The purpose of this letter is to notify you that the City of Aransas Pass, Texas ("City") has officially annexed the property described in City Ordinance No. 2019-4246 into its city boundaries effective on July 6, 2019, ("Annexed Area"). Attached is: • A copy of City of Aransas Pass Ordinance No. 2019-4246, which includes its exhibits with a description of the Annexed Area's metes and bounds, map, and City's Service Plan; and • A list of tracts in the Annexed Area identifying each tract's County Appraisal District Number and legal description.

NOTICE IS HEREBY GIVEN TO ALL INTERESTED PERSONS THAT:

On April 15, 2019, the City of Aransas Pass, Texas proposed to institute annexation proceedings to enlarge and extend the boundary limits of said city to include the following described territory, to wit:

An area that consists of up 1,400 acres of land located North of Aransas Pass and extending up to the City of Rockport's extraterritorial jurisdiction, and along Highway 35 Bypass and Highway 35 Business and depicted in attached Exhibit A. More specific information regarding each proposed annexed tract's legal description is available at City Hall, 600 W. Cleveland, Aransas Pass, Texas and on the City's website at www.aransaspasstx.gov

CITY OF ARANSAS PASS

The City held public hearings on May 17, 2019, May 18, 2019, and June 17, 2019. The City Council will conduct a 4th and 5th public hearing to hear comments for and against whether the City should annexed the proposed Phase 2 annex area. The 4th and 5th public hearings will be held by and before the City Council of the City of Aransas Pass, Texas on July 22, 2019 at 12:00 pm and 6:00 p.m., Aransas Pass Civic Center, 700 W. Wheeler, Aransas Pass, Texas, for all persons interested in the above proposed annexation. At said time and place all such persons shall have the right to appear and be heard.

ORDINANCE NO. 2019-4246

AN ORDINANCE OF THE CITY OF ARANSAS PASS, TEXAS ANNEXING THE HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF ARANSAS PASS, TEXAS, SAN PATRICIO COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE THE DESCRIBED TERRITORY WITHIN THE CITY LIMITS AND ITS EXTRATERRITORIAL JURISDICTION, AND GRANTING TO ALL THE INHABITANTS OF THE TERRITORY ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING THE INHABITANTS BY ALL OF THE ORDINANCES, RESOLUTIONS, ACTS AND REGULATIONS OF THE CITY; ADOPTING A SERVICE PLAN; FINDING AND DETERMINING THAT ALL REQUIREMENTS FOR ANNEXATION INCLUDING PUBLIC HEARINGS, NOTICES AND OPEN MEETINGS HAVE BEEN MET ACCORDING TO LAW; PROVIDING INSTRUCTIONS FOR FILING THIS ORDINANCE AND FOR CORRECTING THE OFFICIAL MAP BOUNDARIES AN EXTRATERRITORIAL JURISDICTION OF SAID CITY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Chapter 43 of the Texas Local Government Code and City Charter of the City of Aransas Pass, Texas, Article 1, Section 4 authorizes the annexation of territory to extend the corporate limits of the City and its extraterritorial jurisdiction, subject to state law;

WHEREAS, the City desires to annex certain territory described herein ("Property", "Territory" or "Annexed Area") by metes and bounds in Exhibits "A-1, A-2, A-3, and A-4" and by map in Exhibit "B", which is hereby incorporated for all purposes;

WHEREAS, offers of development agreements pursuant to Texas Local Government Code Section 43.016 have been made;

WHEREAS, this annexation will leave out property where the property owner has signed a Development Agreement with the City of Aransas Pass as per Texas Local Government Code Chapter 43, however, properties with a Development Agreement are identified and described in Exhibit A-4 and Exhibit B for all necessary purposes;

WHEREAS, all of the Property or Territory described herein is contiguous to and within the exclusive extraterritorial jurisdiction of the City;

WHEREAS, all required notices, all public hearings, and all requirements for such annexation have been provided, held, and met in accordance with applicable law, which is attached hereto and incorporated herein for all purposes as Exhibit "C" - City Resolution No. 2019-889;

