M E M O R A N D U M To: Southwest Water Authority Board of Directors From: Mary Massad, Manager/CEO Subject: January 6, 2020, SWA Board of Directors Meeting Date: December 26, 2019 The next Southwest Water Authority (SWA) Board of Directors meeting will be Monday, January 6, 2020, at 9:00 a.m. MST at the Southwest Water Authority O&M Center Office in Dickinson, ND. Happy New Year! I hope your holiday season was merry and bright. As Southwest Water Authority looks back on 2019, the accomplishments which have been made developing the Strategic Plan and action plans to serve the remainder of our service area are commendable. The commitment and dedication of the Board of Directors, consultants, management and staff have made 2019 another successful year. Cheers to 2020! Under Board monitoring, there is one policy this month, Policy III.D. Board Governance Process-Board Committee Principles. The policy is included in the Board packet for your review. I will be presenting the Manager/CEO Report for Policy II. C. Executive Limitations-Financial Condition and Policy II. E. Executive Limitations-Asset Protection. I will request the Board approve these reports. Please let me know if you have any questions. Southwest Lime, LLC, has been under contract to haul away lime residual from the Residuals Handling Facility since April 30, 2019. The original contract was a six month contract and was renewed for another six months through Board action at the October 7, 2019, Board of Directors meeting. Jon Wert has asked to extend the contract for a duration to coincide with the North Dakota Department of Environmental Quality permit. This item is on the agenda under decision making. Mr. Wert continues to make large financial investments to make this work. The Strategic Plan approved at the December 2019 Board of Directors meeting is included in your Board packet. The Strategic Plan will be included in the Board packet each month as the Board works toward completing the goals and action plans. Hard copies are available upon request. The SWC met Friday, December 6, 2019, on the last day of the 56th Annual Joint North Dakota and Upper Missouri Water Convention and Irrigation Workshop. The Transfer of Ownership Technical Memoranda were presented and discussed. The Governor asked many questions. An SWC subcommittee meeting with Apex Engineering and DGR Engineering to discuss the Southwest Pipeline Project Transfer of Ownership memoranda was held on Friday, December 20, 2019. This subcommittee was chaired by the Southwest Water Authority Board of Directors Page 2 December 26, 2019 Lt. Governor, Brent Sanford. Director Schneider attended the subcommittee meeting. The city of Dickinson was also in attendance. The memoranda are included in your Board packet. The city has formed a committee about the Southwest Pipeline Project and SWA. Director Schneider also attended the city of Dickinson committee meeting. Sindhu S. Pillai-Grinolds will be providing a Project update and status of current construction. Sindhu’s memo is included in the Board packet. Jim Lennington will give an update on Specific Authorization 219 the study of preliminary design of distribution system expansion and Specific Authorization 220 main line transmission design from the Ray Christensen Pump Station to the Davis Buttes, New England, and Belfield Reservoirs. The Return on Investment information is included in the Board packet. The SWPP returned $378,262.94 to the Resources Trust Fund in December 2019, for a total of just over $5 million for the year. With payments made by Perkins County Rural Water System included, the Return on Investment number is $73,168,248.22. Misti Conzemius will give an update on subsequent customers, complaints, and waiting lists. The waiting list continues to grow. The sign-up and easement department continues to call potential customers from the waiting list and review hydraulic capacity. The waiting list now has 713 potential locations. Please see the included spreadsheets of breakdown by county, service area, and customer type. We will review Project funding. Sindhu’s updated Project funding spreadsheet is included for your discussion and includes the MTL Capacity Upgrades for providing additional water to the first reservoirs outside of Dickinson in all directions. A new 12 MGD water treatment plant to replace the original water treatment plant in Dickinson is included. It is important to continue moving forward with design and construction of the Project in a timely manner to serve those who continue to wait. The 56th Annual Joint ND and Upper Missouri Water Convention and Irrigation Workshop was held December 3-6, 