A video excerpt from the City of Kamloops' Council Meeting of September 13, 2011 was presented. The excerpt provided an update regarding the large scale failure that occurred at the Pulp Mill Lift Station on July 15, 2011 and identified the distinct problems as infrastructure failure and human error. It was noted that the City of Kamloops Public Works and Sustainability Department is currently reviewing its standard operating practices and procedures to minimize the chances of a future occurrence. Upon question, the Chair advised that the City of Kamloops conducts on-going inspections and upgrades to their water and sewer lines.

He advised that installation of the cell tower in Blue River is underway, the site in Vavenby will be underway in the near future and that Wire Cache may be delayed until the spring of 2012.

(e) OkanaQan Valley Transportation Symposium

Director Taylor advised that he and the Director of Development Services attended the Okanagan Valley Transportation Symposium in Pentiction on September 16 and added that any interested Directors should contact him for a copy of the information presented at the meeting.

(f) Teck Resources Investment at HiQhlandValley Copper

Director Dosch advised that Teck Resources announced that it is investing $685 million in two of its operations. He reported that $475 million will be allocated to modernize Highland Valley Copper with the remaining investment directed to Teck Resources' Trail Operations. Director Dosch added that the investment at Highland Valley Copper will result in 500 construction jobs over the next two years.

(g) Phase 2 WideninQ of Trans Canada HiQhway Between Monte Creek and Pritchard

Director Taylor discussed the recent Ministry of Transportation and Infrastructure Open House he and Director Sternig attended regarding the Phase 2 project to widen the Trans Canada Highway between Monte Creek and Pritchard. Director Taylor specifically addressed the Ministry's design changes which alter the original plan to construct an underpass/overpass at Martin Prairie Road in Pritchard. He advised that he has received numerous comments pertaining to safety at the intersection from residents of Pritchard.

Director Pennell advised that a meeting was held on September 14, 2011 in Lake Country. He further advised that in regard to the annual conference, the days of the week that it has historically been held will be changed.

He advised that the 2012 conference will be held in Revelstoke and added that a number of communities have requested an opportunity to host future conferences.

The Chair called the Public Hearing to order and invited input from the public.

Upon question, the Director of Development Services advised that no written submissions had been received.

Mr, Dan Ashley addressed the Board stating that he lives in Pinantan Lake and received a Public Hearing Notice. He was not in support of the application and believed that the zoning should remain residential. He also expressed concerns regarding subdivision; rewarding bylaw non-compliance; granting approvals after the fact; and the impact that development may have on the environmental quality of the creek and Pinantan Lake.

The Director of Development Services clarified that there was no subdivision as a part of this process or facilitated by the zoning changes and that the property was previously and currently zoned C1, commercial.

Discussion followed regarding building permit and bylaw compliance. Concern was expressed that proper building permit processes were not followed. Mr. Ashley was invited to clarify his concerns.

The Director of Development Services provided some history and what actions and consultations had occurred to date in order to rectify the unlawful building and land use situation.

Discussion ensued regarding the definitions and differences of C-1 versus C-5 zonings.

It was questioned how the recommendation for split zoning had come about, Staff clarified that this was at the request of the applicant but that the land use changes were more restrictive: comprising of a "down-zoning".

Ms. Michelle Ashley, resident of Pinantan Lake, addressed the Board expressing her concerns that the rezoning may have a negative impact on Pinantan Lake and its residents, as well as setting a precedent for others to not follow building permit processes.

Mr. Corey George, applicant, addressed the Board and provided background information on the subject property and spoke to concerns raised in waterfront protection and possible future commercial developments.

Following questions from the Board, the applicant stated he has no current plans for commercial development but that he wished to maintain that option for the future and was taking action to legalize the buildings upon the land. Upon further discussion, the applicant confirmed that he would not oppose a covenant for the property to protect the creek.

The Chair called for additional input, having heard none the Chair closed the Public Hearing for this bylaw.

DISCUSSION:

The subject property is located on Kealty Road in Vinsulla. The property is bordered by Kealty Road to the east and the to the west with the Canadian National Railway (CNR) right of way bisecting the middle of the property from north to south. One manufactured home is located on Lot 1 between the CNR right of way and Kealty Road. The area west of the CNR right of way is vacant.

The Kamloops North Official Community Plan (OCP) supports rural residential development and associated uses, including agricultural use, on parcels with a minimum size range of 0.8 to 2 hectares. ln accordance with the direction provided in the OCP, the application was assessed against the following OCP criteria:

a) the existing use of the parcel- Residential and agricultural uses exist on the subject property. Residential use will continue on the Remainder of Lot 1.

b) the nature of the surrounding land uses - The surrounding lands, with the exception of the North Thompson River, CNR right of way and public road, currently support residential and agricultural uses and maintain the ruralform and character of the area with a range of parcel sizes and the Agricultural Land Reserve to the north.

c) the ability to obtain potable water and to dispose of effluent on the parcel without adversely affecting lands or water bodies on the parcel or outside of the parcel- The subject property is currently used for residential purposes. The existing residence has a well and sewage disposal system. Agricultural uses are envisioned for the areas adjacent to the North Thompson River.

The proposed parcel sizes fall within the range of parcel sizes envisioned in the OCP. The future subdivision will not result in an increase in the number of parcels or a change in land use.

Accordingly, the zoning amendment bylaw documents will need to be approved by MOTI prior to final adoption. The Ministry further advises that it has no objection to the proposed zoning bylaw amendment. . The applicant had a Qualified Environmental Professional prepare a Riparian Area Assessment Report No. 1867 for the proposed development, which was submitted and accepted by the Ministry of Environment on January 4, 2011.

GONGLUSION:

Planning Services supports the proposed zoning bylaw amendment as the proposed subdivision/consolidation generally complies with the Rural Residential policies in the Kamloops North OCP.

WHEREAS an application for amendment to Zoning Bylaw No. 940 has been made;

AND WHEREAS the desirable changes in uses of Land and Buildings have been considered;

DISGUSSION: The three subject properties are located south of the City of Merritt on the northwest, uphill side of Midday Valley Road. These vacant properties are across Midday Valley Road from the Merritt Mountain Music Festival properties. The applicant is applying to amend the OCP and Zoning Bylaws to allow a comprehensive residential and hotel development.

Boundary Extension ln response to the applicant's request, the City of Merritt has initiated a Boundary Extension Application with the Ministry of Community, Sport, and Cultural Development to include the

The Board of Directors, at their meeting of June 23,2011, resolved to support the City of Merritt application to extend city boundaries. ln accordance with Section 24 of the Local Government Act,land use bylaws adopted by the Board of Directors will remain in force on the subject properties, until amended by City Council, should the municipal boundary extension application be successful. Planning Services has worked extensively with City of Merritt staff and the applicant in the development of the proposed OCP Amendment and Zoning Amendment Bylaws, and the Development Permit application.

OCP Provisions The existing OCP designations for the subject properties are RuralResource, and Comprehensive Entertainment Commercial, which would have allowed the development of a racetrack and associated facilities. The applicant is now applying to create a new OCP designation Comprehensive Resrdentiat Commercial, which would allow the proposed residential and hotel development to proceed, provided the development is serviced by the City of Merritt community water system, sanitary sewer system, and road network; and with due consideration for stormwater drainage, environmental concerns, wildlife protection, wildfire hazard, and unstable soils.

