Introduction The purpose of this report is to set out the way 1866-1900 Crown purchase data filed in July 2012 (Wai 1040, #1.3.2c) have been validated. Essentially this report follows the terms of the 25 February 2016 Waitangi Tribunal research commission (Wai 1040, #2.3.42). The Tribunal commissioned a report ‘to produce data which: a) Completes essential Crown purchase information; b) Records the name and acreage of Native reserves within each purchase; and c) Identifies and comments on the sources of information where appropriate’. This brief report addresses those three commission components. It concludes with a discussion of what can be meaningfully quantified from the attached sheets summarising 1866-1900 Te Raki Crown purchases and Native reserves.

Essential Crown purchase information

Nineteenth century Crown officials recorded the most essential purchase information as given in the original deeds. The attached purchase sheet follows the numerical sequence of the deeds held at Archives New Zealand in Wellington (ABWN 8102, W5279). Column A, entitled ‘AUC DEED REF’ [‘Auckland Crown purchase deed references’], provides the most essential source information for the main purchase sheet. Like the 2012 Crown sheet, the main sheet follows an alphabetical listing. Unlike the main Crown purchase sheet here, the 2012 Crown sheet followed Native Land Court ‘block’ names as its primary organisational framework. It records Crown purchases only as a secondary listing.

Column B ‘TRANSACTION NAME’ generally follows the name stated on the cover sheet of each deed. The equivalent information in the 2012 Crown sheet appears as a Native Land Court ‘Block Name’, if the block was the subject of a Crown purchase. Column C ‘LOCALITY’ provides much more specific geographic information to assist the reader than the ‘Hearing District’ information provided by the Crown in 2012. Column D ‘SUBREGION’ provides the closest equivalent to the Crown’s 2012 ‘Hearing District’ column.

Column F ‘ACREAGE’ presents the best documented figures, largely based on deed plans, additional survey plans, and on gazette notices. Column I ‘PLANS’ records essential plan

information (missing from the Crown’s sheet). Additional survey plans are indicated with their usual alphanumeric descriptors (eg. ML4321; SO12193).

Column H records ‘PRICE’ information from the original deeds. The Crown did not include price information in its 2012 sheet. No price per acre calculations has been attempted, because the circumstances of different purchases varied so widely.

Native reserves

Column J: ‘NATIVE RESERVES’, which has no equivalent in the 2012 Crown sheet, is supported by an additional Native reserves sheet recording detailed information (labelled AUCKNRs). That information includes the originating Crown purchase, the deed reference, the name of the reserve, and the surveyed acreage. Additional source information is provided in a dedicated Native reserves comments column.

The Native reserves sheet records that the Crown created 27 Native reserves amounting to 5,578 acres between 1866 and 1900. This compares to the 57 Native reserves amounting to almost 14,000 acres created in Crown purchases before 1866.

The remarks columns in both the main purchase and supporting reserves sheets identify areas subsequently Crown purchased. This includes Pipiwharauroa (AUC 1751), Ngatahuna (AUC 869), Maroparea (AUC 1205), Te Karu (AUC 960) and Waimahutahuta (AUC 961). In addition, the remarks column in the main sheet shows three cases of the Crown purchase of Native reserves arising from the pre-1865 period. They are Kopuawaiwaha (AUC 2030), Ngamahanga (AUC 1872), Te Totara (AUC 1421) and Pokapu (AUC 2036).

Source information

The Crown purchase deeds with their associated plans and supporting surveys remain the basic sources for this validation report. In cases where the original deeds are missing (eg Kauaeoruruwahine 1-3 and Otangaroa 1-4), it has been necessary to rely upon Turton’s copies. Gazette notices provided essential sources of acreage information. After 1874 the Crown began what amounted to a series of part-purchases, and the deeds often failed to record acreage accurately. Part-purchases can be identified in the main sheet by a numerical, or

alpha-numerical, suffix in Column B ‘Transaction Name’ (eg. Aukumeroa 1-2, Horahora 2A and Ketetangaiki B1).

Maori opposed to wholesale alienation, usually described as ‘non-sellers’, compelled the Crown to purchase only part of an area to which the Native Land Court had determined title. The Crown often recorded the full ‘block’ acreage in the deed, but it had to agree to partition ‘non-seller’ interests out of the eventual purchase. The Crown then published the effective purchase acreage in the New Zealand Gazette.

