Project Background

The Assam Power Sector Investment Program (the Investment Program) is intended to finance a series of investments in the state of Assam, India including generation capacity enhancement to transmission and distribution infrastructure development. The Investment Program will also finance a number of “softer” activities, including improvements of power utility companies in operational and financial capacity, and training. The funding will be extended via a Multi-tranche Financing Facility (MFF) of Asian Development Bank (ADB). The objectives of the investment will be to achieve increased capability and efficiency of power system, including renewable energy. The state lacks adequate electricity supply, suffers from system efficiency coupled with low electrification rates. Further, the power utility companies are not in the best financial shape.

The approach of ADB for the proposed investment program is two-fold: (i) by strengthening transmission and distribution networks to reduce technical and commercial losses and improve the financial health of state utilities; and (ii) by focusing on capacity issues. The Program is consistent with the government’s policies and strategies, as well as with ADB’s ongoing CPS. The size of the MFF is $300 million with funding structured into three tranches.

The Investment Program (Tranche 2) will be implemented during 2016- 2019 by the Assam Power Distribution Corporation Ltd (APDCL) the sole power distribution company in the state (Table A1). APDCL has three regions of operation namely Upper Assam Region (UAR), Central Assam Region (CAR), Region (LAR), spread over 18 electrical circles. These units are responsible for operation, maintenance, development and improvement of sub-transmission and distribution system in their respective regions of operation (Annex1).

Tranche 2 project has two outputs: (i) expansion and upgradation of the distribution system; and (ii) strengthening institutional capacity of APDCL. Expansion plans will add a 33/11 kV substation and associate facilities to reduce losses and enhance the power supply capacity of overloaded substations and lines. Under upgradation, aged and degraded components in the system are to be replaced and rehabilitated to reduce losses, improve voltage profile and provide better and reliable service to customers. Output 2 seeks to improve distribution control and customer services and includes four major activities: (i) establish an independent meter testing laboratory; (ii) design information technology module for introduction of centralized uniform revenue billing system; (iii) establish area load dispatch centers; and (iv) provide consulting services to support implementation of project components. Project progress

Procurement status The package-wise procurement status is as follows.  Package 1: the Contract Agreement was signed with M/s NECCON Infra & Power Ltd. on 16 December 2016, and the mobilization advance received on 28 April 2017. Subsequently, NECCON initiated the work and the review of technical design and drawings is under progress.  Package 2: Lot I contract was awarded to M/s Hemen Deka/JV M/s T&T Projects on 17 December 2016 but effective from 17 February 2017. For Lots II and III, M/s N.K.Power JV and M/s T&T Projects were successful bidders. Contract agreements were signed on 17 December 2016 with effect from 5 May 2017.  Package 3: M/s NECCON Infra & Power Ltd. signed the contract on 16 December 2016, and the mobilization advance was received on 28 April 2017.  Package 4: M/s NECCON JV, M/S Scope JV M/S Survalent Technology were recipients of this contract signed on 17 December 2016. Mobilization advance received on 28 April 2017.

 Package 5: ADB’s No Objection on draft bid document for Smart Meters was received on 30 March 2017. Thereafter package was dropped.

Project Implementation Status Project implementation highlights The progress made in the execution of all the packages during this period has been slow, thus impacting the compliance status of social monitoring (Table A3)  There are minor deviations in the planned outputs. These are reflected in the revision in the scope (quantity) of select sub-outputs, owing to technical factors (Annexure 2A &2B).

 With the route surveys under progress, further changes in the scope of the sub-outputs while complying with social safeguard guidelines are anticipated.

 Though there is also no change in the scope and methodology of the project, field visits have not been undertaken in the reporting period owing to delays in the execution of the packages.

 All the outputs under various packages are currently in the pre-construction stage.

 Even though the commencement of the project activities was delayed by over a year owing to technical issues, the commissioning of the project components is expected on time.

Overview of social impacts

The Resettlement Plan (RP) prepared (November 2015) for the project has identified social impacts due to acquisition of land, damages to crop, and other losses, for sub-station construction and stringing of distribution line. The RP has indicated that the sole (1) new substation is proposed on government land. No major impact has been envisaged due to stringing of distribution line.

However, the final site selection for the sole new sub-station is pending and the land yet to be handed over to the Contractor by APDCL. Initial site visit revealed that the allotted plot (approx 42x39 m) is a part of the land is already occupied by the 107 MLD water treatment plant under Guwahati Water Supply Project. The layout of the plant site being tight, there is no scope for extension or expansion of the said plot. In the light of this situation, an alternative site is now to be identified. Thus the construction of the sub-station is being delayed owing to the uncertainty over the final site selection. The route survey for the distribution lines are in progress, hence any resulting changes impacting land, structures, vegetation and people will be reflected after its completion.

Impacts on land: the construction of the sub-station requires about 1638 m2 area, and its impact on land will depend on the ownership status. As (to date) the new site is yet to be finalized, the assessment of impact will be undertaken after site selection. In case of distribution line, an area of 0.422 m2 (0.65m x 0.65m) is required for foundation of each concrete pole. Hence, the damage to land will be minimal. Underground cabling will entail temporary and insignificant impact as trenchless construction is planned for (Annex-3).

The final assessment of impact on structure, crop damage, trees, livelihood and common property resources will be verified after the route surveys are completed and the land for substation selected. Any additional impact during construction/installation activities will be addressed as per provisions in the Resettlement Framework. It is anticipated that installation and stringing of distribution lines will have minimal impact; and the contractors have been advised to document stretches of distribution line where obstructions are likely, to enable EA to take necessary timely action.

B. SOCIAL SAFEGUARD CATEGORISATION The RP provides an assessment of temporary and permanent impacts. No permanent impacts are expected as land acquisition for the substation will not entail private sources. The likely impact on land from sub-projects, namely installation of new 11 and 33 kVA lines, re-stringing of old lines and replacement of overhead cables by underground cables will be temporary. Thus these components have been categorized as “B” for Involuntary Resettlement (IR) impact as per the ADB’s Safeguard Policy Statement (2009). Overall impacts would be further minimized during subproject implementation. Further, no impact on indigenous people or Scheduled Tribes is envisaged except if any such individuals or households are identified during the route surveys. Thus Tranche-2 is categorized as 'C’ for Indigenous Peoples.

H. INSTITUTIONAL MECHANISM

5061168 | A P D C L | Bi annual Report (Social Safeguard Monitoring) | Report No.01 58 Annexure-5 Grievance Redress Mechanism APDCL does not have any specific Environment or Social Safeguards Policy regarding generation/distribution subprojects currently. SPS 2009 requires APDCL to establish a Grievance Redress Mechanism (GRM) having suitable grievance redress procedure to receive and facilitate resolution of affected peoples’ concerns, complaints, and grievances about the subproject’s environmental performance. The grievance mechanism will be scaled to the risks and adverse impacts on environment due the subproject type, size, type of area (sensitive area) and impacts. It should address affected people's concerns and complaints promptly, using a transparent process that is gender responsive, culturally appropriate, and readily accessible to all segments of the affected people at no costs and without retribution. This GRM consist of a Grievance Redress Committee (GRC) headed by the Project Head. The committee consist of the following:

i. Project Head, APDCL ii. Sub District Magistrate/District Revenue Officer or their nominee iii. Representative of local Panchayat/Council iv. Representative Women representative of village/council v. Representative of EPC contractor vi. AGM of Environment and Social Management Unit (ESMU) at PMU or nominee GRM will provide an effective approach for resolution of complaints and issues of the affected person/community. Project Management Unit (PMU) shall formulate procedures for implementing the GRM, while the PIU shall undertake GRM’s initiatives that include procedures of taking/recording complaints, handling of on-the- spot resolution of minor problems, taking care of complainants and provisions of responses to distressed stakeholders etc. paying particular attention to the impacts on vulnerable groups. Grievances of affected persons (APs) will first be brought to the attention of the Project head of the PIU. Grievances not redressed by the PIU will be brought to the Grievance Redress Committee (GRC) set up to monitor subproject Implementation for each subproject affected area. The GRC will determine the merit of each grievance, and resolve grievances within two weeks of receiving the complaint. The proposed mechanism does not impede access to the country’s judicial or administrative remedies. The AP has the right to refer the grievances to appropriate courts of law if not satisfied with the redress at any stage of the process. The PIU will keep records of all grievances received including: contact details of complainant, date that the complaint was received, nature of grievance, agreed corrective actions and the date these were affected, and final outcome.
