Booking Conditions

1. Availability - Travel, LLC (hereafter referred to as “Magnificat Travel”) is pleased to plan, manage, and facilitate packaged travel experiences and related products hereafter referred to as Journeys. Unless stated otherwise, Journeys are filled on a first-come, first-served basis. Your Journey registration is commenced with receipt of your completed Registration Packet and your Non-refundable deposit (or Pay-in-Full amount). Your registration is confirmed once an open seat is reserved, your Registration Packet is fully processed, and your initial payment is processed. You will receive a confirmation of registration once it is complete. Individuals who register after payments in the payment plan have been due are required to make a catch-up payment by paying the full amount due at that time including regular payments. Please see the payment schedule on the Registration Form to ascertain the total amount due. Some Journeys are sponsored and/or led by outside parties, and those parties reserve the right to choose who participates in the Journey. Magnificat Travel also reserves the right to choose who may or may not participate in any Journey. If no availability exists at the time of receiving your Registration Packet, you will be placed on the Waiting List.

2. Waiting List - If no availability exists at the time of receiving your Registration Packet, you will be placed on the Waiting List. Unless otherwise stated, individuals are placed on the Waiting List in the order that their registrations are received. The Non- refundable Deposit will not be processed while you are on the Waiting List. If a seat becomes available, you will be contacted to see if you still desire to travel and, if so, you will be required to submit an additional payment to catch up on the Payment Plan, if applicable, or Pay-in-Full. Seats may become available either by additional spaces being added or by other participants cancelling. If Magnificat Travel is unable to provide additional availability to any registered individual who is on the Waiting List by the time of travel, then your Non-refundable Deposit and Registration Packet will not be processed.

3. Physical Requirements - Different types of Journeys including, but not limited to, pilgrimages, missions, retreats, and youth trips sometimes require extensive walking and/or physical activity. Journey participants should be able and willing to walk between 3 - 5 miles cumulatively per day. Occasionally, participants will walk more than 5 miles in one day. Journey participants should also expect to walk with all of their luggage during transfers. Actual physical requirements may vary between Journeys. Participating on mission trips or youth trips may include light construction including, but not limited to, heavy lifting, mixing cement, digging holes, pushing wheelbarrows, climbing ladders, climbing stools, hiking, painting, and working outside in the sun. Please contact Magnificat Travel for anticipated physical requirements for individual Journeys.

4. Non-refundable Deposit - A Non-refundable Deposit (sometimes referred to as just “deposit” or “registration deposit”) is non- refundable and due to reserve your seat on the Journey and to cover some of the administrative and operational expenses of Magnificat Travel. Non-refundable Deposit amounts vary by Journey, are included in the total cost of the Journey, and are included in the Pay-in-Full amount at registration. Please see the Registration Form for Non-refundable Deposit information.

5. Late Payments - A $35 non-refundable late fee will be assessed per person per month for all Regular Payments received or postmarked after due dates. All late fees are non-refundable. Participants will not be allowed to travel unless all of their complete balance (including, but not limited to, regular payments, late fees, deviation fees, upgrade fees, insurance premiums, taxes, surcharges, occupancy supplements, and additional applicable service charges) are received before 50 days prior to departure. Magnificat Travel reserves the right to retain or release participant’s seat if a balance still exists in their account 50 days prior to departure, and the Cancellation Policy will apply.

6. Taxes and Fees - All taxes, surcharges, fuel surcharges, exchange rate charges, and additional fees will be determined and assessed as Taxes and Fees at the time of the Final Invoice and may vary from the estimated amount on the registration form. Pay- in-Full participants are charged the base Journey price plus the highest estimated Taxes and Fees. Exchange rate charges will be assessed if applicable exchange rate or rates fluctuate more than 3% above the rate observed at commencement of Journey initiation. Taxes and Fees estimates vary by Journey, travel dates, departure and arrival cities, and may be non-refundable.

