INDICTMENTANDCHARGES MilomirStakićwasoriginallyindictedwithSimoDrljačaandMilanKovačevićinanindictmentconfirmed on13March1997andkeptundersealuntilhisarreston23March2001.ThisindictmentchargedMilomir Stakićwithonecountofcomplicityingenocide. On10July1997,MilanKovačevićwasarrestedinPrijedor andtransferredtoTheHague.Thatsameday,SimoDrljačawaskilledwhileresistingarrestandhisname wasconsequentlydeletedfromtheindictmenton12May1998.TrialproceedingsagainstMilanKovačević beganon6July1998.On1August1998,MilanKovačevićpassedawayintheDetentionUnit.On24August 1998,theTrialChamberissuedanorderterminatingtheproceedingsagainsthim. On6August2001,theProsecutionfiledanamended indictmentchargingMilomirStakićwithindividual andsuperiorresponsibilityforatotaloftwelvecounts–twocountsofgenocide,fivecountsofcrimes againsthumanityandfivecountsofviolationsofthelawsorcustomsofwar. On5October2001,theProsecutionfiledthesecondamendedindictmentwhichincludedtwoadditional countsofinhumaneacts.AftertheDefence’sobjectiontotheformoftheindictment,theTrialChamber orderedtheProsecutortoreorganisetheindictment.Thesecondamendedindictment(reorganised)was filedon27November2001. On4March2002,theProsecutionfiledthethirdamendedindictmentwiththeaimofstreamliningthe case.Inthisindictment,thenumberofcountswas reducedtoeightandtherelevanttimeperiodwas reducedtocoverbetween30April1992and30September1992. On11April2002,theProsecutionfiledthefourthamendedindictmentfollowinganoralrulingbythepre trial Judgeof10 April 2002.Thefourthamended indictment contained the same charges as the third amendedindictmentwithonlyafewminorchanges. MilomirStakićwaschargedonthebasisofindividualcriminalresponsibility(Article7(1)oftheStatute) andsuperiorcriminalresponsibility(Article7(3)oftheStatute)with: • Genocide;complicityingenocide(genocide,Article4), • Murder;extermination;persecutions;deportation;inhumaneacts(crimesagainsthumanity,Article5), • Murder(violationsofthelawsorcustomsofwar,Article3). THETRIAL The trial against Milomir Stakić commenced on 16 April 2002 before Judge Wolfgang Schomburg (presiding),JudgeVolodymyrVassylenkoandJudgeCarmenMaríaArgibay.TheProsecutioncompletedits caseinchief on 27 September 2002. Forty Prosecution witnesses testified in court. In addition, the Prosecutionsubmitted19witnessstatementspursuanttoRule92 bis .Twoforensicexpertwitnesseswere called by the Trial Chamber. The Chamber admitted 796 exhibits tendered into evidence by the Prosecution. TheDefencecasecommencedon18November2002andlasteduntil1April2003.FortyDefencewitnesses testifiedincourt.Inaddition,theDefencesubmittedsevenwitnessstatementspursuanttoRule92 bis and twoexpertreportspursuanttoRule94 bis .TheChamberadmitted594exhibitstenderedintoevidenceby theDefence. SixwitnesseswerecalledbytheTrialChamber. TheclosingargumentsbytheProsecutionandtheDefencetookplaceon11April2003and14April2003. Following the close of the arguments, the accused was given permission by the Chamber to make a statementon15April2003. Therewere150courtdays. TRIALCHAMBERJUDGEMENT MilomirStakićwasconvictedforhisparticipation intheextermination,murderandpersecutionofthe

