Q. Are any sums payable by the purchaser from its return?

•How can the purchaser verify its return?

The Rooms Revenue will be reviewed and verified by an external auditor by end of every operational year. Audited copy of Gross Room Revenue and the return distribution shall be shared with the owner.

Q.What is the period of the rental pool?

Q. What is the time period that the purchaser will receive the return/share?

Returns will be received on a quarterly/ annual basis.

Q.Does the Purchaser have a say on the management of the hotel apartments?

The purchaser shall not interfere in the management of the project or its unit, as the return is based on the rooms revenue, unaffected by the management costs and expenses.

Q. Can the purchaser live/ reside in the unit?

Yes, but a limited stay. In the first two years, 10 days during the high season (Nov – April) or 20 days during the low season (the remaining months), and thereafter a standard 14 day period each year.

If the privileged stay period (PSP) is not used the unit will be operated as part of the active rental pool and the Purchaser will receive compensation for the unused days. The seasonality (high and low) will be defined by the operator on a yearly basis during the budget submission period.

Q. What will happen if the hotel operator fails to secure a reasonable profit for the units’ owners?

Deyaar has agreed with the hotel operator to specific performance tests, which if not met for two consecutive operational years Deyaar may replace the operator.

Q. Can the purchaser finance the hotel apartment?

Yes, a hotel apartment in the rental pool can be financed by banks just as any other residential units after a certain completion threshold.

Q. If the hotel apartments are making a loss or in case of adverse market conditions, is the Purchaser required to contribute towards the loss?

No, a Purchaser will not be required to bear any loss as the Purchaser’s return is unaffected by costs and expenses of the hotel. However, Deyaar or the Operator may terminate the rental pool program and Deyaar will then return the unit to the Purchaser.

Q. Can the Purchaser sell his/her unit while it is in the rental pool?

Yes, the new owner of the unit will have to enter in the similar SPA and RPA – and will be treated alike to the original purchaser. A sale, however can only take place after at least 30% of the unit purchase price is paid to Deyaar as part of the off-plan payment plan.

Q. Can the Purchaser exit the Rental Pool?

Yes, subject to payment of compensation for loss of revenue to both Deyaar and the hotel operator at the rate of AED 70 per square foot of the unit area.

Q. Will Purchaser be charged service charges?

No, since they are covered from the 60% of the gross rooms revenue retained by Deyaar, and therefore will not be charged to the purchaser. However if the purchaser exits the rental pool, then service charges become payable directly by the purchaser.
