1. PROJECT DESCRIPTION

1. The Madhya Pradesh Paschim Keshtra Vidyut Vitaran Co. Limited (MPPKVVCL) as power distribution company-DISCOM-W serves as the executing agency (EA) for the projects under DISCOM-West for distribution system improvement for Indore & circle. DISCOM-W currently serves about 3.75 million customers within an area of 77,021 km2 in the rural and urban areas. The objective of the project is to strengthen and modify existing 33 kV and 11 kV network including 33/11 kV substations of all 14 Districts of DISCOM-West.

2. DISCOM-West area hires distribution transformer for irrigation normally, during rabi and kharif season for the group of cultivators. MPPKVVCL intends to install distribution transformer online to the 11 kV feeders during this process lot of time is consumed, so to overcome this situation, It is decided to install permanently 100 KVA 11/.4 star rated distribution transformer in place of temporary rental distribution transformer and now almost 95% temporary connection converted into permanent connections.

3. To implement this project district wise sub projects are prepared for strengthening and modification of present electrical network and work is planned to be awarded to different competent vendors so that entire project can be completed within the time limit.

4. As per ADB approved resettlement plan in September,2013 scope of work of DISCOM- West was planned as per following:

 Construction of 40 nos new 33/11 kV substations

 Augmentation of existing 168 nos substation by installing transformers form 3.15 MVA to 5 MVA, from 5 MVA to 8 MVA and additional 5 MVA

 Addition of 57 nos 33 KVA feeder

 Addition of distribution lines for substation by stringing 213.4 km of 33 KV,139.25 km of 11 KV & 201 km of 11 KV for addition & augmentation

5. A combined RP report for all distribution companies were submitted for ADB’s approval in September, 2013. However, during the course of progress of the works, sub statin site locations changed during land acquisition process, further some distribution lines and additional LT line were also added to the subprojects. Some feeder bifurcation location has also dropped as they were no longer required. In progress of project execution & also based on actual survey carried out, original scope of work has been updated as mentioned below, which is scheduled to be completed by June-2018.

6. Updated scope of work in totality has been summarized & shown in table no 1.1. Updated lot wise details of scope of work under Indore zone & Ujjain zone has been provided district wise in supporting Annexure-I.

1.1 Need for due diligence update

7. The Due diligence has been conducted to examine the social safeguard issues of the sub projects implemented by the executing authority (DISCOM-West) under ADB loan - 3066-IND.The DDR exercise has been conducted with respect to the requirement of ADB safeguard policy statement 2009 as well as with other national regulation and policies are as relevant .This report provide the findings, based on review of documents available with respect to the resettlement impacts, verification on site through field visits and consultation with the relevant stakeholders.

2. SCOPE OF LAND ACQUISITION AND RESETTLEMENT IMPACTS

8. The land requirement for all 40 substations of the Discom-west is estimated to be 7.03 hectare. All the substations are located on government land and the land allotment approvals received by the MPPKVVCL. Through Govt circular no-F-6-25/2010/7/Nazul, Bhopal, dated 18th August 2010 & department of energy, Govt of MP circular no. F-6- 2/2009/13, dated 26th August 2010. The copy of circular is attached Annexure-2.

9. The distribution lines of 33 kV (total KM-846.2) and 11 kV (total KM-963.25) & LT line (total KM-504.0) are double pole based and distribution lines mainly follow the road right of way. Additionally, wherever the distribution lines passes through the agriculture land care has been taken to place the pole on the plot edges to avoid impacts on the land. Therefore the project has no resettlement impacts due to the implementation of its components. The summary of impacts is given in table 2.1, and component wise details are given in table 2.2.

3. INFORMATION DISCLOSURE, CONSULTATION AND PARTICIPATION

3.1 Consultations

10. Public participation and community consultation has been taken up as an integral part of the project social and environmental assessment process. Consultation was used as a tool to inform and educate stakeholders about the project. The participatory process helped in involving the local people in project activities. Initial public consultation has been carried out in the project areas by project authority through transact walk/walk over survey with the objectives of minimizing probable adverse impacts of the project through alternate design solutions and to achieve speedy implementation of the project through bringing awareness among the community on the benefits of the project. Consultations were held during project preparation stage with project beneficiaries, elected representatives of the local body and officials of the DISCOM-West (MPPKVVCL).

11. The tools used for consultations were individual discussions and focused group discussions (FGD). These consultations provided insights into the present energy situation and needs of the communities, their expectations and cooperation with officials of the energy department in identifying sites for substations.

12. The project has conducted public consultation and disclosure of safe guard documents as per the schedule given in table 3.1.

3.2 Findings of Consultation during DDR preparation

13. Focused group discussions were held at 40 locations including the 8 change location for substations for DDR preparation. Informal discussions were conducted with the villagers in and around the substations sites. These discussions were held between the period of September-2017 to December 2017. Local community from the villages where substations and/or distribution lines have been executed participated in the discussions and information’s about the project was provided. Further, the local community accompanied the consultants and officials during the respective site inspection and explained why the particular location was chosen from the alternatives considered.

14. The public consultation summery is presented in Table 3.2 for Indore region, Table-3.3 for Ujjain region & sample attendance lists of FGDs are presented in Annexure 3.