2019, at the Ramkota Hotel and Conference Center in Bismarck, ND. This year’s theme was “Overflowing with Possibilities.” Our Chairperson, Larry Bares, was presented with the Upper Missouri Distinguished Service Award and Director Brian Roth received the 2019 Water Wheel Award. Congratulations and thank you both for your dedication to water! I presented an update on SWA and the SWPP on Thursday, December 5 during the general session. The rural water managers met prior to the North Dakota Rural Water Systems Association Board of Directors meeting. The Missouri River Joint Board (MRJB) also met on Thursday, December 5. SWA once again provided financial support of Missouri River Recovery Implementation Committee (MRRIC). The Water Convention and the MRJB agendas are included with the Board packet. The North Dakota Water Users Association Board of Directors met on December 6, 2019, in conjunction with the Water Convention. The meeting agenda, Board of Directors, staff and the 2020 work plan are included in the Board packet. SWA has renewed its membership with the North Dakota Water Coalition. The Coalition hosted a luncheon on Friday, December 6, 2019, for members and the State Water Commission. During the luncheon Senate Majority Leader Wardner gave a presentation on the Legacy Fund Earnings Committee. I am including the fund projections as provided to this Committee by Legislative Council. Southwest Water Authority Board of Directors Page 3 December 26, 2019 Water Topics Overview Committee met Tuesday, December 10, 2019. The agenda is included in the Board packet. The next meeting will be held on March 25, 2020. SWA has been asked to present information on our current biennium construction and to give an update on the intake. The North Dakota Water Education Foundation Board meeting agenda and related information is included in the Board packet. The Project WET program was established in 1984 by the ND State Water commission to educate the public about water resources and management. The program, which is the co- sponsor of the “Make a Splash” Water Festival each year, is now offered in all 50 states and in 33 countries. Project WET is conducting facilitator leadership training on February 8-9, 2020, at the State Water Commission. This is a great opportunity to become a certified Project WET facilitator to help educate the public on the importance of water. Information on this topic is included in your Board packet. SWA continues to research solutions regarding the replacement of IDT satellites which will cease to transmit after December 2020. Information on moving forward is included under a separate memo. Updating the Emergency Response Plan (ERP for each department remains a priority. The Water Distribution System ERP is complete. Remaining updates to the Administration ERP include phone number and contact information corrections for vendors, city mayors and auditors. The Water Treatment ERP remains a work in progress as equipment and O&M manuals for the Southwest Water Treatment Plant and the Residuals Handling Facility are being reviewed and logged. This is about 60% complete. The North Dakota Rural Water Systems EXPO and Annual Meeting will be held February 11-13, 2020, at the Delta by Marriott Fargo. The agenda is included under incidental information. Please let the office know if you would like to attend so arrangements can be made. Sandy Burwick will give an update on Perkins County Rural Water System. SWA continues to record the radio show, the “Southwest Water Cooler.” It is currently airing Tuesday mornings at 7:30 a.m. on I94, 93.9 FM and on Thursday afternoons at 12:40 p.m. The show can also be heard on SWA’s website, www.swwater.com. Please go to “Contact Us” on the header and click on “SWA Social Media.” The radio show is at the top of the page. I ask you to let me know what you think of the show and pass on suggestions for content to increase our public relations efforts. SWA continues to prepare for risk and resilience and emergency response plan certification with the Environmental Protection Agency under section 2013 of America’s Water Infrastructure Act (AWIA of 2018. The assessment process is under investigation. Section 1321 of the AWIA has provisions for North Dakota property, acquired through hazard mitigation assistance, be exempted from open space deed restrictions to the extent necessary to complete the Fargo-Moorhead Metropolitan Area Diversion Project. This provision also gave F-M Diversion the greenlight to apply for a $510 million federal loan through the EPA’s Water Infrastructure Financing and Innovation Act (WIFIA loan program as previously announced.
