FOR YOUR SAFETY Cold Water Survival Tips What To Do In The Water Cold water robs the body’s heat 32 times faster than cold air. If you should fall into the water, all efforts should be given to getting out of the water by the fastest means possible.

Persons boating in the cold water months should be thoroughly skilled in rescue and self-rescue techniques. Most accidents involve small boats which with practice, can be righted and re-entered. Most boats, even fi lled with water, will support the weight of its occupants. If the boat has capsized and cannot be made right, climb on top of it.

Physical exercise such as swimming causes the body to lose heat at a much faster rate than remaining still in the water. Blood is pumped to the extremities and quickly cooled. Few people can swim a mile in fi fty degree water. Should you fi nd yourself in cold water and are not able to get out, you will be faced with a critical choice - to adopt a defensive posture in the water to conserve heat and wait for rescue, or attempt to swim to safety.

Should you fi nd yourself in the water, avoid panic. Air trapped in clothing can provide buoyancy as long as you remain still in the water. Swimming or treading water will greatly increase heat loss and can shorten survival time by more than 50%.

M On February 11th MLA’s President, Arthur “Sooky” Sawyer and Executive Director, Beth Casoni met with DONG Energy representatives to talk about the various fisheries currently going on in their lease area and the upcoming site survey this May. DONG Energy will be surveying the 427 square mile lease area on the feasibility of constructing a 100 turbine wind farm southeast of Martha’s Vineyard and Nantucket.

The MLA is currently talking and meeting with fishermen fishing in the wind farm / survey area to develop a direct line of communications to ensure the fishermen are not displaced entirely during the survey. There is great concern being expressed by the fishermen due to the timing (May) and length (4-6 weeks) to conduct the survey during a highly profitable fishing time. While the survey area will not change, there is possibility that the towed instrumentation depths and timing of the survey may be subject to change.

Also during our discussion with the DONG representatives we discussed the need to conduct a complete study on the ecosystem and marine resources before, during and after the construction, integrated industry participation throughout the entire process and much more. The MLA will continue to keep the communication lines open with DONG throughout the project.

Northeast Fisheries Observer Program (NEFOP) Observers in the Lobster Fishery What vessels are eligible for coverage? Any vessel that holds a federal American lobster permit is eligible to be selected for NEFOP observer coverage. The sampling frame was expanded to include all federally permitted lobster boats rather than only lobster boats which submit Fishing Vessel Trip Reports (VTRs). This change was made based on the broad agreement of committee members at the December 2015 ASMFC Lobster Technical Committee meeting held in Woods Hole, MA. Discard data collected by the NEFSC are used in fish/invertebrate stock assessments, incidental take assessments of marine mammals and sea turtles, monitoring the effectiveness of Take Reduction Plans, as well as in SBRM analyses to determine the coverage needed in the upcoming year to estimate discards. The Greater Atlantic Regional Fisheries Office also uses these data for quota monitoring/catch accounting.

AOLA tagging study summary The Atlantic Offshore Lobstermen’s Association (AOLA) recently wrapped up a lobster tagging project in cooperation with the observer program, MRAG Americas, and New Hampshire Fish and Game. Several observers were trained to tag lobsters by NH Fish and Game staff and completed a total of five tagging trips on offshore lobster vessels from July- October 2015. As many v-notched, egg-bearing, and oversize lobsters as possible were tagged by observers using equipment provided by AOLA and NH Fish and Game. A total of 2,611 tags were applied by observers during the course of the study. Data from the tagged lobsters will be used to model movement, growth, and other factors for years to come.

Lobster boats and observers have already reported a number of recaptured tagged lobsters. If you haul a tagged lobster, please release it with the tag intact and report tag number, date, location, and egg and v-notch presence to AOLA.

Other ASMFC Actions DOGFISH The ASMFC Dogfish Board approved a Commercial Quota of 40,360,761 pounds for 2016-2017 fishing season (May1-April 30).This is a 20% cut even though the fishery is not overfished and overfishing in not occurring. This mirrors a federal council’s decision. The Board did approve a 6,000 pound daily trip limit for the Northern area provided that the federal NMFS does the same.

