Definition of Terms

Compensation means payment in cash or kind for an asset to be acquired or affected by a Project at replacement cost at current market value.

Cut-off-date means the date after which people will not be considered eligible for compensation, i.e. they are not included in the list of DPs as defined by the census.

Dekhan Farm means farms, usually midsized, that are legally and physically distinct from household plots, for which full user rights but not ownership is allocated to either individuals or groups. Regulations concerning Dekhan farms in Tajikistan are laid out in the Law No. 48 on Dekhan Farms, dating from 2002.

Detailed measurement survey means the detailed inventory of losses that is completed after the fixed road alignment for the LARP Part I and detailed design and marking of Project boundaries on the ground for the LARP Part II.

Displaced persons DPs In the context of involuntary resettlement, displaced persons are those who are physically displaced (relocation, loss of residential land, or loss of shelter) and/or economically displaced (loss of land, assets, access to assets, income sources, or means of livelihoods) as a result of i) involuntary acquisition of land or ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. Encroachers mean those people who move into the Project area after the cut-off date and are therefore not eligible for compensation or other rehabilitation measures provided by the Project.

Entitlement means the range of measures comprising cash or kind compensation, relocation cost, income rehabilitation assistance, transfer assistance, income substitution/business restoration, which are due to DPs, depending on the type, extent and nature of their losses, and which suffice to restore their social and economic base.

Hukumat This is the District administration

Inventory of losses means the pre-appraisal inventory of assets as a preliminary record of assets to be affected or lost as a result of the Project

Jamoat This is the Sub-district administration under each District Land acquisition means the process whereby a person is compelled by a public agency to alienate all or part of the land s/he owns or possesses, to the ownership and possession of that agency, for public purposes, in return for fair compensation.

Non-titled means those who have no recognizable rights or claims to the land that they are occupying and includes people using private or state land without permission, permit or grant, i.e. those people without legal title to land and/or structures occupied or used by them. ADB’s

safeguards explicitly states that such people cannot be denied compensation.

Oblast a Region in Tajikistan

Poor means households falling below the monthly income of TJS 1020/- (per household per month).

Presidential Land means land for which use rights have been allocated by Presidential Decree but ownership remains with the state.

Replacement cost means the method of valuing assets to replace the loss at current market value, or its nearest equivalent, and is the amount of cash or equivalent in kind needed to replace an asset in its existing condition, without deduction of transaction costs or for any material salvaged and depreciation for age cannot be deducted from the compensation. Calculation of full replacement cost is based on following elements i) fair market price ii) transaction costs iii) interest accrued iv)transitional and restoration costs and v) other applicable payments, if any.

Reserve Fund Land means land owned by the state and controlled by the district administration that may be rented, mainly for agricultural use.

Sharecropper means the same as tenant cultivator or tenant farmer, and is a person who cultivates land they do not own for an agreed proportion of the crop or harvest.

Significant impact means 200 people or more will experience major impacts, which are defined as; (i) being physically Affected from housing, or (ii) losing ten per cent or more of their productive assets (income generating).

Vulnerable means any people who might suffer disproportionately or face the risk of being marginalized from the effects of resettlement and includes; (i) female-headed households with dependents; (ii) disabled household heads; (iii) poor households (within the meaning given previously); (iv) landless; (v) elderly households with no means of support; (vi) households without security of tenure; (vii) ethnic minorities; and (viii) marginal farmers (with landholding of five acres or less).

Executive Summary

The Republic of Tajikistan received a $120 million grant (Grant TAJ 0245) from the Asian Development Bank (ADB) for implementing the CAREC Corridor 3 (Dushanbe– Uzbekistan border) Improvement Project (the Project). The Project includes upgrading of the 57 kilometer long Dushanbe-Tursunzade-Uzbekistan border highway under one civil works construction package through a design-build contract. The Ministry of Transport (MOT) of the Government of Tajikistan is implementing the Project through its existing Project Implementation Unit (PIU), supported by a Project Management Consultant (PMC).

Implementation of upgrading works includes improvement of the road to a four lane highway between West Gate and and to 2 lane category between Tursunzoda to Uzbekistan border with Tajikistan. Physical implementation of improvement works with widening of the existing road and upgrading to category ‘A’ road triggered greater involuntary resettlement impacts. To address the land acquisition and resettlement (LAR) issues, the Project implemented LARP in two phases. LARP phase 1 covered a length of 36.15 km of the road based on preliminary design and LARP 2 corresponds to the remaining 20.85 km length of the road for which the Contractor finalized design in 2013 followed by small changes and designing additional road structures such as drainages and community access roads, that caused additional impact on DPs , where LARP was accordingly updated and implemented.