7. Travel Insurance - Trip Cancellation/Interruption Insurance is recommended and is not included in your Journey price. Magnificat Travel is not an insurance company and insurance products are offered through a third-party provider. Travel insurance policies cover cancellations and interruptions of your Journey as stated in the insurance policy. The Insurance Premium amount listed on the Registration Form is calculated on the Journey base price plus the highest estimated Taxes and Fees and is due at the time of Registration. To cover add-ons such as occupancy supplements, upgrades, deviations, or any other Journey components in excess of the base price and highest estimated taxes and fees, additional insurance premium will be due at the time of payment for the add-on. Travel Insurance premium must be paid to be enrolled. If you choose to purchase insurance and cancel prior to paying the insurance premium, you are still required to pay the insurance premium. Please see the attached insurance brochure for more details, including information and restrictions on pre-existing conditions.

8. Deviations and Upgrades - A Deviation is a departure from or return to an airport other than what is included in the standard Journey package and/or a return date extension after the return date included in the standard Journey package. An Upgrade is a requested change in seating or seating class on a flight or flights to a seating product or products higher than included in the standard Journey package. Upgrades may include, but are not limited to, economy comfort, economy plus, business class, first class, suite accommodations, larger or generally better accommodations than provided with the standard Journey price, or equivalent products. We will make every effort to request and secure Upgrades and Deviations based on availability from suppliers. Payment for Deviations and Upgrades will be due upon acceptance and are non-refundable. Availability is not confirmed until payment and is not guaranteed until final fulfillment. Airlines reserve the right to change schedules, aircraft types (equipment), and any other variable in their operations that may result in changes to availability of specific seat types. Lodging providers also reserve the right to make changes at their discretion. Magnificat Travel is not responsible for changes due to airline or lodging providers’ discretion. 9. Non-Refundable Fees - Non-refundable fees may include, but are not limited to, registration deposit (included in the Pay-in-Full amount for those electing the Pay-in-Full method of payment), insurance premium, insurance premium supplements, late payment fees, airline deposits and payments, airline upgrades, accommodation upgrades, airline deviations, airline surcharges, airline taxes, airline fees, ticketing fees, motor coach deposits and payments (domestic and abroad), accommodation deposits and payments, cruise cabin deposits and payments, cover charges, entrance fees, tour guide deposits and payments, Oberammergau Passion Play fees and related payments, non-refundable amounts retained from COVID impacted Journeys, non-refundable amounts indicated on the registration form as well as administrative expenses of Magnificat Travel, including, but not limited to, Journey planning and/or booking and any other expenses not recoverable at the time of cancellation.

10. Cancellation Policy - Cancellations can be issued by the participant or by a group leader in coordination with Magnificat Travel for situations that are outside of our control such as pandemics, political unrest at the destination, etc. If the participant cancels, cancellation notifications must be submitted in writing by mail, fax, email, or in person at Magnificat Travel. Cancellation date is determined by: date postmarked for mail, date received for fax, email, or in-person. All reservations are non-transferable between participants and non-participants. Reservations are also non-transferable between Journeys. After receipt of your written cancellation request, you will receive cancellation documents that will require your signature. Refunds are issued within 90 days of acceptance of the cancellation documents and are issued in the same form of payment as used for the reservation.

Terms and Conditions

1. I agree to release, indemnify and hold harmless Magnificat Travel and its affiliates (which term shall include parents, subsidiaries, officers, directors, shareholders, agents, and employees of Magnificat Travel as well as Magnificat Travel itself) and my school, my parish, my school board, my diocese, and group leader (the “Released Parties”) from, and agree not to sue the Released Parties for, any claims that I may have arising from, or in connection with, any personal injury, bodily injury, mental anguish, emotional distress, physical, property, or other damage that I may suffer from any cause whatsoever related in any way to my participation in any Magnificat Travel sponsored Journey. Without limiting the generality of the forgoing, I release, indemnify, and hold harmless the Released Parties from, and agree not to sue them for any personal injury, bodily injury, mental anguish, emotional distress, physical property, or other damage that I may suffer from the Released Parties’ negligence other than from intentional or reckless acts by such parties. I further agree to release, indemnify, and hold harmless the Released Parties from any and all unforeseen disasters and all acts of God (examples including, but not limited to, epidemics, pandemics, outbreaks, earthquakes, tsunamis, weather events, hurricanes, tornadoes, floods, high winds, rain storms, thunderstorms, snow storms, blizzards, lightning, hail storms, storms, etc.), war (whether declared or undeclared), terrorist activities, incidents of politically motivated violence, illness or quarantine, strikes or government restrictions, or the acts or omissions of any other entities and persons over which the Released Parties have no direct or indirect control, including, without limitation, airlines, railways, bus companies, hotels, shipping companies, guides, and sub- contracted agents or tour operators. This release also includes activities not offered by Magnificat Travel that may be considered risky including, but not limited to, exercising, running, skydiving, parasailing, paragliding, bungee jumping, horseback riding, scuba diving, snorkeling, river rafting, mountain climbing, mountain biking, ropes courses, climbing, hiking, whitewater rafting, swimming, canoeing, and any other sporting or recreational activities.

