Overview

There are 102 piers and harbours around the coast of Donegal under the control of Donegal County Council, with a number of additional harbour/piers in existence under private ownership. These harbours range in size from very small facilities catering for a small number of vessels to the larger commercial harbours. In 2003 a report and inventory of all of the harbours in Co. Donegal was prepared and published and this is regularly updated by Donegal County Council. A full list of the piers/harbours is included in Appendix A.

Importance of Delivery of Ship-generated Waste & Cargo Residues

The ultimate purpose of proper delivery of ship-generated waste and cargo residues to shore reception facilities is to reduce the discharge of waste into the sea from ships using ports, thereby contributing to the protection of the marine environment.

SI 117 / 2003 Eurpoean Communities (Port Reception Facilities for ship-generated waste and cargo residues) Regulations 2003 require the Local Harbour Authority (Donegal County Council) to prepare a waste reception plan in accordance with schedule 2 of said regulations.

Consultation and Assessment of Need for Port Reception Facilites

Most of the Council’s harbours are small and are used by local inshore fishermen and leisure craft owners. Any waste generated by the users of the smaller ports/piers/harbours is generally taken home for disposal.

None of the harbours under the control of Donegal County Council have cargo vessel traffic.

Following a review of all of the piers and harbours under the Council’s control, it was determined that there are thirteen ports with significant activity and it is at these locations that the Donegal County Council Waste Reception Plan will be implemented: Greencastle Carrickarory Glengad Malin Head Bunagee Magheraroarty Donegal Town

From analysis of the marine traffic in the area and in consultation with harbour users, an assessment was undertaken to establish the level of PRF required at each location to adequately meet the needs of the ships normally visiting each pier/harbour. The considerations and outcomes are documented in this the Port Reception Plan 2018-2021 and any significant changes arising from the previous plan are recorded in Appendix C.

The Council has key stakeholders at these facilities and works in consultation with same to continuely assess changing or growing needs due to seasonal demand or growth in activity. The Piers & Harbours team liaises with these user groups, fishing organisations, the

Harbour Masters, the environment section and waste collection providers to amend facilities as demanded by the level of use at piers and harbours.

Public consultations are ongoing through direct contact from the public to the Executive and through Elected Representatives.

Said stakeholders assist the Council on an ongoing basis to manage these port reception facilities by reporting on issues arising with respect to said reception facilities (as no Council presence at most of the sites).

Following the consultations and assessment process, the Council has identified a requirement for the following types of waste reception facilities at the following piers/harbours :

1. Greencastle Harbour Greencastle Harbour is the largest harbour in Donegal under the control of Donegal County Council. It is a major fishing port and a base for The Foyle Pilot Boat. There is a seasonal Car Ferry operating from here to Magilligan in Northern Ireland. There are 57 boats based at Greencastle Harbour. It has been determined that there is a need for waste reception facilities for food waste, general waste, metal recycling, net and plastics recycling, commercial fishing waste including damaged ropes and equipment, waste oil, used oil filters/fuel filters and general recycling materials.

2. Carrickarory Carrickarory is used by a small number of fishing boats and seasonal leisure craft. It has been determined that there is a need for waste reception facilities for food waste and general waste.

3. Glengad Glengad is used by shellfish fishing boats, some pleasure craft (domestic) and small boats. It has been determined that there is a need for waste reception facilities for food waste, general waste, commercial fishing waste including damaged nets, ropes and equipment, waste oil and used oil filters/fuel filters.

4. Buncrana Buncrana is used by a small number of fishing boats, the RNLI lifeboat and seasonal leisure craft. A seasonal Car Ferry service operates from this port to Rathmullan. It has been determined that there is a need for waste reception facilities for food waste and general waste.

5. Rathmullan Rathmullan is used by commercial fishing boats. There is a small marina and a seasonal Car Ferry operates from the port to Buncrana. It has been determined that there is a need for waste reception facilities for food waste and general waste. The management of the Marina, which is privately operated, provides a waste disposal service for users of said Marina.

6. Downings Downings is used by crab fishing boats, pleasure craft (domestic) and small boats. It has been determined that there is a need for waste reception facilities for food waste and general waste.