WHEREAS, on May 28th and May 29th , 2019, public hearings were held by the City Council, during City Council meetings, at City Hall, City Council Chambers, 600 W. Cleveland, Aransas Pass, Texas at 6:00 p.m. (CST) following publication of notices of the public hearings: (1) on the City's internet website; and (2) in newspapers of general circulation in the City of Aransas Pass arid San Patricio County, Texas known as the Aransas Pass Progress and the Rockport Pilot in their respective publications on May 8th and 9th, 2019, for the consideration of annexation proceedings and the service plan for the defined lands and territory, during which all persons interested in the annexations were allowed to appear and be heard;

WHEREAS, pursuant to Section 43.056(b) of the Texas Local Government Code, a service plan for the area proposed to be annexed was made available for public inspection, including on the City's website

Page 1 The City will provide "full municipal services" in the Annexed Area in the manner and time required by Texas Local Government Code Section 43.056. Nothing in this Service Plan shall require the City to provide uniform level of full municipal services to each area of the City, including the Annexed Area, if different characteristic of topography, land use, and population density are considered sufficient basis for providing a different level of service.

Section 4. The official map and boundaries of the City and its extraterritorial jurisdiction, previously adopted and amended, are amended to include the Annexed Area as part of the City of Aransas Pass, Texas.

Section 5. The City Manager and the City Secretary are directed and authorized to perform or cause to be performed all acts necessary to correct the official map of the City to add the Annexed Area and its extraterritorial jurisdiction as required by applicable law.

Section 6. It is hereby declared by the City Council of the City of Aransas Pass that if any of the sections, paragraphs, sentences, clauses, phrases, words, or provisions of this Ordinance should be declared unconstitutional or otherwise invalid for any reason, such event shall not affect any remaining sections, paragraphs, sentences, clauses, phrases, words to provisions of this Ordinance.

Section 7. It is hereby officially found and determined that the meeting held at which this Ordinance was passed was open to the public as required by law.

Section 8. The City Secretary and/or the City Attorney are hereby directed to file a certified copy of this Ordinance with the County Clerk of San Patricio County, Texas on or about July 8, 2019, and with other appropriate officials and agencies as required by state and federal law.

Section 9. This Ordinance shall be in full force and effect immediately upon its passage and approval by the City Council of the City of Aransas Pass, Texas.

FINALLY ENACTED THIS 6th day of July, 2019 at a special meeting of the Elective Council of the City of Aransas Pass, Texas at which a quorum was present and which was held in accordance with TEXAS GOVERNMENT CODE, TITLE 5, SUBTITLE A, CHAPTER 551.

RESOLUTION NO. 2019-889

Resolution declaring City's intent to begin annexation of up to 600 acres of land into the territorial limits of the City of Aransas Pass, directing the City Manager to prepare a service plan for the extension of municipal services to the proposed annexation area, and setting, posting and publishing two public hearings on annexation

WHEREAS, state law requires the City to direct its staff to prepare a service plan that provides for the extension of municipal services to the area to be annexed; and

WHEREAS, state law provides that the City should conduct two public hearings at which persons interested in the annexation are given the opportunity to be heard;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE ARANSAS PASS THAT:

1. The City Council declares its intent to begin the process of annexing the territory depicted in Exhibit "A" attached hereto and incorporated herein, consisting of up to 600 acres lying adjacent to the City of Aransas Pass, Texas into the territorial limits of Aransas Pass, Texas. 2. In accordance with Texas Local Government Code, Section 43.065, the City Council directs the staff to prepare a service plan that provides for the extension of municipal services to the annexation area. 3. In accordance with Texas Local Government Code, Section 43.063, the City Council hereby schedules two public hearings on this annexation on May 28, 2019 and May 29, 2019 during special scheduled meetings beginning at 6:00 p.m. in the City Council Chambers, 600 W. Cleveland, Aransas Pass, Texas. 4. If more than 10 percent of the adults who are permanent residents of the area to be annexed file a written protest of the annexation with the City Secretary within 10 days of the publication of the notice, then the City Manager is authorized and directed to reschedule at least one of the hearings to a suitable site, if available, in the area proposed for annexation. 5. The provisions of this resolution shall become effective immediately upon final passage and approved by the City Council.

