Dear Mr. Scarborough: This letter of findings provides the results of a desktop waters of the United States (U.S.), including wetlands, desktop assessment performed by BIO-WEST, Inc. (BIO-WEST) approximately 90.5 acre property, located in the North Beach area of Corpus Christi, Texas primarily focused around Timon Boulevard (Blvd), Surfside Blvd, and the median in between the two paralleling streets within Nueces County (Attachment A). The area of investigation (subject property) includes developed land, roadside maintained herbaceous land, marshes and wetlands, and two proposed entry points to . The center of the subject property is approximately 27.825211°N, -97.386629°W (WGS 1984).

Desktop Assessment Methods

BIO-WEST conducted a desktop assessment of waters of the U.S., including wetlands, which are defined jointly by the United States Army Corps of Engineers (USACE) (Title 33 Code of Federal Regulations [CFR] 328.3) and the Environmental Protection Agency (EPA) (Title 40 CFR 230.3), in order to evaluate the subject property for the potential presence of wetlands, special aquatic sites, and other waters of the U.S., which includes, but is not limited to, lakes, rivers, ponds, mud flats, and perennial, intermittent, and ephemeral stream channels.

BIO-WEST performed the following activities to complete the desktop assessment:

1. A review of publicly available databases: U.S. Fish and Wildlife Services (USFWS) National Wetland Inventory (NWI), U.S. Geological Survey (USGS) Topographic Maps, Federal Emergency Management Agency (FEMA) Floodplain Service Center, Texas Parks and Wildlife Department (TPWD) Texas Watershed Viewer, U.S. Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Web Soil Survey, USDA NRCS List of Hydric Soils, and USDA NRCS Published Soil Surveys for Texas 2. A review of multiple years of true color and infrared aerial imagery

It should be noted that BIO-WEST did not perform a waters of the U.S., including wetlands, delineation according to the 2010 Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coast Plains Region (version 2.0) on the subject property. A limited field effort to verify the desktop assessment results was conducted on July 23. 2020.

Desktop Assessment Results

The subject property site lies within the Corpus Christi, Texas (1977) USGS 7.5-minute Quadrangle reference map. The topographic map shows the subject property to be relatively flat and gently sloping east toward Corpus Christi Bay (Appendix A, Figure 3.0).

BIO-WEST utilized the USDA NRCS Web Soil Survey (NRCS, 2019), the Soil Survey of Nueces County, Texas (NRCS, 1965), and the NRCS list of hydric soils for Nueces County, Texas (2015) to describe the mapped soil types within the subject property (Appendix A, Figure 4.0). Table 1 provides the soil type and a short description of the soil located within the subject property.

The USFWS NWI map identified seven features inside the subject property: two palustrine, unconsolidated bottom, semipermanently flooded (PUBF) freshwater ponds, two palustrine, emergent, persistent, seasonally flooded (PEM1C) wetlands, two estuarine, intertidal, unconsolidated shore, irregularly flooded (E2USP) wetlands, and one estuarine, subtidal, unconsolidated bottom, subtidal (E1UBL) estuarine and marine deepwater feature (Corpus Christi Bay) (Attachment A, Figure 5.0).

The subject property lies within the -Corpus Christi Bay watershed and the Oso Creek watershed (TPWD, 2020) and after review of the Federal Emergency Management Agency (FEMA) floodplain map (2020), the entire subject property is located within an area of 100-year coastal flooding with velocity, by Corpus Christi Bay. (Appendix A, Figure 6.0).

Field Verification Results

BIO-WEST conducted a limited field verification to verify the results of the desktop assessment within the subject property by a BIO-WEST ecologist on July 23, 2020. During the field verification, the topography identified within the subject property confirmed the topography depicted on the USGS topographic maps with a slight slope east toward Corpus Christi Bay.