One of the properties is also within the Nicola Valley OCP Coal Hill Development Permit Area for the protection of the natural environment; the protection of development from hazards (specifically historic mine shafts); and the regulation of form and character of commercial, industrial and multi-family residential development. The applicant has submitted Development permit Application No. DP 2for allthree properties. Proposed Development Permit DP 2 will contain detailed requirements for the proposed residential and hotel development, and will come before the Board of Directors should Bylaws 2357 and 2358 be adopted. The existing Coal Hill Development Permit No. 27 on Lot 2 includes a guideline requiring berms, screens and landscaping to mitigate the noise and visual impacts of the racetrack; given the racetrack was not developed, this provision is unnecessary and would be deleted by OCP Amendment Bylaw No. 2357.

Zoning The properties are zoned RL-1 (Rural), and C-10 (Comprehensive Entertainment Commercial), which would have allowed the development of a racetrack and associated facilities' The applicant is seeking the Board's supporl to delete the C-10 Zone, and create a new zone: CD-2 (Gomprehensive Residential Commercial Two) Zone allowing the applicants to develop 90 country residential lots; 200 townhouses; and a hotel with 125 rentable units. The benefit of a new CD-2 zone rather than a combination of existing zones is that the CD-2 zone would allow the developer some flexibility in locating the different residential and commercial components of the proposed project, as more information becomes available.

Regional Growth StrategY (RGS) The RGS states that residential and commercial growth should be directed into established centers where local government can ensure that adequate and appropriate services are provided. As the City of Merritt has requested a boundary extension to encompass the subject propeúies, and as the proposed Comprehensive Residential Commercial OCP designation and CD-2 zone require that the proposed development be serviced by the City of Merritt community water and sanitary sewer systems, the proposed development conforms to the RGS.

It is anticipated that the subdivision stage of the development approval process would occur after the properties are included within the expanded boundaries of the City of Merritt. At the subdivision stage the local government will advise the applicant of the park dedication, road layout, and other subdivision servicing requirements.

Referrals and Liaison o The subject properties were used for coal mining in the past. The applicant has submitted a Prelimina4¡Assessment of Historicat Mining on Proposed Soleado Ridge report, prepared by Michael Cullen, P. Eng, which identifies the locations of the historic mine shafts. Further geotechnical hazard assessments will be required should this application move to the subdivision and building permit stages of the development approval process.

. ln accordance with the Fringe Areas Policy Paper, this proposed development was referred to the City of Merritt for their consideration. At their meeting of July 26,2011, Merritt City Council resolved to recommend support for the proposed development and determined that the development can be serviced by the community water system and sanitary sewer system.

o Advisory Planning Gommission advises that it does not approve of this application, stating that the area does not appear to be suitable for residential development.

o Building lnspection Services states that there are no outstanding building permits or building violations on the subject properties, and that building permits will be required for all construction.

o Ministry of Transportation and lnfrastructure states that the applicant is required to submit a traffic impact study and plan for this proposed development. Covenant No. KR024393 currently registered against the subject properties, states that a traffic impact study and plan shall be submitted and approved by the City of Merritt and the Ministry of Transportation and lnfrastructure (MOTI) prior to the issuance of a Building Permit. On April 14, 2011, the Board of Directors authorized the amendment of Covenant No. KR024393, so that the MOTI is now listed as a Transferee on the covenant.

. Fisheries and Oceans Ganada advises that any works considered within 30 meters of a stream will require their review. Planning Services has received correspondence from a Qualified Environmental Professional who states that there are no streams on the properties that meet the definition of a stream in the Riparian Areas Regulation.

¡ Wildfire hazard report, as submitted, states that the subject propefties have a moderate fire hazard rating, but that this rating can be lowered by implementing the mitigative measures recommended in the report. The proposed development shall be required to conform to the recommendations of the wildfire hazard report.

Archeologicat Branch of the Ministry of Forests, Lands, and Natural Resource Operations advises that there are two known archaeological sites on these properties and a significant potential for other unrecorded archaeological sites. Prior to any land altering activities, the Archeological Branch requires that the owner have a qualified archaeologist determine the steps that will be required to manage impacts to protect archaeological sites, which could include an Archaeological lmpact Assessment and Alteration Permit.

First Nations Engagement The Lower Nicola lndian Band advises that the properlies are in their traditional territory and that there is a significant potentialfor unrecorded archaeological sites to exist onsite. The Lower Nicola lndian Band (LNIB) recommends that an Archeological lmpact Assessment (AlA) be conducted prior to the commencement of any proposed work. LNIB further states that they would like to be active participants in the AlA. Planning Services has given the applicant a copy of the LNIB letter and recommended that the applicant contact Lower Nicola lndian Band directly to discuss the proposed development. ln response to the concerns raised by the Lower Nicola lndian Band, Development Permit No. DP 2 requires that, prior to development occurring, the owners must hire an archeologist to determine how to protect the archeological resources on the property.

The Shackan lndian Band has expressed concerns about the impact that the proposed development will have on the water supply in the area. ln addition, the Shackan point out that the Coldwater River, which is located east of the subject properties, is being considered for placement on the Outdoor Recreation Council list of Endangered Rivers. ln response to the concerns expressed by the Shackan lndian Band, the following two requirements were added to proposed Development Permit No DP 2: 1) an environmental impact assessment shall be completed prior to development commencing onsite; and 2) water conservation measures such as watering restrictions, low-flow plumbing fixtures, and xeriscape landscaping shall be required during the development.

Public Consultation The Local Governmenf Act requires the Board of Directors to consider early and on-going public consultation regarding the OCP amendment. On August 19 and 26,2010, the applicant placed notices in two editions of a local newspaper advertising an Open House regarding the proposed development which was held at the Merritt Desert lnn on September 2,2010. ln addition, Planning Services mailed formal Notice regarding this proposed amendment to property owners within 100 metres of the subject property on October 19, 2010. The Regional District has received three letters in support of this proposed development, which will be provided to the Board should this application proceed to a Public Hearing.

CONGLUSION: Planning Services supports this development application as it conforms to the Regional Growth Strategy, is supported by the City of Merritt, and would be serviced by the City of Merritt community water and sanitary sewer systems.

WHEREAS the Board of Directors adopted the Nicola Valley Official Community Plan Adoption Bylaw No. 1450, 1995 on July 18, 1996;

AND WHEREAS an application (BA 17) has been received to amend the Nicola Valley Official Community Plan;

AND WHEREAS the Board of Directors of the Thompson-Nicola Regional District deems it desirable to adopt the amendment to the Nicola Valley Official Community Plan;

AND WHEREAS the amendment is consistent with the Regional District's Regional Growth Strategy and Waste Management Plan, and as the amendment does not affect the Regional District's Financial Plan;

NOW THEREFORE, the Board of Directors of the Thompson-Nicola Regional District, in open meeting assembled, enacts as follows:

1.1 This bylaw may be cited as "Nicola Valley Official Community Plan Amendment Bylaw No. 2357, 2011".

2. PURPOSE

2.1 Amend Section 2.1 lo read as follows:

"This Plan provides for six (6) residential types of residential development of varying densities and servicing requirements"

2.2 lnsert a new residential land use in Section 2.1, as follows:

"- Comprehensive Residential Commercial"

2.3 lnsert a new Section 2.17, Comprehensive Residential Commercial, as follows:

Comprehensive Residential Commercial development may be permitted within the Plan area in suitable locations as shown on Map 7, provided that:

a) The development is adequately serviced by the City of Merritt community water and sewage systems.

b) The development is designed to protect the integrity and right-of-way of the City of Merritt Street Network Plan and stormwater drainage system

DIVISION THIRTY- SEVEN - CD- 2 COMPREHENSIVE RESIDENTIAL COMMERCIAL DEVELOPMENT TWO ZONE

PURPOSE

The purpose of this zone is to permit comprehensive residential commercial land use and development within the area designated Comprehensive Residential Commercial Development in the Nicola Valley Official Community Plan Area of ElectoralArea "N".

