MINUTES OF SIXTH MEETING 2015-2016 BOARD OF LICENSURE FOR PROFESSIONAL ENGINEERS AND LAND SURVEYORS Montgomery, Alabama July 13-14, 2016

Chair Barter called the sixth meeting of the 2015-2016 Board to order at 1:00 P.M., Wednesday, July 13 , 2016 at the Board Office, Montgomery, Alabama. The following were in attendance:

It was determined that a quorum was present. The meeting was opened with the Pledge of Allegiance and a prayer. Everyone congratulated Mr. Barter on being reappointed to the Board.

The proposed meeting agenda was reviewed. Additional agenda items were identified and were added to the agenda under New Business.

16-113. IT WAS MOVED by Mr. Johnson and seconded by Mr. Christy to adopt the proposed agenda as amended. MOTION CARRIED 5-0.

Minutes of the fifth meeting of the 2015-2016 Board were received for approval.

16-114. IT WAS MOVED by Mr. Christy and seconded by Mr. Johnson that the minutes of the fifth meeting of the 2015-2016 Board held June 1-2, 2016 be approved as amended. MOTION CARRIED 5-0.

Action items from previous board meetings were reviewed. A question was raised if the Board should respond to the ASPLS Position Statement that had been provided to the Legislative Reference Service.

Page 1 It was determined that at this time the Board would not comment on any of the position statements that were included in the request for a review of Administrative Rules 330- 14-.0S(f) and 330-X-14-.06(a)14.

APPLICATIONS - Mr. Nathan Johnson, Advisor

The Board previously authorized the Executive Director to approve applications for licensure, intern certification, and examinations if the application is in order and all requirements have been met. All applications for licensure, intern certification and examinations issued since the June 1-2, 2016 Board meeting were reviewed.

Applications of those applying for Professional Engineer licensure by comity, as provided by Section 34-11-4( 1)(b) of the Li censure Law, were considered.

Applications of those applying for Professional Engineer licensure by examination, as provided by Section 34-11 -4(1 )a. and b. of the Licensure Law having previously passed the FE Examination in Alabama or in another jurisdiction, were considered.

Applications of those applying for Engineer Intern certification, as provided by Section 34-11-4(2) of the Licensure Law, were considered.

Applications of those applying for Land Surveyor licensure by examination, as provided by Section 34- 11-4(3)a., b. , and c. of the Licensure Law, were considered. Applications of those applying for Professional Land Surveyor licensure by examination having previously passed the Fundamentals of Land Surveying Examination and the Principles and Practice of Land Surveying Examination in Alabama or in another jurisdiction were considered and were approved for the Alabama Land Surveying Standards, History, and Law Examination. Mr. Grace arrived during the discussion on applications.

IT WAS MOVED by Ms. Hyde and seconded by Mr. Whorton that the Board ratify the approval of licenses issued since the June 1-2, 2016 Board Meeting and that the list of those issued be included in the minutes on Attachment #1; ratify the approval oflntern Certifications issued since the June 1-2, 2016 Board Meeting and that the list of those be included in the minutes on Attachment #2; and ratify the approval for examination those applicants approved since the June 1-2, 2016 meeting and listed as approved on Attachment #3. MOTION CARRIED 6-0.

16-116. IT WAS MOVED by Mr. Johnson and seconded by Mr. Grace that the Board approves for licensure Zonglei Mua and Saddam Ahmad. MOTION CARRIED 6-0.

16-117. IT WAS MOVED by Ms. Hyde and seconded by Mr. Grace that the Board denies for licensure Mark Steven Frey and John Kee Paik. MOTION CARRIED 6-0.

16-118. IT WAS MOVED by Mr. Johnson and seconded by Ms. Hyde that the Board approves for examination those applicants listed as "approved"; defers for examination those applicants listed as "deferred"; denies for examination those applicants listed as "denied" on Attachment #3. MOTION CARRIED 6-0.

Page 2 LAW ENFORCEMENT - Ms. M. Elisabeth Hyde, Advisor

The Board reviewed the status of the files pending with the Board, the Investigator, and/or the Investigative Committee. The Board was briefed on the 2015-2016 statistics.

The Board reviewed pending cases that the investigative committees have completed to accept, modify, or reject the suggested courses of action. Cases that are being recommended for closure or where they are recommendations from the investigative committee are discussed in a sanitized format so that in the event the Board suggests another course of action that the due process of the investigation has not been compromised. Respondent's information is not divulged until after a proposed consent order is accepted and a final order is approved.

16-119. IT WAS MOVED by Mr. Christy and seconded by Ms. Hyde to accept the proposed Consent Order and issue the Final Order for Case 2015-50-B. It was determined that there was probable cause that Mr. Russell W. Duke, PE #27813 had failed to provide the required documents to validate the continuing education courses that had been listed on his 2014 licensure renewal form. The accepted terms of the Consent Order are that Mr. Duke must pay the Board $212 for the cost of the investigation and must pay a fine of $1 ,000 to the Board, his license to practice engineering is suspended for six months with that suspension being strayed; and that he had to provide the Board by June 1, 2016 certificates showing he has completed 15 professional development hours. The Consent Order and Final Order will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 5-0 with Mr. Whorton recused.

