Pre-Application Narrative

The following text is intended to satisfy the applicable requirements outlined in the Pre- Application Checklist (Appendix 5.1.a-f) of the Madison County Subdivision Regulations.

a. Project Description:

The Moonlight Basin Overall Development Plan (formerly the Moonlight Basin Ranch Overall Development Plan) (ODP) has been the guiding document for development within the Moonlight Basin area which encompasses approximately 8,000 acres. The most current version of the ODP, updated and approved in 2007, is the county-approved guidance document for land uses on the site. Previous versions of the ODP were reviewed and approved originally in 1994 and again in 2001. Development nodes have been established and refined throughout the duration of the ODP using the constraints-based land use planning method. The objective has been to locate these nodes as sensitively as possible to protect the natural amenities of the area and to provide for public safety and convenience. Current land uses within the boundaries of Moonlight Basin ODP area consist of various residential and commercial developments which are primarily tied to the recreational nature of the area. Also included are undeveloped and recreational lands which include those utilized for the ski terrain and other recreational endeavors along with vast expanses of open spaces intended to protect both the natural and built environment. The uses that are proposed as part of this request are similar in nature and consistent with those anticipated in each of the prior versions of the ODP. There is no underlying zoning within the ODP site. The Madison County Growth Policy provides general, county-wide land use policies and goals. These policies and goals generally strive to protect natural resources, avoid burdening county and local services, promote the development of the tourism and recreation industry, and enhance the county's economy. As will be noted throughout the ODP application narrative, this is a master planned area reviewed and approved as an Overall Development Plan. Impacts associated with master planned areas are analyzed in a more comprehensive manner for compliance with the goals and objectives of the Growth Policy. Therefore, development proposals for sites within the overall area that are consistent with the uses and densities anticipated as part of the master plan are permitted accordingly. This update to the ODP, along with the individual development proposals that would be associated with it in the future, will be subject to review for compliance with the Growth Policy. Access, both primary and secondary, will be discussed as part of the ODP application narrative and a Traffic Impact Summary will be provided as part of the anticipated appendices. Water supply and wastewater treatment will be analyzed in a Facilities Summary highlighting the capabilities of each system to accommodate both the current uses and densities as well as those anticipated in the future. Topics that will be summarized throughout the narrative and further detailed in the appendix also include: ° Land Stewardship Plan ° Geological Review ° Wetland Summary ° Governing Documents (Design Guidelines, Standards & Regulations) ° Adjacent Owners Notification, Outreach & Response(s) ° Agency Notification & Responses ° Wildlife Analysis ° Fire Protection Plan

Christina – I have received your June 2 mailing regarding the Overall Development Plan for Moonlight Basin. My comments and questions follow : 1. The written information provided is very general so it is very difficult of ascertain what is going on. We are at the “Pre-Application” stage of the ODP process, which is basically the point where we notify everyone that we are applying to update our ODP. When we submit our ODP, which is a binder of information, you will receive another notice from the County. The ODP is very general in nature; it tracks our overall density allowed by the County (1,651 units, including those units already subdivided) against an environmental assessment, which analyzes that density against things like traffic, wildlife, vegetation, etc. When you receive notice from the County, please feel free to reach out to me again if you are not in town to view the binders in person (which are public record and will be located at the Big Sky Fire Department as well as the Ennis Public Library). In the meantime, if there are things you’d like to share based on your experiences generally, I’d be happy to tell you

1 if/how it fits into the ODP and how it relates to our development more generally. The idea at this stage is that we solicit your feedback on Moonlight so as to inform what we submit to the County. 2. The drawing “Figure No. 1” does not have a key or legend so one does not know what PA means (probably Plan Area) and does not know what each numbered PA is. You are correct. The only takeaway from this figure at this time is that these are the areas where density was intended to be located when the 2007 ODP was prepared (the ODP’s have a 10-year lifespan). 4. The drawing “Figure No. 2” has areas labeled, like “Lee’s Pool”, but is also color coded without indicating what the colors might signify. This figure has the same goal as the previous, we just intended to give the development areas names instead of “PA-1”, for example, so that they’re easier to identify. The two figures together are intended to show that we haven’t greatly shifted density areas. When we submit our ODP application, those areas will have density numbers attached to each of them. They are intended to guide future subdivision applications, and in turn, each subdivision application is an opportunity to update the ODP.

You may have received a notification in hardcopy mail about the Overall Development Plan (copy attached), but it’s a County-regulated process that renews every 10 years so we are currently undergoing that update now. The ODP measures our overall entitlements (the number of density units we are allowed to build) against an environmental assessment, which studies things like traffic, wildlife, water, wastewater, etc. We are entitled for 1,651 units, which includes those units already subdivided/constructed, which leaves us with about 1,200 units remaining.

I would be happy to speak with you further about what it entails and our approach going forward at your convenience if you are unable to listen in during either of those times.

Thanks for sending the letter in the mail about the meeting tomorrow. I own property in Moonlight (Timber Ridge lot 4) and have some questions:

1. What is the First Minor Subdivision that was referenced in the letter? Where will it go? I believe you’re referring to Part D – First Minor Subdivision – the paragraph explains that the ODP is not a First Minor Subdivision. This section is clunky, but it’s part of the County form to explain that the ODP is reviewed through criteria that is outlined in the Madison County Subdivision Regulations. It is not a subdivision, but the overarching framework for future subdivisions. 2. The last sentence of the letter refers to "Jack Creek Paving." Are you all paving that road? No – an RSID is a “Rural Special Improvement District” that funds road maintenance. The name “Jack Creek Paving” is confusing because RSID 99-01 actually encompasses paving/maintenance from the Mountain Fire station (across from Big Sky Resort) up to the entrance to Moonlight. Montana Highway 64 ends before the entrance to Moonlight, so this bridges the gap. 3. I've heard rumors about you all moving the Jack Creek Road gate back a bit. Is that true, and do you know where it will be located? We are requesting that the current location of the Jack Creek Road gate be maintained as part of this ODP. When the Strawberry Ridge subdivision was created behind the gate, the road had a portion of public access as an outgrowth of changes to County regulations, so the County required the gate to be relocated as part of that subdivision. Moonlight Basin requested a period of time (5 years) to address the relocation, which is timed with the ODP update. We agree that we do not want to relocate the gate and thank you for expressing your concern.

As an owner in the Timber Ridge area, I'm obviously very concerned about increasing the amount of traffic down that road. We bought our property for the peace and quiet and I don't want to see that compromised.