37.1 PERMITTED USES

The use of any parcel of land in this zone shall be in accordance with the provisions herein and any use of buildings, structures, or land not in accordance with these provisions shall be prohibited:

(a) Single family dwellings, and a maximum of one garden suite per parcel

(b) Multiple family dwellings;

(c) Hotel

(d) Home based businesses

(e) Accessory buildings except for cargo containers

(Ð Public service or utility buildings and structures including towers, transmitters and utility lines; and

(g) Parks and playgrounds.

37.2 MINIMUM PARCEL SIZE

(a) The minimum parcel size for a single family residential parcel shall be 8,000 square metres.

(b) The minimum parcel size for a multi-family residential parcel shall be 3 hectares.

(c) The minimum parcel size for a hotel parcel shall be 3 hectares.

37.3 SETBACKS (a) Front

The front setback shall be 6 metres.

(b) Side

37.4 MAXIMUM DENSITY

(a) There shall be no more than one single family dwelling, and one garden suite per single family parcel;

(b) There shall be no more than 40 dwelling units per hectare for multiple family parcels.

37.5 MAXIMUM DWELLING UNITS

(a) The maximum total number of single family residential parcels is 90.

(b) The maximum total number of multi-family dwelling units is 200

(c) The maximum total number of hotel rental units is 125.

37.6 CONDITIONS OF USE

(a) All development shall be serviced with the City of Merritt community water system

(b) All development shall be serviced with the City of Merritt community sewage disposal system.

(c) For uses permitted under Section 7.1 (d), no exterior storage of any kind, and no garages for the repair and maintenance of equipment shall be permitted

(d) The maximum floor area of a garden suite shall be 65 square meters.

(e) No more than one accessory building shall be permitted on a parcel.

(f) The maximum floor area of an accessory building shall be 65 square meters.

(g) Other than a hotel the maximum height of a principal building is 12.0 metres and 6.0 metres for an accessory building

(h) A maximum of two horses are permitted per parcel.

(i) Home based business:

(a) The following conditions apply to home-based businesses in single family dwellings:

.1 A home-based business shall involve no structural alterations to the dwelling and shall give no exterior indication except as permitted in Sub-Section 2 that the dwelling is being used for any purpose other than a residential use.

.2 A fascia sign not exceeding zero point one nine (0.19) square metres in area.

.3 The home-based business shall be carried out wholly within a dwelling unit or within an accessory building and shall involve no external storage of materials, containers, or finished products.

.4 The home-based business shall þe operated solely by the resident of the residential dwelling unit and no more than one additional employee shall be permitted.

.5 Home-based businesses, excluding day care, are permitted to use to a maximum area of twenty (20) square metres entirely within the residential dwelling unit.

.6 A maximum of one (1) home-based business will be permitted per dwelling unit.

.7 A home-based business requiring delivery of material to or from the residence by commercial vehicles or trailers shall not be permitted.

.8 The home-based business use shall not generate the need for more than one additional on-site parking space.

.9 A home-based business shall not produce offensive noise, vibration, smoke, dust, odor, heat, glare radiation, or electrical interference.

.10 A home-þased business is not permitted in garden suites if the single family dwelling has a home-based business.

.11 A bed and breakfast shall not alter the residential character or show an external indication the dwelling is being used for any purpose other than a residential use

(b) The following conditions apply to home-based business in multiple family dwellings:

.1 Home-based business use is limited to an office or home working space, and no other use.

.2 The public is not permitted to do business in the home where the home-based business use is occurring.

.3 Delivery of goods to the residence for the operation of the home- based business use is not permitted.

.4 The home-based business use in the residence will not occupy more than ten (10) square metres of floor space.

.5 Vehicles for the operation of the home-based business use are limited in size to a maximum of a one ton pick-up or a one ton cube van.

.6 Non-resident employees are not permitted in home-based businesses.

37.7 OFF-STREETPARKING

Lac Le Jeune (which includes Little Lac Le Jeune) is located approximately 25 kilometres southwest of Kamloops. The property under application is located on Cowan Pond, just north of Lac Le Jeune on Lac Le Jeune Road. The property gently slopes from the middle of the property north to pond's natural boundary. Tree cover consists of a sparse mix of deciduous and spruce trees. Most of the Lodgepole pine was killed by the pine beetle and removed. The existing fishing and hunting resort, clustered at the north end of the propefty, is comprised of 15 duplex units, a lodge and an accessory building

Woody Life Village, originally developed in the late 1980s as a fishing and skiing resort permitted under the AF-1 zone, operated until 2001. Since that time, the resort buildings have not been used with the exception of a few years where the buildings were used as a seasonal youth camp. Building code and servicing non-compliance issues impacted the use of the buildings.

Zoning Amendment Bylaw No. 2369 Page 75 of 173 Zoning Amendment Application No. BA 28 October 3,2011 Page 3 of 6 Subject: Zoning Amendment Bylaw No. 2369 BA28 ln 2009, the applicants submitted an Approval for Marketing of Shared lnterest Development application for Board approval. This application sought shared ownership within the resort with additional development planned in a second phase. ln September 2010, the applicant abandoned this application for an application for Conversion of Previously Occupied Buildings into Strata Lots. Unlike the 2009 Shared lnterest application process, the strata conversion requires a zoning bylaw amendment for a reduced parcel size for each unit and a maximum density of 30 rentable units. The applicant wishes to continue operating a fishing and hunting resort within the AF-1 zone.

Cowan Pond is not currently classified in the Lakeshore Development Guidelines (LDG); however, the property is within one kilometer of Lac Le Jeune and impacted by the LDG. Lac Le Jeune is currently classified as a Development Lake (Developed Subclass). The applicant's environmental consultant, Don Holmes, R.P. Bio., from Lakeshore Environmental Ltd., addressed this designation and lake impacts in his report entitled "Assesstnent of lmpact of Woody Life ResorT on Lac Le Jeune". The assessment provides a detailed biological and chemical analysis of Lac Le Jeune, the LDG lake classification and management criteria as well as the potential impacts including recommendations for the proposed development. Mr. Holmes' assessment and Riparian analysis concluded that the proposed building improvements at Woody Life Resort should be allowed with the following provisos:

Building lnspection Services reported that two permits were issued in 1989 and 1990 but neither permit had been completed. As a requirement for building code compliance and future strata conversion, the applicant hired M. Milligan & Associates Ltd. to complete the required Declaration of Buitding Condition. Merv Milligan, a Professional Engineer, identified areas of concern related to health and safety and made recommendations for BC Building Code compliance. ln his March 23,2OQg report, Mr. Milligan identified several building deficiencies. Building lnspection Services further confirmed that Building Permit Nos. 10818-10832 had been recently issued to complete the buildings.