Vegetation communities were evaluated within the subject property during the limited field verification. Vegetation communities observed within the subject property consists of estuarine scrub- (E2SS) wetlands, estuarine emergent (E2EM) wetlands, and herbaceous uplands. Vegetation commonly found inside of these communities is listed below:

• E2SS wetlands in the area were typically dominated by vegetation such as black mangrove (Avicennia germinans), saltgrass (Distichilis spicata), bushy seaside tansy (Borrichia frutescens), and saltwort (Batis maritima). • E2EM wetlands in the area were typically dominated by vegetation such as bushy seaside tansy, shoregrass (Monanthochloe littoralis), and annual glasswort (Salicornia bigelovii). • Herbaceous uplands in the area are typically dominated by vegetation such as Bermudagrass (Cynodon dactylon), littleleaf sensitive briar (Mimosa microphylla), honey mesquite (Prosopis glandulosa), switchgrass (Panicum virgatum), and St. Augustine grass (Stenotaphrum secundatum).

Conclusions and Recommendations

Results of our investigation revealed the potential presence of one E2SS wetland, two E2EM wetlands, and one tidally-influenced open waterbody, Corpus Christi Bay, within the subject property. It is BIO-WEST’s professional judgement that these features and any other delineated during the course of a formal waters of the U.S., including wetland delineation, would be classified as jurisdictional under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act and would be subject to regulation by the USACE and EPA for the following reasons:

1. Corpus Christi Bay is currently a Section 10 regulated TNW and classified as a Type 1 jurisdictional waters by the USACE – Galveston District under 33 CFR 328.3 2. Any potential wetland features within the subject property likely exhibit a significant nexus to Corpus Christi bay, a documented TNW, due to their proximity and resulting biological, chemical, and hydrological connections

Only the USACE and the EPA are the final authority over the jurisdictional status of both wetlands and other waters of the U.S. under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act. The findings discussed in this report are solely the best professional judgment of BIO-WEST and have not been verified by the aforementioned regulatory government agencies.

If impacts to features within the subject property are anticipated, further coordination may be necessary. Therefore, BIO-WEST recommends a formal delineation according to the 1987 Corps of Engineers Delineation Manual, 2010 Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coast Plains Region (version 2.0), and Regional Guidance Letter (RGL) 05-05 – OHWM/MHT Delineations be conducted in order to identify the extent of feature boundaries within the subject property and to obtain a definitive answer on jurisdictionality from the USACE and EPA.

Threatened and Endangered Species Assessment

Federal Regulations

Since 1973, the Endangered Species Act (ESA) has regulated a wide range of activities affecting flora and fauna classified as endangered or threatened. Reauthorized in 1988, provisions of the act apply only to species listed in the Federal Register as endangered or threatened. Under the provisions of the ESA, all federal agencies, federally-issued permits, and federal engagements are required to undertake programs for conservation of threatened and endangered species and are prohibited from authorizing, funding, or carrying out any action that would jeopardize a listed species or destroy or alter its critical habitat. Specifically, the ESA prohibits acts, by anyone or any organization, such as:

• The importation and exportation of endangered species from the United States. • Taking (killing, capturing, collecting, harming, harassing, pursuing, hunting, trapping) listed species within the United States and territorial waters. • Taking listed species on the high seas. • Possessing, delivering, selling, delivering, carrying, transporting, or shipping any such species unlawfully taken within the United States or on the high seas. • Selling or offering for sale any such species in interstate or foreign commerce.

The United States (U.S.) Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS) share responsibility for administration of the ESA. In general, the USFWS is responsible for terrestrial and freshwater species and migratory birds, while the NMFS regulates and protects marine species and anadromous fish. Additionally, the Animal and Health Inspection Service, U.S. Department of Agriculture, oversees importation and exportation of listed terrestrial .

State Regulations

In 1973, the Texas legislature authorized the Texas Parks and Wildlife Department (TPWD) to establish a list of endangered and threatened animals in the state. Laws pertaining to these endangered and threatened

An “endangered” species is a species named by the Executive Director of TPWD as being threatened with statewide extinction. “Threatened” species are those species deemed by TPWD as likely to become endangered in the future.

TPWD regulations prohibit the “taking”, possession, transportation, or sale of any species designated by state law as endangered or threatened without a permit. State laws and regulations prohibit commerce in threatened and endangered plants and the collection of listed species on public land without a permit issued by TPWD. These laws apply to individuals, municipalities, and all organizations.

