Background

The Natural Environment and Rural Communities (NERC) Act came into force on 1st Oct 2006. Section 40 of the Act requires all public bodies to have regard to biodiversity conservation when carrying out their functions. This is commonly referred to as the ‘Biodiversity duty.’

Each local planning authority should ensure that the Local Plan is based on adequate, up-to-date and relevant evidence about the environmental characteristics and prospects of the area (NPPF 158).

Planning policies and decisions should be based on up-to-date information about the natural environment and other characteristics of the area. Working with Local Nature Partnerships where appropriate, this should include an assessment of existing and potential components of ecological networks (NPPF 165).

Local planning authorities should seek opportunities to achieve each of the economic, social and environmental dimensions of sustainable development, and net gains across all three. Significant adverse impacts on any of these dimensions should be avoided and, wherever possible, alternative options which reduce or eliminate such impacts should be pursued. Where adverse impacts are unavoidable, measures to mitigate the impact should be considered. Where adequate mitigation measures are not possible, compensatory measures may be appropriate (NPPF 152).

Ecological Asset Desktop Appraisal

This desktop appraisal is one of a number prepared by Lancashire Environment Record Network (LERN) for Burnley Borough Council. Arising from the consultation on the Preferred Options Local Plan, this report considers new sites and any existing sites that have been extended in a way that may increase the possibility for impacts on an ecological feature.

The appraisal has investigated the relationship between 15 sites being considered for allocation for development, and information on ecological assets which is held by the LERN. These assets include records of designated sites, protected and priority species, and other environmental assets of significance.

Consideration of such features will help a local planning authority demonstrate that it has fulfilled its requirements in respect of the relevant legislation and guidance such as the NPPF, NERC Act etc.

This report (with accompanying GIS layers) details the information sources checked and whether they are relevant to individual land allocations. The information provided is purely factual and contains no opinions as to the merits or desirability of the allocation of particular sites. It is recommended that appropriate advice is sought in

respect of the implications of the information provided. Such advice is available from specialist environmental consultancies.

Methodology

Allocation locations, preferably as polygons, are provided by the local planning authority. If supplied as individual allocation boundaries then these are compiled into a single layer.

Within ArcMap GIS the allocations are compared spatially to locations of designated sites and known environmental features and records of protected species and other species considered important in a local context including: Species of European Importance, NERC Act S41 species, Lancashire BAP Long List species, Invasive Non-native Species etc. Such species are collectively referred to as Lancashire Key Species (LKS). A definition of LKS appears as Appendix 3.

Where Site Allocations coincide, are adjacent to, or are within a specified distance of, an environmental asset then the layer attribute table is updated to indicate this.

Results

Results are presented in the form of a PDF document with interactive maps and a number of ESRI shapefiles which can be viewed in an appropriate GIS.

Table 1 (below) describes the attributes defined in the primary assessment shapefile. The attribute table for this shapefile is also provided as a MS Excel spreadsheet. Each row in the spreadsheet relates to a single land allocation.

Summary Site Reports including maps of Site Allocations are given in Appendix 1. N.B. Because multiple overlapping environmental features may relate to a single Site Allocation the mapping is presented in the form of interactive PDFs in which the individual map features can be turned on or off to aid clarity and feature attributes can be viewed. Introductory guidance on the use of interactive PDFs is given in Appendix 4.

Site reports and boundary plans for the Biological Heritage Sites in the vicinity of the Site Allocations appear as Appendix 2.

Records for Lancashire Key Species identified by this report are plotted on the site plans and provided as an Excel spreadsheet. To assist interpretation the LKS are mapped according to their 'status' e.g. NERC Act S41; Wildlife and Countryside Act Schedules 1, 5 and 8 etc. It is not uncommon for a single species to have multiple statuses and, as a consequence, the same record may appear multiple times on a single map. The value in the FID and OBSKEY fields can be used to identify the corresponding records in both the PDF maps and the spreadsheet.

Information relating to other datasets identified (e.g. Phase 1 Habitat Survey) can be provided on request to inform subsequent decision-making.

Description: The site comprises an estate with a high proportion of broad-leaved woodland. Scattered parkland trees are also present and some of these are estimated to be over 200 years old. Such trees are a rare and threatened habitat in Lancashire. They include pedunculate and hybrid oaks, beech and ash. The white-letter hairstreak butterfly has been recorded at the site.