16-120. IT WAS MOVED by Mr. Christy and seconded by Mr. Grace to accept the proposed Consent Order and issue the Final Order for Case 2016-01-B. It was determined that there was probable cause that Mr. Jeffrey H. Stricklin, PE #16480 had affixed his PE seal and signature on a certification of construction of an impoundment built on behalf of his employer that had not been properly constructed and suffered catastrophic failure. The accepted terms of the Consent Order are that Mr. Stricklin must pay a $5,000 fine to the Board and his license to practice engineering is suspended for five years with the final three years being stayed. The Consent Order and Final Order will become a public record. The Board accepted the Consent Order and issued the Final Order. MOTION CARRIED 5-0 with Mr. Barter recused.

16-121. IT WAS MOVED by Ms. Hyde and seconded by Mr. Grace to close Case 2016-06-B with no formal action. MOTION CARRIED 5-0 with Mr. Johnson recused.

16-122. IT WAS MOVED by Ms. Johnson and seconded by Mr. Christy to close Case 2016- 17-B with no formal action. MOTION CARRIED 5-0 with Mr. Grace recused.

CERTIFICATES OF AUTHORIZATION - Mr. Marc S. Barter, Advisor

The Board previously authorized the Executive Director to issue certificates of authorization to applying firms if the application is in order and all requirements have been met. A list of the certificate of authorizations issued since the March 2016 Board Meeting were reviewed.

IT WAS MOVED by Mr. Christy and seconded by Ms. Hyde that the Board ratify the approval of the Engineering and Land Surveying Certificates of Authorization issued since the June 2016 Board Meeting and that the list of those issued be included in the minutes on Attachment #4. MOTION CARRIED 6-0.

The Board discussed the Certificate of Authorization applications that had exceptions. The Board determined physical addresses were required for all CA applications.

16-124. IT WAS MOVED by Mr. Johnson and seconded by Ms. Hyde to approve the CA for Southern Electrical Consulting, LLC once the application lists a physical address. MOTION CARRIED 6-0.

COMMUNICATIONS - Mr. Charles Willis, Advisor

Griffin Pritchard briefed the Board on the various publication efforts that are in development or are planned. Deadline dates for the next edition of the newsletter were set. The general topics for the four webinars per year were briefed. Rick Huett will be the presenter at the October webinar with the topic being the continuing education audit process. The comments received for the Signing and Sealing Webinar were distributed. Samples of possible recognition pins were shown.

LEGISLATURE - Ms. M. Elisabeth Hyde, Advisor

The status of the draft law changes was discussed. Possible additions to the law changes were discussed and the Board identified which changes should be incorporated into the current draft. Ben Albritton was asked to review the current draft version to see if he had any concerns/comments. Mr. Albritton's comments and the new changes will be incorporated in the current version with a new version being ready for discussion at the September board meeting.

FINANCE-Mr. Richard Grace, Advisor

Financial report for May was reviewed. The timelines for closing out FY 2016 and beginning FY 2017 were discussed. The window for the bidding of the AV system is currently closed so there will be a delay in getting the upgrade for the board room. Everyone was encouraged to get their travel documents filed.

ENGINEERING

The Board considered a request received from the University of Alabama College of Engineering. The College was asking the Board to consider the BS in Environmental Engineering and the BS in Architectural Engineering was being equivalent to ABET engineering degrees when the transcript also lists that the graduate has a double major one of which is civil engineering. It is the university's policy

Page 4 to issue only one BS in Engineering so some of the time the transcripts list the BS in the unaccredited program. The Board had questions on how they would be able to know that all requirements for a BS in civil engineering had been met and deferred acting on the request until such time as representatives from the college could meet with the board.

The Board approved the results of the April 2016 SE examination results.

16-125. IT WAS MOVED by Mr. Christy and seconded by Mr. Grace to accept NCEES' recommended cutoff score for the SE Examination, to approve the results of the SE Exam given April 2016, to license those individuals who passed the SE having previously passed the FE Exam and further that the list of those issued licensure as a result of passing these examinations be included in the minutes on Attachment #1. MOTION CARRIED 6-0.

CHAIR'S REPORT

The agenda items under the Chair's Report were deferred to later in the meeting.

EXECUTIVE DIRECTOR'S REPORT

The Board reviewed the requests for qualifications that had been received from engineering and land surveying firms to provide a monitoring service as board technical advisors. Some of the firms have agreed to the requirements as outlined by the Board at the last board meeting. Others have asked for an increase in the fee rate. After discussion about the requirements and how these paid advisors will be utilized a motion was made.