DISCUSSION:

This development proposal is generally consistent with the Regional Growth Strategy's destination resort policy which recommends consideration based on site specific and distinct location factors, characteristics and amenities, while minimizing impacts on adjacent resource uses. The proposed development will utilize existing buildings from a previous resort operation and support the broad range of lake-based and environmental activities that prevail at Lac Le Jeune. Furthermore, the Coquihalla Highway Corridor Special Planning Study recognizes existing resort development and development must only occur in accordance with the LDG.

The proposed bylaw amendment will provide the opportunity for the applicant to develop individual rentable unit ownership within a strata fishing and hunting resort. The site-specific amendment will not:

impact existing resort building locations as the proposed strata boundaries will align with existing building footprints;

a increase the density as the amendment includes a maximum 30 rentable units;

a change the historic fishing and hunting resort use at this location; or

a impact the LDG user unit ratio or perimeter development on Lac Le Jeune.

The zoning bylaw amendment and future strata conversion will provide the resort ownership with the ability to attract new investors and visitors to the resort while concurrently providing individual commercial strata lot owners the opportunity to benefit from advanced servicing levels and unit rentals in conjunction with the resort.

Substantial improvements have been made to the existing community water and sewage disposal systems with approvals from the appropriate Provincial agencies. Community service systems, operated within a self-sufficient strata environment, will ensure adequate health compliance, alleviate any potential impacts on adjacent watercourses and comply with the servicing goals in the LDG's lnfrastructure Guidelines. Further mitigative measures related to flood construction, fencing and wildfire protection will be required in conjunction with the future strata conversion application review process.

Referrals and Liaison:

o The Advisory Planning Commission for Electoral Areas "J", "L" and "P" recommends approval of this apPlication. . The lnterior Health Authority supports the proposed zoning bylaw amendment application and future strata conversion as the rentaþle units and lodge will be serviced with the community sewage disposal and water systems. The strata conversion is favoured over the original marketing of shared interest development. o The Ministry of Transportation and lnfrastructure requests that the applicant acquire a commercial access permit and adhere to the required building setbacks, o The Ministry of Environment's Environmental Management Section has no concerns with the development as there have been numerous improvements to the sewage disposal system on the property. A Permit to discharge sewage effluent has been issued by the Ministry. . The Ministry of Forests provided advice to that will help limit the spread of noxious weeds. The Ministry asked that perimeter fencing be completed during the subdivision process along with a covenant to ensure ongoing maintenance' ¡ A Qualified Environmental Professional reviewed the property in May 2008 and determined that no fish bearing watercourses exist on the property and not subject to an assessment under the Riparian Areas Regulation.

The applicant is working cooperatively towards completing the necessary building code infractions which will be completed before the final strata conversion approval. DIVISION FOUR - AF-1 AGRICULTURAL/FORESTRY ZONE

PURPOSE

The purpose of this zone is to permit activities associated with a broad range of agricultural, forestry, recreational, and resource uses and to preserve land from premature or inappropriate development.

4.1 PERMITTED USES

The use of any parcel of land in this zone shall be in accordance with the provisions herein and any use of buildings, structures, or land not in accordance with these provisions shall be prohibited:

(a) Single family dwellings, two family dwellings, mobile homes, holiday homes or recreational cottages;

(b) Professional practice, homecraft, or occupation;

(c) Agricultural and horticultural uses including the storage, sale, and processing of agricultural products produced on the individual farm on which the storage, sale, and processing is taking place;

(d) lntensive agricultural uses, including stockyards and slaughterhouses;

(e) Fishing and hunting resorts and rustic guest ranches including riding stables;

(f) Forestry practice including silviculture, logging and the processing of timber grown on the property on which the processing is taking place supplemented by the processing of a maximum of 500 cubic metres of timber annually grown elsewhere;

(g) Processing of aggregate materials, including screening, crushing, watering, concrete and asphalt production using materials extracted from the site only;

(h) The storage of explosives;

(i) Open land recreation, including archery and firearm ranges, ski hills, golf courses, rodeo grounds, equestrian centres, and camps for service or non-profit organizations;

ü) Aircraft landing fields; (k) Pet boarding and breeding kennels;

(l) Accessory buildings;

(m) Public service or utility buildings and structures, including towers, transmitters, and utility lines;

(n) Parks, playgrounds, cemeteries, public schools, firehalls, community halls, and refuse disposal sites;

(o) Extraction, processing and packaging of water, using water extracted from the site only; and

(p) Wineries, involving the manufacture, packaging, storage and sales of grape or fruit-based wines licenced under the Liquor Control and Licensinq Act. Wineries may include a small bistro and gift shop operating in conjunction with the wineries, 4.1.1 PERMIÏTED USES - SITE SPECIFIC

ln the AF-1 zone, the following uses are permitted on a site specific basis only:

(a) Fruit stand in the case of That Part of District Lot 288 shown on Plan E15708, Kamloops Division Yale District except Plan K4P46259 (2640 ïrans Canada Highway, east of Monte Creek, BC).

(þ) Custom meat cutting and retail meat and produce sales in the case of the Southwest % of Section 4, Township 22, Range 15, W6M, Kamloops Division Yale District except Plan H13323 (6224 Heffley Louis Creek Road, east of Heffley Creek, BC).

(c) Monastery in the case of lhe E Yz of the SE % of Section 18, Township 17, Range 16, W6M, Kamloops Division Yale District (south of Smith Lake, BC).

(d) Storage and animal remains (including associated effects) crematorium in the case of the South Tz of L.S. 14, Section 10, Township I 8, Ranþe 17, WOM, Kamloops Division Yale District as shown on the Plan of the SE % of said Township dated at Ottawa the 1Oth Day of May 1921 except Plan K4P57792 and K4P57834 and lying north of the Princeton- Kamloops Highway No. 5A (Shumway Lake, BC).

(e) A Health Resort including spa and personal health services with guest accommodation in the case of Lot 1, Section I 1, Township 22, Range 15, W6M, Kamloops Division Yale District, Plan 34648 (7046 Upper Louis Creek Road, Whitecroft, BC).

(Ð A sawmill and planer operation and ancillary log and lumber storage for wood not grown on the property in the case of that portion of Lot 3, Block 1, District Lot 458 and of Section 30, Township 17, Range 13, W6M, Kamloops Division Yale District, Plan 4063 except Plans 18871 and 19616 consisting of 7 .0 ha (4924 Kamloops-Vernon Highway, Highway 97, Westwold, BC).

4.2 MINIMUM PARCEL SIZE

The minimum parcel size shall be 8 hectares except for the uses permitted under Sections a.1 @) and 4.1 (n) where no minimum parcel size shall be required. 4.2.1 MINIMUM PARCEL SIZE - SITE SPECIFIC (a) The minimum parcel size for a strata rentable unit within a fishing and hunting resort in the case of Lot 1, District Lot 6286, Kamloops Division Yale District, Plan K4P91518 (Cowan Pond) is 64.2 square metres.

4.3 SETBACKS (a) Front

The front setback shall be 6 metres.