3.3 Plan for further Consultation in the Project

15. The consultation process will be continued under the project as necessary. The PMU will be responsible for conducting the consultation as envisaged for the project:

(i) In case of any change in the site for substations and/or distribution line alignments, the APs and other stakeholders will be consulted regarding the factors that necessitated the change, efforts taken to minimize resettlement impacts and mitigation measures available in accordance with the principles of the RP. (ii) The PMU will carry out information dissemination sessions in the project area and solicit the help of the local Panchayat/community leaders and encourage the participation of the APs in plan implementation. (iii) During the implementation of RP, PMU will organize public meetings, and will appraise the communities about the progress in the implementation of project works. (iv) Consultation and focus group discussions will be conducted with the vulnerable groups such as women, to ensure that the vulnerable groups understand the process and their needs are specifically taken into consideration in the implementation.

3.4 Disclosure

16. DISCOM-west provided relevant information in a timely manner, in an accessible place, and in a form and language (Hindi/ English) understandable to stakeholders. Notification as per the electricity act, 2003 on project information disclosed in the local newspaper. A summary of the draft RP has been made available in local at relevant local government offices and at the PMU and site offices. This DDR will be disclosed on ADB website and MP discom west. Information dissemination and consultation will continue throughout the project implementation, and especially during the implementation of the project.

4. GRIVANCE REDRASSAL MECHANISM

4.1 Introduction

17. A grievance redressal mechanism (GRM) has been established to receive, evaluate and facilitate the resolution of displaced people’s concerns, complaints, and grievances about the social issues arising out of the project and RP implementation. The GRM is aimed to provide a trusted way to voice and resolve concerns linked to the project, and to be an effective way to address displaced people’s concerns without allowing it to escalate resulting in delays in project implementation.

4.2 Grievance Redressal Committees

18. The EA has establish a mechanism to receive and facilitate the resolution of affected persons’ concerns and grievances about physical and economic displacement and other project impacts, paying particular attention to the impacts on vulnerable groups. The grievance redress mechanism will address affected persons’ concerns and complaints promptly, using an understandable and transparent process that is gender responsive, culturally appropriate, and readily accessible to the affected persons at no costs and without retribution.

19. A Grievance Redress Committee (GRC) has been formed as provided in annexure-4, to ensure APs grievances are addressed and facilitate timely project implementation. Minor grievance will be redressed at the site level through the concerned project engineer and contractor failing which the case will be referred to the GRC.

20. The GRC have representatives from, EA, the officer in PMU designated for safeguards compliance comprising Project Director, Environmental Specialist, SE level officers. The GRC generally have meeting once in a month or as and when required by EA. The main responsibilities of the GRC are to:

i) provide support to APs on problems arising from land/property acquisition and crop/tree compensation; if any

ii) record AP grievances, categorize, and prioritize grievances and resolve them within 4 weeks; if any.

iii) immediately inform the EA of serious cases; and iv) Report to APs on developments regarding their grievances and decisions of the GRC and the EA. Other than disputes relating to ownership rights and apportionment issues, GRC will review grievances involving all resettlement benefits, compensation, relocation, replacement cost and other assistance. Grievances will be redressed within 4 weeks from the date of lodging the complaints. The GRCs will continue to function during the life of the Project including the defects liability period.

5. CONCLUSION

21. All substation sites are being constructed in Govt land & barren land only. There is no any encroachment of acquired land for all substations. 22. There are no grievances recorded during project / subprojects implementation. 23. Aside from best engineering practice and survey approaches of project planning, where land acquisition was one of the primary considerations in selecting the sites for the proposed new 33/11 kV substation, including changed location of substation, distribution lines to minimize social impacts on surrounding community. 24. The distribution lines mainly follow the road ROW for which obtains permission has been obtained from the concerned department. Wherever the distribution lines passes through the agriculture land care has been taken to place the pole on the plot edges to avoid impacts on the land. 25. To finalize the distribution line network, walkover surveys, were held with the participation of local communities and representatives of local rural bodies. 26. All project components do not affect / damage vegetation, crops. Also project activates are stopped during cultivation/ harvesting season to avoid any loss of crops. Also going on project components / activities do not effect to indigenous people & any settlements. 27. Based on due diligence survey & field visits, it is concluded that DISCOM-West subproject does not adverse social impact. 28. Outcome of project implementation will be positive social impact to community for direct & indirect employment & local area development as well as fulfillment of power demand on rural level.

29. Project is almost 80% completed by conforming all social safeguard polices & applicable National & Local laws under PMU of DISCOM-West.

30. DISCOM-West has ensured contractor’s on bid contract document for ADB social safe guard policies for employed staff/ local labor for project implementation going on. 31. Execute agency is closely monitoring and coordinating with respective departments to expedite RP activities implementation and resolving of any social issues, if any.

Sub: Allotment of Government Land free of cost to M.P. Electricity Transmission Company, M.P. Electricity Generating Company and M.P. Electricity Distribution Companies.

The Revenue Department, Government of Madhya Pradesh Notification No. F-6-150/ 2003/Seven/Nazool, Dated: 02.08.2007, through which directives were issued that after 01.04.2008 the land allotted to the M.P. Electricity Board and it successor Companies will have to pay 50% of premium on market rate and as per law to pay annual lease rent is hereby cancelled.

The Government of M.P. now decided that for Electricity Generation/Transmission and Distribution related projects, the Revenue Department will allot the land to Energy Department. Energy Department will allot these Govt. Land to M.P. Electricity Transmission Company, M.P. Electricity Generating Company and M.P. Electricity Distribution Companies without premium and @ Rs. 1/- as annual lease rent.

Please ensure to take necessary action as per the above decision.