16-126. IT WAS MOVED by Mr. Christy and seconded by Mr. Grace to accept the three firms that had agreed to the provisions and send a letter thanking the others for their interest. 5-1 with Mr. Johnson voting in the negative.

The Board was briefed on the level of coverage that the Department of Risk Management provides that is the state's general liability insurance and fidelity bond coverage. With the additional coverage that the Department has added for Board Members, it was determined not to seek additional private coverage.

The Board was provided the agenda, summary of motions and the convention report for the NCEES Annual Meeting to be held in August in Indianapolis, IN.

The recently issued Office of Information Technology directives were discussed. The concerns of mixing state information onto personally owned systems will be causing changes on how board members will be receiving board information. The Executive Director will develop various options that the board members will be able to use. Once those options have been identified then each board members will be able to choose which option will work best for them.

Page 5 The upcoming out-of-state travel was identified. It was requested that everyone identify as soon as possible who was planning on attending the fall conferences so that the board office would be able to track the travel requests that are required to be approved by the Governor' s office.

Suggestions on the format for the master calendar were discussed. The Board requested they receive one calendar that will includes deadlines and events instead of having multiple calendars.

The Board was updated on the efforts to fill the vacant account and investigator positions. An individual has been identified to be hired for the accountant position with a possible start date of July 16 and the interviewing of candidates for the investigator position will be the two weeks following the July board meeting.

In order to determine the best dates for the 201 7 board meetings, the board members will be polled prior to the September board meeting so that a tentative calendar can be approved at that time.

CORRESPONDENCE

The Board reviewed a request for a declaratory opinion on the use of electronic seals/signatures when using the Building Information Modeling(BIM) software package REVIT. The consensus of the board members was that a professional engineer or professional land surveyor should never allow the seal and signature be out of their control. The documents in REVIT are not the final plans and should not be considered as such.

NEW BUSINESS

The officer for 20176-2017 year were elected.

16-127. IT WAS MOVED by Mr. Barter and seconded by Mr. Grace that Mr. Christy be elected as Chair of the Board for the 2016-2017 year. MOTION CARRIED 6-0.

16-128. IT WAS MOVED by Mr. Grace and seconded by Mr. Christy that Ms. Hyde be elected as Vice Chair of the Board for the 2016-2017 year. MOTION CARRIED 6-0.

16-129. IT WAS MOVED by Mr. Grace and seconded by Ms. Hyde that Mr. Johnson be elected as Secretary of the Board for the 2016-2017 year. MOTION CARRIED 6-0.

CHAIR'S REPORT

The Executive Director' s, Deputy Director' s, and Executive Assistant' s job descriptions and performance appraisals were discussed. Mr. Barter was thanked for taking the lead to develop a process for the evaluation of the three appointed positions. It was noted that efforts should be made to continue to have one time to consider all the positions and ideally the annual date will be October 1. The issues and procedures for requesting pay raises for the three positions were discussed. It was identified that there are available promotion steps in the pay series that the executive assistant is filling and a motion by the board is all that is necessary. The deputy director's position would have to be moved into a higher

Page 6 pay series which requires approval by the Finance Director and the State Personnel Board. A raise for the executive director would also require approval of the Finance Director and the State Personnel Board.

16-130. IT WAS MOVED by Ms. Hyde and seconded by Mr. Christy to award a 5% pay raise to Bonnie Kelly, Executive Assistant. MOTION CARRIED 6-0.

16-131. IT WAS MOVED by Ms. Hyde and seconded by Mr. Christy to request a 5% pay raise for William Huett, Deputy Director. MOTION CARRIED 6-0.

16-132. IT WAS MOVED by Mr. Christy and seconded by Ms. Hyde to request a 5% pay raise for Regina Dinger, Executive Director. MOTION CARRIED 5-1 with Mr. Barter voting in the negative.

IT WAS MOVED by Ms. Hyde and seconded by Mr. Johnson to amend the previous motion to be a 2 Yi% pay raise instead of a 5% raise for the Executive Director. MOTION CARRIED 6-0.

The Board meeting adjourned at 8: 15 P.M. The Board reconvened July 14, 2016 at 8:00 A.M. with Mr. Barter and Mr. Willis being absent.

FORMAL HEARING

A formal disciplinary hearing was convened at 8:05 A.M. to hear testimony concerning a complaint against Mr. David Fannon, regarding allegations that he had discredited the professional engineering profession. Mr. Fannon was represented by an attorney. A court reporter was present and a transcript of this proceeding was requested.

Ms. Dana Billingsley, contracted Administrative Law Judge, presided at this hearing. All board members present heard evidence presented by Assistant Attorney General Mr. Benjamin Albritton. The hearing was concluded at 2:45 P.M.

Ms. Billingsley will write her findings and conclusions that will be presented to the Board at a later board meeting at which time they will deliberate.

CLOSING REMARKS

The Board members were made aware that Mr. Charles Willis tendered his resignation from the Board effective immediately. He has identified that his employment responsibilities have changed and he can no longer devote the time necessary to be a board member.