2. I understand that the air carrier’s liability for loss of or damage to baggage or property, or for death or injury to a person, is limited by their tariffs, or the Warsaw Convention, or both.

3. I understand and agree that Magnificat Travel shall have no liability or responsibility for me when I am absent from Magnificat Travel supervised activities or for non-Magnificat Travel supervised activities including, but not limited to, visits to friends or relatives or during deviation periods or any other time during or outside the Journey program when I am away from the group.

4. I understand and agree that Magnificat Travel reserves the right to refuse or cancel my registration at their sole discretion. Group leaders may also refuse or cancel any participant’s registration including my own. I understand that my registration may be cancelled for reasons beyond the direct or indirect control of Magnificat Travel and/or group leaders. In the event of any cancellation, I understand and agree that the Cancellation Policy as outlined in the Booking Conditions apply.

5. I agree to abide by Magnificat Travel’s regulations and the directions of my group leader, my Journey director, tour manager, tour director, tour guide, or Magnificat Travel representative(s) during my Journey. Failure to do so may result in Magnificat Travel terminating me from the Journey immediately. I understand that to disobey such rules or directions is to waive the right to a refund, and that Magnificat Travel or my group leader may then send me home at my own expense.

6. I agree to abide by all local laws when abroad or traveling domestically, including those concerning drugs and alcohol. Minors must have a parent’s written permission to use alcohol even if the local law would otherwise permit. I understand that if I abuse or disobey such laws, even unintentionally, I waive my right to a refund, and Magnificat Travel may send me home at my own expense. I also understand that should local authorities be involved. I will be subject to the laws of the country I am visiting.

7. I understand and agree that if I become ill or incapacitated, Magnificat Travel and its employees, or my group leader, may take any action they deem necessary for my safety and well-being, including securing medical treatment and transporting me home at my own expense.

8. I understand and agree that Magnificat Travel has the right to make changes in Journey itineraries and travel dates, and to modify transportation arrangements, lodging accommodations, attractions, entertainment, sites of interest, and events, including, but not limited to, the use of substitute airlines, ground transportation, lodging accommodations, cruise or ship operators, churches, memorials, events, sites of interest, attractions, entertainment, and museums. In the event I choose to cancel my registration as a result of any such change made by Magnificat Travel or the group leader, I understand and agree that the Cancellation Policy, as outlined in the Booking Conditions, applies.

9. I understand that by enrolling on this Journey, I have made the choice to travel with the group leader organizing my group, and I understand that this choice may not be the responsibility of Magnificat Travel. I understand that a group leader must accompany me on the Journey. If my group leader cancels for any reason, Magnificat Travel will ask him or her to assign a new group leader. If I cancel at this point and choose not to travel with the replacement group leader, I agree that the Cancellation Policy, as outlined in the Booking Conditions, applies. I may also request that Magnificat Travel place me with another Magnificat Travel group. If Magnificat Travel cannot find another group for me, Magnificat Travel’s Cancellation Policy will apply.

10. I understand that it is my responsibility to secure the necessary travel documents including, but not limited to, passport and visa[s]. Failure to do so does not constitute grounds for a refund except according to the Cancellation Policy as outlined in the Booking Conditions.

11. I understand that I will be required to pay for any incidental personal expenses that I incur prior to and while traveling, as well as for any damage I cause to hotel rooms, buses, or other property.