nonSerbpopulationin Prijedor.The municipality ofPrijedorislocated inthenorthwesternregionof BosniaandHerzegovinaknownastheBosanskaKrajina.ThetownofPrijedoristhelargestsettlementin the municipality. According to the 1991 census, out of a total population of 112,543, 43,9% regarded themselves as Muslims, 42.3% as Serbs, 5.7% as Yugoslavs, 5.6% as Croats and 2.5% as “others”. The census,forthefirsttime,identifiedtheBosnianMuslimsasthelargestethnicgroupinthemunicipalityof Prijedor.TheshiftingdemographicbalanceinfavouroftheMuslimpopulationwasconsideredachallenge bytheSerbsandbecameoneofthecentralissuesinthemunicipality’spoliticallifeduring1991and1992. DuringthewarinCroatia,thetensionincreasedbetweentheSerbsandthecommunitiesofMuslimsand Croats.TherewasahugeinfluxofSerbrefugeesfromSloveniaandCroatiaintothemunicipality.Atthe sametime,MuslimsandCroatsbegantoleavethemunicipalitybecauseofagrowingsenseofinsecurity andfearamongstthepopulation. ProSerbpropagandabecameincreasinglyvisible.TheSerbmediapropagandisedtheideathattheSerbs hadtoarmthemselvesinordertoavoidasituationsimilartothatwhichhappenedduringWorldWarII whentheSerbsweremassacred.AsaresultofthetakeoverofthetransmitterstationonMountin August1991bytheSerbianparamilitaryunitthe“Wolves of Vučjak”,TV was cutoff. It was replacedbybroadcastsfromBelgradeandBanjaLukawithinterviewsfromSerbianDemocraticParty(SDS) politicianswhoarguedthat,whileSerbssoughttopreserveYugoslavia,theMuslimsandCroatswantedto destroythecountry. At the meeting of the Prijedor Municipal Board of the SDS on 27 December 1991 it was decided to overthrowtheexistingauthoritiesinthetown,replacelegitimatecentralauthoritieswithSDSorSDSloyal personnel,andformindependentSerbbodies.Atthesessionon7January1992,theSerbianmembersof thePrijedorMunicipalAssemblyandthepresidentsofthelocalMunicipalBoardsoftheSDSproclaimed theAssemblyoftheSerbianPeopleoftheMunicipalityofPrijedor.MilomirStakićwaselectedPresidentof thisAssembly. BytheendofApril1992,anumberofclandestineSerbpolicestationswerecreatedinthemunicipality andmorethan1,500armedmenwerereadytotakepartinthetakeover. Inthenightofthe29to30April1992,thetakeoverofpowertookplace“withoutasinglebulletfired”. EmployeesofthepublicsecuritystationandreservepolicegatheredinČirkinPolje,partofthetownof Prijedor. They were broadly divided into five groups. One group was responsible for the Municipal Assemblybuilding,onefortheSUPbuilding,oneforthecourts,oneforthebankandthelastforthepost office. TheTrialChamberfoundthatthetakeoverofPrijedorwasanillegalcoupd’étatwhichhadbeenplanned and coordinated for months and which had as its final goal the creation of a Serbian municipality eventuallytoformpartofanenvisagedpureSerbianstate.Afterthetakeover,MilomirStakićbecame, amongst other things, President of the Municipal Assembly and President of the Prijedor Municipal Peoples’ (National) Defence Council. From May 1992, he served as President of the Prijedor Municipal CrisisStaff.TheTrialChamberestablishedthatMilomirStakićwastheleadingpoliticalfigureinPrijedor municipalityin1992. Acomprehensivepatternofatrocitiesamountingtoacampaignofapersecutorialnaturewasprovedto have been committed against nonSerbs in Prijedor municipality in 1992. This included killings on a massive scale in the Omarska, Keraterm and Trnopolje camps, in Bosnian Muslim towns and villages throughout the municipality, and, finally, on Mount Vlašić. The Trial Chamber held Milomir Stakić responsibleformorethan1,500killingsandwasabletoidentify,byname,486victims.Rapes,sexual assaultsandbeatingswerecommittedatthecampsandatleast20,000nonSerbseitherfledPrijedoror weredeported. Despitethescaleoftheatrocities,theTrialChamberwasunabletoinferthenecessary dolus specialis for genocide,this dolus specialis orspecificintenttodestroy,inwholeorinpart,agroupassuchbeing the coreelement of the crime. Thus, based on the evidence in this case, the Trial Chamber did not concludethatMilomirStakićhadthenecessaryspecificintenttocommitgenocide. TheTrialChamberfoundthatthecrimesofpersecutionsandexterminationcommittedagainstnonSerbs throughoutthemunicipalityconstitutedthecoreelementofthecriminalconductofMilomirStakićandon 31July2003,theTrialChamberrendereditsjudgement.

Milomir Stakić was found guilty, on the basis of individual criminal responsibility (Article 7(1) of the Statute)andasacoperpetratoractingtogetherwithhisassociatesintheCrisisStaff,policeandarmyin acoordinatedcooperationtoconsolidateSerbiancontrolanddominanceinPrijedormunicipalityofthe followingcrimes: • Murder(violationofthelawsorcustomsofwar,Article3), • Extermination, persecutions (committed by inter alia murder and deportations torture, physical violence,rape,sexualassault,constanthumiliationanddegradation,destructionofreligiousbuildings deportationonamassivescale)(crimesagainsthumanity,Article5). Sentence:lifeimprisonment. APPEALSCHAMBERJUDGEMENT Both the Prosecution and the Defence appealed the Trial Chamber’s judgement. Milomir Stakić also appealed his sentence. In addition, the Appeals Chamber, in accordance with the Tribunal’s Rules of ProcedureandEvidence,consideredcertainissuesofitsowninitiative.MostoftheAppealsChamber’s findingsrelatedtospecificlegalissues. Initsjudgement,theAppealsChamberaffirmedtheTrialChamber’sdecisiontoconvictMilomirStakićfor his responsibility in exterminating, murdering and persecuting the nonSerb population in Prijedor. The AppealsChamberalsofoundthattheTrialChamberincorrectlyfailedtoconvicthimfordeportingand forcibly transferring the nonSerb population. The Appeals Chamber agreed with the Trial Chamber’s decisiontoacquitMilomirStakićofgenocideandcomplicityingenocide. OneoftheissuestheAppealsChamberaddressedofitsowninitiativewashowtolegallydefineMilomir Stakić’s responsibility for the crimes he committed. The Appeals Chamber found that Milomir Stakić participated in a joint criminal enterprise whose purpose was to commit crimes against the Bosnian MuslimandBosnianCroatpopulationsofPrijedor.Thesecrimeswerepartofacampaigntopersecutethe nonSerbpopulationofPrijedor,withthefinalgoalofcreatingaSerbianmunicipalityeventuallytoform partofanenvisagedpureSerbianstate. The Appeals Chamber found that the Trial Chamber committed some errors in determining Milomir Stakić’ssentence.However,italsofoundthattheimpactoftheseerrorsonthesentenceisverylimited. On22March2006,theAppealsChamberconfirmedtheconvictionsagainstMilomirStakićandrenderedits judgment,sentencinghimto40years’imprisonment.

On12January2007,MilomirStakićwastransferredtoFrancetoservetheremainderofsentence.Credit wasgivenforthetimeservedsincehisarreston23March2001.