Survey plans usually confirm the reliability of the gazetted acreage, as opposed to that contained in the deed. For instance, the 1895 Horahora 2 deed (AUC 2027B) records the purchase of 1336 acres. That is the full area of Horahora 2. ‘Non-sellers’, however, retained the 859 acres that became Horahora 2B. The Crown succeeded in purchasing the remaining 477 acres as Horahora 2A (as verified in New Zealand Gazette 1897, p 1747).

AJHR returns, particularly for the period prior to 1884, record the name of the Crown purchase agent responsible for each transaction. These returns also provide information about incidental payments over and above the purchase price. This has allowed the identification of Edwin Torrens Brissenden as the primary negotiator of some 58 purchases during 1875-1876. It also allows us to see a pattern of incidental payments associated with these Brissenden purchases. Further analysis of Brissenden’s purchases follows under Quantification.

Quantification

The main sheet (AUCKCPI) records that the Crown completed 231 purchases between 1866 and 1900, amounting to 615,079.5 acres. Just as with the pre-1865 Crown purchases, a number of these purchases straddled the northern boundary with the Muriwhenua inquiry area. The Muriwhenua acreage of these straddling purchases comes to approximately 26,372 acres. Deducting this Muriwhenua acreage from that purchased within the Te Raki inquiry area leaves an adjusted figure of 588,707.5 acres.

This overall deduction is recorded at the conclusion of the main sheet. The specific percentage deductions for the straddling Takahue 1-2, Te Awaroa 1A1 and the Unuhia

3 purchases are also recorded in the remarks column of the main sheet, and they are illustrated in Map 1: Te Paparahi o Te Raki Northern Boundary.

The 2012 Crown sheet records approximately 68 percent of the 231 purchases recorded here. Purchases missing from the Crown sheet are indicated with ‘missing’ in Column G ‘Crown NLC sheet 2012’. The Crown also unhelpfully recorded the purchased area in hectares, rather than in acres. It also grouped purchases in decades, rather than recording precise purchase dates. Finally, it failed to add up hectares purchased by decade. This has prevented a direct comparison of Crown and validated purchase figures.

The prevalence of 1875-1876 purchases constitutes the most striking feature in the purchase pattern between 1866 and 1900. According to the adjusted figures in the main sheet, the Crown acquired 294,735 acres (or approximately 50 percent of the adjusted total for 1866- 1900) during 1875-1876. Brissenden negotiated purchases totalling 231,552 acres (or 78.5 percent) during these two remarkable years.

The incidental payments associated with Brissenden purchases far exceed those associated with other purchases recorded between 1872 and 1883. His incidental payments for 1875- 1876 averaged £113/8/- per purchase. These incidental payments amounted to about 33 percent of the purchase prices Brissenden negotiated in 1875-1876. By contrast, incidental payments associated with other purchases up until 1883 averaged £51/8/- per purchase, which amounted to about 7 percent of the purchase price.

The remarks column contains significant vendor information. Sole vendors appear, for example, among the Brissenden purchases. He negotiated five purchases in the Mangakahia area with Kamariera Te Wharepapa signing as the sole vendor on 1 and 4 February 1876. On these two days Te Wharepapa alone signed the Kairara (AUC 867), Opouteke (AUC 882), Oue (AUC 873), Pekepekerau (AUC 866) and Waerekahakaha (AUC 865) deeds. These five purchases transferred nearly 80,000 acres to the Crown, for which it paid the sole vendor a total of £6,607 (see Map 2: Brissenden’s Mangakahia purchases, February 1876).

Since Brissenden’s purchases feature so prominently in the attached main sheet, it is worth noting that Native Minister McLean felt compelled to dismiss him before their completion. A parliamentary inquiry reported on 11 October 1875 by the Tairua Investigation Committee 4

uncovered the controversial nature of many of Brissenden’s Te Raki purchases. During the 26 August 1875 committee hearing chaired by Sir George Grey, and in answer to McLean’s questioning, Colonel Thomas McDonnell described Brissenden as ‘a scoundrel and a Yankee sharper’.1 Brissenden succeeded in defending himself against multiple accusations by McDonnell, his fellow Crown purchase officer. Yet McLean publicly announced his dismissal of Brissenden within days of the completion of the Tairua report.