7. Malin Head Malin Head is used by shellfish fishing boats, some pleasure craft (domestic) and small boats. It has been determined that there is a need for waste reception facilities for for food waste, general waste and commercial fishing waste including damaged nets, ropes and equipment.

8. Bunagee Bunagee is used by shellfish fishing boats, pleasure craft, charters and small boats. It has been determined that there is a need for waste reception facilities for food waste and general waste.

9. Bunbeg Bunbeg is used by fishing boats and seasonal leisure craft. A passenger only Ferry service operates from this port to on occasion (in exceptional weather conditions when said Ferry can not operate from its normal base in Magheraroarty. It has been determined that there is a need for waste reception facilities for food waste and general waste.

10. Burtonport Burtonport is used by fishing boats and seasonal leisure craft. A regular Car Ferry service operates from this port to Aranmore Island. It has been determined that there is a need for waste reception facilities for food waste and general waste.

11. Magheraroarty Magheraroarty is used by fishing boats and seasonal leisure craft. A regular passenger only Ferry service operates from this port to Tory Island. It has been determined that there is a need for waste reception facilities for food waste and general waste.

12. Teelin Teelin is used by fishing boats, seasonal leisure craft and charters. It has been determined that there is a need for waste reception facilities for food waste and general waste.

13. Donegal Town Donegal Town is used by the Donegal Bay Water Bus, fishing boats and seasonal leisure craft. It has been determined that there is a need for waste reception facilities for food waste and general waste.

Capacity of the PRF

Level of Service Donegal County Council provides a service to its customers and pier/harbour users in relation to waste management at a selected number of piers/harbours around its shore. The Council does not provide a waste collection service from individual boats/vessels. Instead it provides facilities at the identified piers/harbours as herein referred to, to which its customers may deposit specific waste types in recepticles. The Council then arranges for the collection of said waste by appropriately licenced waste contractors to dispose of or recycle said waste in accordance with EU legislation and waste disposal regulations.

Waste/cargo residue handled by third parties There are no arrangements with third parties to handle waste/cargo residue or to provide a waste service on behalf of the Local Authority at any of the 13 piers/harbours identified in the Donegal County Council Waste Reception Plan 2018-2021. It is noted that the Rathmullen Marina which is privately owned and operated, provides its own waste management arrangements. The Council, in delivering its waste reception plan, relies on assistance from local fishing community groups and individuals at a number of pier/harbour locations (Glengad, Buncrana, Rathmullen, Malin Head, Bonagee, Bunbeg and Donegal Town) to identify when collection services are required or when additional collection services are required due to an increase in normal / expected use.

Waste/cargo residue which cannot be received at the pier/harbour  The waste/cargo residue which cannot be received at each of the 13 piers/harbours as per identified herein is any waste or cargo residue not referred to under the various pier/harbour need assessment.  There is no demand for cargo residue reception in the Donegal County Council jurisdication.

 There are no onsite facilities to handle sewage at any of the identified pier/harbour facilities. However, to assist boat owners/masters of vessels, details are included in this plan in Appendix D for local licenced waste management contractors available for direct hire.

Pre-treatment equipment/processes Donegal County Council has no pre-treatment equipment at any of the 13 piers/harbours identified herein. The Council does provide a pre-treatment of waste process through the provision of recycling facilities and the subsequent collection of same by approved waste collectors.

Delivery and Disposal of Waste

Type/Capacity of Waste Facilites & Procedures for Reception/Collection of Waste

Food Waste Procedure for reception of food waste – Boat owner/master of vessel shall arrange for food waste from the vessel to be transferred to the allocated food waste bin provided on site in a manner that avoids any spillage or contamination of the pier/harbour itself. Procedure for collection of food waste – The Local Authority shall procure an appropriately licenced waste contractor to collect said waste from site on a scheluded basis and dispose of same in accordance with their waste permit and associated waste disposal regulations.

General Waste Procedure for reception of general waste – Boat owner/master of vessel shall arrange for general waste from the vessel to be transferred to the allocated general waste skip or wheel bin provided on site in a manner that avoids any spillage or contamination of the pier/harbour itself. Procedure for collection of food waste – The Local Authority shall procure an appropriately licenced waste contractor to collect said waste from site on a scheluded basis and dispose of same in accordance with their waste permit and associated waste disposal regulations.