In the south of the site The Dean consists of a mature beech plantation with sycamore and pedunculate oak occupying a moderately steep-sloping clough above Dean Brook. Small areas of the wood are dominated by pine and larch. The understorey comprises rhododendron with hazel, hawthorn, holly and rowan. The field layer includes ramsons, opposite-leaved golden-saxifrage, bluebell, enchanter’s-nightshade, wood horsetail, dog’s mercury, wood-sorrel, wood sage and remote sedge. Giant hogweed is present.

In the south-east Fiery Wood comprises broad-leaved and mixed plantation. Sycamore and beech dominate with ash, pedunculate oak, wych elm, rowan and Scot’s pine. There is a patchy understorey of hawthorn and holly and locally dominant rhododendron. Species present in the ground flora include bluebell, wood-sorrel, raspberry, foxglove, red campion, hedge woundwort and broad buckler-fern. A dried-up pond is being encroached by crack willow.

In the north Ox-Hey Wood and Badger Plantation are dominated by beech and/or sycamore with occasional pedunculate and hybrid oaks.

The site provides important habitats for breeding and wintering birds. Breeding birds include grey heron, sparrowhawk, woodcock, curlew, tawny owl, great spotted woodpecker, lesser spotted woodpecker, meadow pipit, pied wagtail, lesser whitethroat, willow warbler and nuthatch. Wintering birds include fieldfare, redwing, brambling and siskin.

Description: The site comprises a complex mosaic of habitats including neutral grassland, acid grassland, modified bog, flushes and scattered scrub and trees. The M65 motorway, the Leeds/Liverpool Canal and the East Lancashire railway line dissect the site.

Neutral grassland is typically dominated by tufted hair-grass. False oat-grass is also abundant, Yorkshire-fog is frequent and cock’s-foot, common bent and common couch are occasional. Tall-herb species such as great willowherb, rosebay willowherb and common nettle are often abundant or locally dominant. Species-rich areas support plants including greater bird’s-foot-trefoil, common bistort, ragged-robin, common knapweed, common spotted-orchid, lesser spearwort, meadow crane’s-bill, meadow vetchling, great burnet, goat’s-beard, zigzag clover and glaucous sedge.

Acid grassland tends to be dominated by wavy hair-grass, with mat-grass co-dominant in places. Tormentil, sheep’s-fescue, creeping soft-grass and common sedge are also present. This dry grassland grades into marshy grassland with the following species: purple moor-grass, soft-rush, sharp-flowered rush, common cottongrass, hare’s-tail cottongrass, marsh thistle, heather and heath-rush.

Small, species-rich flushes are associated with the wetter areas of Pollard Moor in the south of the site. Plants occurring here include tufted hair-grass, Yorkshire-fog, hammer sedge, hard rush, soft-rush, sneezewort, ragged-robin, greater bird’s-foot-trefoil, common knapweed, common spotted-orchid, devil’s-bit scabious, selfheal, meadowsweet, glaucous sedge and carnation sedge.

There is frequent hawthorn, elder, grey willow and goat willow; occasional downy birch, pedunculate oak and bramble; and rare sycamore, holly and alder. Isolated specimens of whitebeam and gorse occur.

Description: The site comprises species-rich grassland situated along the western side of the Leeds/Liverpool canal.

The western section of the site supports flushed neutral grassland with hawthorn scrub and scattered pedunculate oak. The grassland sward is dominated by common bent, creeping bent, sweet vernal-grass, Yorkshire-fog and creeping buttercup, with common knapweed, greater bird’s-foot-trefoil, selfheal, devil’s-bit scabious, meadow vetchling, sneezewort, common spotted-orchid, autumn hawkbit, meadowsweet, wild angelica, bugle and glaucous sedge.

Grassland in the eastern section has a similar composition, with additional species including pignut, cat’s-ear, common bird’s-foot-trefoil, bluebell, mouse-ear hawkweed and quaking-grass.

Description: The site comprises a section of the Leeds/Liverpool canal, running from Old Hall Street in the south to Junction 12 of the M65 in the north. Aquatic and marginal vegetation is present in the canal itself, and the towpath and banks support a range of habitats, including species-rich grassland, tall-herb vegetation and scrub.

