Of said sum, $3,283 is from the general fund, $442 5 is from the old age pension fund created in section 1 of article XXIV of 6 the state constitution, $4,697 is from reappropriated funds received from 7 the department of health care policy and financing out of the 8 appropriation made in subsection (3) of this section, and $5,342 is from 9 federal funds. 10 (3) In addition to any other appropriation, there is hereby 11 appropriated, to the department of health care policy and financing, for 12 the fiscal year beginning July 1, 2014, the sum of $4,697, or so much 13 thereof as may be necessary, for allocation to department of human 14 services medicaid-funded programs, office of information technology 15 services-medicaid funding, Colorado benefits management system, for 16 system modifications related to the implementation of this act. Of said 17 sum, $2,301 is from the general fund, $12 is from the old age pension 18 health and medical care fund pursuant to section 7 (c) of article XXIV of 19 the state constitution, $29 is from the children's basic health plan trust 20 fund created in section 25.5-8-105 (1), Colorado Revised Statutes, and 21 $2,355 is from federal funds. 22 (4) In addition to any other appropriation, there is hereby 23 appropriated to the governor - lieutenant governor - state planning and 24 budgeting, for the fiscal year beginning July 1, 2014, the sum of $13,764, 25 or so much thereof as may be necessary, for allocation to the office of 26 information technology for the provision of services to the department of 27 human services related to the implementation of this act. (2) In addition to any other appropriation, there is hereby 1 appropriated, out of any moneys in the general fund, not otherwise 2 appropriated, to the department of revenue, for the fiscal year beginning 3 July 1, 2014, the sum of $177,129 and 0.5 FTE, or so much thereof as 4 may be necessary, to be allocated to the taxation business group for the 5 implementation of this act as follows: 6 (a) $20,041 and 0.5 FTE for the taxation and compliance 7 division for personal services; 8 (b) $36,578 for the taxation and compliance division for capital 9 outlay and operating expenses; and 10 (c) $120,510 for CITA annual maintenance and support. 11 (3) In addition to any other appropriation, there is hereby 12 appropriated to the department of personnel, for the fiscal year beginning 13 July 1, 2014, the sum of $31,400, or so much thereof as may be 14 necessary, for allocation to integrated document solutions for the 15 provision of postage, data entry, imaging and printing for the department 16 of revenue related to the implementation of this act. Said sum is from 17 reappropriated funds received from the department of revenue out of the 18 appropriation made in paragraph (b) of subsection (2) of this section. 19 (4) In addition to any other appropriation, there is hereby 20 appropriated, out of any moneys in the general fund not otherwise 21 appropriated, to the department of revenue, for the fiscal year beginning 22 July 1, 2014, the sum of $2,356,965, or so much thereof as may be 23 necessary, for allocation to the taxation business group for old age heat 24 and fuel and property tax assistance grants pursuant to section 39-31-102 25 (1), Colorado Revised Statutes. 26 (5) In addition to any other appropriation, there is hereby 27 appropriated, to the department of health care policy and financing, for 28 the fiscal year beginning July 1, 2014, the sum of $1,397, or so much 29 thereof as may be necessary, for allocation to department of human 30 services medicaid-funded programs for Colorado benefits management 31 system related to the implementation of this act. Of said sum, $684 is 32 from the general fund, $9 is from the children’s basic health plan trust 33 created in section 25.5-8-105 (1), Colorado Revised Statutes, $4 is from 34 the old age pension health and medical care fund created in section 7 (c) 35 of article XXIV of the state constitution, and $700 is from federal funds. 36 (6) In addition to any other appropriation, there is hereby 37 appropriated, to the department of human services, for the fiscal year 38 beginning July 1, 2014, the sum of $4,092, or so much thereof as may be 39 necessary, for allocation to the office of information technology services, 40 Colorado benefits management system for Colorado benefits 41 management system, operating expenses related to the implementation of 42 this act. Of said sum, $976 is from the general fund, $131 is from the old 43 age pension fund created in section 1 of article XXIV of the state 44 constitution, $1,397 is from reappropriated funds received from the 45 department of health care policy and financing out of the appropriation 46 made in subsection (5) of this section, and $1,588 is from federal funds. 47 (7) In addition to any other appropriation, there is hereby 48 appropriated to the governor - lieutenant governor - state planning and 49 budgeting, for the fiscal year beginning July 1, 2014, the sum of $4,092, 50 or so much thereof as may be necessary, for allocation to the office of 51 information technology, for the provision of computer center services for 52 the department of human services related to the implementation of this 53 act. It is, therefore, the intent of the general assembly to 37 encourage these activities by limiting the civil liability of certain persons 38 involved in providing the opportunity to participate in these activities. 39 (2) As used in this section, unless the context otherwise requires: 40 (a) "Activity instructor or equipment provider" means an 41 individual, facility person, group, club, association, partnership, or 42 corporation, whether or not engaged for compensation, that instructs a 43 participant or that rents, sells, or otherwise provides equipment to a 44 participant for the purpose of engaging in an agricultural recreation OR 45 AGRITOURISM activity. 