Methods

BIO-WEST biologists conducted a desktop assessment of the subject property for the potential presence of federally and state protected species, and a one-day limited field investigation to verify determinations made based on aerial imagery, topographic maps, USFWS Information for Planning and Consultation (IPaC), TPWD Annotated County Lists of Rare Species, and the Texas Natural Diversity Database (TXNDD). In addition, BIO-WEST submitted a Texas Natural Diversity Database (TXNDD) request to TPWD on July 22, 2020 for the nine USGS 7.5-minute quadrangles including the subject property and immediately surrounding the subject property for an approximate 15-mile search radius surrounding the subject property.

Results and Determinations

The subject property consisted of an approximate 90.5-ac area in the North Beach area of Corpus Christi, Texas. The subject property is primarily focused around Timon Blvd, Surfside Blvd, and the median in between the two paralleling streets.

Habitat and Vegetative Communities

The subject property encompasses the North Beach area of Corpus Christi, Texas with two proposed entry points to Corpus Christi Bay. Vegetation communities observed within the subject property consisted of estuarine scrub-shrub wetlands, saltmarsh wetlands, and mowed and maintained herbaceous uplands. Vegetation commonly inside of these communities is listed below:

• Scrub-shrub wetlands in the area were typically dominated by vegetation such as black mangrove (Avicennia germinans), saltgrass (Distichilis spicata), bushy seaside tansy (Borrichia frutescens), and saltwort (Batis maritima). • Saltmarsh wetlands in the area were typically dominated by vegetation such as bushy seaside tansy, shoregrass (Monanthochloe littoralis), and annual glasswort (Salicornia bigelovii). • Herbaceous uplands in the area are typically dominated by vegetation such as Bermudagrass (Cynodon dactylon), littleleaf sensitive briar (Mimosa microphylla), honey mesquite (Prosopis glandulosa), switchgrass (Panicum virgatum), and St. Augustine grass (Stenotaphrum secundatum).

Soils

BIO-WEST referenced the Web Soil Survey of Nueces County (Natural Resources Conservation Service [NRCS], 2020) and the Soil Survey of Nueces County, Texas (NRCS, 1965) to determine the types of mapped soils within the subject property. In addition, BIO-WEST consulted the NRCS list of hydric soils

for Nueces County, Texas (2015) to assist with determining the potential for hydric soils. According to these sources, two mapped soil types are located within the subject property (Appendix A, Figure 4):

• Ijam clay loam, rarely flooded (Ma) a poorly drained clayey soil found on lagoons or flats. This soils type is classified as hydric and is neither wooded nor farmable under natural conditions. • Urban land (Ua) an area of development that is influenced by buildings or other urban structures that makes accurately delineating soil types difficult. This soils type is classified as non-hydric.

Fifteen federally listed species and thirty-seven state listed species are documented to occur in Nueces County, Texas. Table 1 presents the common name, scientific name, the federal status, the state status, and the BIO-WEST’s Effects Determination of each federally protected species listed to occur in Nueces County. Effect Determinations were estimated by BIO-WEST by comparing habitat requirements of each species to the likely field conditions based on a review of the publicly available databases and current and historical aerial photographs.

The Gulf Coast jaguarundi (Herpailurus yagouaroundi cacomitli) is an endangered species listed by USFWS for Nueces County, Texas. The last confirmed sighting of the Gulf Coast jaguarundi in Texas was near Brownsville, Texas in 1986 approximately 132 miles from the project area. The Gulf Coast jaguarundi is assumed to have been extirpated from its historical range in Texas. Due to the lack of habitat and belief of extirpation from its historical range in Texas the determination of no effect is proposed for the Gulf Coast jaguarundi for this proposed project.

The ocelot (Leopardus pardalis) is an endangered species listed by USFWS for Nueces County, Texas. Currently the only remaining population of Ocelots in Texas is limited to dense scrub brush habitat in the Lower Rio Grande Valley. Due to the lack of suitable habitat within the project, the determination of no effect is proposed for the ocelot for this proposed project.

