MINUTES No. 11

On the seventeenth of April of two thousand eighteen, around 2:30 PM, the National Coordinating Committee (CNC – Comité Nacional de Coordenação) assembled at the Ícaro Auditorium of Airport for an informative session with the following agenda:

1. Approval of the minutes of the tenth meeting of the General Assembly; 2. Bylaws of the Portuguese Association for the coordination and facilitation of slots

The Chairman of the General Assembly, Paulo Barbosa, thanked everyone’s presence and conveyed his wishes for a good work session. He mentioned that this was an informative session concerning the articles of incorporation of the new Association for the coordination and facilitation of slots.

An attendance sheet circulated in Auditorium. The meeting started at 02:45PM

1 – Approval of the minutes of the tenth meeting of the General Assembly:

The Chairman questioned if there were any objections to the minutes of the tenth General Assembly of the National Coordinating Committee. In the absence of objections, it was approved unanimously.

2 – Bylaws of the Portuguese Association for the coordination and facilitation of slots:

The representative of the National Slot Coordination, Isabel Cysneiros summarized the topics discussed in the previous General Assembly concerning the changes planned for the Coordination of slots in the Portuguese airports and the developments that had so far taken place (Appendix II). The ANA representative, Altino Pinto, disclosed that ANA, in conjunction with TAP, SATA, EasyJet, operators who had, by then, expressed their desire, is creating a non-profit Association (in accordance with the proposed law set forth in the public consultation

Minutes No. 11 of the General Assembly of the National Coordination Committee (CNC – Comité Nacional de Coordenação) INFORMATIVE SESSION 17/04/2018 drafted by ANAC). He reported that Transavia had initially shown interest, but at the end did not participate in the working meetings.

He explained that the drafted/elaborated statutes, sent to all members of the General Assembly of the CNC along with the notice of the meeting, were inspired by the Spanish model. Although some points were adapted to the Portuguese reality/situation (type of traffic, number of coordinated airports and air operators), such as the composition of the Board limited to six members instead of ten and the majority of 2/3 instead of 3/4, it nevertheless maintained the weight of 50% for each of the Association’s bodies. He further reported that, despite having no knowledge regarding the approval and publication of the law, ANA intends to have the Association constituted in the coming month of May. After showing a list of members eligible to create the Association, Mr. Altino reiterated the invitation to the interested operators to join this Association, who shall for this purpose send an email to the Head of the Slot Coordination.

NAV’s representative, Ana Lima, asked if any change is expected in the existing relationship between the slots coordination and NAV. Isabel Cysneiros informed/replied that the operation/work will be carried out in the same way, and a merely formal separation will take place. She clarified that the major difference will be in the Association’s financing, of which 50% will come from the airports and the remaining 50% from the operators through the payment of the fee. NAV will continue to declare the runway movement processing capacity within each airport’s capacity and will always be an important partner in the slots coordination activity. Lastly, Altino Pinto stated that in DL 109/2008, ANA was named the slot coordination and facilitation entity and that a fee had to be paid by the air operators for the services it already provided. The issue lies in the Portuguese Government’snon-compliance concerning the formal separation of ANA and the funding of the slots activity.

APPTA’s representative, Rogério Pinheiro, asked if TAP’s and TAP Express’s total slots were jointly calculated. Altino Pinto clarified that they operate with the same IATA code and are the same operator.

The representative of , Francine Corte-Real asked whether, regarding the members, it was possible to have more than one member as an airport manager. Altino Pinto replied that, at the moment, ANA was the only manager for the Portuguese airports but that, if this situation changes in the future, the other manager can be also a member.

The representative of Ryanair in Portugal, Frederico Melim questioned if the displayed table included all operators that could become members. Isabel Cysneiros informed that, at the moment, these were the operators with 0.4% of the traffic volume in the national airports over the last two full IATA periods, i.e., the data from Summer S17 and Winter W17, making them the potential members.

Paulo Barbosa asked whether six months will be enough to transition from the Coordination to the Association and if there is a scheduled date . Altino Pinto reported that this was the period followed in Spain for the transition from AENA to the Association. Since ANAC was not present at this meeting, there was no way to raise this question TAP’s representative, Mafalda Carvalho, stated that the period of IATA’s calendar in which this transition will be carried out is what matters in functional terms and that some periods are not adequate given the resulting volume of work for the operators and for the coordinator.

Rogério Pinheiro asked whether the slot coordinators remain within ANA if they will move to the Association. He mentioned that, since there will be a public tender for the selection of the entity that will provide the slot coordination services, there may be more applications for the concession of the public service. Regarding the question about coordinators, Altino Pinto replied that it will be analysed after the decree-law is published and within the scope of the Association.

With no additional questions being raised, the General Assembly of the National Coordinating Committee (CNC)/Information Session was closed at 3:26 PM.