(6) Operation and Maintenance of Roads and Streets, including Road and Street Lighting: The City will maintain public roads and streets over which the City has jurisdiction. Roads, streets or alleyways which are dedicated to and accepted by the City of Aransas Pass, Texas, or which are owned by the City of Aransas Pass, Texas, shall be maintained to the same degree and extent that other roads, streets, and alleyways are maintained in the City. Lighting of public roads, streets and alleyways shall be maintained by the applicable utility company servicing the City unless the lighting facilities have been dedicated to the public, in which case the City will be the operator.

(7) Operation and Maintenance of Parks, Playgrounds and Swimming Pools: Currently, there are no public recreational facilities in the annexation area including parks, playgrounds, or swimming pools. Any park that may be under the responsibility of the County will be maintained by the City only upon dedication of the park by the County to the City and acceptance of the park by the City Council.

(8) Operation and Maintenance of any other Publicly Owned Facility, Building or Service: Currently, there are no such other publicly-owned facilities, buildings, or services identified in the annexation area. lf the City acquires any publicly-owned facilities, buildings, or services within the annexed area, an appropriate City department will provide these services.

(9) Other Municipal Services: Excluding gas and electric services, all other City Departments with jurisdiction in the area will provide services according to City policy and procedure.

Additional information regarding above-services to be provided are attached and incorporated for all purposes as Exhibit "1" b. Capital Improvement program pursuant to Texas Local Government Code 43.056(e) The City will initiate the construction of capital improvements necessary for providing municipal services for the annexed area as necessary. Landowners in the area are not required to fund capital improvements necessary to provide municipal services in a

2 (11) Capital Improvements Planning: The annexed area will be included with other territory in connection with the planning for new or expanded facilities, functions, and services as part of the City's Capital Improvement Plan c. Effective Term This Plan shall be in effect for a ten-year period commencing on the effective date of the annexation unless otherwise stated in this Plan. Renewal of the Plan shall be at the option of the City. A renewal of this Plan may be exercised by the City Council provided the renewal is adopted by ordinance and specifically renews this Plan for a stated period of time. d. Special Findings The City Council of the City of Aransas Pass, Texas, finds and determines that this Plan will not provide any fewer services or a lower level of services in the annexation area than were in existence in the annexation area at the time immediately preceding the annexation process. The Plan will provide the annexed area with a level of service, infrastructure, and infrastructure maintenance that is comparable to the level of service, infrastructure, and infrastructure maintenance available in other parts of the municipality with topography, land use, and population density similar to those reasonably contemplated or projected in the annexed area. The City reserves the right guaranteed to it by the Texas Local Government Code to amend this Plan if the City Council determines that changed conditions or subsequent occurrences or any other legally sufficient circumstances exist under the Local Government Code or other Texas laws to make this Plan unworkable or obsolete or unlawful. e. Governing Law This Plan may not be amended or repealed except as provided by the Texas Local Government Code or other controlling law. Neither changes in the methods or means of implementing any part of the service programs nor changes in the responsibilities of the various departments of the City shall constitute amendments to this Plan, and the City reserves the right to make such changes. This Plan is subject to and shall be interpreted in accordance with the Constitution and laws of the United States of America and the State of Texas, the Texas Local Government Code, and the orders, rules, and regulations of governmental bodies and officers having jurisdiction.

f. Force Majeure In case of an emergency, such as force majeure as that term is defined in this Plan, in which the City is forced to temporarily divert its personnel and resources away from the annexed area for humanitarian purposes or protection of the general public, the City obligates itself to take all reasonable measures to restore services to the annexed area of

• The City of Aransas Pass has a contract with Tri- County EMS Ambulance to provide service to all of the area within the city limits. • Tri-County EMS will automatically and immediately extend its service to any newly annexed areas. • No upfront costs will be needed. However, when we are presented with a new contract, prior to the beginning of the upcoming Fiscal Year, there will be a proposed cost increase to cover the newly annexed area. The additional cost for Phase III should be minimal. Aransas Pass Service Plan Phase 111 Fire

• Fire protection will be provided immediately to the newly annexed areas. • No additional officers will be immediately needed for Phase III only, however, as soon as practical steps should be taken to increase the number of fire personnel because of the larger geographical area. • A "safer" grant is being applied for to accomplish this goal.