The West Indian manatee (Trichechus manatus) is a threatened species listed by USFWS for Nueces County, Texas. The West Indian manatee prefers large rivers, brackish water bays, coastal waters and feeds primarily on sea grass beds present in these habitats. A species that cannot tolerate cold water temperatures well, the west Indian manatee is primarily restricted to the Florida coastline and the more tropical Central American and Mexican coastline. West Indian manatees are infrequent visitors to the Texas coast where individuals sometimes wonder into Texas waters during the warmer summer months. Four individuals have been observed within 0.5 miles of the southern terminus of the project area within Corpus Christi Bay and the Corpus Christi Channel that leads into the Main Turning Basin from 2001 to 2016. The last confirmed individual observed based on TXNDD data was one manatee observed in April, 2016. Due to the lack of suitable warm water habitat and the infrequent use of the Texas coastline, the determination of may affect but is not likely to adversely affect is proposed for the west Indian manatee for this proposed project.

The northern aplomado falcon (Falco femoralis septentrionalis) is an endangered species listed by USFWS for Nueces County, Texas. The northern aplomado falcon habitat includes open areas and open wooded areas. Due to the lack of habitat within the subject property and the mobility of the species to relocate to an area away from the work being performed the determination of no effect is proposed for the northern aplomado falcon for this proposed project.

The piping plover (Charadrius melodus) is a threatened species listed by USFWS for Nueces County, Texas. The piping plover prefers sand and algal flats along the coast with beaches being used secondarily as well. Due to the mobility of the species to relocate to an area away from the work to be performed even though the potential for habitat to be present within the subject property is possible the determination of may affect, but is not likely to adversely affect is proposed for the piping plover.

The red knot (Calidris canatus rufa) is a threatened species listed by USFWS for Nueces County, Texas. The red knot winters along the Texas coast utilizing emergent wetlands, tidal flats, and beaches. Due to the mobility of the species to relocate to an area away from the work to be performed even though the potential for habitat to be present within the subject property is possible the determination of may affect,

The whooping crane (Grus americana) is an endangered species listed by USFWS for Nueces County, Texas. The whooping crane is a migratory species that winters in the coastal marshes along the Texas coastline. Potential stopover and wintering habitat could be present within the project area. The population present along the coast winters on and around the Aransas National Wildlife Refuge approximately 33 miles away from the subject property. Due to the mobility of the species and ability to locate to an area away from the work to be performed as well as the lack of critical habitat within the subject property the determination of may affect, but not likely to adversely affect is proposed for the whooping crane for this proposed project.

The (Chelonia mydas, Threatened), hawksbill sea turtle (Eretmochelys imbricate, Endangered), Kemp’s Ridley sea turtle (Lepidochelys kempii, Endangered), leatherback sea turtle (Dermochelys coriacea, Endangered), and loggerhead sea turtle (Caretta caretta, Threatened) are listed as threatened and endangered species respectively by the USFWS for Nueces County, Texas. Due to the mobility of the species and ability to relocate to an area away from the work to be performed the determination of may affect, but not likely to adversely affect is proposed for the green sea turtle, hawksbill sea turtle, Kemp’s Ridley sea turtle, leatherback sea turtle, and loggerhead sea turtle for this proposed project.

Conclusions and Recommendations

Based on the results of the desktop and field investigations of the subject property, BIO-WEST determined that any development within the subject property is not likely to adversely affect any federally listed threatened or endangered species. However, any development within the proposed subject property may impact up to six state-listed species, and affect, but not adversely affect 11 federally listed species.

The USFWS and the NMFS are the final authorities over the “Effects Determination” of federally listed threatened and endangered species protected by the ESA. The findings discussed in this report are the professional judgment of BIO-WEST and have not been verified by the aforementioned regulatory government agencies.

Probability of Presence ( )

Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your project overlaps during a particular week of the year. (A year is represented as 12 4-week months.) A taller bar indicates a higher probability of species presence. The survey eort (see below) can be used to establish a level of condence in the presence score. One can have higher condence in the presence score if the corresponding survey eort is also high.

How is the probability of presence score calculated? The calculation is done in three steps:

1. The probability of presence for each week is calculated as the number of survey events in the week where the species was detected divided by the total number of survey events for that week. For example, if in week 12 there were 20 survey events and the Spotted Towhee was found in 5 of them, the probability of presence of the Spotted Towhee in week 12 is 0.25. 2. To properly present the pattern of presence across the year, the relative probability of presence is calculated. This is the probability of presence divided by the maximum probability of presence across all weeks. For example, imagine the probability of presence in week 20 for the Spotted Towhee is 0.05, and that the probability of presence at week 12 (0.25) is the maximum of any week of the year. The relative probability of presence on week 12 is 0.25/0.25 = 1; at week 20 it is 0.05/0.25 = 0.2. 3. The relative probability of presence calculated in the previous step undergoes a statistical conversion so that all possible values fall between 0 and 10, inclusive. This is the probability of presence score.

