, this/these person(s) will be excluded for the purpose of calculating the number of household members, income, rent and subsidy amount. 2 those persons who have entered Hong Kong not for the purpose of settlement, and/or those who have demonstrated to the satisfaction of the Immigration Department (ImmD) that they have adequate financial means to sustain their living in Hong Kong before they are issued with a visa / entry permit by the ImmD 8 9; and

(g) if the applicant is renting accommodation in private housing, an industrial building or a commercial building, the rented accommodation must not be a property owned by the father, mother, son, daughter10, husband or wife of the applicant and/or of the applicant’s household members.

3. In calculating the number of household members, the applicant and / or the household members can include the following persons who are not residing with them:

(a) the parents who reside in non-subsidised places of private residential care homes for the elderly; and

(b) the household member(s) who reside in non-subsidised places of private residential care homes for persons with disabilities.

4. University student hostels are excluded from the housing types under the 2020 Programme. However, if the families of students living in university student hostels are eligible, those students can be included in the number of household members when making an application.

Application Arrangements

(1) Submission of Applications by Phases

5. Applicant households must meet all the eligibility criteria as listed in paragraph 2 above when submitting an application11. Please refer to Annex 2 for the application procedures. Applicant households are required to submit their individual application forms according to their household sizes12 by phases13 from 2 July to 30 November 2020 (application period) as follows:

6. Applicant households are required to submit their application forms together with all the required documents (see item 7 below) to the respective service units near their residences to facilitate the submission of supplementary information if necessary and/or the arrangement of home visit by the service unit:

(a) General households: Please submit your application to service units accepting general applications (see the list in Part 1 of Annex 1).

(b) Households with elders only (i.e. all members in the household are at the age of 60 or above): Please submit your application to elderly service units14 (see the list in Part 2 of Annex 1);

(c) Households with young people only (i.e. all members in the household are at the age of 24 or under): Please submit your application to youth service units15 (see the list in Part 3 of Annex 1); and

(d) Homeless persons: Please submit your application to service units accepting applications from homeless persons (see the list in Part 4 of Annex 1).

If your application is made by post, please ensure that the address of the service unit shown on the envelope is correct and sufficient postage is paid before posting. If there is insufficient postage, application forms will not be delivered to the service unit and applications will not be processed. To avoid any delay, please also write the correspondence address of the applicant at the back of the envelope. Please do not submit applications by fax or by email.

(2) Submission of Documents

7. Applicant households are required to submit copies of the following required documents:

(a) Hong Kong Identity Cards16 of the applicant and all household members (may produce the original copies at the service units if submitting application in person);

the commencement of the respective “application phase” applicable to the relevant household size owing to subsequent changes of household situations, he/she may contact the Secretariat for special arrangements. 14 They refer to district elderly community centres, neighbourhood elderly centres, social centres for the elderly, support teams for the elderly and other non-subvented elderly service units. 15 They refer to integrated children and youth services centres, and children and youth centres. 16 Or a Hong Kong Birth Certificate or other proof of identity (only applicable to persons under the age of 11) or a Certificate of Exemption (if applicable). 4 (b) (if applicable) receipts for renting accommodation in private housing, an industrial building, a commercial building or social housing; or a “Certificate of Participation – Tenant” for renting accommodation under the T-Home “Letting Scheme for Subsidised Sale Developments with Premium Unpaid” (the status of one of the household members as the tenant of the accommodation concerned, the residential address and the monthly rent must be shown);

(c) (if applicable) documentary proof of staying in the following hostels / shelters (e.g. rent receipts or the proof of occupancy issued by the hostels / shelters): (i) bedspaces provided under the HAD’s Singleton Hostel Programme; (ii) hostel bedspaces provided by NGOs for rehabilitated offenders; (iii) emergency / temporary shelters, hostels or short-term hostels operated by NGOs (see Footnote 5); or (iv) Po Tin Transit Centre in Tuen Mun or Lung Tin Transit Centre in Tai O operated by the Housing Department;

(d) (if applicable) documentary proof of a parent residing in a non-subsidised place of a private residential care home for the elderly, or of a household member residing in a non-subsidised place of a private residential care home for persons with disabilities (e.g. a receipt of fee or the proof of occupancy issued by the residential care home); documentary proof of household members residing in a university student hostel (e.g. a receipt for hostel fees or the proof of occupancy issued by the university);

(e) (if applicable) for a household member who is incapable of managing his/her own affairs17 or mentally incapacitated18: supporting documents to prove that the household member concerned is incapable of managing his/her own affairs or mentally incapacitated (e.g. a certificate of appointment issued by the court or a certificate issued by a locally registered medical practitioner); and

(f) for an applicant who chooses to receive the subsidy through bank transfer19: documentary proof of a bank account (e.g. the page of a passbook showing the name of the account holder, or a bank statement, etc.).

