SUMMARY

1 Purpose of Report

1.1 To consider the findings of a review of polling districts and polling places and agree a way forward.

2 Background

2.1 In accordance with the Electoral Registration and Administration Act 2013 (Section 17), and the Representation of the People Act 1983 (Sections 18a to 18e), this council is required to review the polling districts and polling places within the borough before 31 January 2015. Interested parties have been consulted and Council is asked to consider their responses, prior to approving the revised schedule of polling arrangements detailed in appendix 1.

2.2 Polling districts are the areas created by the subdivision of a constituency into smaller parts, within which a conveniently located polling place can be determined. It is the smallest administrative unit of electoral area, and cannot be divided by a ward, division or constituency.

2.3 Polling places are the areas in which the Returning Officer must select polling stations on the occasion of an election.

2.4 This current review of polling districts and places commenced on 25 June 2014 and initial proposals and consultation materials were sent to; all borough councillors, the and District Disability Forum, all parish councils, and the public via media publications online, in the Gazette, and through the councils leaflet distribution service. The Acting returning officers for Borough Council, Hart District Council, Test Valley Borough Council and the Members of Parliament for Basingstoke, North West and North East Hampshire were also consulted. All responses have been published on the council’s website.

2.5 In total, thirty consultation responses were received. A summary of the responses and corresponding officer comments is attached in appendix 2.

3 Issues Considered within the Review

3.1 The review examined current polling districts and considered if any changes were required. Only one comment was received regarding polling districts and, having considered the current arrangements, no changes are recommended.

3.2 This review also considered polling places and the suitability of the current arrangements.

3.3 When the last polling review was conducted in December 2011, the opportunity was taken to widen the Returning Officer’s choice for the location of a polling station to include the whole of the relevant polling district and, in some cases, adjacent polling district(s) (Appendix 3). This was because there may be instances when a change is required and it is impractical to seek Council approval for an amended schedule of polling places just before an election. This approach ensured that the Returning Officer was still able to run a legally compliant election in the event of the loss of a premises within a polling district.

While this is still a valid consideration, subsequent guidance from the Electoral Commission states:

‘We are aware that some authorities designate the entire polling district as the polling place. However, section 18B (4)(e)of the Representation of the People Act 1983 states that:

‘the polling place must be small enough to indicate to electors in different parts of the district how they will be able to reach the polling station’. We therefore consider that polling places should always be defined more specifically than simply the polling district - for example, by designating the name of the polling place (normally a particular building or area and its environs)’.

As a result, it is proposed to revert to naming specific polling places but to note that the current constitution provides delegated authority to the Head of Governance and Commissioning to “Designate alternative polling places, after consultation with the Council’s Returning Officer, in the event that an existing polling place becomes unavailable.” It is believed that this provides the necessary level of protection to the Returning Officer. Having considered the latest guidance from the Electoral Commission and the views of the Returning Officer’s and other consultees, an amended list of proposed polling places is attached in Appendix 1. Members should note that it may be necessary to designate alternative polling places for both the Popley Spotlight Centre and Harlech Hall prior to the May 2015 elections

4 Recommendation

4.1 It is recommended that Council:
