MEMORANDUM To explain the situation in the Democratic Republic of Congo

Preamble

The Congolese patriots, united within the Alliance des Patriotes pour la Refondation du Congo, APARECO, a movement of the Congolese resistance against the occupation of the Democratic Republic of Congo, raise awareness to the European Union about the world’s deadliest crisis since the second World War, and is currently disrupting our country for almost 21 years.

For two decades, the Congolese people are passing through a period of their history mainly characterized by the deprivation of its sovereignty, the total absence of personal and property safety, as well as war crimes and crimes against humanity whose known perpetrators remain unpunished to this day.

Therefore, the Congolese people are deprived of their absolute and universal principle reaffirmed in the Charter of the United Nations, which also notes in its first and most famous article: “All human beings are born free and equal in dignity and rights”. They have the right to be protected and supported when needed, as it can be seen from the massacres, the planned systematic destruction of women, young girls and Congolese infants by rapes followed by mutilations, organized plunder of natural resources with proven active complicity of some multinationals and some leaders of the neighbouring countries especially Rwanda and Uganda.

The freedom given to those responsible for the crimes and misdeeds committed, reported many times by UN experts and both nationals and internationals NGO’s brings meaningful questioning and leads to a deep analysis to estimate the level of diminishment of the Congolese people by the international community.

Therefore, in this memorandum, the patriots of the Congolese resistance intend to call upon the European Union, from now on, to focus their attention and efforts on the real problem tormenting the Congolese people from 1996 to this day. It is the aggression and occupation of the Democratic Republic of Congo and its institutions by military forces and both Rwandese and Ugandan politics, supported by politic and international financial lobbies, through the massacres of Congolese, the rape of Congolese women and the plundering of national wealth.

To this end, the APARECO, along with all the patriots in the Congolese resistance, through this memo attempt to provide a brief overview of both the process and the depth of the Congolese patrimony’s destruction. Because they feel that this extremely serious situation should not escape the attention

Président national of the countries member of the European Union, but in the contrary, challenge their conscience and responsibility in the root causes of misery threatening the very existence of Congolese people.

The violation of the Democratic Republic Of Congo’s sovereignty

Since October 1996 Congo’s national sovereignty has been violated as a result of its aggression and invasion by a coalition of regular armies from several countries: Rwanda, Uganda, Burundi, Angola, Eritrea and Chad. Under the pretext of going after Hutus extremists who perpetrated the genocide against Tutsi and moderated Hutus, staying as refugees in the eastern part of our country, therefore representing a threat to the security of Republic of Rwanda, the sponsors succeed to hide Congo’s aggression.

This unfair war of aggression against the former Republic of Zaïre, now Democratic Republic of Congo, perpetrated by its eastern neighbours was marked by a significant mass massacre of defenceless Zairean people and Hutu refugees who fled the bombing of Sake and Mugunga. More than a billion victims who fled in the Zairean forests were decimated by the APR (Armée Patriotique Rwandaise), which is an army with a majority of Tutsi, led by , the current President of the Republic of Rwanda. Many investigations report and damning accounts by witnesses were brought by eminent personalities of the United Nations in DRC, such as Roberto Garreton and Emma Bonino, in denouncing the massacres of Ting-Tingi, and confirming those facts.

The greatest single force of evidence for the invasion of RDC by foreign troops to plunder its resources lies in the deadly clashes with heavy weapon between the Rwandese army and the Ugandan army in the heart of the Congolese territory. First in august 1999, then the 5thof may 2000, and finally from the 5th to the 10th of June of the same year. More than 6600 shells were fired in the city of Kisangnani alone, causing more than 1000 deaths, and at least 3000 casualties amongst civilians.

As a result of those blatant and recurring violation of Congo’s sovereignty by both Rwandese and Ugandan armies:

Président national to ignore its existence. The Apostolic Nuncio of the Holy See in , Monseigneur Luis Mariano Montemayor, alone, had the courage to publicly recognize the existence of the Congolese genocide, when he witnessed the atrocities in the East of DRC, following his visit. b) The unprecedented deterioration of the people’s safety and their assets. One of the most brutal instance is that more than 5 million Congolese autochthons are first removed from their homes and native land, then they are chased away by Rwandese troop, substituting them by allochthone people from Rwanda. c) The intentional death of the Democratic Republic of Congo as a State. To this end, the Rwandese leader Paul Kagame and his Ugandan accomplice Yoweri Museveni, with the complicity of their pawn “” infiltrated to the head of our institutions in Kinshasa, have multiplied pseudo- rebellions mainly made up of soldiers of the Rwandese army, in the east of Congo, to install permanent chaos in this region and enable the planned balkanization. d) The pillage and illegal exploitation of DRC’s natural resources. To secure their control on the natural wealth in the east of our country, both Rwandese and Ugandan leaders have set up structured networks maintaining an organized chaos in the east of our country. At the present time this chaos extended to the whole national territory: Kinshasa, Bas-Congo, and currently in Kassaï. e) The widespread insecurity established and intentionally sustained by various militias and pseudo-rebellions furnished and guided from Kigali and Kampala to control mining sites in the east of the DRC. Those armed troops plunder and kill Congolese people to control mine sites. That is in fact to ensure better management of those “blood minerals”: Uganda just inaugurated this past February the first refinery of gold in the region, while its reserve of gold is strictly limited. Similarly, Rwanda has just started the execution of his long term plan, in building an ore processing plant, to process coltan, in its territory, while its national production is not on an industrial scale.

