REALTORS® LEGISLATI E SCORECARD 2018 SESSION SCR LOBBY TEAM

On May 10, 2018, the South Carolina Legislature adjourned Sine Die, marking the end of the second regular session of the 122nd General Assembly. However, the work of the General Assembly did not stop there.

Per the Sine Die resolution, both bodies returned to Columbia at the end of June to continue their work on the state budget, state tax conformity, and V.C. Summer related legislation. The 2018 session brought about many challenges as most of the time spent conducting business was consumed with debate regarding the state’s energy future as it relates to the failure of the V.C. Summer Nuclear Project.

SCR made a responsive effort to ensure SCR's priorities were not lost in the energy turmoil. Even with the uncertain political climate, 2018 was one of the SCR’s best legislative sessions ever! SCR, with the help of key supporters in both the House and Senate, ensured that our priority issues remained at the forefront of lawmakers’ agendas.

I am extremely pleased to announce that the General Assembly recognized and took action on ALL of SCR's top 2018 REALTOR® legislative priorities this session including:

H.4683 (Act #173 of 2018)- Beachfront Management Reform Act H.3886 (Act # 245 of 2018)- Homeowners Association Reform S.1101 (Act #156 of 2018)- Prohibition of Eminent Domain for Petroleum Pipeline Companies

2. LEGISLATIVE PRIORITIES

Beachfront Management Reform Act H.4683 In October 2017, the Department of Health and Environmental Control (DHEC) released proposed changes to the beachfront lines of jurisdiction (the baseline and the setback line). The changes proposed would dramatically and in many cases, negatively impact coastal properties. The lack of adequate, raw data, a compressed timeline, and the ACT 173 setting of a permanent baseline position at a future date put South Carolina's coastal property owners at a huge disadvantage.

Senator Chip Campsen and Representative filed legislation in their respective bodies to provide a transparent process in the establishment of new jurisdictional lines and to establish parameters for the review and appeals process for property owners who may be adversely affected by changes.

The legislation also requires adequate notice to the public on and prior to beginning new establishment cycles and provides parameters on when data can be collected for accuracy.

Homeowner's Association Reform

Issues and disputes regarding HOAs are an ongoing issue for REALTOR® membership and the real estate industry as a H.3886 whole. H.3886, the SC Homeowners Association Act, is an important first step in providing uniformity, transparency, and relief for homeowners across the state. The bill implements consistent guidelines that encourage good governance ACT 245 among HOAs and protect homeowners’ interests.

The legislation passed the House in the 2017 session and was amended by the Senate and passed in the 2018 session. The legislation requires the recording of governing documents, provides the ability to resolve financial disputes between homeowners and HOAs in magistrate court, requires HOAs to provide notice to homeowners at least 48 hours in advance of any increase in the annual budget in any single year, and provides that the Department of Consumer Affairs shall receive and record data from any calls or written complaints and provide an annual report to the General Assembly from the data collected.

Private For-Profit Pipeline Companies

In 2016, SCR championed legislation that would prohibit private, unregulated, petroleum pipeline companies from S.1101 exercising eminent domain powers. The legislation clarified a gray area in existing South Carolina law and provided for a three-year moratorium, halting petroleum pipelines from using eminent domain to take the land and homes of ACT 205 South Carolina citizens.

In the 2018 session, Senators Young, Massey, and Hutto and Representative Hixon introduced legislation in their respective bodies to extend the moratorium. The continuing legislation would keep the ban intact, allowing lawmakers an additional 2-year session to work on a more comprehensive approach to a permanent ban.