A rather sparse aquatic flora includes Common Duckweed, Ivy-Leaved Duckweed, Fennel Pondweed and Perfoliate Pondweed. Marginal vegetation includes species such as Gipsywort, Reed Sweet-grass, Marsh Horsetail, Reed Canary-grass, Meadowsweet, Water Mint, Marsh Woundwort, Hemlock Water-dropwort, Yellow Iris, Wild Angelica and Soft-rush.

Grassland tends to be dominated by grasses such as False Oat-grass, Yorkshire-fog and Cock’s-foot, with Red Fescue, Crested Dog’s-tail, sweet Vernal-grass and Yellow Oat-grass. Other plants present include Meadow Vetchling, Herb-robert, Meadow and Creeping Buttercup, Hedge Woundwort, Sneezewort, Common Knapweed, Tufted Vetch, Common Bird’s-foot-trefoil, Common Spotted-orchid, Tormentil, Eyebright, Zigzag Clover, Cat’s-ear, Oxeye Daisy, Bush Vetch, Broad-leaved Willowherb and Creeping Cinquefoil.

Lady-fern and Male-fern occur occasionally amidst the grassland, whilst other ferns such as Wall-rue and Maidenhair spleenwort are found on the mortared joints of walls. There are also stands of tall-herb vegetation with Rosebay Willlowherb, Common Nettle and Cleavers.

Scattered scrub is present with Osier, Goat Willow, Rusty Willow, Hawthorn, Ash, Elder, Blackthorn, Dog-rose, Sycamore, Bramble, Wych Elm, Downy Birch and Alder.

Description: The site comprises an extensive mosaic of habitats situated along approximately 3.5km of the Rivers Don and Brun. Included are areas of species-rich grassland, flushes, broad-leaved woodland and scrub. Some of the woodland is ancient, semi-natural in character.

Goit Wood and Scrogg’s Wood in the north-west of the site support semi-natural woodland and scrub. Downy birch dominates, accompanied by abundant pedunculate oak, sycamore and alder. Rowan, hawthorn and hazel are frequent and wych elm, bird cherry, ash and sessile oak are occasional. The ground flora is dominated by creeping soft-grass, with frequent bluebell, wood-sorrel, lady-fern, broad buckler-fern and bramble. Flushed areas support species such as opposite-leaved golden-saxifrage, giant horsetail, marsh hawk’s-beard, meadowsweet and marsh-marigold. The remains of an old mill stream (The Goit) on the edge of Goit Wood flows into a fishing pond used as a breeding site by common toad. Land to the north-west, above the wood, supports a diverse mixture of planted and natural scrub over species-rich grassland. Scrub includes willows, hawthorn, rowan, hazel, ash, blackthorn, pedunculate oak, common alder and grey alder. Ground flora species include meadow crane’s-bill, greater bird’s-foot-trefoil, selfheal, common spotted-orchid, perforate St. John’s-wort, zigzag clover, marsh woundwort, meadowsweet and glaucous sedge.

On the south side of the River Brun, Ridge Wood is a semi-natural woodland dominated by alder and ash, with downy birch, rowan and sycamore. The ground layer supports abundant creeping soft-grass and broad buckler-fern, and frequent bluebell, wood-sorrel, bramble and butterbur. Other species present include dog’s mercury, opposite-leaved golden-saxifrage, meadowsweet and giant horsetail. To the west and east of Ridge Wood there is planted scrub of varying age and composition. On the lower slopes the planted scrub merges with semi-natural scrub, including hawthorn, goat willow and grey willow. Open areas support acid and neutral, flushed grassland with species such as meadowsweet, wild angelica, selfheal and common spotted-orchid.

The central and eastern sections of the site support substantial areas of species-rich, neutral grassland (with scattered scrub). Description: The site comprises an area of land to the east of the Michelin Tyre Factory and adjacent industrial units. Of particular interest is a pond with a seasonally fluctuating water level and associated areas of swamp, grassland and scrub.

The amphibians present include breeding great crested newts with smooth newts and common toad. The pond supports an assemblage of breeding dragonflies and damselflies - the regionally scarce emerald damselfly as well as common hawker and common darter dragonflies and azure, blue-tailed and large red damselflies.

The open water has abundant bog pondweed and common duckweed, occasional broad-leaved pondweed and common stonewort. The swampy areas beside the pond and elsewhere on the site are dominated by bulrush and common spike-rush with hard rush around the margins. Other frequent species include jointed rush, toad rush, greater bird’s-foot-trefoil, tufted forget-me-not, lesser spearwort, cuckoo-, glaucous sedge, marsh willowherb, common marsh-bedstraw and occasional sneezewort, common yellow sedge, great willowherb, hoary willowherb, branched bur-reed, bog mosses (Sphagnum) and narrow buckler-fern, an uncommon in East Lancashire.

The grasslands and disturbed ground around the pond and swampy areas includes species such as tufted hair-grass, Timothy, Yorkshire fog, yarrow, common spotted-orchid, common knapweed, creeping thistle, curled dock, creeping buttercup, field horsetail, white clover and zig-zag clover.

The adjacent scrub consists of self-sown grey willow, goat willow and silver birch with planted sycamore, grey alder, ash, crack willow and white willow.

Butterfly species include green-veined white, small heath, meadow brown, small copper, large skipper and small skipper.

It is protected under UK law by the Conservation (Natural Habitats & c.) Regulations 1994 and also by the Wildlife and Countryside Act 1981 (as amended). This means it is illegal to kill, injure, disturb or interfere with young or adult newts, their eggs or tadpoles. It is also illegal to damage or destroy the places where they live, including their ponds and places where they hibernate.

Description: The site comprises land alongside the Preston- railway line which has been modified by landraising at some time prior to the 1939?45 war. It now carries a series of unimproved grasslands, tall herb and scrub communities.

The east?facing slopes support a mosaic of tall ruderal herbs, such as rosebay willowherb, and acid grassland and a small amount of heather.

The top of the mound is generally level; it supports species?rich neutral grassland. The southern half of the site is presently grazed by tethered ponies; the northern half is unmanaged. Great burnet is abundant, with frequent Lady's? mantle (Alchemilla glabra), meadow vetchling and common knapweed together with a range of other grassland species including: adder's?tongue fern, field wood?rush, glaucous sedge, bistort, selfheal, ribwort plantain and autumn hawkbit. Taller grasses such as false oat?grass and cocksfoot are present in the unmanaged area.

There are a series of shallow depressions in the central area of the mound. Here the vegetation is adapted to the damper conditions and species such as sneezewort, great willowherb, tufted hair?grass, hairy sedge and a number of rush species are present.

The species?rich grassland communities present are believed to resemble the species?rich agricultural grasslands that existed in this area prior to the last war but have now disappeared due to agricultural improvement.

The presence of meadow brown and small tortoiseshell butterflies and 5?spot burnet suggests that the site may also support a range of other grassland invertebrates.

Hawthorn and willow are scattered thinly over the site.

Description: The site comprises broad-leaved woodland on the steep slopes above Pendle Water. The woodland ground flora is ancient, semi-natural in character.

The canopy is dominated by sycamore, accompanied by frequent ash, oak and beech and rare horse-chestnut. Alder is locally frequent by the river. The understorey comprises hawthorn, elder, holly, rowan, wych elm and bird cherry. Saplings of sycamore, ash and beech are common. On the upper slope the ground flora is dominated by bramble, creeping soft-grass and tufted hair-grass, with bluebell, wood-sorrel, wood anemone, red campion, hedge woundwort, wood avens and rosebay willowherb. The lower slope and areas of flat ground by the river support ramsons, herb-robert, wild angelica, marsh hawk’s-beard, enchanter’s-nightshade, opposite-leaved golden-saxifrage, lady-fern, broad buckler-fern and hairy-brome. Indian balsam is present along the river’s edge.

'Lancashire Key Species' (LKS) is used by LERN as a collective term to refer to species which have a recognised status, either (inter)nationally or locally.

Specifically, it includes species identified in one or more of the following sources:

The Conservation of Habitats and Species Regulations 2010

Usually referred to as the 2010 Habitats Regulations they implement Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora (the Habitats Directive) into national legislation. Articles 12 and 13 of the Habitats Directive contains a range of prohibitions seeking to protect species listed on Annex IV ( and plant species in need of strict protection).

European Protected Species are animals and plants that receive protection under The Conservation of Habitats and Species Regulations 2010.