Furthermore, UN experts’ reports presented in 2005 denounce illegal trafficking of minerals extracted in Congo’s territory, but yet benefit to Rwanda, and some regional companies based in Kigali. f) Several deadliest invasion wars in the African continent including the aggression and invasion war from 1996 to 1997. Under the cover of a supposed rebellion of the AFDL (Alliance des Forces Démocratiques pour la Libération du Congo), they wanted to hide an aggression that caused the

Président national massacre of more than 1 billion of Hutu Rwandese and of Congolese in the east of the DRC (under the orders of the Rwandese General , assisted by Commander Hypo as known as “Joseph Kabila”, the current President of DRC), and led to the fall of Maréchal Mobutu. Another war to conquer Congolese territories from 1998 to 2002 had been hidden as well, still under the cover of “rebellions” of the RCD-Goma, and of the MLC. Note that the IRC (International Rescue Committee) in its report evaluated the account of the mass killing, for that period alone, to3,8 million deaths. Those are in addition to wars intended to sustain the chaos and the infiltration of Rwandese soldiers in the Congolese police and army, adding the entrance of CNDP and M23, both created by Rwanda and Uganda…

All the conflicts mentioned above, are instigated and provided for by both Rwandese and Ugandan Presidents, and aim for the balkanization of the DRC, followed by the annexation of parts of the national territories rich in mineral resources to their own countries. With the compilation of the reports provided by UN experts, in the present time, it is to be noted that the strategy of organized chaos has already caused the genocide of more than 12 million Congolese.

The massacre and extermination of people whose crime is to be Congolese!

When dealing with a crime, choosing to remain silent is acting out of passive complicity. There is something incongruous when all international institutions keep a guilty silence and turn a blind eye to the bloody repression of Congolese people by the barbaric regime of occupation, and even attempt to ignore the cruellest and longest genocide in our history!

The sense of injustice and non-assistance to a person in danger is exacerbated by the international community’s attitude, who knows the paradigms laying the foundations of DRC’s crisis, but indulge in tranquilizers to keep Congolese people asleep, instead of attacking the evil at its root source: the presence of the Rwandese occupation with “Joseph Kabila” imposed to the head of DRC’s institutions with the international community’s consent solely!

To speed up their plan of the occupation, the balkanization and the annexation of the east part of the DRC, both Rwandese and Ugandan leaders are using rape as a weapon of war. To this end, they sent soldiers carrying HIV-AIDS in the Congolese territory to accentuate the rape of women, young girls, even 2 to 3 weeks’ infants and small children.

Then to move forward the demographic decline of Congolese, the authorities of the occupying forces in Kinshasa established a policy of terror and massive violation of Human Rights, in parallel to the specific strategy of extermination of Congolese people in targeted areas.

Acts of repression committed by the authorities of the occupying forces are characterized by:

a) The kidnappings and arbitrary arrest of politicians representing quite a threat to the occupying forces. For instance, Franck Diongo, President of Mouvement Lumubiste Progressiste, Eugène Diomi Dongala, President of Démocratie Chrétienne, Jean-Claude Muyambo, etc… b) The assassinations of politicians of the opposition and human rights activists such as the vice president of the Provincial Assembly of Kinshasa, Mr Daniel Botheti in the second and last term of his office, Mr Floribert Chebeya, President of the Congolese NGO “La voix des sans voix” … c) The bloody repressions of peaceful civilians’ rallies as recently when “Joseph Kabila” forced his way in the case of his second and last term in September and December 2016 causing more than hundred deaths; d) The assassinations of journalists of the opposition such as Serge Maheshe editorial secretary in Radio Okapi cold-bloodedly executed in Bukavu, Franck Ngyke head of political news desk in the independent daily La Référence Plus shot by bullets with his spouse in his home in Kinshasa, let not forget the independent reporter Bapuwa Mwamba, former correspondent of Jeune Afrique Economie magazine, also shot by bullets in his home; e) The assassinations of senior military officers fighting to defend the territorial integrity of the DRC such as Brigadier general Masasu Nindaga, Colonel Mamadou Ndala, Major Martin Tshimanga, etc.