Only three days after the appearance of that report, the Member of the House of Representatives for Newton, William Swanson, asked McLean: (1) Whether Mr Brissenden’s land purchases in the North have anything to do with his dismissal from the Government Land Purchase Agency? [and] (2) Whether these purchases have been satisfactory to the Government? McLean ‘replied that Mr Brissenden’s land purchases in the North had nothing to do with his dismissal from the Government Land Purchase Agency’. McLean added: ‘The purchases had been clear and satisfactory, and no difference or dispute had arisen in connection with them’.2

McLean apparently dismissed Brissenden because he failed to account for £800 supposedly deposited in a Pakiri Trust fund. Ironically, McDonnell, his later detractor, initiated the Pakiri purchase in 1872. This allowed McLean to label Pakiri a McDonnell purchase, so that he could say that Brissenden’s dismissal was unrelated to a Brissenden purchase. Nonetheless Brissenden, at a subsequent parliamentary inquiry, made no effort to disassociate himself from the Pakiri purchase.3 In 1876, shortly before his death, McLean agreed that the Crown Pakiri purchase conducted with ‘Trustees . . . [who had] no power to sell’ the land was, by his own admission, ‘illegal’.4

So the Pakiri fiasco brought about Brissenden’s downfall. At the same time, McLean’s highly misleading 14 October 1875 statement to the House of Representatives shielded Brissenden’s 58 Te Raki purchases, amounting to 223,272 acres, from further public scrutiny. Those Brissenden purchases stand out in the attached main sheet like a sore thumb. Furthermore, McLean’s successor as Native Minister, John Sheehan, was able to retrospectively legalise

Many of these 1875-1876 purchases were concentrated in the and Mangakahia areas. This contrasts with the pre-1865 pattern where Crown purchases were concentrated in Whangaroa, Bay of Islands, Whangarei and Mahurangi.

Conclusion

The adjusted 1866-1900 Crown purchase total of 580,427.5 acres exceeds the similarly adjusted pre-1865 Crown purchase total of 522,034 acres. Nothing comparable to the 1875- 1876 surge in Crown purchases occurred prior to 1866. As indicated above, Native reserves figure much more prominently before 1866. The Crown created 57 Native reserves covering almost 14,000 acres before 1866. During the 1866-1900 period, it created only 27 Native reserves covering 5,578 acres.

WAITANGI TRIBUNAL

CONCERNING the Treaty of Waitangi Act 1975

AND the Te Paparahi o Te Raki inquiry

DIRECTION COMMISSIONING RESEARCH

1. Pursuant to clause 5A of the second schedule to the Treaty of Waitangi Act 1975, the Tribunal commissions Dr Barry Rigby, a member of the Tribunal’s staff, to prepare a validation review report on the Crown’s tabulated 1866-1900 Crown purchase data for the Te Paparahi o Te Raki inquiry.

2. The purpose of the review is to test the reliability of the Crown’s 1866-1900 Crown purchase data filed in July 2012 (#1.3.2(c)) and to address any inaccuracies and gaps found. The report is to produce data which:

a) Completes essential Crown purchase information;

b) Records the name and acreage of Native reserves within each purchase, and

c) Identifies and comments on the sources of information, where appropriate.

3. The data should be provided in table format together with a brief analytical report. Where information from primary sources not on the record of inquiry has been consulted, the source material should be filed as supporting documents wherever possible.

4. The commission commenced on 5 January 2016. A complete draft of the report and data will be circulated in electronic file format to the claimants and the Crown for feedback, including on the accuracy of the data.

5. The commission ends on 30 June 2016, at which time the report and data must be submitted for filing in unbound form, together with indexed copies of any supporting documents. An electronic copy of the report and supporting documents should also be provided in PDF file format. The data should be provided in both Excel spreadsheet and PDF formats. The report, the accompanying data and any subsequent evidential material based on it must be filed through the Registrar.

6. The report may be received as evidence and the author may be cross-examined on it.

7. The Registrar is to send copies of this direction to:
