CHAPTER ONE INTRODUCTION

1.0 LOCAL AGENCY FORMATION COMMISSIONS

A. Authority and Objectives

Local Agency Formation Commissions (LAFCOs) were established in 1963 and are political subdivisions of the State of California responsible for providing regional growth management services in all 58 counties. LAFCOs’ authority is currently codified under the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (“CKH”) with principal oversight provided by the Assembly Committee on Local Government.1 LAFCOs’ are comprised of locally elected and appointed officials with regulatory and planning powers delegated by the Legislature to coordinate and oversee the establishment, expansion, and organization of cities, towns, and special districts as well as their municipal service November 2015 areas. LAFCOs’ creation were engendered by Governor Edmund “Pat” Brown Sr. (1959-1967) to more effectively address the needs of California’s growing and diversifying population with an emphasis on promoting governmental efficiencies. Towards this end, LAFCOs are commonly referred to as the Legislature’s “watchdog” for local governance issues.2

Guiding LAFCOs’ regulatory and planning powers is to fulfill specific purposes and objectives that collectively construct the Legislature’s regional growth management priorities under Government Code (G.C.) Section 56301. This statutes reads:

“Among the purposes of the commission are discouraging urban sprawl, preserving open space and prime agricultural lands, efficiently providing governmental services, and encouraging the orderly formation and development of local agencies based upon local conditions and circumstances. One of the objects of the commission is to make studies and to obtain and furnish information which will contribute to the logical and reasonable development of local agencies in each county and to shape the development of local agencies so as to advantageously provide for the present and future needs of each county and its communities.”

LAFCO decisions are legislative in nature and therefore are not subject to an outside appeal process. LAFCOs also have broad powers with respect to conditioning regulatory and planning approvals so long as not establishing any terms that directly control land uses, densities, or subdivision requirements.

B. Regulatory Responsibilities

C. Planning Responsibilities

Municipal service reviews, in contrast, are a relatively new planning responsibility enacted as part of CKH and are intended to inform – among other activities – sphere determinations. The Legislature mandates all sphere changes as of 2001 be accompanied by preceding municipal service reviews to help ensure LAFCOs are effectively aligning governmental services with current and anticipated community needs. An expanded summary of these two planning responsibilities follows.

As of January 1, 2008, LAFCO must review and update as needed each local agency’s sphere every five years. In making a sphere determination, LAFCO is required to prepare written statements addressing five specific planning factors listed under G.C. Section 56425. These mandatory factors range from evaluating current and future land uses to the existence of pertinent communities of interest. The intent in preparing the written statements is to orient LAFCO in addressing the core principles underlying the sensible development of each local agency consistent with the anticipated needs of the affected community.

All municipal service reviews – regardless of their intended purpose – culminate with LAFCOs preparing written statements addressing seven specific service factors listed under G.C. Section 56430. This includes, most notably, infrastructure needs or deficiencies, growth and population trends, and financial standing.

D. LAFCO Composition / Direction on Decision-Making

All LAFCOs, nevertheless, must appoint their own Executive Officers to manage agency activities and provide written

recommendations on all regulatory and planning actions before the membership. All LAFCOs must also appoint their own legal counsel.

E. Prescriptive Funding

As part of the original negotiations between the State and local agencies in establishing LAFCOs in 1963 and later updated in 2001, CKH prescribes local agencies fund LAFCOs’ annual operating costs. Counties are generally responsible for funding one- third of LAFCO’s annual operating costs with the remainder one-third portions allocated to the cities and independent special districts. The allocations to cities and special districts are calculated based on standard formula using general tax revenues unless an alternative formula has been approved by a majority of the local agencies. LAFCOs are also authorized to collect applicant fees to offset local agency contributions.

1.1 MARIN LAFCO

A. Adopted Policies and Procedures / Sphere Updates and Municipal Service Reviews

The majority of Marin LAFCO’s (“Commission”) existing policies and procedures were comprehensively updated in June 2016. These policies and procedures collectively guide the Commission in implementing LAFCO law in Marin County in a manner consistent with regional growth management priorities as determined by the membership. This includes overarching policies and procedures to direct existing and new urban uses towards city centers along the State Highway 101 corridor and maintaining restrictive allowances for the potential development and use therein of agricultural and open-space lands. The Commission has also established pertinent policies and procedures specific to preparing sphere updates and municipal service reviews with several key statements summarized below.

• The Commission shall adopt a study schedule every five years to calendar sphere of influence updates and the associated municipal services reviews at noticed public hearings. The adopted study schedule shall guide and prioritize the studies to be undertaken by the Commission over the five-year period paired with the ability to approve amendments as needs and or resources merit.

• The Commission shall generally defer requests made by applicants for individual sphere of influence amendments for consideration as part of the next comprehensive update as determined in the adopted study schedule.

• The Commission shall orient the establishment and update of spheres of influence to focus on community needs over the next 10 years.

• The Commission shall consider the plans and objectives contained within the adopted general plans of the local land use authorities in establishing and updating spheres of influence.

• The Commission shall utilize municipal service reviews as the source document in informing all sphere of influence determinations. The Commission shall only utilize municipal service reviews that are less than five years old in making sphere determinations unless specific circumstances warrant otherwise.

• The Commission shall generally assign three types of sphere of influence designations for local agencies unless special circumstances warrant otherwise. A larger sphere denotes the Commission’s expectation the agency will annex certain lands in the near-future. A smaller sphere denotes an expectation the agency will detach certain lands in the near-future. A coterminous sphere denotes an expectation of no changes to the agency in the near future.

• The Commission shall assign a zero sphere of influence encompassing no territory to signal the membership’s interest and intent to dissolve and or disincorporate the affected agency.

• The Commission shall assign a common sphere of influence to include the territory served by two or more agencies to signal the membership’s interest and intent to consolidate and or merge the affected agencies.

Further, and pertinent to this report, this referenced new oversight limits LAFCOs’ authority to approve these type of service arraignments – which previously worked to circumvent the annexation process – only to lands within the affected agencies’ spheres of influence with limited exceptions. To this end, a central assumption within the report and reflected in its analysis is the explicit intention that the sphere of influence represent the State’s formal designation – and byway of the Commission – of MMWD’s appropriate service area, and all annexations and service extensions conform accordingly. Other pertinent assumptions and premises underlying the report and its analysis are summarized below.

• Analyses of potential changes to the MMWD sphere of influence emphasize a 10- year horizon in which resulting boundary changes – annexations or detachments – and outside service extensions are expected.

• Non jurisdictional lands included in the MMWD sphere of influence does not provide any guarantees the territory will be annexed or provided outside services. Jurisdictional changes and outside service extensions must be considered on their own merits with particular attention focused on assessing whether the timing of the request is appropriate.

• Potential changes identified and evaluated in this report shall be vetted with MMWD and any resulting comments – should there be any – will be incorporated into the final analysis prior to Commission action.

2.1 AGENCY PROFILE

A. Formation and Organization

MMWD was formed in 1912 as the voter-approved successor to the Marin County Water Company; a private utility formed in 1871 and tasked with providing potable water service within the developing San Rafael and Ross Valley areas. MMWD subsequently purchased over two dozen other private water companies following its formation and the associated expansions therein have cumulatively contributed to a current jurisdictional boundary spanning 148 square miles. The jurisdictional boundary presently includes 10 of the 11 cities and towns in Marin County along with two dozen plus distinct unincorporated communities as well as the San Quentin State Prison.7

Marin Municipal Water Jurisdiction Adopted Sphere North Marin Water Jurisdiction Adopted Sphere City/Town Boundaries Unincorporated Communities

; MMWD is currently organized as a limited-purpose agency and provides three distinct services: (a) potable water; (b) non-potable water; and (c) public recreation with the latter primarily dedicated to watershed management.8 Governance is provided by a five- person board whose members are registered voters elected by division to staggered four- year terms. MMWD appoints an at-will General Manager to oversee all District activities. The current General Manager – Krishna Kumar – was appointed by the Board in 2012 and oversees a present budgeted staff of 242 fulltime equivalent employees.

B. Service Population

The Commission independently estimated MMWD’s total service population within its jurisdictional boundary at 186,048 as part of the recently completed municipal service review. The Commission also estimated MMWD’s service population – specifically those directly served by the District’s potable water system – increased by 0.4% over preceding five-year period and falls slightly below the countywide growth rate average of 0.6% over the same period. Registered voters total 110,224 and represents 59.2% of the current estimated service population.

C. Potable Water Services

MMWD’s potable water services represent the District’s principal service function and was the focus of the recently completed municipal service review. Below is a summary of key analysis and conclusions generated as part of the municipal service review as it relates to the supply and demand of MMWD’s potable water.