The current massacres taking place in Kasaï, in the centre of the DRC, which was videotaped and posted online by several medias, is only the continuity to

Président national reverse the demographic balance in a war initiated from Kigali and implemented in the Congolese soil by “Joseph Kabila”.

The several massacres committed on the Congolese soil reveals the implementation of the mass destruction and extermination of the Congolese people policy. Some of the mass crimes committed, since the aggression started in 1996, are listed below (the following list is non-exhaustive):

• The massacre of Tingi Tingi in 1997: According to a report of Médecins Sans Frontières (MSF), some 190 000 Hutu Rwandese refugees were killed in the eastern forests of the DRC;

• The massacre of Kisangani from the 14th to the 15th of May 2002:” At least 200 Congolese killed under the orders of Rwanda” as reported by the French daily online Liberation on the 30th of May 2002, 11:38 pm;

• The massacre of February 2007 in Bas-Congo: Following a preliminary investigation, the UN mission in DRC (MONUSCO) reported at least protesters killed;

• The massacre of Kiwanja in 2008: Located 80 km from Goma in the North Kivu, at least 150 people were killed according to a report from Human Rights Watch (HRW)“most of the people killed in Kiwanja, were summarily executed November 5th by the forces of Congrès National pour la Défense du Peuple (CNDP) of the rebel commander ”. He is peacefully staying in Rwanda.

• The massacre of Béni and its surroundings in the North Kivu: More than 1 116 were killed between October 2014 and May 2016, as reported by the CEPADHO, a local civil society’s NGO;

• The mass grave of Maluku: Located 80km from the city of Kinshasa, where 400 people were buried at night, in April 2005;

• The mass graves in province of Kasaï: At least 17 mass graves were found currently. Already in December 2016 the MONUSCO mentioned “allegations on the presence of 7 mass

• graves” in the province. Two members of the UN experts group, an American citizen and a Swedish citizen, on assignments in the area to investigate possible violations of human rights, who went missing since the 12th of March 2007, were brutally murdered by DRC’s

special services, because they found out the depth of the genocide and the real perpetrators of the Congolese mass killings.

The atrocities committed in targeted areas by Rwandese troops allowed them to chase away Congolese autochthones from their native land to substitute them by allochthones people from Rwanda, who comes to occupy the space freed up, in compliance with their strategy of reversing the demographic balance. Therefore, according to the OCHA/RDC’s estimations the numbers of displaced Congolese went from 800 000 in 1998 up to 3,4 million in august 2003.

Conclusions

The analysis of the crisis we are seeing in DRC since 1996 to this day is not related to democratic issues. It is not interethnic conflicts between Congolese either. The source of repeated conflicts in Congo comes from the aggression, followed by the occupation of the Congolese territory and pillage of its wealth by political and military forces of Rwanda and Uganda, who invaded the DRC and infiltrated all its institutions, and are killing, raping, mutilating, and chasing billions of Congolese from their native land to achieve the plan of balkanization and annexation of the eastern part of the DRC!

In this context, proposing to Congolese another political dialogue and agreement with the impostor “Joseph Kabila”, the main agent of the occupying forces and oppressor of Congolese people, is disregarding billions of Congolese who were killed, and the perpetrators of their deaths have never been brought to justice! It is showing an active complicity with Rwanda and Uganda, who violate the basic principles of fundamental freedoms in DRC.

Indeed, since the aggression of the DRC in 1996 followed by its occupation in 1997, all pretended political dialogues and agreements to bring back peace didn’t produce the desired results. In the contrary, all the agreements, one after another, facilitated the infiltration of Rwandese military officers and soldiers within the Congolese national army and police, also within Congolese special services, through operation of “mix”, of “incorporation”, of “integration” of several Rwandese armed movements operating under cover of “Congolese rebellions”.

The APARECO and the Congolese resistance fighters want to say clearly to the International Community, through the European Union, that Congolese people are saying:

STOP to Rwanda’s Trojan horse in DRC, “Joseph Kabila” under his real name, Hyppolite Kanambe, who was a full member of the Armée Patriotque du Rwanda (APR) and a Rwandese intelligence officer assigned within the AFDL as a task officer, under the orders of his uncle James Kabarebe, the current Minister of Defence of Rwanda;

STOP to Fantasy solutions, such as political dialogues (more than twenty!), elections (in 2006 and 2011) which won’t resolve the real source of the crisis being the occupation of DRC;

STOP to the choosing of puppet leaders, imposed to the Congolese people by black hands, to benefit foreign political and financial lobbies;

The APARECO and the Congolese resistance fighters think that after the failure of the current political negotiations in DRC, reported by the President of the CENCO to the United Nations Security Council, acknowledged and resumed by all the Congolese political class, the European Union, main economic partner of DRC should drop the mask and ride to the rescue of the Congolese people support him in its expressed will to get rid of the occupying forces, to recover its confiscated and violated sovereignty. It is a sine qua non prerequisite to build a stable and democratic republic in the heart of Africa.