Directive 2009/147/EC on the conservation of wild birds

Usually referred to as the Birds Directive it provides a framework for the conservation and management of, and human interactions with, wild birds in Europe. It sets broad objectives for a wide range of activities; rare or vulnerable species are listed in Annex I.

In England, the provisions of the Birds Directive are implemented through the Wildlife & Countryside Act 1981 (as amended), the Conservation (Natural Habitats, & c.) Regulations 2010 (as amended); the Offshore Marine Conservation (Natural Habitats & c.) Regulations 2007 as well as other legislation related to the uses of land and sea.

LKS includes species listed on Annexes II and IV of the Habitats Directive and Annex 1 of the Birds Directive. These species are called species of Community interest.

The Wildlife and Countryside Act 1981 (as amended) (WCA)

This legislation implements parts of the Birds Directive 2009 and the Berne Convention (1979) into national legislation. It includes a number of Schedules which are reviewed (usually every five years) on which details of the protected species, and their level of protection, are shown. A detailed summary of the relevant sections of the Wildlife and Countryside Act, along with the protection afforded under them can be found within Paragraphs 118-122 of ODPM Circular_06/2005.

Species listed on Schedules 1, 5 and 8 are included on the list of LKS: Schedule 1 refers to Birds and their young, for which it is an offence to intentionally or recklessly disturb at, on or near an ‘active’ nest. Schedules 5 and 8 refer to protected species of wild animals and plants.

The Natural Environment and Rural Communities (NERC) Act 2006 - Habitats and Species of 2016 April v1d Principal Importance in England

The England Biodiversity List has been developed to meet the requirements of Section 41 of the Natural Environment and Rural Communities Act (2006). This legislation requires the Secretary of State to publish a list of species of flora and fauna and habitats considered to be of principal Lancashire Key Species Key Species Lancashire

The S41 list will be used to guide decision-makers such as public bodies, including local and regional authorities, in implementing their duty under section 40 of the Natural Environment and Rural Communities Act 2006 “to have regard” to the conservation of biodiversity in England, when carrying out their normal functions. In particular:

• Regional Planning Bodies and Local Planning Authorities will use it to identify the species and habitats that should be afforded priority when applying the requirements of Planning Policy Statement 9 (PPS9) to maintain, restore and enhance species and habitats. • Local Planning Authorities will use it to identify the species and habitats that require specific consideration in dealing with planning and development control, recognising that under PPS the aim of planning decisions should be to avoid harm to all biodiversity. • All Public Bodies will use it to identify species or habitats that should be given priority when implementing the NERC Section 40 duty.

The Protection of Badgers Act 1992

The legislation affording protection to badgers is primarily concerned with animal welfare and the need to protect badgers from activities such as baiting and deliberate harm. The Protection of Badgers Act 1992 makes it an offence to:

• Wilfully kill, injure, take, possess or cruelly ill-treat a badger, or attempt to do so;

• To intentionally or recklessly interfere with a sett (this includes disturbing badgers whilst they are occupying a sett, as well as damaging or destroying a sett or obstructing access to it.

National red lists

Red lists based on IUCN Criteria

The IUCN Red List System was first conceived in 1963 and set a global standard for species listing and conservation assessment efforts. For more than 30 years the Species Survival Commission (SSC) has been evaluating the conservation status of species and subspecies on a global scale - highlighting those threatened with extinction and promoting their conservation.

Species in GB in the following categories of the IUCN Red List are included as Lancashire Key Species. 2016 April v1d These relate to post 2001 evaluation only. The pre-1994 'Rare' category was not included in the 1994 or 2001 criteria, (In GB, this was interpreted as species which exist in fifteen or fewer 10km squares), neither was 'Lower risk - conservation dependent', but these are still applicable to lists that have not been reviewed since 1994. Taxa which are no longer known to exist in the wild after repeated Extinct searches of their localities and other known likely places.

A taxon is Extinct in the wild when it is known to survive only in cultivation, in captivity or as a naturalised population (or populations) well outside the past range. A taxon is presumed extinct in the wild when exhaustive surveys in known and/or Extinct in the Wild expected habitat, at appropriate times (diurnal, seasonal, annual) throughout its range have failed to record an individual. Surveys should be over a time frame appropriate to the taxon's life cycle and life form.

A taxon is Critically Endangered when it is facing an extremely high Critically risk of extinction in the wild in the immediate future, as defined by Endangered any of the criteria A to E.