(3) Notes to Applicants

8. Applicant households must note the following:

17 For the purpose of the Programme, a person who is incapable of managing his/her own affairs refers to a person whose affairs are required to be managed by other persons appointed by the court. 18 For the purpose of the Programme, in accordance with the Mental Health Ordinance (Cap. 136, Laws of Hong Kong), a mentally incapacitated person refers to a person who is incapable, by reason of mental incapacity, of managing and administering his property and affairs. Specifically, mentally incapacitated persons refer to persons with the following conditions - (a) mental illness; (b) a state of arrested or incomplete development of mind which amounts to a significant impairment of intelligence and social functioning which is associated with abnormally aggressive or seriously irresponsible conduct on the part of the person concerned; (c) psychopathic disorder; (d) any other disorder or disability of mind which does not amount to mental handicap; or (e) mental handicap (which means an IQ of 70 or below according to the Wechsler Intelligence Scales for Children or based on a standardised intelligence scale with deficiencies in adaptive behaviour). 19 It must be made to a local Hong Kong dollar savings/current bank account solely under the name of the applicant. 5 (a) Applications must be made on a “household”20 basis, and no restriction is imposed on the relationship between household members.

(b) For a household with more than one member, an eligible adult21 among the members should be designated as the applicant to make the application. Other household member(s) should sign on the application form to give consent for the designated applicant to apply on their behalf. For household members who are under the age of 18, their parent/guardian (must be a Hong Kong resident who is at the age of 18 or above) is required to make a declaration and sign on their behalf. For eligible household members who are incapable of managing their own affairs or mentally incapacitated, their agent22 or legal guardian23 (must be a Hong Kong resident who is at the age of 18 or above) is required to make a declaration and sign on their behalf. Should the application be successful, the subsidy for all eligible household members will be disbursed to the designated applicant (e.g. the designated applicant of a two-person household will receive HK$9,000 of subsidy (see item 10(a) below)).

(c) Applicants should submit one application only during the application period. Multiple applications from the same applicant / household member will be voided and lead to delay in processing application and disbursement of allowance. Withdrawal of the application, once submitted, is not allowed unless for exceptional reasons. All information and documents submitted for application under the Programme will not be returned.

(d) At the time of submitting an application, applicants are required to declare on the application form that the average monthly household income in the past three months does not exceed the income limit applicable to the relevant household size, while the submission of relevant documentary proof of income is not required24.

(e) Applicants are required to declare that they and their household members are residing in the accommodation as shown in the Local Residential Address field under Part 1 of the application form on the application date (except the parents residing in non-subsidised places of private residential care homes for the elderly / household members residing in non-subsidised places of private residential care homes for persons with disabilities / university student hostels) and that the accommodation is a type covered under the Programme (see item 2(a) above).

(f) Applicants who rent accommodation in private housing, industrial buildings, commercial buildings or social housing are required to note the following: (i) each rent receipt25and26 shall be used by only one household for application purpose. The rented accommodation shown on the rent receipt must be the same as the local residential

Applicants are required to declare that the average monthly rent of the accommodation in the past three months does not exceed the rent limit applicable to the relevant household size; (ii) applicants who fail to provide a rent receipt as proof are required to provide a self-declaration27 to declare that they and their household members are tenants of the accommodation in private housing, industrial buildings, commercial buildings or social housing as indicated in the application form, and to provide the reason(s) for failing to provide a rent receipt; and (iii) the rented accommodation must not be a property owned by the father, mother, son, daughter, husband or wife of the applicant and/or of the applicant’s household members. Applicants and their household members are required to declare that the criterion has been met.

(g) Applicants who are street sleepers must declare that they have been sleeping on the street for at least seven consecutive days as at the submission date of the application.

(h) Applicants and their household members must declare that they are not CSSA recipients (see item 2(d) above).

(i) Applicants and their household members must declare that they do not own a property in Hong Kong (see item 2(e) above).

(j) Applicants and their household members must declare that they do not belong to those persons who have entered Hong Kong not for the purpose of settlement, and/or those who have demonstrated to the satisfaction of the ImmD that they have adequate financial means to sustain their living in Hong Kong before they are issued with a visa / entry permit by the ImmD (applicable to those who are not Hong Kong permanent residents, see item 2(f) above).

(k) For eligible persons under the age of 18, if their household members are ineligible for the Programme (e.g. two-way permit holders or CSSA recipients), their parent/guardian (must be a Hong Kong resident who is at the age of 18 or above) can make an application on their behalf and collect the subsidy for them when their eligibility under the Programme has been confirmed (please contact the Secretariat on 2180 6666 for appropriate arrangements).

(l) For eligible persons who are incapable of managing their own affairs or mentally incapacitated, if their household members are ineligible for the Programme, their agent or legal guardian (must be a Hong Kong resident who is at the age of 18 or above) can make an application on their behalf and collect the subsidy for them when their eligibility under the Programme has been confirmed (please contact the Secretariat on 2180 6666 for appropriate arrangements).

(4) Processing of Applications

9. The procedures for processing applications are as follows:

(a) The Secretariat and service units will vet every application, including verifying the eligibility of the applicant and examining the supporting documents submitted. They may contact the applicant and request him/her to clarify the information on the application form or submit additional information.

