The following provisions form an integral part of the contract concluded between Oyrone Ltd, our travel partner ACAPA Tours GmbH and you. By accepting your written, telephone or personal registration, the contract is concluded between you and ACAPA Tours GmbH (and / or the service provider / organizer). The provisions and notes on the invoice shall also apply. Also the AVRB of the respective organizer or service providers. We would like to draw your attention to the fact that the Swiss Federal Law on Package Travels of June 18, 1993, which came into effect on 1 July 1994, basically regulates only the interests of package tours according to Article 1. Flight tickets and other individual services of transport companies (bus, taxi, rental car, etc.) as well as hotel bookings or similar offers of service providers, which are all listed as individual services on the invoice or which point to a separate detail on the invoice, are not subject to the Swiss Federal Law. For this purpose, e.g. the Warsaw Convention or the Montreal Convention on Air Transport regulates the rights and obligations of consumers and service providers.

Complaints due to non-fulfilment during a journey are to be announced immediately on the spot to the organizer (the local tour guide) and the service provider (transport company, hotel, etc.). If this is not possible, these must be sent to ACAPA Tours GmbH within 14 days in writing, with reasons. Price increases are. Section 6 of the Swiss Federal Law regulates the rescission of package travel. For flight tickets and hotel (and / or similar character) bookings the terms and conditions of the respective tariff apply.

The liability of ACAPA Tours GmbH is limited by the content of Articles 14, 15 and 16 of the Swiss Federal Law, or for travel which does not fall under package travel according to Swiss Federal Law. Securing and refunding of paid amounts in the sense of the above Swiss Federal Law in the event of insolvency of individual organizers, is guaranteed by the guarantee fund of the Swiss Travel Agency Association.

The relationship between ACAPA Tours GmbH and you are governed by Swiss law, with jurisdiction being Brugg / AG.

Some explanations on the AVRB:

1. We shall be liable for the damages suffered by the customer during the trip, insofar as it is a matter of malicious preparation of ours or of false information, which represents a breach of the original agreement. Liability claims may include damage caused by force majeure, war, civil disturbances, strikes, epidemics, natural catastrophes, breakdowns or technical defects of transport equipment, sovereign requirements such as the removal of land rights without the fault of the tour operator, seizures or incidents the above-mentioned examples. Furthermore, damages which are caused by the customer’s own behavior are excluded.

2 We can not accept liability for third-party culpable behavior, such as carriers, hoteliers, vehicle rental companies, eventual intermediaries or other travel agents.

3. Every organizer or service provider, as well as us, ACAPA Tours, reserves the right to make changes to the program for important reasons (changes to airlines or types of flights, changes in the timetable and timetables). The same applies to hotel accommodation and other services, whereby we endeavor to find equivalent substitute services in order to preserve the character of the trip as far as possible. 4. Our prices have been calculated on the basis of the tariffs, prices and exchange rates valid at the time of printing the brochures of the various organizers. Flight prices for special tickets as well as tickets which have been calculated and offered on the basis of the IATA price structure are valid at the time of the offer, and after ticket issuance, in the event the entries entered in the ticket are not changed. Price adjustments as a result of fuel prices for transport means of any kind, taxes etc. are also expressly reserved. Any price increases will be billed before travel or can be collected directly before departure.

5. If a trip cannot be carried out for any reason (for example, due to insufficient participation, force majeure, deportation or withdrawal of land, fuel shortages, disturbances, strikes, etc.), we shall notify the customer as soon as possible. The amount paid by the Customer will be refunded in such case, without prejudice to any further claims and without deduction. Naturally, in such a case, we are endeavoring to offer the customer an equivalent program.

6. If the customer does not make full or partial use of the services booked by him, no (or only according to the organizer or service provider) will be refunded. Likewise, in such cases, any liability is excluded.

7. We accept no liability for late arrival at the customer’s departure port.

8. If a booking and invoicing is made by a third person (clubs, companies, etc.), the same is responsible for the fact that our travel conditions are communicated to the participants in time.

And if you still have to cancel a booked trip? In your interest, please inform us as soon as possible. Some operators or service providers charge the cancellation fees in percent / days before departure. In the case of special air tickets, the cancellation costs will be up to 100 per cent from 30 days or more before arrival. In order to cover our additional costs, we charge a fee in addition to the cancellation costs of the organizers or service providers: CHF 40 .- per person, maximum of CHF 120.- per order. Also our effective costs such as telephones, faxes, visa fees, etc., will be charged against cancellation costs (only with non-voluntary rescission) you can protect yourself with a special insurance.