12. I understand and agree that this Agreement and Magnificat Travel’s Booking Conditions constitute the entire agreement between Magnificat Travel and me with reference to the subject matter herein, and I do not rely upon any promises, inducements, or agreements not herein, including but not limited to, any oral statements made to me by any persons or entities directly or indirectly, employed or contracted, or otherwise associated or affiliated with Magnificat Travel, or by my school, parish, diocese, or group leader. This Agreement may be amended or modified only in writing, signed by both parties. The waiver by Magnificat Travel of any provision of this Agreement shall in no way affect the remaining provisions of this Agreement, and this Agreement shall be interpreted as if such clause or provision were not contained herein. I also understand and agree that Magnificat Travel does not and will not share internal private, proprietary, or confidential data or information concerning its operations and business dealings in either general or detailed terms.

13. I understand and agree that this Agreement shall be governed in all respects, and performance hereunder shall be judged by the laws of the State of Louisiana. In the event of any claim, dispute, or proceeding arising out of my relationship with Magnificat Travel, or any claim which in contract, tort, or otherwise at law or in equity arises between the Released Parties, whether or not related to this Agreement, the parties submit and consent to the exclusive jurisdiction and venue of the courts of the State of Louisiana and of the United States District Court for the District of Louisiana.

14. I understand and consent that Magnificat Travel may use any film likenesses taken of me and any of my comments while on a Magnificat Travel Journey for future publicity and use my contact information for future Magnificat Travel promotions.

PRE-EXISTING CONDITION EXCLUSION WAIVER Pre-existing medical conditions are eligible for coverage when: • Plan is purchased at or before final trip payment • Full trip cost is insured • The traveler is medically able to travel at the time of plan purchase A pre-existing condition is an Injury, Sickness or other condition (excluding any condition from which death ensues) of an Insured, Traveling Companion, Business Partner or Family Member which, within the 60 day period immediately preceding and including the Insured’s coverage effective date. This exclusion applies to those not traveling.

This plan does not cover any loss caused by or resulting from: intentionally self-inflicted Injury, suicide, or attempted suicide of the Insured, Family Member, Traveling Companion or Business Partner while sane or insane; Normal Pregnancy or Childbirth, other than Unforeseen Complications of Pregnancy, of the Insured, a Traveling Companion or a Family Member; participation in professional athletic events; motor sport, or motor racing, including training or practice for the same; mountain climbing that requires the use of equipment such as; pick-axes, anchors, bolts, crampons, carabineers, and lead or top-rope anchoring or other specialized equipment; operating or learning to operate any aircraft, as student, pilot, or crew; air travel on any air-supported device, other than a regularly scheduled airline or air charter; war (whether declared or not) or act of war, participation in a civil disorder, riot, insurrection or unrest; any unlawful acts committed by the Insured; Mental, Nervous or Psychological Disorder; if the Insured’s tickets do not contain specific travel dates (open tickets); being under the influence of drugs or narcotics, unless administered upon the advice of a Physician or intoxication above the legal limit; any Loss that occurs at a time when this coverage is not in effect; traveling solely or substantially for the purpose of securing medical treatment; any Trip taken outside the advice of a Physician; Pre-Existing Medical Conditions of an Insured, Traveling Companion, Business Partner or Family Member (within a 60 day period immediately preceding coverage effective date). The following exclusions also apply to the Medical Expense Benefit: routine physical examinations; mental health care; replacement of hearing aids, eye glasses, contact lenses, sunglasses; routine dental care; any service provided by the Insured, a Family Member, or Traveling Companion; alcohol or substance abuse or treatment for the same; Experimental or Investigative treatment or procedures; care or treatment which is not Medically Necessary, except for related reconstructive surgery resulting from trauma, infection or disease; coverage for Trips less than 100 miles from the Insured’s Primary Residence (also applies to the Emergency Evacuation Benefit). The following exclusions also apply to Accidental Death and Dismemberment: Benefits will not be provided for the following: loss caused by or resulting directly or indirectly from Sickness or disease of any kind; stroke or cerebrovascular accident or event; cardiovascular accident or event; myocardial infarction or heart attack; coronary thrombosis; aneurysm.