27 Please contact service units for the self-declaration form in specified format. 7 (b) To determine the eligibility of applications under the Programme, the Secretariat / service units will conduct an examination in accordance with the applicants’ situation on the date when they submit their applications (i.e. the date when the duly completed application form, together with copies of all the required documents, reach the service unit).

(c) The Secretariat / service units may make sample checks, including a means test or home visits on some applications in the course of processing applications or after disbursement of the subsidy.

(d) The Secretariat / service units will issue a notification of application results to applicants after vetting the applications concerned. For ineligible applications, the Secretariat will send a notification of application results by registered mail. For applicants who do not have a postal address or are homeless persons, such notifications will be delivered through service units. Applicants who disagree with the application results can seek a review in writing (to this address: 4/F, Southorn Centre, 130 Hennessy Road, Wan Chai, Hong Kong) with justifications within 14 days upon receipt of the notification.

(e) Applicants are requested to provide a local mobile phone number for the Secretariat / service units to contact them on matters relating to their applications.

(f) As regards those incomplete applications, if applicants fail to provide the required supplementary information and / or documents before the deadline specified by the Secretariat / service units, their applications will not be processed.

(5) Disbursement of a Subsidy

10. The arrangements for disbursement of a subsidy are as follows:

(a) The Secretariat will disburse a subsidy of HK$4,500 to eligible one-person households, HK$9,000 to eligible two-person households, HK$12,500 to eligible three-person households, HK$14,500 to eligible four-person households and HK$15,500 to eligible five-or-more-person households.

(b) For an applicant who chooses to receive the subsidy through bank transfer, the subsidy (including the amount received by the applicant and the amount collected by the applicant on behalf of other eligible household members) will be deposited directly into the bank account as specified in his/her application form through autopay. The applicant is required to provide the account number of his/her valid local Hong Kong dollar savings/current bank account solely under his/her name. Joint account, credit card account, loan account, fixed deposit account, investment account or foreign currency account are not accepted.

(c) Applicants must provide correct name and bank account number. The Secretariat and the service units will not be responsible for any late payment, loss of the subsidy amount and / or the administrative fee charged by the bank owing to the omission or provision of incorrect information on the bank code and / or account number.

(d) For an applicant who chooses to collect the subsidy in the form of an order cheque, the service unit concerned will inform the applicant to bring along his/her Hong Kong Identity Card28 to collect the notification of application results and the cheque, upon verification of his/her name and the Hong Kong Identity Card number at the service unit responsible for the relevant

28 Or a Certificate of Exemption (if applicable). 8 application within the specified period. If the applicant fails to collect the cheque within the specified period without reasonable explanations, no subsidy will be granted.

Annex 2 Application Procedures

Number of eligible person(s) in the household

2 persons  applications to be accepted starting from 3 August 2020 3 persons  applications to be accepted starting from 1 September 2020 4-or-more persons  applications to be accepted starting from 5 October 2020 (i.e. applications to be accepted from all eligible households (irrespective of household size))

Submit your application to the service unit near your residence by post or in person –

General households  service units accepting general applications (see the list in Part 1 of Annex1) Households with elders only  elderly service units (see the list in Part 2 of Annex 1) Households with young  youth service units (see the list in Part 3 of Annex 1) people only Homeless persons  service units accepting applications from homeless persons (see the list in Part 4 of Annex 1)

Submit the duly completed application form with copies of the following documents – (1) Hong Kong Identity Cards of the applicant and all household members; (2) (if applicable) a receipt for renting accommodation in private housing, an industrial building, a commercial building or social housing, or documentary proof of staying in a hostel/shelter; (3) documentary proof of your bank account if you choose to receive the subsidy through bank transfer; (4) (if applicable) supporting documents to prove that the household member concerned is incapable of managing his/her own affairs or mentally incapacitated; and (5) (if applicable) supporting documents to prove that the parent is renting accommodation in a non-subsidised place of a private residential care home for the elderly, or that the household member is renting accommodation in a non-subsidised place of a private residential care home for persons with disabilities, or that the household member is residing in a university student hostel.

*The service unit will initially examine your application, and you may be required to clarify or submit additional information to the service unit as necessary. If you have been picked at random for a means test or home visit, please be fully co-operative and provide the required information.

*The Secretariat will further vet your application, including checking household information against the data held by the Land Registry and the Social Welfare Department.

Successful application: you will receive a notification Unsuccessful application: you will receive a of application result from the Secretariat / service notification of application result from the Secretariat / unit and receive the subsidy through bank transfer or service unit. If you disagree with the application in the form of an order cheque. result, you can seek a review in writing with justifications within 14 days upon receipt of the notification.

* For applications with all required supporting documents, the service unit and the Secretariat will take about two months to process and arrange disbursement of subsidy. The time is for reference only. Subject to the circumstances of individual applications and the overall number of applications received under the Programme, the time required may vary. 1