(b) Side

The side setback shall be 1.5 metres, unless the side lot abuts a street where it shall be 4.5 metres, except where varied in accordance with the Hiohwav Act.

(c) Rear

The rear setback shall be 6 metres, except in the case of accessory buildings where it shall be 1.5 metres.

(d) Notwithstanding Section 4.3 (a), (b), and (c) buildings or structures required for intensive agricultural uses permitted under Section 4.1 (d) shall be set back a minimum of:

i) 300 metres from an established residence on a parcel not in the AF-1, RL-1, or C-6 Zone;

ii) 30 metres from a public road; and

iii) 15 metres from any lot line.

(e) Notwithstanding Section 4.3 (a), (b), and (c) livestock pens and containment basins used for intensive agricultural uses permitted under Section 4.1 (d) shall be set back a minimum of 90 metres from the natural boundary of a lake, river, stream, or other body of water.

(f) Notwithstanding Section 4.3 (a), (b), and (c) buildings, structures or equipment permitted under Section 4.1(f) shall be setback a minimum of:

¡) 300 metres from an established residence; and i¡) 60 metres from a public road.

(g) Notwithstanding Section 4.3 (a), (b), and (c) buildings, structures, or equipment permitted under Section 4.1 (g) shall be set back a minimum of 300 metres from an established residence.

4.4 DWELLINGS PER PARCEL

(a) There shall be no more than one single family dwelling, two family dwelling or mobile home on any parcel, unless such parcel is used exclusively for agricultural or horticultural practice.

(b) Notwithstanding Section 4.4 (a), where a parcel is used exclusively for agricultural or horticultural uses, and is classified as a farm by the British Columbia Assessment Authority, additional single family dwellings or mobile homes in conjunction with the agricultural or horticultural use may be permitted.

4,5 CONDITIONS OF USE

(a) Mobile homes permitted under Section 4.1 (a) shall be subject to the following conditions:

i) The mobile home shall be placed on a foundation complying with the provisions of the current edition of the British Columbia Building Code; and

i¡) The mobile home shall be protected by skirting.

(b) Professional practice, homecraft, or occupation uses permitted under Section 4.1 (b) shall be carried out primarily by residents on the property and confined to the interior of the single family dwelling, two family dwelling, mobile home, or in an accessory structure with a maximum height of 5 metres, provided that the floor area of the professional practice, homecraft, or occupation does not exceed 65 square metres, and shall not:

i) create a nuisance;

ii) involve exterior storage of any materials used directly or indirectly in the processing or resulting from the processing of any product of such craft or occupation;

iii) involve materials or products that produce flammable or explosive vapours or gases under ordinary temperatures; and

iv) involve advertising or identification signs exceeding 0.3 square metres in area.

(c) All livestock pens used in intensive agricultural uses permitted under Section 4,1 (d) shall þe designed to allow shallow ditching to collect runoff from each pen and shall slope to an impervious containment basin, and shall be designed so that runoff water from areas surrounding the pens shall be diverted away from the pens.

(d) Rustic guest ranches permitted under Section a.1(e) shall be subject to the following conditions:

i) The parcel on which the use is to be located shall be classified as a farm by the British Columbia Assessment Authority and shall be contiguous and ancillary to the principal bona-fide horse and/or cattle ranching use;

ii) That the use shall not be permitted on a parcel which is contiguous to a rural residential development of two or more parcels having a minimum parcel size of 4 hectares or less.

(e) The processing of timber permitted under Section 4.1(f) and the processing of aggregate materials permitted under Section 4.1(g) shall be permitted only where the use shall not create a nuisance,

(f) The storage of explosives permitted under Section 4.1 (h) is subject to the provisions of the federal Explosives Act and Regulations thereto.

(g) Parcels used for open recreation uses permitted under Section 4.1 (i) and parks and playgrounds permitted under Section 4.1 (n) shall be kept in their natural state except where modifications are necessary to facilitate outdoor recreation. Without limiting the generality of the foregoing, site modifications may include earthworks required for the construction and development of fain¡rays, greens, traps, or playing fields, or the removal of trees for ski runs.

(h) Boarding and breeding kennels permitted under Section 4.1 (k) shall be subject to the following:

i) the kennel shall be sited so that there shall be a minimum setback of 30 metres from all property lines;

ii) outdoor runs are effectively contained and screened from adjacent parcels by a solid fence or wall not less than 2 metres in height nor more than 2.5 metres in height; and

i¡i) kennels are maintained in a clean, dry, and well ventilated condition and shall not create a nuisance.

Inspector's Comments: A site visit was conducted on May 31,2011 revealing the construction of an accessory building without a building permit, a Stop Work Order was posted. On June 6,2011 a registered SWO letter was sent to the owner. There is no SFD on the property. Numerous phone conversations were had with the owner during month of June, 2011. lt was explained to the owner the requirement of the zoning bylaw for a SFD prior to an accessory building. Reviewed with the owner the possibility of building this structure as an SFD (HPO, Health, P.Eng req'd) and convert to accessory in future when permanent home built. BACKGROUND:

On April 8, 2008 a public meeting was held to discuss the feasibility of a joint community water system to service both the Spences Bridge community and the Cooks Ferry Indian Band. The result of a "straw poll" at the meeting indicated support for a joint system.

Through the petition process the area residents approved the borrowing of funds to cover the shortfall in upgrade costs based on the following estimated cost summary:

On February 26, 2009 the Board of Directors adopted the Spences Bridge Community Water System Service Area Loan Authorization Bylaw No. 2227, 2008. This bylaw authorized borrowing of funds to make up the shortfall in upgrade costs not funded by other sources, to a maximum of $800,000.

DISCUSSION:

Required at this time is the adoption of a temporary borrowing bylaw. Once the final amount of borrowing is determined, taxpayers will have the opportunity to payout their portion of the debt through a commutation process before the debt is placed with the Municipal Finance Authority.

CONCLUSION:

Introduction and adoption of this temporary borrowing bylaw will allow the TNRD to borrow the funds to cover the project costs, over and above other funding sources. Subsequent to bylaw approval, staff will complete the commutation process and then bring a Security Issuing Bylaw, for the exact amount, forward for adoption at a later date.

A BYLAW TO AUTHORIZE TEMPORARY BORROWING PENDING THE SALE OF DEBENTURES

WHEREAS it is provided by section 823.2 of the Local Government Act that the Board of Directors may, where it has adopted a loan authorization bylaw, without further assents or approvals, borrow temporarily from any person under the conditions therein set out;

AND WHEREAS the Board of Directors has adopted Bylaw No. 2227, 2008, cited as the "Spences Bridge Community Water System Service Area Loan Authorization Bylaw No. 2227, 2008" authorizing the improvements to the water system, in the amount Eight Hundred Thousand Dollars ($800,000.00);

AND WHEREAS the sale of debentures has been temporarily deferred;

NOW THEREFORE the Board of Directors of the Thompson-Nicola Regional District, in open meeting assembled, enacts as follows:

1 CITATION

1.1 This Bylaw may be cited as the "Spences Bridge Community Water System Service Area Temporary Borrowing Bylaw No. 2368, 2011"

2 AUTHORITY

2.1 The Board of Directors is hereby authorized and empowered to borrow an amount or amounts not exceeding the sum of Eight Hundred Thousand Dollars ($800,000.00) as the same may be required.

