WHEREAS, not all of the substances described below are yet categor- ized as illegal con- trolled substances un- der state or federal law; and

WHEREAS, the sub- stances described be- low are often as an al- ternative to marijuana, opiods and other con- trolled substances and are potentially danger- ous to users; and

WHEREAS, is has de- termined that the ef- fects of these sub- stances are a health concern to the citizens of Lowndes County, Mis- sissippi; and

WHEREAS, the Board of Supervisors of Lowndes County, Mississippi, have determined the need to establish regu- lations preventing the use, possession, pur- chase, distribution, sale or attempt to use, pos- sess, purchase, distrib- ute or sale or publicly display for sale any one or more of the following chemicals or sub- stances within Lowndes County, Mississippi; and therefore adopt the following regulation and penalties; and

This Ordinance shall not apply to any person who shall commit any act described in this Or- dinance pursuant to the direction or prescription of duly-licensed physi- cian or dentist author- ized to direct or pre- scribe such act. This Or- dinance shall not apply to the inhalation of an- esthesia for a medical or dental purpose which inhalation of anes- thesia shall be admin- istered by or under the supervision of a duly li- censed physician or dentist.

5. Any person found to be guilty of violating this Ordinance shall be deemed guilty of a mis- demeanor and shall be punished by a fine not to exceed One Thou- sand and no/100 Dol- lars ($ 1,000.00) or im- prisonment not exceed- ing six (6) months, or both.

6. That should any sen- tence, paragraph, subdi- vision, clause, phrase or section of this ordin- ance be adjudged or held to be unconstitu- tional, illegal or invalid, the same shall not af- fect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be in- valid, illegal or unconsti- tutional, and shall not affect the validity of the Code of Ordinance as a whole.

7. This ordinance shall become effective imme- diately. The Clerk shall cause the ordinance to be published in a local newspaper with a gener- al circulation.