46 (b) "Agricultural recreation OR AGRITOURISM activity" means an 47 activity related to the normal course of agriculture, as defined in section 48 35-1-102 (1), C.R.S., which activity is engaged in by participants for 49 entertainment, pleasure, or other recreational purposes, or for educational 50 purposes, regardless of whether a fee is charged to the participants. 51 "Agricultural recreation OR AGRITOURISM activity" also means hunting, 52 shooting, swimming, diving, tubing, and riding or operating a motorized 53 recreational vehicle that occurs on or in proximity to the property of an 54 agricultural operation or an adjacent roadway. "Agricultural recreation 55 OR AGRITOURISM activity" includes, but is not limited to planting, 56 cultivation, irrigation, or harvesting of crops; acceptable practices of 57 animal husbandry; rodeo and livestock activities; and maintenance of 58 farm or ranch equipment. "AGRICULTURAL RECREATION OR AGRITOURISM 59 ACTIVITY" DOES NOT INCLUDE ANY ACTIVITY RELATED TO OR ASSOCIATED 60 WITH MEDICAL MARIJUANA AS DEFINED IN SECTION 12-43.3-104, C.R.S., 61 OR RETAIL MARIJUANA AS DEFINED IN SECTION12-43.4-103, C.R.S. 62 (c) "Equipment" means a device used to engage in an agricultural 63 recreation OR AGRITOURISM activity. 64 (d) "Facility" means a privately owned and operated farm, ranch, 65 or a public property that is leased or rented and under the control of the 66 person defined in paragraph (e) of this subsection (2) on which the 67 Page 790 Senate Journal-99th Day-April 16, 2014

opportunity to engage in one or more agricultural recreation OR 1 AGRITOURISM activities is offered to a participant, regardless of whether 2 it is situated in an incorporated area or unincorporated area. 3 (e) "Facility person" means a person who owns, leases, operates, 4 manages, IS AN INDEPENDENT CONTRACTOR TO, or is employed at or who 5 volunteers at a facility. For purposes of this paragraph (e) only, "person" 6 includes any individual, corporation, partnership, association, 7 cooperative, or commercial entity. 8 (f) "Inherent risks of agricultural recreation OR AGRITOURISM 9 activities" means those dangers or conditions that are an integral part of 10 such activities, including but not limited to: 11 (I) The varied degrees of the skill and experience of the 12 participants; 13 (II) The nature of the activity, including but not limited to the 14 equipment used and the location where the activity is conducted; 15 (III) Certain hazards, such as ground conditions, surface grade, 16 weather conditions, and animal behavior; 17 (IV) Collisions with other persons or objects; 18 (V) The types and the complexity of equipment used by the 19 participants; 20 (VI) Malfunctions with equipment used by the participants; 21 (VII) The potential of a participant to act in a negligent manner 22 that may contribute to injury incurred by the participant or others, such 23 as imprudent showmanship, failing to maintain control over his or her 24 equipment, or not acting within his or her ability. 25 (g) "Participant" means a person who engages in an agricultural 26 recreation OR AGRITOURISM activity, whether or not a fee is paid to 27 participate in the activity. 28 (3) Except as provided in subsections (4) and (5) of this section, 29 an activity instructor or equipment provider or facility person shall not be 30 IS NOT civilly liable for an ANY PROPERTY DAMAGE OR DAMAGES FOR 31 injury to or the death of a participant resulting from the inherent risks of 32 agricultural recreation OR AGRITOURISM activities performed or 33 conducted on or in a facility. A PARTICIPANT EXPRESSLY ASSUMES THE 34 RISK AND LEGAL RESPONSIBILITY FOR ANY PROPERTY DAMAGE OR 35 DAMAGES ARISING FROM PERSONAL INJURY OR DEATH THAT RESULTS 36 FROM THE INHERENT RISK OF AGRICULTURAL RECREATION OR 37 AGRITOURISM ACTIVITIES. A PARTICIPANT HAS THE SOLE RESPONSIBILITY 38 FOR KNOWING THE RANGE OF THAT PERSON'S ABILITY TO PARTICIPATE IN 39 AN AGRICULTURAL RECREATION OR AGRITOURISM ACTIVITY. IT IS THE 40 DUTY OF A PARTICIPANT TO ACT WITHIN THE LIMITS OF THE PARTICIPANT'S 41 OWN ABILITY, TO HEED ALL WARNINGS, AND TO REFRAIN FROM ACTING IN 42 A MANNER THAT MAY CAUSE OR CONTRIBUTE TO THE INJURY OR DEATH 43 OF ANY PERSON OR DAMAGE TO ANY PROPERTY. A participant or a 44 participant's representative may not make any claim against, maintain an 45 action against, or recover from an activity instructor or equipment 46 provider or facility person for injury, loss, damage, or death of the 47 participant resulting from any of the inherent risks of agricultural 48 recreation OR AGRITOURISM activities performed or conducted on or in a 49 facility. 50 (4) (a) Nothing in subsection (3) of this section shall prevent or 51 limit the liability of an activity instructor or equipment provider or 52 facility person if the activity instructor or equipment provider or facility 53 person: 54 (I) Rented, sold, or otherwise provided equipment to a participant, 55 and knew that the equipment was faulty, and such equipment was faulty 56 to the extent that it caused the injury; 57 (II) Committed an act or omission that constituted gross 58 negligence or willful or wanton disregard for the safety of the participant, 59 and the act or omission was the cause of the injury; or 60 (III) Intentionally injured the participant. 61 (b) Nothing in subsection (3) of this section shall prevent or limit 62 the liability of an activity instructor or equipment provider or facility 63 person under liability provisions set forth in the product liability laws. 64 (c) A participant is not precluded under this section from suing 65 and recovering from another participant for injury to person or property 66 resulting from the other participant's act or omission.