2.2 The form of obligation to be given as acknowledgement of the liability shall be a promissory note or notes bearing the corporate seal and signed by the Chair and the Director of Finance.

2.3 The money so borrowed shall be used solely for the purposes set out in said Bylaw No. 2227.

2.4 The proceeds from the sale of debentures or so much thereof as may be necessary shall be used to repay the money so borrowed.

WHEREAS the Thompson-Nicola Regional District has, by Bylaw No. 2087, 2006, established the Spences Bridge Community Water System Service Area;

AND WHEREAS the Board of Directors of the Thompson-Nicola Regional District authorized the borrowing offundsin the amount of $400,000.00 to provide for capital improvements to the Spences Bridge Community Water System under Bylaw No. 2088, 2006;

AND WHEREAS it is desirable to borrow the reqlJired funds necessary to provide for additienal capital improvements; to include ihe construction of a groundwater source, reservoir and distribution system improvements to the Spences Bridge Community Water System;

The applicant is seeking to legalize a non-conforming use and allow the property to continue to be used for the repair, maintenance and storage of equipment used in the forest industry.

DISGUSSION:

The subject property is zoned RL-1 (Rural)and is located a|2256 Blackwater Road, south of Blackpool, There is an existing shop/storage building of 333 sqm (358 sqft) and a smaller accessory structure on the property but no dwelling unit. Contrary to the permitted uses in the RL-1 zone, the applicant has been using the property for the storage and servicing of heavy equipment used in conjunction with their contracting business.

The Regional District first became aware of bylaw infractions on the property in the fall of 1996 when it was reported that the parcel was being used as a cement batch plant business with trucks serviced in an existing steel shop building. ln 2000, the cement manufacturing business ceased operating and the property was subsequently sold to the current owner, The new owner began using the property for the storage and repair of contracting equipment (graders, excavators, bulldozers, etc.) thereby resulting in continued efforts by the Regional District to achieve bylaw compliance.

The applicant submitted a rezoning application in February 2010, seeking bylaw compliance. Staff has worked with the applicant since that time to receive the necessary information to process the application and to find a suitable zoning designation. The applicant is requesting to rezone the subject property to l-2 (Light lndustrial)with a site-specific amendment allowing heavy equipment storage and service. The applicant has indicated that they intend to only service their own equipment. The proposed zoning would also allow one single family dwelling to be constructed in conjunction with the industrial use. While the C-2 (Service Commercial) zone was also contemplated (given it permits heavy equipment service and storage), the l-2 zone with a site specific amendment was deemed more appropriate as it includes fewer uses that may not be suitable for this rural site adjacent to the Yellowhead Highway. Referrals and Llaison o Ministry of Transportation and lnfrastructure (MOTI) has advised that they have no objection to the proposal provided that the owner submits a Commercial Access Permit Application to the Ministry for access to Blackwater Road. On August 25,2011, the applicant confirmed that an application for a Commercial Access Permit has been submitted to MOTI. The subject parcel is located within 800 metres of a Controlled

Access Highway; therefore, the zoning amendment bylaw will require approval by MOTI prior to final adoption in accordance with Section 52 of the lransportation Act. o lnterior Health has advised that they have no objections to the proposed rezoning. o Building lnspection Services has indicated that any alteration to the existing shop and storage building would require a valid building permit prior to construction. o First Nations engagement: this rezoning application was referred to the Simpcw First Nation. To date, no written response has been received. o Advisory Planning Commission for Electoral Areas "A" and "8" has recommended approval of this application. No other technical issues were raised during the application review process.

GONCLUSION:

Planning Services supports this application as ít will legitimize the existing industrial use on the propefty, resolve a longstanding bylaw infraction and allow the applicant to continue operating their contracting business in the area.

THAT the application for conversion of the previously occupied building on Lot 41, Section I 1, Township 22, Range 15, W6M, KDYD, Plan 26002, into two (2) strata lots be approved and that staff be directed to sign the appropriate documents once the applicant has met the terms and conditions outlined in Preliminary Layout Approval Application No. SC 01.

BACKGROUND:

Planning Services has received a request for the conversion of a previously occupied building on the subject property into two strata lots. The remaining land will become common property of the strata corporation.

DISCUSSION:

The subject property is located in the community of Whitecroft, west of Sun Peaks Resort, and is affected by Land Use Contract No. 80 (LUC), which permits a two-family dwelling.

The applicant submitted LUC Amendment Application No. BA 07 to amend LUC 80 to allow the two-family dwelling on the subject property to be subdivided into two building strata lots. LUC Amendment Bylaw No. 2366 permitting the subdivision of the building on Lot 41 was adopted by the Board of Directors on September 29, 2011.

Liaison and Referrals

Building lnspection Services reported that five permits were issued to the property since 1997. The first four permits were not completed. The fifth permit, Building Permit No. 12081, was issued and completed for the most recent renovations. As a requirement for building code compliance and the future strata conversion, the applicant hired Owen and Hunter Architects to complete the required Declaration of Building Condition. Trevor Owen, a registered Architect, identified areas of concern related to health and safety and made recommendations for BC Building Code compliance. ln his November 9, 2009 report, Mr. Owen identified several building deficiencies. On August 10,2010, Mr. Owen confirmed that all identified deficiencies have been corrected and the building meets the health and safety requirements of the current Building Code for the purposes of building strata conversion. The lnterior Health Authority is satisfied that the appropriate sewage disposals have been completed. The Whitecroft Village Water Users Society, Ministry of Environment- Water Stewardship Division and Ministry of Transportation and lnfrastructure have no objection to the development proposal.

Under Section 242 of the Sfrafa Property Act, a local government must consider the following issues involving the conversion of a previously occupied building into strata lots:

1. RentalAccommodation The conversion of this previously occupied building will not decrease the availability of compliant rental accommodation in the area as each strata lot will remain as a single family dwelling.

2. Relocation of Residents The occupants of the building will not have to be relocated if this strata conversion is approved.

GONGLUSION:

Planning Services believes that this is an acceptable application, as it will allow the creation of two separate building strata titles, but will not result in a change in use or density.

A. This contract shall pertain to that area outlined in red on the Plan forming Schedule "C" of this Agreement;

B The total perimeter of the subdivision shall be fenced sufficient to restrict the movement of livestock onto the Development Area; Fences shall be well maintained by the individual owners of the lots; c No livestock shall be permitted to be kept on the sites;

D Areas designated as Residential shall conform to the R-1 Standards of the Thompson- Nicola Regional District Zoning Bylaw No. 940 (including amendments). Mobile homes shall be permitted on these lots by permit for a maximum period of twelve (12) months, except in the case of Lot 50, Section 1 1, Township 22, Range 15, W6M, Kamloops Division Yale District, Plan 26002, a modular home constructed in compliance with the CSA 4277 Standard shall be permitted as a permanent residence. Areas designated as Mobile Home Park shall conform to the Provincial Mobile Home Park Regulations;

E. All Commercial or Multi-Family site layouts and buildings shall be approved by the Thompson-Nicola Regional District Building and Planning Departments;

F Buildings must carry the appropriate postal numbers as designated by the Thompson- Nicola Regional District Office; tr Front yards of all residential buildings shall be suitably seeded or landscaped to provide a neat appearance by the owner of the individual lots within twelve (12) months from the date of occupancy of the homes;

