Introduction

1. The Government published Planning Policy Statement 3: Housing in November 2006. This PPS requires local planning authorities to identify and maintain a 5-year supply of deliverable land for housing. The Government has recently published further guidance Land Supply Assessment Checks (Department for Communities and Local Government, May 2009). Whether or not an authority can demonstrate an up to date 5-year supply of housing land has implications for determining planning applications.

2. To be considered deliverable, sites should be available now, be suitable for development, and be achievable within the next 5 years. In this case, the period is 1st April 2010 to 31st March 2015. Potential sites include those allocated for housing in the Development Plan, those with outline or full planning permission, and specific unallocated brownfield sites with potential to make a significant contribution to housing delivery during the 5-year period. No allowance has been made for small windfall sites.

3. This statement demonstrates that Waveney District Council has identified a 5-year supply of deliverable housing sites.

Identifying the 5-year housing requirement

4. The East of Plan (RSS14) was adopted in May 2008. The RSS requires that a minimum of 5,800 new homes be built in Waveney between 2001 and 2021. At the end of March 2009, 2,932 dwellings had been completed. This leaves 2,868 dwellings to be delivered from 2009 to 2021, at an average of 239 per annum, in order to meet the RSS target. A 5-year supply of land would therefore need to be sufficient to deliver at least 1,195 dwellings.

Identifying deliverable sites

5. The adopted Development Plan for the District consists of the Plan (2008), the Waveney Core Strategy (Adopted January 2009) and the ‘saved’ policies from the Adopted Waveney Local Plan (1996). In addition, the Waveney Interim Plan was adopted by the Council for development control purposes in 2004. The Interim Local Plan represents the Council's emerging planning policies in this transitional period, as the Council makes progress towards preparing all the Development Plan Documents under the new Local Development Framework system.

6. This assessment considers housing sites allocated in the Waveney Interim Plan (2004). Some of these were carried forward from the Adopted Waveney Local Plan (1996). It also includes sites under construction or with outline or full planning permission at 31st March 2009. The Lake Lothing and Outer Harbour Area Action Plan Preferred Options (2007) expects 1,500 dwellings to be developed in the Lake Lothing area of . Development within the Lake Lothing area is expected to start from April 2013.

7. Where planning permission has been granted on an allocated site (subject to Section 106 or otherwise), then calculations have been based on the number of dwellings given permission. Where planning permission has not yet been granted, an estimate of the number of dwellings deliverable on the site has been used.

Assessing deliverable sites

8. The assessment of whether identified sites are available, suitable and achievable has been based on the following assumptions.

For sites to be considered available they will: • Be under construction, • Have outline or full planning permission, • Be allocated in the Waveney Adopted Local Plan or Waveney Interim Local Plan • Be allocated or identified for development in an adopted or submitted Local Development Framework Development Plan Document.

10. Additionally, available sites will have no known constraints that would prevent them being available for development in the next 5 years. For example, a site allocated for housing might not be deliverable until the longer term due to being in current use for employment, or to allow phasing or sequential construction of larger developments.

11. To be considered suitable, PPS3 indicates that sites should offer a suitable location for development that would contribute to the creation of sustainable, mixed communities.

12. For sites with planning permission, an assessment of suitability will have informed the decision to grant planning permission. Therefore all sites under construction or with extant planning permission are assumed to be suitable.

13. Sites allocated in the Adopted Local Plan (1996) that have not been granted planning permission, or have not been carried forward as allocations in the Interim Local Plan (2004) will no longer be considered suitable for development. Such sites have not been included in this assessment.

14. Sites allocated in the Interim Local Plan (2004) will be considered suitable for development provided that they comply with current national policies on sustainable locations for development. This includes policies set out in PPS7 – Sustainable Development in Rural Areas and PPS25 – Development & Flood Risk.

15. An allocated site will no longer be considered suitable for development if it is in a small rural village without a good range of services (i.e. is not a ‘Larger Village’ as listed in Policy CS01 Spatial Strategy, Core Strategy 2009), or if it is in Flood Zones 2 or 3. In regard to flood risk, the only exception will be within the boundary of the 1st East Urban Regeneration Company area of Lowestoft where the Exception Test can be met and the Environment Agency has indicated that the flood risk can be mitigated, e.g. through land raising in regeneration areas at risk of tidal flooding.

16. For sites to be considered achievable there should be a reasonable prospect that housing will be delivered on the site within a 5-year period.

17. Sites with planning permission will be assumed to be achievable unless they are subject to any known ownership, physical or environmental constraints that would prevent development within 5 years.

18. Allocated sites (or other sites identified in submitted/adopted DPDs) without permission will be considered achievable if they are subject to known developer interest and there are no known ownership, physical or environmental constraints that would prevent development within 5 years.

19. Slippage has been built into the 5-year supply due to the current economic climate. Any slippage has been identified in the Comment

1 The Government requires that for the purposes of monitoring Core Indicator H2(c) – net additional dwellings in future years, the 15-year land supply is calculated to exclude the current financial year. This also has an impact on calculating the five year land supply. Waveney District Council along with the East of England Regional Assembly has written to the Government expressing concern regarding the omission of the current financial year in these calculations.

Results summary

20. This assessment has identified sites within Waveney that are considered capable of delivering 1,750 dwellings within the next 5 years (2010/11- 2014/15).

21. Given the number of dwellings that have already been completed up to the end of March 2009, this is the equivalent of 7.3 years supply based on the annual average East of England Plan target.

22. Appendix C reports the historic delivery of dwellings. As at 31st March 2009 there have been 2,932 additional dwellings provided which equates to an over-supply of 612 dwellings or 2.11 years.

Consultation and Monitoring

23. This assessment has been the subject of targeted consultation with County Council Highways, the Environment Agency, 1st East Urban Regeneration Company and the Waveney Developers Forum (members include local developers, architects, housing associations, WDC Officers and Councillors). A draft report was prepared for a 4- week consultation from Monday 1st June to Monday 29th June 2009. The consultation was also published on the Council’s website.

24. Responses were received from Persimmon Homes (Anglia), Badger Building (E. Anglia) Ltd, Environment Agency, MS Oakes Ltd and 1st East.

25. The key points raised through the consultation were: • Confirmation of timescales for the development sites at Ullswater, Carlton Colville and Woods Meadow, Oulton (Persimmon Homes) • Concern that development forecasts within the Lake Lothing area are optimistic (Persimmon Homes, Badger Building, MS Oakes) • Confirmation that if the forecast of 423 dwelling completions within the Lake Lothing area are not achieved within the 5-year period, a 5.5-year supply of housing land still exists (Persimmon Homes) • Further sites not included as preferred options need to be brought forward swiftly (MS Oakes) • Clarification that allocations R2.1, R2.2 and TM3 are in addition to the 1,500 dwellings proposed within the Lake Lothing Area Action Plan area (Environment Agency, 1st East) • Concern that the Council regards the RSS minimum figure of 5,800 new homes to be provided in the period 2001 to 2021 as a maximum figure (Badger Building)

• Past building rates (366 p.a.) should be used rather than the residual figure (239 p.a.) to calculate future supply i.e. 4392 dwellings for 2009-2021 rather than 2868 (Badger Building) • Limited locational choice for purchasers (Badger Building) • Delivery on two larger sites in the short term in the hands of a maximum of two national housebuilders (Badger Building) • Clarity required that development within Flood Zones 2 or 3 will only be acceptable within the Lake Lothing area and only if the development passes the Exception Test and is appropriately mitigated (Environment Agency)

26. The Council welcomes the confirmation of development forecasts and the agreement that in excess of a 5-year supply can be demonstrated. The Council will monitor the progress and deliverability of all sites (allocations and sites with planning permission) and in particular those within the Lake Lothing area. The Area Action Plan for Lake Lothing and the Outer Harbour area of Lowestoft will be progressed by consultants (EDAW soon to be AECOM) over the coming months. Waveney Interim Local Plan (2004) Allocations R2.1, R2.2 and TM3 are not within the key intervention areas of Lake Lothing and are in addition to the 1,500 dwellings proposed within the Lake Lothing Area Action Plan area.

27. The Council is following national guidance in preparing the housing trajectory (and 5-year supply) based on the regional minimum figure of 5,800 new homes to be delivered in the District between 2001 and 2021. The Council is currently preparing the Site Specific Allocations Development Plan Document which will allocate further land for housing in the District to 2021. No allowance has been made for small windfall sites in the 5-year supply, however based on past trends it is anticipated that further windfall sites will become available for development each year.

28. Policies CS01 Spatial Strategy and CS11 Housing of the Core Strategy, January 2009 reflect the existing and future role and function of settlements in Waveney and provides 5,800 new homes over the period 2001 to 2021 and a further 1160 new homes for the period 2021 to 2025.

29. The Council has no influence on which housebuilders (whether national or local) are working within the District.

30. The Council has amended the text at paragraph 15 (page 3) Exception Test in relation to the Lake Lothing area to provide clarity and to align with Policy CS03 Flooding and Coastal Erosion of the Core Strategy, 2009.

The AMR is prepared and submitted to the Secretary of State in December each year. The next AMR to be prepared in December 2009 will cover the monitoring period 1st April 2008 to 31st March 2009.

APPENDIX C: Historic Delivery of Dwellings

The East of England Plan (RSS14) requires that a minimum of 5,800 new homes be built in Waveney between 1st April 2001 and 31st March 2021. This is equivalent to 290 new dwellings per year.