Based on the finalized project road designs for each sections of the project road, EA prepared and implemented LARPs phase 1 and 2. Detailed design of the road resulted in additional land acquisition impacts at certain stretches of the project road, which were inevitable. Assessment of these additional impacts on DPs has been conducted appropriately followed by preparation and implementation of Addendums into the LARP. Overall 4 Addendums to the LARP have been prepared and implemented of the project road until June 2014. However, Addendums to the LARP were not limited to the additional impact on DPs but also these include grievance cases found eligible by GRM and the additional costs were included to achieve DPs satisfaction. Table E1 below provides information on LARP phases 1 and 2 and all Addendums prepared and implemented under the project road.

The present document refers to LARP Addendum 5. Civil works are not allowed at the particular stretches of the road sections where there is adverse impact on DPs properties, which have not been compensated. Commencement of civil works at such locations will be conditional to the satisfactory implementation of the Addendum 5 of LARP, verified by a compliance report by an independent external monitor.

Table E2 below provides information on overall impact on lands, structures, incomes and businesses of affected entities of the entire LARP of the project road including Addendum 5. Out of total 804 affected households/entities, 387 will lose portions of their agricultural lands cultivated with annual crops, orchards and vineyards, 379 households will lose portions of their residential/commercial lands. There are 176 severely affected DPs and 163 DPs (households) considered vulnerable. A total of 6338 persons have been affected by the project.

A combined area of 42.6 ha agricultural land and 8.1 ha of residential and commercial lands of DPs have been taken by the project road. There have also been adverse impacts on 566 buildings of different usage and 845 miscellaneous structures including boundary walls and fences. Table E2 summarizes these additional impacts of the Addendum 5 and the entire LARP of the project road.

1. Objectives of the Addendum 5

1. Addendum 5 to the LARP is prepared by the Ministry of Transport of Tajikistan (MOT). It addresses the land acquisition and resettlement additional and unanticipated impact associated with the Project, and provides an assessment of compensation to the affected persons and affected households, due under the Tajikistan law and according to ADB requirements on Involuntary Resettlement as embedded in the ADB’s Safeguards Policy Statement (2009).

2. This Addendum 5 to the LARP of the project road aims to document and address the LAR impact on the newly identified and iteratively affected entities, and validate their entitlements in association to policies and practices adopted in the Project LARP. A compensation budget has been provided in this addendum to enable Ministry of Transport (MOT) to pay compensation to the DPs. Overall, Addendum 5 registers additional impact on 33 DPs affected by reconstruction of 2.7 km subproject road ‘Access to Gisar’ and the Project road: Subproject ‘Gisar Access’ Road: 17 DPs are affected by the rehabilitation of the 2.7 km long subproject road which connects the Gisar town to the Project road. Initial studies of the subproject, which focused on identifying any potential Involuntary Resettlement impacts suggested that subproject road does not incur major impact, locating part of sub project road within the RoW. However, it has become impossible to avoid temporary disturbance of individual small businesses along the road, during the civil works, and keeping open accesses to these businesses. Besides temporary stoppage of the businesses, there are registered structures, which have to be demolished for the construction purposes but without any land take. DPs can restore their affected structures when the construction of the road is completed. Additional impact on different stretches of the project road registers 16 cases of additional impact and DPs complaint cases, which were resolved to the favor of the aggrieved DPs. Out of these 9 DPs are with newly identified impact and 7 are aggrieved persons whose complaint cases were resolved by the GRC in their favor and included into this addendum for implementation of the GRC resolution.

Based on the detailed design, of 33DPs, only 1 DP has impact on commercial plots and 2 DPs will loss small portion of their agricultural lands. 20 DPs identified losing different types of structures, 10 DPs found to have temporary business interruption and 3 DPs with permanent loss of business. However within these DPs some have been repeatedly affected by the project as having different types of properties such as lands, structures, commercial

Addendum 5 aims to document the LAR impact on the newly identified and iteratively affected households and validate their entitlements based on the matrix used for the main LARPs of the project road.

2. Additional Impacts

A detailed measurement survey (DMS) was carried out in June 2015 to assess the impacts due to additional land take and impact on DPs businesses and structures along the Project road and Gisar Subproject road. In parallel with the survey works, interviews and discussions with local people and DPs were carried out and information pamphlets were given to each DP (Appendix 1). Businesses of 13 DPs (10 temporarily and 3 permanently affected), 25 buildings and 34 miscellaneous structures of 20 DPs and 2 agriculture and 1 commercial lands of 3 DPs have been affected and registered under LARP Addendum 5. Table 1 summarizes these additional impacts by road section and district.