H All permits for building shall be taken out from the Regional District Office, who will give final approvals;

Serious consideration shall be given to the ecology of the land throughout the subdivision. Where practical, all trees shall remain. No disturbance shalltake place on the land on either side of any Creek within thirty (30) feet above high water mark;

K No old machinery, car or truck bodies or other such equipment or old lumber shall be stored on the site except that which is of immediate requirement of the a fore stated use;

L. Footings of all buildings shall be placed so that they are six (6) inches below the recognized frost level, or at the discretion of the Building lnspector;

M All roads within the Development shall be fully compacted and paved to Department of Highway Standards. Such said roads shall be fully sign posted. Roads entering the subdivision shall have standard cattle guards;

N All lots shall have water, hydro and telephone service. The water service shall provide for fire hydrants; fire hydrants shall be provided at the cost of the developer and under the recommendations of the appropriate Fire Protection District of the RMCP as laid down in the NFPA Standards as enacted by the Provincial Fire Marshall's Office;

o An area of seven (7) acres, more or less, together with Lot A, Plan 8256, shall be dedicated as school and park area. The above described area shall be graded to natural levels, well drained, and seeded within twelve (12) months of following forty (40o/o) percent of single-family residential occupancy;

P. No building shall be constructed close than 100 feet from the bank of any stream and not lower in elevation than five (5) feet above the high water mark of the stream in the immediate vicinity;

o There shall be no disturbance of the ground surface within a continuous width of one hundred feet (100') from the boundary of lots fronting on the Louis Creek;

R. Where ground absorption of sewage disposal systems are used, no part of portion of the disposal field shall be less than 4' above highest ground water table, as determined by the Medical Health Officer;

DISCUSSION: Site The subject property, zoned MH-1 (Mobile Home Park), is the site of the Mountain Meadows Manufactured Home Park (MHP) in Blackpool, The site was developed in 1998 to accommodate 19 manufactured homes. The park owners live in a single family dwelling on the east side of the property, The MHP is serviced by a private water and sewer system, approved and monitored by lnterior Health. The existing single family dwelling on the property is serviced by an independent well and septic system that is not connected to the MHP. Zoning The applicants wish to subdivide the property to allow their existing dwelling and accessory building to be located on a separate 0,813 hectare (2 acre) parcel. The proposed CR-1 (Country Residential) zone allows a minimum parcel size of 8,000 square metres and would apply to the northeast corner of the existing property. The MHP would continue to operate on the 2.8 hectare remainder of the property, The applicants have indicated that they intend to subdivide the property in order to be able to remain in their existing home and sell the park separately in the future when they retire. ocP The subject property is designated Rural Residential in the Clean¡rater Official Community Plan (OCP). The Rural Residential designation requires a minimum parcel size of 0,8 hectares. The property is also identified as being located within a Wildfire Hazard Area BufferZone in the OCP. Policy 12.13 of the OCP specifies that during any subdivision or land use application within a Buffer Zone, the property owner shall register a standard restrictive covenant on the titles of the properties encouraging landowners to use Fire Smart wildfire hazard mitigation practices for building construction and land management. ln accordance with this OCP policy, the applicants have agreed to voluntarily register a Wildfire Covenant against the title of the property; this covenant will carry over to both parcels at time of subdivision. The applicants are in the process of having the covenant prepared by their legal counsel. Flood Plain The subject property is located within the 200 year floodplain of the North Thompson River. Any new structures built or located on the property must meet the floodplain siting requirements of the Zoning Bylaw.

The Regional Growth Strategy (RGS) encourages rural residential development to locate in existing settlement areas that have, or can establish, community services and encourages rural residential developments to develop in clusters. This proposal represents infill development within an existing cluster of rural residential development.

Referrals and Liaison ¡ Ministry of Transportation and Infrastructure (MOTI) has advised that it has no objection to the proposed rezoning. The subject parcel is located within 800 metres of a Controlled Access Highway (Yellowhead South Highway); therefore, the zoning amendment bylaw will require approval by MOTI prior to final adoption in accordance with Section 52 of the lranspoñation Act. ¡ Building lnspection Services has indicated that their interests are unaffected by the application. ¡ Interior Health has advised that their interests are unaffected by this application provided no further development occurs on the parcel. o First Nations engagement: this rezoning application was referred to the Simpcw First Nation. To date, no written response has been received, o Advisory Planning Commission for Electoral Areas "4" arìd "B" has recommended approval of this application.

CONCLUSION:

Planning Services supports this application as it is consistent with OCP and RGS policies and will allow the property owners to create a separate parcel for their existing dwelling without impacting the manufactured home park,

WHEREAS an application for amendment to Zoning Bylaw No. 940 has been made;

AND WHEREAS the desirable changes in uses of Land and Buildings have been considered;

AND WHEREAS the zoning amendment conforms to the Cleanryater Official Community Plan;

NOW THEREFORE, the Board of Directors of the Thompson-Nicola Regional District, in open meeting assembled, enacts as follows:

On Monday, August 29,2011, I had the pleasure of unveiling Climate Insights 101: Climate Science Basics, a series of animated and interactive short courses on climate change for civil servants, at the Victoria Convention Centre.

This DVD, created by the Pacific Institute for Climate Solutions, represents a first for North America, as the Institute strives to educate both civil servants and the public on addressing climate change. Building a solid knowledge base about climate change within the civil service is essential because of its impact not only on the environment but also on the economy, the way we live and how we use our land and water.

I felt that with your obvious focus on the environment, reducing greenhouse gases and building green, you would be interested in receiving a copy of this interactive DVD, which I have enclosed here.

BACKGROUND:

At the March 26,2009 Regular Meeting, the Board of Directors adopted the TNRD Community Wildfire Protection Plan (CWPP) in principle, with all operational components of the plan to be implemented and funded by third parties. TNRD financial support is limited to applying for either

DISCUSSION:

The TNRD maintains an excellent working relationship with Wildfire Management Branch (WMB) staff. With new changes being implemented in the way WMB operates, the TNRD has been asked to implement these three projects on their behalf. Kamloops WMB has identified these areas as high and or very high hazard threat and provides a work project location for immediate dispatch of initial attach crews. Fieldwork completed over the last month by WMB indicates that the 3 areas of concern are in the high or very high hazard fuel risk rating, consistent with the UBCM funding guidelines. ln the past, WMB have contacted residents for concerns and then implemented fuel management operations adjacent crown land. This application will be at "no" cost to the taxpayer. With your resolution to move fonvard, the TNRD will obtain a prescription which will provide operational direction of fuel management operations to be conducted by WMB, in these areas,

CONCLUSION:

The projects proposed for Heffley Lake, Barnhartvale, and Red Lake are consistent with the objectives of the TNRD CWPP. Approval of the recommendations will benefit these communities by obtaining fuel management prescriptions and allowing the WMB to implement fuel management modification, all to reduce the future wildfire risk surrounding these communities.

Directors, Sternig, Taylor and Elliot are aware of this initiative and endorse it.

DISCUSSION:

The Carrington Loop Line project will improve water pressure, water quality and will reduce service interruptions in the area.

Director Murray would like to contribute $85,000.00 of the Gas Tax funding allocated to Electoral Area "M" to assist in funding the project.