When birds may be breeding in the area, identifying the locations of any active nests and avoiding their destruction is a very helpful impact minimization measure. Additional measures and/or permits may be advisable depending on the type of activity you are conducting and the type of infrastructure or bird species present on your project site.

What does IPaC use to generate the migratory birds potentially occurring in my specied location? The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern (BCC) and other species that may warrant special attention in your project location.

The migratory bird list generated for your project is derived from data provided by the Avian Knowledge Network (AKN). The AKN data is based on a growing collection of survey, banding, and citizen science datasets and is queried and ltered to return a list of those birds reported as occurring in the 10km grid cell(s) which your project intersects, and that have been identied as warranting special attention because they are a BCC species in that area, an eagle (Eagle Act requirements may apply), or a species that has a particular vulnerability to oshore activities or development.

Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not representative of all birds that may occur in your project area. To get a list of all birds potentially present in your project area, please visit the AKN Phenology Tool.

What does IPaC use to generate the probability of presence graphs for the migratory birds potentially occurring in my specied location?

The probability of presence graphs associated with your migratory bird list are based on data provided by the Avian Knowledge Network (AKN). This data is derived from a growing collection of survey, banding, and citizen science datasets .

Probability of presence data is continuously being updated as new and better information becomes available. To learn more about how the probability of presence graphs are produced and how to interpret them, go the Probability of Presence Summary and then click on the "Tell me about these graphs" link.

How do I know if a bird is breeding, wintering, migrating or present year-round in my project area?

To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may refer to the following resources: The Cornell Lab of Ornithology All About Birds Bird Guide, or (if you are unsuccessful in locating the bird of interest there), the Cornell Lab of Ornithology Neotropical Birds guide. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specied. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area.

What are the levels of concern for migratory birds?

Migratory birds delivered through IPaC fall into the following distinct categories of concern:

1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacic Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. "Non-BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements (for eagles) or (for non-eagles) potential susceptibilities in oshore areas from certain types of development or activities (e.g. oshore energy development or longline shing).

Although it is important to try to avoid and minimize impacts to all birds, eorts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. Details about birds that are potentially aected by oshore projects

For additional details about the relative occurrence and abundance of both individual bird species and groups of bird species within your project area o the Atlantic Coast, please visit the Northeast Ocean Data Portal. The Portal also oers data and information about other taxa besides birds that may be helpful to you in your project review. Alternately, you may download the bird model results les underlying the portal maps through the NOAA NCCOS Integrative Statistical Modeling and Predictive Mapping of Marine Bird Distributions and Abundance on the Atlantic Outer Continental Shelf project webpage.

Bird tracking data can also provide additional details about occurrence and habitat use throughout the year, including migration. Models relying on survey data may not include this information. What if I have eagles on my list?

If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur.

Proper Interpretation and Use of Your Migratory Bird Report

The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ “What does IPaC use to generate the migratory birds potentially occurring in my specied location”. Please be aware this report provides the “probability of presence” of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look carefully at the survey eort (indicated by the black vertical bar) and for the existence of the “no data” indicator (a red horizontal bar). A high survey eort is the key component. If the survey eort is high, then the probability of presence score can be viewed as more dependable. In contrast, a low survey eort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be there, and if they might be breeding (which means nests might be present). The list helps you know what to look for to conrm presence, and helps guide you in knowing when to implement conservation measures to avoid or minimize potential impacts from your project activities, should presence be conrmed. The responsibilities for the protection, conservation, and management of marine mammals are shared by the U.S. Fish and Wildlife Service [responsible for otters, walruses, polar bears, manatees, and dugongs] and NOAA Fisheries3 [responsible for seals, sea lions, whales, dolphins, and porpoises]. Data limitations

The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information on the location, type and size of these resources. The maps are prepared from the analysis of high altitude imagery. Wetlands are identied based on vegetation, visible hydrology and geography. A margin of error is inherent in the use of imagery; thus, detailed on-the-ground inspection of any particular site may result in revision of the wetland boundaries or classication established through image analysis.