TAUTOG The Tautog Board is working on an Amendment for this species. The fishery is depleted and overfishing is occurring according to the latest stock assessment. This is not a federally managed fishery so its all up to the states and the ASMFC. It is expected that a Draft Amendment will be ready by the November ASMFC meeting with hearings in the winter of 2017. The Board is considering a tagging provision, similar to Commercial Striped Bass requirements and is also trying to find a way to cut down on black market sales of these fish.

The 1800 members of the Massachusetts Lobstermen’s Association (Association) strongly urge you to include the long-term funding needs for the Fishing Safety Training Grants Program and Fishing Safety Research Grant Program in your Fiscal Year 2017 Budget. The Association strongly supports the Governor Charles Baker letter sent to you on December 18, 2015 asking your administration to support these two grant programs, a letter co-signed by all of our federal legislators.

Established in 1963, the Association is a member-driven organization that accepts and supports the interdependence of species conservation and the members’ collective economic interests. The membership is comprised of fishermen from Maryland to Canada and encompasses a wide variety of gear types from fixed gear and mobile gear alike.

The new regulations enacted under the CGGA Coast Guard and Maritime Transportation Act of 2012 (CGGA) are causing more burdensome and negative economic impacts on our members and countless other commercial fishermen here in the Northeast operating beyond three nautical miles. Under these new regulations, commercial fishermen are required to be outfitted with updated safety & survival equipment, and to undergo mandatory dockside exams; previously, these safety regulations only applied to vessels operating beyond 13 nautical miles.

Should your administration include the safety and research grant funding in your FY 17 budget, organizations like the Fishing Partnerships Support Services (Partnership) are prepared to provide matching funds for New England and have set goals to train all of the commercial fishermen in Massachusetts over the next ten years.

While we are encouraged and supportive of the Partnerships’ initiative to train the fishermen, we are discouraged that your administration has not once funded these grants since their creation in 2012. The safety training and equipment mandates are all well and good providing they do not cause further economic stressors, which are preventable with continued funding. We believe every fisherman’s life is priceless and ask you please to fund these two grant programs.

COM The Government – 2016 Your Partner in Your Retirement Savings I recently met with a new client, Mary, and we went over her retirement savings to date. She was quite happy – and she should have ARCH

M been – because she had a few setbacks and recently made a concerted effort to get back on her retirement savings track. A predominant amount of Mary’s retirement savings was in her company’s 401(k). She also had a couple of deductible IRAs. She wanted to know what were her retirement savings possibilities and an ideal age to retire. “That is great, Mary”, as I looked at her statements. “On this current trajectory, you should have $X by the time you retire at 66. If I assume 30% between federal and state taxes, that means you will have an estimated after-tax amount of $Y.” The joy in Mary’s face drained away. “You mean, I have to pay taxes on this?”, Mary asked. My retirement conversation can be long and thorough – and it should be – since it represents a client’s future and what they are, or have been, working so hard for. It encompasses a lot of discussion and one aspect I always address (as I discuss in previous articles) is the impact of taxes. How much you will pay in taxes from your pre-tax retirement accounts are unique and depend on your own situation; however, to get the client understanding about the overall potential impact of taxes, I always convert that pre-tax savings amount to an estimated after-tax amount. I explained to Mary that the Government can be our partner in our retirement savings. We accumulate monies pre-tax over a number of years and that, at some point, the Government will want its share. I told her not to despair. Taxes are a part of retirement savings. We need to pay; however, the estimated amount is not set in stone and there are several strategies to mitigate the retirement savings tax impact that she could do now: (1) Open a Roth IRA – unlike a deductible traditional IRA, contributions are not tax deductible. Like the traditional IRA, earnings in a Roth IRA grow tax-deferred. One of the benefi ts of the Roth comes when it’s time to make a withdrawal. Withdrawals are tax- free provided the Roth account has been in existence for 5 years and the investor is over 59.5 years of age. Moreover, the Govern- ment currently does not require you to take the money out of the Roth account (which is required for Traditional IRAs). This can make the Roth account a viable part of an estate plan.

(2) Possible Roth conversion – there are earnings tests and income limits to qualify opening a Roth IRA account. If you don’t qualify to open an account directly, you could convert any monies from a traditional IRA into a Roth IRA account. The catch? You will have to pay taxes on the transfer.

(3) Location, Location, Location – I’m not talking about where to live (although that can help if you move to a state with no state Confused income taxes), but where your investments are located. Generally speaking, any investments held in an IRA or 401(k) are taxed at about the best ways to save ordinary income rates.