A taxon is Endangered when the best available evidence indicates that it meets any of the criteria A to E for Endangered, and it is Endangered therefore considered to be facing a very high risk of extinction in the wild.

A taxon is Vulnerable when the best available evidence indicates that it meets any of the criteria A to E for Vulnerable, and it is Vulnerable therefore considered to be facing a high risk of extinction in the wild.

A taxon is Near Threatened when it has been evaluated against the criteria but does not qualify for Critically Endangered, Endangered or Vulnerable now (or Lower risk- conservation dependant in the Near Threatened pre 1994 criteria), but is close to qualifying for or is likely to qualify for a threatened category in the near future. In Britain, this category includes species which occur in 15 or fewer hectads but do not qualify as Critically Endangered, Endangered or Vulnerable.

Birds of Conservation Concern

The fourth review of the status of birds in the UK, Channel Islands and Isle of Man was published in December 2015 (http://www.bto.org/science/monitoring/psob). Using standardised criteria, 244 species were assessed and assigned to the Red, Amber or Green list of conservation concern. The assessment criteria include conservation status at global and European levels and, within the UK, historical decline, trends in population and range, rarity, localised distribution and international importance.

Species on the Red List are included as Lancashire Key Species.

The list comprises species of biodiversity significance in Lancashire and includes a number of species for which there is a published Species Action Plan (SAP). However, it is not the intention to produce SAPs for each of the species as many will be covered in general terms by HAPs. The list indicates species over which particular consideration is needed whether through Development Control, land management or agri-environment schemes.

It is intended that species action will be delivered through associated habitat action and as such the Technical Working Group will consider preparation of new SAPs on a needs basis.

For those species groups for which Long Lists have yet to be prepared or published, Key Species include species identified within the BHS selection guidelines where these are also listed in the relevant British RDB, are Nationally Scarce or occur at three or fewer localities in Lancashire.

Guidelines for the Selection of Biological Heritage Sites (2006)

The guidelines set out the basis for the selection of Biological Heritage Sites (BHS). Part 2 of the guidelines identifies lists of species which are significant in Lancashire and for which BHS may be identified. The species are broken down by taxonomic grouping; in general, the first four guidelines in each section deal with rarity from the international to the local level. BHS may be identified based on the presence of a single species, population size or geographic distribution. Appendix 4 Using LERN interactive PDFs

As part of our response to requests for environmental information we provide site and species information in the form of an interactive PDF. This guide provides an introduction to viewing the PDF using Adobe Reader. This guide was prepared using v9 and has been updated to changes in 11.0.12.

We cannot provide guidance on using any other PDF viewing software or on the Mac OS. Further guidance on using these aspects of Acrobat and Adobe Reader is available on-line.

1. Open the supplied PDF document.

2. When an interactive PDF is opened the Layers tab should automatically appear in the Navigation Bar (down the left hand side of the Adobe Reader window).

You also need to open the Model Tree tab . This can be found by right clicking the Navigation Bar. Model Tree is available in versions of Acrobat or Adobe Reader from 7.0.7.

3. Map Layers can be turned off and on by expanding the folders in the Layers tab and clicking the eye symbols on and off:

4. The information in the Model Tree can be similarly expanded to show the record species name. Selecting a record species name in the upper section of the Model Tree tab will highlight the location on the map, and show other details of the record in the lowest section.

5. To make the selected objects easier to spot on the map you can turn off the background mapping layer. You can also change the selected object colour to make it stand out more on the map by selecting the Color symbol on the Model Tree:

6. Searching (keyboard shortcut 'Ctrl F') on all or part of a species name will highlight the location on the map and show the record details in the Model Tree tab. You can use the Find Next button to move through all of the records for that species name.

The Object Data Tool can be used to select objects (record locations) in the view. A selected record is surrounded by a coloured box: In Acrobat Reader version XI the Object Data tool is found by navigating to Edit > Analysis > Object Data Tool.

N.B. Where a record location represents a single record it will be selected and its details will be shown in the Model Tree tab. Where the map symbol represents more than one record then all the symbols on the map will be selected and no record details will be displayed in the Model Tree tab.

The file export process appears to include details of some records lying beyond the map extent, if you cannot see the selected object, zoom out to be able to see beyond the page extent.