The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts, the amount and quality of the collateral data and the amount of ground truth verication work conducted. Metadata should be consulted to determine the date of the source imagery used and any mapping problems.

Wetlands or other mapped features may have changed since the date of the imagery or eld work. There may be occasional dierences in polygon boundaries or classications between the information depicted on the map and the actual conditions on site.

Data exclusions Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial imagery as the primary data source used to detect wetlands. These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters. Some deepwater reef communities (coral or tubercid worm reefs) have also been excluded from the inventory. These habitats, because of their depth, go undetected by aerial imagery.

Data precautions

Federal, state, and local regulatory agencies with jurisdiction over wetlands may dene and describe wetlands in a dierent manner than that used in this inventory. There is no attempt, in either the design or products of this inventory, to dene the limits of proprietary jurisdiction of any Federal, state, or local government or to establish the geographical scope of the regulatory programs of government agencies. Persons intending to engage in activities involving modications within or adjacent to wetland areas should seek the advice of appropriate federal, state, or local agencies concerning specied agency regulatory programs and proprietary jurisdictions that may aect such activities.

Area S of tracks, on N shoulder of highway, supports what amounts to a monoculture of nonnative grasses from which Ambrosia cheiranthifolia are absent. Ambrosia is also absent from mesquite huisache woodland on steep slope along drainage ditch, and presumably absent from cultivated fields to the N.

EO Data: July 1969: A specimen was collected on the railroad tracks. 14 Aug 1969: A specimen was collected 0.5 miles W of Violet. 23 Nov 1969: A specimen was collected 0.25 miles W of Violet. 10 July 1986: A specimen was collected from a colony along the railroad tracks approx. 0.5 miles W of Violet. 6 Nov 1991: Ambrosia cheiranthifolia is scattered throughout site, locally abundant in some spots, found in both soil types ( Victoria clay and Clareville complex). Jackie Poole set up 6 plots, 3 on each side of 24. Each plot was 25 square meters. The total number of basal stems was counted for each of the plots: 220, 149, 117, 83, 480, and 397. 5 Oct 2000: 30-40 stems were found, but the entire ROW was not surveyed. Most plants were 10-15 cm high with herbivore (beetle) damage. 17 Dec 2004: On the W side of Hwy 24 there was 317 plants plus 47 additional plants around and in the gully. There were 117 individuals to the E of 24. Most of the Ambrosia was in patches of Aristida; Approx. width of Ambrosia patch was 5 meters. Plants were in flower where they were not cut.

Re: Cultural resources desktop review for the North Beach Canal Project, Nueces County, Texas

Mr. Chastain,

Gray & Pape, Inc. (Gray & Pape) of Houston, Texas was contracted by BIO-WEST, Inc. of Houston, Texas to conduct an assessment for possible effects that the above-referenced project would have on archaeological and historic properties in Nueces County, Texas. The current research revealed that there is a moderate to high probability that the proposed project area contains significant cultural resources and will require additional cultural resources assessment. The results of the current desktop assessment are presented below.

PROJECT AREA DESCRIPTION

The project area can be found on the Corpus Christi, TX 7.5-minute United States Geological Survey (USGS) topographic quadrangle maps (Figure 1). The study area consists of 36.6 hectares (90.5 acres), is amorphic in shape, and measures 2.62 kilometers (1.63 miles) long by 500 meters (1,640 feet) at its greatest extents. Of the 36.6 hectares (90.5 acres), approximately 0.85 hectares (2.1 acres) is submerged in Corpus Christi Bay at Sea Rim State Park. The proposed project activities include constructing a large-scale detention basin/navigation channel within the median of the existing right- of-ways (ROWs) for Timon Boulevard and Sunset Boulevard. The primary purpose and need to alleviate drainage and flooding concerns for the North Beach area. The secondary purpose is a navigable channel to help revitalize the area and provide economic incentive for development.

SURFACE GEOLOGY AND SOILS

One soil type, Urban Land, is mapped within the current project area. Urban land consists of areas that are 75-100% developed with structures such as buildings and streets. Small areas of soils consisting of soils covered with fill material may also be present. Due to the extent of altered soils, they are unable to be classified (Soil Survey Staff, Natural Resources Conservation Service, United States Department of Agriculture [SSS NRCS USDA] 2020). ARCHIVAL RESEARCH RESULTS

Site file research was completed using the online Texas Archeological Sites Atlas, maintained by the Texas Historical Commission (THC). The site file research revealed that no identified cemeteries, historic properties, previously recorded archaeological sites, or National Register properties are located within the current subject area.

Ten cultural resources surveys (9 area and 1 linear) have been previously conducted within 1.6 kilometers (1 mile) of the project area, one of which overlaps the northeastern portion of the project area (THC 2020a) (see Figure 1, Table 1).

One archaeological site is located within 1.6 kilometers (1 mile) of the subject area. It was recorded in 1988 during the survey for the Texas State Aquarium. It is situated on a level point of land barely 5 feet above sea level adjacent to Corpus Christi Bay on the east and the Corpus Christi Ship Channel in the south. The site was described as a historic military post, training ground, and battle site. The site consisted of military account remnants, clay marbles, minie balls, musket balls, a cigar clipper, bottles, ceramics, lead slag, clay pipe, glass, bone and shell buttons, plastic, and metal. The site was noted as not having the potential as a State Archeological Landmark (SAL) or for the National Register of Historic Places (NRHP). A survey and test of the southwest portion of the site, after buildings were removed, was recommended (THC 2020a).

One cemetery, Old Bayview Cemetery, is located within 1.6 kilometers (1.0 miles) of the subject area (see Figure 1). It is also known as the Military Cemetery and the Grave Yard. It is 3.49 acres in size and has 540 graves. Burial dates are noted as 1845 to the mid-twentieth century. In 2002, Old Bayview Cemetery was designated as a SAL (THC 2020b). It is the oldest federal military cemetery in Texas. U.S Army Engineers established this cemetery in 1845, after a steamship’s boiler exploded and killed seven soldiers. Pioneer settlers and veterans of the War of 1812, the Texas War of Independence, the Mexican War, the Indian Campaigns, and Civil War are buried in this cemetery (obc.cclibraries.com 2020).

For the submerged portion of the study area, the Automated Wrecks and Obstructions Information System (AWOIS) database, which also contains wreck data from Electronic Navigation Charts (ENCs), and the Texas State Archaeological Atlas were consulted to aid in identifying any potential marine resources that maybe located within or partially within the study tract.

Review of the AWOIS database did not reveal any obstructions or wrecks within submerged portions of the project area. Within the 1.6 kilometers (1 mile) of the study area, there are eight reported obstructions and two ENC wrecks (see Figure 1; Table 2). Review of the Texas Archaeological Sites Atlas revealed that there are not any reported shipwrecks in the submerged portion of the project area and four shipwrecks within 1.6 kilometers (1 mile) of the study area (Table 3). All the THC recorded shipwrecks have a positional accuracy of 0.4 kilometers (0.25 miles) and are not depicted on Figure 1.

CARTOGRAPHIC REVIEW

A review of historic aerial photographs and historic maps, including but not limited to historic USGS historic quadrangles indicate that the project area has undergone significant development. The relevant historic quadrangles examined in the ESRI-based U.S. Historical Topographic Map Explorer available online at https://livingatlas.arcgis.com/topoexplorer/index.html. Historic quadrangles reviewed consisted of 7.5-minute quadrangles, dated 1925, 1950, 1968, and 1970, were downloaded and prepared with the proposed project era overlain.

The earliest quadrangle map reviewed is the 1925 USGS Corpus Christi 7.5-minute quadrangle. Cultural features present within the proposed project area include roads, a railroad and associated spurs, and a structure, which is located adjacent to the railroad at the northern extents of the proposed project area (Figure 2). There are several structures mapped immediately outside of the study area.

The 1950 version of the USGS Corpus Christi 7.5-minute quadrangle reveals numerous improvements surrounding the project area. Within the project area, there are additional residential roads, the railroad and its associated spurs, a church, an unspecified structure and two industrial storage tanks (Figure 3). The structure that was plotted within the northern extents of the project area is no longer present. Also present on this map are a church plotted immediately outside of the study area and a school (see Figure 4).

