5-Year Deliverable Housing Land Supply Statement 2019

Introduction

1.1 This statement sets out the Five Year Deliverable Housing Land Supply position in Doncaster. It covers the five-year period from 1st April 2019 to 31st March 2024 and identifies a greater than five year supply with a 10% buffer. This Statement supersedes previous five-year land supply statements.

Why do we need to demonstrate a 5-Year Supply?

1.2 National planning policy (NPPF 2019 para 73) states that local planning authorities should identify and update annually a supply of specific deliverable sites sufficient to provide a minimum of five years’ worth of housing against their housing requirement set out in adopted strategic policies, or against their local housing need where the strategic policies are more than five years old. The supply of specific deliverable sites should in addition include a buffer (moved forward from later in the plan period) of…10% where the local planning authority wishes to demonstrate a five year supply of deliverable sites through an annual position statement or recently adopted plan, to account for any fluctuations in the market during that year.

How can a 5-year housing land supply be confirmed as part of the examination of plan policies?

1.3 Planning Practice Guidance confirms that the examination will include consideration of the deliverability of sites to meet a 5 year supply, in a way that cannot be replicated in the course of determining individual applications and appeals where only the applicant’s / appellant’s evidence is likely to be presented to contest an authority’s position. When confirming their supply through this process, local planning authorities will need to:

 be clear that they are seeking to confirm the existence of a 5 year supply as part of the plan-making process, and engage with developers and others with an interest in housing delivery (as set out in Para 74a of the Framework), at draft plan publication (Regulation 19) stage.  apply a minimum 10% buffer to their housing requirement to account for potential fluctuations in the market over the year and ensure their 5 year land supply is sufficiently flexible and robust. Where the Housing Delivery Test indicates that delivery has fallen below 85% of the requirement, a 20% buffer should be added instead1.

Following the examination, the Inspector’s report will provide recommendations in relation to the land supply and will enable the authority, where the authority accepts the recommendations, to confirm they have a 5-year land supply in a recently adopted plan.

What is the Housing Requirement?

1.4 Planning Practice Guidance states housing requirement figures identified in adopted strategic housing policies should be used for calculating the 5 year housing land supply figure where: the plan was adopted in the last 5 years, or the strategic housing policies have been reviewed within the last 5 years and found not to need updating. In other circumstances the 5-year housing land supply will be measured against the area’s local housing need calculated using the standard method.

1.5 Doncaster Council’s Core Strategy is more than 5 years old and the emerging Local Plan has now reached Submission stage (March 2020) which is proposing to express the housing requirement as a range. The bottom of the range for calculating 5-year supply is proposed as being the figure derived using the Local Housing Need requirement as per the government’s Standard Methodology. This will be reviewed and updated on an annual basis in line with the latest published projections and affordability ratios throughout the plan period. PPG supports such an approach where the Local Authority has successfully argued through the plan-making and examination process that the requirement should be set as a range.

1.6 As at April 2019, the Council’s Local Housing Need requirement is 550 dwellings per annum (see summary table and workings out below) which generates a 5-year requirement of 2,750 net dwellings for the period. An additional 10% buffer (275 dwellings) as set out above derives a total 5- year requirement of 3,025 net dwellings (or 605 per annum). There is no shortfall to factor into the requirement and, even if there was, the guidance is clear that the standard methodology factors this in through the affordability ratio. The additional supply delivered during the first 3 years of the plan period (2015-2018) has not been factored in for the purposes of adjusting the 5-year supply requirement (although has been for the purposes of the plan period requirement and in respect to allocations).

Workings out:

Step 1 – Setting the baseline - 131,355 households in 2019 & 136,591 households in 2029 equates to a total of 5,236 households over the 10 year period 2019-2029, and equivalent to an average household growth of 524 per year;

Step 2 – An adjustment to take into account of affordability – the authority’s median workplace-based affordability ratio (2018) is 4.81. For each 1% the ratio is above 4 the average household growth should be increased by a quarter of a percent. To be able to apply the percentage increase adjustment to the projected growth figure we then need to add 1.

Step 3 – There is no need to apply the cap for Doncaster as the capped figure is greater than the minimum annual local housing need figure and therefore does not limit the increase to the authority’s minimum annual housing need figure.

What is Deliverable Housing Land Supply?

1.7 Changes to national policy in 2018 has provided a revised definition of what constitutes deliverable housing land in the context of 5-year housing land supply. Further detail is provided in the Planning Practice Guidance which states that in order to demonstrate 5 years’ worth of deliverable housing sites, robust, up to date evidence needs to be available to support the preparation of strategic policies and planning decisions. Annex 2 of the National Planning Policy Framework defines a deliverable site. As well as sites which are considered to be deliverable in principle, this definition also sets out the sites which would require further evidence to be considered deliverable, namely those which:

 have outline planning permission for major development;  are allocated in a development plan;  have a grant of permission in principle; or  are identified on a brownfield register.

Such evidence, to demonstrate deliverability, may include:

 current planning status – for example, on larger scale sites with outline or hybrid permission how much progress has been made towards approving reserved matters, or whether these link to a planning performance agreement that sets out the timescale for approval of reserved matters applications and discharge of conditions;  firm progress being made towards the submission of an application – for example, a written agreement between the local planning authority and the site developer(s) which confirms the developers’ delivery intentions and anticipated start and build-out rates;  firm progress with site assessment work; or

 clear relevant information about site viability, ownership constraints or infrastructure provision, such as successful participation in bids for large-scale infrastructure funding or other similar projects.

Plan-makers can use the Housing and Economic Land Availability Assessment in demonstrating the deliverability of sites.

How has the Requirement of NPPF Para 73a been Addressed in Relation to Engagement with Developers?

1.8 A new 2018 Five-year Housing Land Supply Statement covering the period 2018-2023 was published alongside the draft Local Plan at Regulation 19 stage. It was based on the latest monitoring available (The 2018 Residential Land Availability Assessment & HELAA Update) and included the appropriate 10% buffer as necessary for demonstrating 5-year supply as part of the Examination process. The supporting text to Policy 6 of the Local Plan (Regulation 19 Publication – June 2019) also set out the relevant text in relation to this option and approach.

1.9 A number of Representations provided comments in respect to promotion and deliverability of both permissions and allocations in the plan. Very few of the Representations made comments in respect to deliverability of sites in the 5-year supply statement. A handful of sites (generally larger schemes) received comments as to whether they would develop as quickly as envisaged by the end of plan period. Some did comment that such an assessment should await the Examination process due to the highly likely chance that a more up-to-date Statement and evidence would be available by that point given the time lapse between Publishing the plan in August 2019 and the Examination/Hearing session(s) in Spring 2020. The most frequent comments were objections to using the standard methodology figure/Local Housing Need requirement for the purposes of calculating the 5-year supply, and there were general comments in relation to the need for allocations to factor in flexibility for non-delivery, such as lapses, a 20% buffer on top of the allocation etc etc.

1.10 The Council’s response to proposing the Local Housing Need figure for the purposes of calculating 5-year supply are set out in the Regulation 22 Statement and this approach is still being maintained. Representations in respect to permissions and allocations have been drawn on for the purposes of preparing this updated statement for the 2019-2024 period, alongside the latest monitoring (2019 Residential Land Availability Report). To address concerns around non-delivery, unlike the 2018 supply statement, this version includes a non-delivery allowance and, as before, the 10% buffer has been applied in line with national policy to provide flexibility and choice.

This supply has only included sites 2019 – all sizes that are under construction so there is no justification to apply a lapse rate to this source. See Tables H2(A-Q) of Local Plan Regulation 19 Version June 2019 with D.