Waste Oil Procedure for reception of waste oil – Boat owner/master of vessel shall arrange for waste oil from the vessel to be transferred to the allocated waste oil tank provided on site in a manner that avoids any spillage or contamination of the pier/harbour itself. This service is limited to Greencastle and Glengad.

Procedure for collection of waste oil – The Local Authority shall procure an appropriately licenced waste contractor to collect said waste from site on a scheluded basis and dispose of same in accordance with their waste permit and associated waste disposal regulations.

Used Oil filters/fuel filters Procedure for reception of used oil filter/fuel filter – Boat owner/master of vessel shall arrange for the used oil/fuel filters from the vessel to be transferred to the allocated waste bin provided on site in a manner that avoids any spillage or contamination of the pier/harbour itself. These materials must be handled with care. This service is limited to Greencastle and Glengad. Procedure for collection of used oil filter/fuel filter – The Local Authority shall procure an appropriately licenced waste contractor to collect said waste from site on a scheluded basis and dispose of same in accordance with their waste permit and associated waste disposal regulations.

Commercial fishing waste Procedure for reception of commercial fishing waste – Boat owner/master of vessel shall arrange for commercial fishing waste from the vessel to be transferred to the allocated waste skip provided on site in a manner that avoids any spillage or contamination of the pier/harbour itself. This service is limited to Greencastle, Glengad and Malin Head. Procedure for collection of commercial fishing waste – The Local Authority shall procure an appropriately licenced waste contractor to collect said waste from site on a scheluded basis and dispose of same in accordance with their waste permit and associated waste disposal regulations.

Recyclable Waste Procedure for reception of recyclable waste/materials – Boat owner/master of vessel shall arrange for recyclable from the vessel to be transferred to the allocated recycling facilities provided on site in a manner that avoids any spillage or contamination of the pier/harbour itself. This service is limited to Greencastle and Burtonport. Procedure for collection of recyclable waste – The Local Authority shall procure an appropriately licenced waste contractor to collect said waste from site on a scheluded basis and dispose of same in accordance with their waste permit and associated waste disposal regulations.

Type and Capacity of waste handled at the identified piers/harbours

Donegal County Council manages the collection of waste from the receptacles provided at the identified piers/harbours. A tender process is undertaken and appropriate licensed

waste collectors are engaged on an annual basis to undertake the service. The procedure for collection (procured licensed waste collector, collection schedule and associated facility) is detailed in Appendix E.

Greencastle The waste facilities are on the far side of the harbour and known to all the harbour users. All facilities are clearly marked and are unlocked. There is a sign in the harbour stating who can use the facilities. The facilities are emptied as per table above and receipts are

given to the Harbour Master stating how much waste was collected. The Car Ferry lands at a dedicated slipway in the harbour. There is a standard size wheelie bin on board the vessel and one on the slipway. These bins are brought to the waste facilities by the ferryman and emptied twice weekly. Donegal County Council provides additional facilities at this harbour for the disposal of used oil/fuel filters.

Greencastle Harbour Facilities

Glengad Donegal County Council has in place an agreement with Malin Head Co-Op for the management of waste facilities at Glengad Pier. Buncrana Donegal County Council has in place an agreement with the RNLI for the management of waste facilities at Buncrana. Rathmullan Donegal County Council has in place an agreement with a local user group for the management of waste facilities at Rathmullan. Malin Head Donegal County Council has in place an agreement with Malin Head Co-Op for the management of waste facilities at Malin Head Pier. Bunagee A marina type facility has been installed at Bunagee Pier. An agreement is in place with a local action group for the management of waste facilities at Bunagee Pier.

Bunbeg Donegal County Council has in place an agreement with the harbour users for the management of waste facilities at Bunbeg Pier. Burtonport There are also recycling facilities for bottles and clothes, these facilities are visible on approaching the harbour and are emptied by the County Council, as required. Burtonport harbour is advertised in the yacht manual and gives details of the Harbour Master’s contact details. When a yacht wants to come into the harbour, the owner contacts the Harbour Master either by phone or VHF CH 16 or 12 or by calling into his office in the harbour. The Harbour Master directs the vessels to the waste facilities, which are in a locked compound that is opened every morning. The fishing vessel owners are all local users and are aware of the waste facilities location. Donegal Donegal Bay Water Bus manages waste facilities at Donegal Town.