This project would fall under the Water and Wastewater category which lists the following as an eligible project: "Developing or upgrading drinking water system to improve water quality and reduce water use, increase energy efficiency, and secure water supply in the face of drought."

An amendment to the Gas Tax Agreement, signed on January 25,2007, allows for the funds to be applied to buildings and infrastructure owned by non-government organizations (NGO). The TNRD is required to enter into a contract with the NGO that obligates the NGO to abide by all the terms and conditions of the Federal Gas Tax agreement.

CONCLUSION:

Staff, at this time, recommends that the Board of Directors approve the expenditure of $85,000.00 in Gas Tax funds to assist the LNWD in installation of the Carrington Loop Line, provided the required agreement is executed between the LNWD and the TNRD.

VANCOUVER - Premier Christy Clark announced the launch of Age-friendly BC, a $650,000 grant and recognition program to help local governments create environments in which seniors will be able to enjoy good health and active participation in their community.

"An age-friendly community is where older British Columbians are supported to live active, socially-engaged and independent lives," said Premier Clark. 'We are working with local governments and the Union of British Columbia Municipalities (UBCM) to provide $650,000 in grants and award local efforts to create communities where people of all ages and abilities feel valued and included throughout their life."

Age-friendly BC is built around three key components: recognition, support and information. To be recognized as an Age-friendly BC community, local governments can apply to show that they have met criteria that focus on seniors' engagement, commitment, assessment and action. Through a partnership with UBCM, a grant program of $650,000 in funding from the Province of B.C. has been created to support local governments in taking these steps.

The Age-friendly BC website contains a new guide and other information to help communities achieve each step to become more age-friendly. This resource package will also be printed and sent to local governments.

"This program will help ensure the province continues to excel in seniors care by making communities more age-friendly," said Parliamentary Secretary for Seniors to the Minister of Health Ron Cantelon. "By supporting communities, we are supporting seniors and ensuring they live active, healthy lives."

The age-friendly concept came from an international study conducted by the World Health Organization and a Canadian study that looked at rural and remote communities. An age- friendly community provides welcoming public spaces, accessible transportation, affordable housing options and employment and volunteer opportunities. Age-friendly communities also provide information and services which fit the needs of seniors. Older people are respected participants in an age-friendly community.

"Local governments are adjusting their approach to community design and program delivery to keep pace with aging populations," said UBCM Pres.ident Barbara Steele. "The additional funding provided by the government of B.C. will support local government efforts to create age friendly communities."

Work to connect rural B.C. underway

VICTORIA - Premier Christy Clark today announced that work has begun to expand connectivity in . rural British Columbia under a 10-year strategic telecommunications services contract signed by the Province and TELUS.

"As part of my commitment to making British Columbia stronger and more competitive, we have secured this partnership to help expand high-speed Internet access to every community in the province, extend critical wireless coverage to highway corridors, and upgrade cutting edge communications technology in hundreds of schools and healthcare facilities," said Premier Clark. "I'm pleased to say work is already underway to make these connections that will bring people better access to education, health information, business and economic opportunities."

The contract with TELUS,the province's largest private employer, will save the province an estimated $400 million over its to-year term. Under the terms of the contract, TELUSwill provide telecommunication services to government and its public sector partners. This leverages rural benefits including the expansion of high-speed Internet in rural and remote communities and the expansion of wireless coverage along highway segments.

"We're going to see a major expansion of Internet connections in rural and remote parts of the province over the next 10 years," said Labour, Citizens' Services and Open Government Minister Margaret MacDiarmid. "Expanding access to high-speed Internet will be an economic driver to rural communities in B.C."

Since finalizing the contract on July 29, 2011, approximately 245 kilometres of previously unconnected highway segments now have new wireless coverage. Within five years, over 1,700 kilometres of new cellular coverage will be extended along highways across the province. As well, groundwork is in place to connect up to 450 schools with high-speed fibre optic cables over the next 10 years.

Work currently underway includes: • Maintaining affordable wholesale Internet access for regional and local internet service proViders in rural communities, so they can continue to provide local service to rural and remote British Columbians . • Increasing Internet speeds up to ten-fold in many areas connected under a previous agreement between the Province and TELUS. Increased Internet speeds help regional and local Internet sen/ice providers to offer quality Internet to businesses, schools, and citizens.

TELUShas already installed sites covering 245 km of highway, and expects to turn on at least 10 additional wireless sites by the end of the year. TELUSis working to secure appropriate sites and permits for dozens of additional sites on highway corridors across B.C.that will be complete within the next five years. o New wireless services now cover Pine Pass near Tumbler Ridge, Lytton, previously un- connected stretches of Highway 5 Coquihalla (Hope to Kamloops), Highway 97C (Merritt to Kelowna) and Highway 16 (from Terrace to Prince Rupert and Prince George to Terrace). o More than half of all 911 calls today are made on wireless phones, making rural highway connection an important public safety enhancement. • A Strategic Investment Fund is being established, setting out a minimum of $80 million for projects identified as strategic to transforming and improving service delivery for government, families and businesses around B.C.

"This partnership builds on the $24.5 billion TELUShas invested across British Columbia since 2000, and will result in a further $350 million to extend advanced communications technology into rural B.C. over the next decade," said Darren Entwistle, TELUSPresident and CEO. "This undertaking is nothing short of transformational and will help to build healthier communities that can compete in the global economy, whilst supporting hundreds of local jobs. Importantly, it will ensure that our youth are able to pursue their ambitions by having equal access to education and that patients across B.C. benefit from new and emerging health care technologies."

Currently, 93 per cent of British Columbians have access to broadband Internet and the goal is to expand high-speed connectivity to 100 per cent of British Columbians across the province in the next 10 years.

VANCOUVER - The Province will provide $30 million in funding to communities to give B.C. families greater access to recreation facilities so they can enjoy the benefits of increased physical activity and community involvement, announced Premier Christy Clark at the Union of B.C. Municipalities convention.

'We know that communities in B.C. face challenges when it comes to providing recreational infrastructure, particularly those in rural B.C.," said Premier Clark. ''This program will help communities address these challenges by boosting the resources available at the local level. As we work to strengthen our families, it is important to understand the value of recreation - quite simply, getting together and having some recreational fun can reap huge rewards."

Eligible recreation projects will include sports facilities, community recreation spaces, fitness facilities, trails, bike paths, walkways, playgrounds and other indoor or outdoor recreational centres. Priority will be given to small communities, many of which lack the capacity to fund infrastructure.

"Not only will this program help families in smaller communities to have greater access to recreation, it will provide jobs and economic stimulus during the construction and operation of the facilities," said Ida Chong, Minister of Community, Sport and Cultural Development. "I look forward to seeing how communities can make the most out of this great opportunity to build upon their recreational infrastructure."

"I am thrilled with today's announcement", said Suzanne Allard Strutt, CEO of the BC Recreation and Parks Association. "This funding will go a long way to help address the pressing need across the province to replenish and renew our stock of recreation facilities. These facilities are the life blood of our communities. They are known to be one of the most cost- effective prescriptions for good health and engaged citizens. It's great to see such a significant investment in B.C. families. "

Applications submitted between Oct. 14 and Dec. 28, 2011 will be considered for project approval, with the limit of one application per community. Regional districts will have the opportunity to submit more than one application.