Supplies

MMWD’s primary potable supply sources are drawn from three local creeks – Lagunitas, Nicasio and Arroyo Sausal. These local surface supplies are accessed from a combination of pre and post 1914 appropriated rights and made available to MMWD through diversions into seven man-made reservoirs with a combined maximum holding capacity or yield of 79,566 acre-feet for any given year. MMWD also maintains a secondary potable supply source drawn from the Russian River by way of a long- standing agreement with the Sonoma County Water Agency. This agreement provides MMWD a contracted and maximum annual supply of up to 14,300 acre-feet. In all, the combined maximum annual potable yield available from primary and secondary sources is 93,866 acre-feet. It is projected, however and for planning purposes, that this maximum yield is reduced by nearly three-fourths to 26,134 acre-feet during a significant drought year based on applying conditions rainfall conditions from 1977.

Demands

The average annual potable water demand production within the MMWD system over the municipal service review’s five-year timeframe (2009 to 2013) totaled 26,521 acre- feet and translates to 387 gallons per day for every active connection.9 The total average annual amount also represents 28.3% of the MMWD maximum yield supply. The average per resident daily water usage over the five-year period was 127 gallons. Overall water demands during the five-year period decreased by (1.6%) despite a corresponding 0.1% increase in service population; all of which suggests improving water use efficiencies occurring within MMWD.

2.2 SPHERE OF INFLUENCE

MMWD’s sphere of influence presently spans 99,305 acres or 155 square miles. The sphere of influence was established by the Commission in June 1983 and purposely set to include MMWD’s entire jurisdictional boundary along with the addition of approximately 500 acres of non-jurisdictional lands concentrated in two unincorporated areas: (a) Homestead Valley and (b) Upper Lucas Valley. No changes to the sphere of influence have been made since establishment in 1983. (The Commission did not include MMWD in either of its first two five-year municipal service review / sphere of influence update cycles.) The amount of non-jurisdictional land within the MMWD sphere of influence, nonetheless, has actually increased – albeit inadvertently by all appearances. This latter comment is the result of the Commission approving a detachment of the Hamilton Field in Novato in 2002 from MMWD without a matching reduction in the District’s sphere of influence.

3.1 STUDY CATEGORIES

A. Selection

As introduced in the preceding section the analysis on potential modifications to the MMWD sphere of influence is the work of staff and divided into two categories. The first – Study Category “A” – represents those areas that existing information and analysis appears sufficient in recommending an action (i.e., addition or subtraction from the sphere). The second – Study Category “B” – represents those areas that existing information and analysis suggests there may be merit for a modification, but given the scope of the potential change additional work is needed to reach a more informed recommendation before reaching any conclusions. An accounting of the areas selected and evaluated therein under both of categories follows.

(Further information regarding the reorganization is detailed in the accompanying footnote and sourced to comments provided by NMWD during the public hearing held on the earlier draft document.2) Analysis performed as part of this update fails to identify a reason to continue to keep the affected area within the MMWD given the District’s services – including potable water and watershed management – do not appear needed now or within the immediate future. This latter comment is highlighted by noting NMWD has assumed all potable water services to A-1.

Additional and technical details – including assessor parcels and existing uses – relating to the lands comprising A-1 are provided as Appendix A.

The acreage size differs from the approximated size provided in the 2002 reorganization file of the subject lands totaling 980 acres. This difference in acreage totals appears primarily tied to GIS including all public right-of-ways in Hamilton. 2 The 2002 reorganization of the Hamilton area was jointly requested by MMWD and NMWD and aimed at resolving a standing dispute between the two agencies with respect to service rights to the subject lands. Water service to the Hamilton area was initially established by MMWD in the 1930s and upon the subject lands’ initial development as a military base through a federally funded transmission line that connected MMWD’s distribution system in San Rafael. Hamilton was substantively expanded in the late 1950s and in doing so a separate water service connection was established to the newly formed NMWD. This dual service relationship in which MMWD and NMWD were now both serving different portions of the Hamilton area eventually generated a long-standing disagreement between the two agencies as to the ultimate service going forward and in step with the subject lands being decommissioned and being transferred over to the City of Novato for development. By the late 1990s NMWD had established itself as the predominate water service provider having established service to the remaining 282-unit Coast Guard housing development as well as the then-newly redeveloped 154-unit Villa Townhome (Lanham Village) site. The agreement reached by the two agencies resulting in the referenced reorganization filed and approved by Marin LAFCO in 2002 resolved the dispute with NMWD assuming water service responsibility for all of Hamilton going forward.

First, earlier census data generated for Nicasio and produced by the Department of Water Resources in step with its own related reporting requirements showed Nicasio’s average median household income as of 2010 qualifying as a DUC. Second, and more pertinent going forward, Nicasio’s average median household income for the study period finished well under the Marin County average tally of $91,000; a difference of nearly 25%. This latter data comparison is important should the Commission were ever to choose – or be prompted by additional legislation – to establish a local policy in defining DUCs.

It is pertinent to note the preceding analysis and conclusion therein for the Commission to formally designate B-1 as a priority review ahead of the next schedule five-year sphere update is premised on fully vetting long-term service options for Nicasio. This short-term focus or remedy – importantly – does not presuppose MMWD’s interest/ability to seek approvals for outside service extensions nor does it presuppose Commission approval of any specific request received.

3.2 RECOMMENDATIONS

The preceding analysis produces a staff recommendation for the Commission to make one modification to the MMWD sphere of influence as part of this scheduled comprehensive update process. This recommended modification is to remove all of the territory that comprises Study Category A-1 (Hamilton) from the sphere of influence. Removal of A-1 is consistent with CKH’s underlying objective in requiring sphere of influence designations to reflect what the Commission independently believes marks the current and probable future jurisdictional boundary and service area of the agency. None of the affected lands within A-1 receive service from MMWD at this time, and none are expected to need or seek District services – whether it be potable water, non-potable water, or watershed management – going forward and more definitely not within the 10 year planning horizon established by the Commission. Removal of A-1 from MMWD sphere of influence also serves to memorialize and affirm the Commission’s earlier action to designate NMWD as the appropriate potable water service provider for the affected lands in placing the lands in their sphere of influence.

Similarly the preceding analysis also produces a staff recommendation the Commission formally encourage more discussion going forward regarding the potential merits of adding some or all of Study Area B-1 (Nicasio) to the MMWD sphere of influence. This discussion would be anticipation of revisiting the topic in greater detail – and potentially for action – in the next five-year update cycle for reasons provided and highlighted by addressing the Commission’s interests under Government Code Sections 56133 and 56425. Deferring this topic in earnest to the next scheduled update process would also provide MMWD the opportunity to internally engage the matter in more detail and allow the Commission to prioritize its earlier determination to assess consolidation opportunities (merits and demerits) involving MMWD and NMWD; the results of which may substantively effect discussions on B-1. Nevertheless, and as a short-term remedy in the intervening 60 month period, it is recommended the Commission agree to work with MMWD to allow limited and termed outside service extensions into B-1 byway of truck deliveries and without conforming sphere changes under the authorizing allowance of making public health and safety findings.

The following statements have been prepared in support of the above recommendations on an updated MMWD sphere of influence and address the Commission’s mandatory review factors required under CKH. The statements collectively address the MMWD sphere of influence as a whole and assume the recommended modifications are enacted.

Present and Planned Land Uses in the Area

Lands in the updated MMWD sphere of influence are predominately developed for urban type uses as planned for by the 11 affected land use authorities that are separately subject to Commission review and oversight directly or indirectly. Agricultural an open-space uses within the updated sphere of influence are relatively limited and generally tied to publicly owned open space and includes MMWD’s watershed holdings that collectively generate the District’s primary potable supplies.

Present and Probable Need for Public Facilities and Services in the Area

Lands within the updated MMWD sphere of influence directly reflect the District’s existing potable water service area and/or its watershed holdings; the latter of which directly contributes to the former.

Present Capacity of Public Facilities and Adequacy of Public Services that the Agency Provides or is Authorized to Provide

The Commission’s recently completed municipal service review on countywide public water services indicates MMWD has generally established adequate administrative, service, and financial capacities to accommodate present and planned uses within the updated sphere of influence.

Existence of any Social or Economic Communities of Interest in the Area if the Commission Determines they are Relevant

Lands in the updated MMWD sphere of influence have established social and economic interdependencies with the District that are distinct from neighboring areas and premised on the existing delivery of potable water and/or watershed management services. This update affirms and strengthens these ties.

Present and Probable Need for Public Facilities and Services of Any Disadvantaged Unincorporated Communities Within or Adjacent to the Sphere

There are two disadvantaged unincorporated communities (DUCs) within the updated MMWD sphere of influence: Alto and Marin City. Both of these communities are already within the MMWD jurisdictional boundary and receive services therein. There are no other DUCs within or adjacent to the updated sphere of influence under the statewide definition in CKH. Nevertheless, the unincorporated community of Nicasio lies immediately adjacent to the updated sphere of influence and previously qualified as a DUC, and as such may once again qualify in the near future. Accordingly, the Commission has flagged the need for more proactive discussions and analyses with MMWD regarding the potential addition of Nicasio into the sphere of influence in anticipation of revisiting the topic in the next five-year update process.