Notification and Reporting

Notification requirements prior to vessesls arrival at Port

There are no notification requirements prior to vessels arrival at Port other than for visiting yachts who can contact the Harbour Master to arrange for assess to waste receptacles. The contact details for the Donegal County Council Harbour Masters are advertised in nautical literature.

Procedures for reporting alleged inadequacies of port reception facilities

Complaints are made initially to the Environment Enforcement Officer, who supplies an IMO grievance form in Appendix F for completion by the complainant.

If the grievance cannot be solved using the grievance procedure, the IMO completed form will be sent to the Maritime Transport Division in the Department of Transport.

Donegal County Council will provide skips on request to facilitate waste disposal at any port under their control. These skips are normally provided free of charge to interested parties to facilitate regular cleaning of harbour areas.

Charging System

The Cost Recovery System is set in place via the Byelaws for the regulation of certain Harbours in cited as the “Donegal County Council (Certain Harbours) Byelaws 2010” came into effect on 1st September 2010. The Byelaws impose a blanket charge for the disposal of ship generated waste as detailed in this plan under “Charging System”.

Copies of the byelaws are available on request from the Council’s Piers & Harbours Section or may be downloaded from its website. The current waste reception charges [Extracted from Donegal County Council (Certain Harbours) Byelaws 2010] for the harbours included in this plan are as follows:

Disposal of ship generated waste (mandatory Less than 10 GT €10 per month on all vessels operating from the harbour) 10 or more GT €20 per month 20 or more GT €30 per month 30 or more GT €60 per month 100 or more GT €100 per month

Cost Recovery System

The Cost Recovery System should in accordance with the current regulations, include for a method of charging an indirect fee for the use of the PRF irrespective of whether the PRF are used. An explanation of how the indirect fee should be calculated so it covers/exceeds 30% or the cost of providing the service. An explanation of any differentiation in charges by size or type of ship should be given and a clear explanation of what is covered in the indirect fee should be set out.

Currently the Donegal County Council byelaws fees are insuffienct in value and/or volume do enable same to cover 30% of the cost of providing the service. A review of said byelaws will be required to address the fee values such that same when calculated equates to at least 30% of the cost of providing the services. It is proposed to commence the aforementioned byelaws review in 2019.

Direct charges levied by external contractors

There are no direct charges levied by external contractors and so no information can be provided on any such charges for delivering waste not covered by the indirect fee.

Payment process for waste reception charges

Charges for the disposal of ship generated waste is currently being collected at the following ports by the Council’s Harbour Masters:  Greencastle  Burtonport The collection of harbour dues (including charges for the disposal of ship generated waste) is undertaken through the issue of an annual invoice. The Harbour Masters identify the larger vessels at the aforementioned ports/harbours. The administration issues an invoice for the appropriate charges to same. Payment can be made in a variety of ways as outlined in the information letter issued to the ship owners, and where payment is not forthcoming, the Council’s income collection team follow up with the owner. It is noted here that only larger vessels are charged as, following assessment, it was considered that the smaller vessels do not generate sufficient waste to warrant charging.

Record Keeping

Records on the amounts of waste and cargo residues received are recorded and submitted on Waste Reception Plan Report Form annually. Information on same is recorded by the Harbour Masters throughout the year. Records are kept at the Harbour Masters offices and are retained for a minimum of 3 years.

Receipts are issued for waste collected and disposed of.

Due to the nature of the fleets and low volumes of waste collected for disposal, charges are only legislated for at the larger ports/harbours. With the introduction in 2018 of the annual charging invoice system, it is considered that there is potential to increase the number of locations where the waste reception plan could be extended to. This will be considered as part of the Byelaws review due to commence during 2019.

Public Consultation

The Port Reception Plan 2018-2021 will be advertised for a 4 week period commencing in September 2018 for consideration by the public and to facilitate submissions in relation to the proposed plan. Any observations submitted will be considered.