Review of the 1968 version of the USGS Corpus Christi, TX 7.5-minute quadrangle reveals numerous improvements within the project area compared to earlier versions (Figure 4). The railroad plotted on earlier versions is not present, instead it has been replaced with roads which aligns with the current Timon and Sunset Boulevards. In the southern portion of the project area, the railroad location aligns with the current Highway 35 Harbor Bridge location. The 1968 version does not show any additional cultural improvements than what is presented in the 1977 version (see Figure 1).

8 AERIAL IMAGERY REVIEW

Review of the recent 2019 aerial imagery reveals that there are two commercial structures fully within the study area. There are, however, 5 commercial structures (i.e. hotels) that are situated partially within the study area (Figure 5). Other features within the study area include roads and greenspaces. Historic aerial imagery was consulted as well to establish a timeline of land-use history, determine the changes to the identifiable features over time, as well as, to determine the potential for submerged historic resources. The dates for the aerial imagery reviewed are 1950, 1956, 1961, 1979, 1985, 2009, and 2020.

The earliest aerial imagery consulted is dated 1950. Structural features present on this edition of the aerial are numerous residential and commercial structures, industrial storage tanks. Other cultural features include roads and the railroad and its associated spurs (Figure 6). Review of the 1956 aerial photography does not reveal any new improvements. The two industrial storage tanks located in the southern extents of the study area are not present (Figure 7). Review of the 1961 aerial indicates that the area has been impacted by Hurricane Carla, which made landfall in September 1961. All of the structures that were present on earlier versions are no longer present or have been severely affected (Figure 8). The 1979 version shows two standing structures within the study area (Figure 9). The other cultural features within the study area are roads. Review of the 1985 aerial, shows the two structures seen in the 1979 version as well as additional commercial properties such as hotels and condominium complexes. The 2009 aerial, like the 2019 version shows two commercial structures fully within the study area and 5 commercial structures (i.e. hotels) partially within the study area (Figure 10).

CONCLUSIONS AND RECOMMENDATIONS

Background research concluded that one reconnaissance-level archaeological survey (USACE, Galveston District 1984) has been conducted partially within the APE, and nine additional archaeological surveys have been conducted within a 1.6-kilometer (1-mile) study radius surrounding the project area. Research also revealed that there is one archaeological site within the same study radius (see Figure 1). Review of the AWOIS and the THC Atlas datasets revealed eight obstructions and two ENC shipwrecks (see Figure 1) within 1.6-kilometers (1 mile) of the study area. Review of the ATLAS online database did not reveal any reported shipwrecks or unidentified submerged obstructions within the project area and four shipwrecks within 1.6 kilometers (1 mile) of the study area (see Figure 1). None of these resources are within the direct APE of the proposed project.

Review of historic USGS quadrangles and historic aerials suggests that the area has the potential to contain buried cultural resources associated with the residential structures as well as the church identified within the study area. The earliest quadrangle map reviewed is the 1925 USGS Corpus Christi 7.5- minute quadrangle which shows roads, a railroad and associated spurs, and a structure (see Figure 3). The 1950 version of the USGS Corpus Christi 7.5-minute quadrangle reveals a railroad and its associated spurs, a church, an unspecified structure and two industrial storage tanks within the study area (see Figure 4).

Based on the research presented, there is a moderate to high probability of significant cultural resources to be located within the study area. While most of the project area has been impacted from previous developments such as road construction and municipal infrastructure development (i.e. drainage projects), the potential remains for significant archaeological resources associated with the locations of residential structures as well as the church. The proposed retention basin/navigation canal will have an adverse impact on any cultural resources located within the study area. Therefore, Gray & Pape recommends that the study area has a moderate to high potential for the discovery of significant Historic archaeological sites associated with the early development of North Beach. Project plans and an understanding of project impacts will assist in developing an appropriate scope of work for cultural resources survey. Based on the review of the AWOIS and Atlas databases and what is currently known about the project, the 0.85-hectare (2.1 acres) portion of the project area that is situated in submerged lands appears to have a low potential for submerged cultural resources.