5. Of the 33 affected entities under Addendum 5, some will experience more than one type of impact. 2 DPsDPs are losing agricultural lands cultivated by annual crops, 13 DPshave impact on business. For some of the DPs(20) although their lands were not affected, their buildings, boundary walls and outbuildings, which are built right at the edge of the RoW will be demolished and compensated accordingly. Table 2 shows repeated and actual number of affected households by category and impact.

2.1 Impact on Land

6. Overall, there are only 3 DPs that will lose part of their 2 agricultural and 1 commercial land. The average percentage of the land area affected to the total land holding of these DPs is 8%. Highest % of land loss is recorded for Presidential land holding DP because of small size of the total land. The affected agricultural lands are being used for production of wheat and vegetables and accordingly DPs will receive compensation for the loss of land use rights and also loss of income from crops. There is no any impact on agricultural lands used as orchards and/or vineyards. The only commercial land use right holder DP land is idle with no commercial or any other activity. The DP will receive cash compensation as per established principles for affected commercial lands. Addendum 5 to the LARP does not have impact on residential lands, only structures and buildings of DPs located at the edge of the RoW will be affected partially and DPs will be accordingly compensated for the whole structures. See Table 3 for more information on affected agricultural lands.

2.2 Property status of affected land by Addendum 5

7. Based on the bundle of rights granted to land users, the affected agricultural land can be categorized as (i) collective Dekhan Farms, (ii) Individual Dekhan Farms, (iii) Family Dekhan Farms, (iv) Presidential Land and (v) Supportive Farms. Dekhan Farms are those for which full user rights, but not the ownership, are given either to individuals (Individual Dekhan Farms) or to groups (Collective Dekhan Farms). Similarly, under the Presidential decree, certain persons were granted only user’s rights over the Presidential Land, but not the ownership.

8. According to the Table 3 above, the affected agricultural lands are of Individual and Presidential for agriculture and commercial type as per the land use rights holding

All land holding DPs have been consulted and they are aware of the impact on their lands. They have been informed that additional compensation for the loss of income and land use rights will be paid to them according to the entitlement matrix provisions.

2.3 Perennial crops / Fruit trees

9. LARP Addendum 5 registered 49 different fruit trees affected by the project (mainly within RoW of Gisar access subproject road. DPs planted fruit trees on the government land without any agreement or and type of use rights. However according to the LARP provisions they are entitled for compensations against loss of income from trees, which is equal to the volume of fruit production per tree x market value of 1 kg of fruit x required number of years to regrow a tree. Table 4 represents information on fruit trees losses under Addendum 5 of the LARP.

2.4 Impact on Structures

10. Table 5 shows that 25 structures with a total area of 1,666.85 square meters will be affected. Within the affected buildings there are 7 single floor, 1 double floor buildings, 8 outbuildings and 8 sheds. Also, 34 different types of walls and other structures will be affected, cumulative volume of which is calculated at 389 cubic meters. Addendum 5 to the project LARP did not have any impact on residential buildings. No relocation cases incurred in the project sections with additional impact under this addendum. Affected buildings refer to commercial buildings based on the DMS results and physical observations, which will be accordingly compensated at replacement cost.

2.5 Impact on Businesses

11. 13 businesses 10 within Gisar access subproject road and 3 in the Project road is registered being affected by addendum 5 to the LARP. Impact on 10 businesses within Gisar access road is temporary, as the business stoppage will occur only during construction work (only accesses to these businesses will be limited for the duration of 3 months. Remaining 3 businesses on different stretches of the project road are permanently affected. DPs have to re-construct structures and buildings to restart the businesses. Businesses have minor area of land affected and will be compensated on a cash-for-land basis as the remaining area of the buildings and the location allows for shops reconstruction. For more information refer to Appendix 4. All affected business will be compensated for income losses due to a possible stoppage of work and costs of structures and buildings, which are included in the budget of Addendum 5 of the LARP. Table 6 below provides information on affected businesses for Gisar access road and the project road. No commercial employees were identified during impact assessment. All affected businesses are small-scale business and are operated by owners and family members.

2.6 Severity of impact

12. The adopted threshold for severe impact is 10% of one year’s income and households who are relocated because of huge impact on their residential plots and houses and households whose residential buildings are affected. Under this addendum during impact assessment only 1 DPs with loss of above 10% of his Presidential land was identified. In case of permanent business losses, the affected households will receive a full year’s income and therefore it is assumed that the severity of impact is addressed by that compensation, which has been included in the budget accordingly.

2.7 Impact on Vulnerable Households

13. Vulnerable households are those formed by poor people and /or headed by single woman. The categorization of poor is based on the reported income data collected during the census survey. According to this data there is no any household/AP that considered as vulnerable.

3. Socio Economic Profile of the Displaced Households

14. All the 33 displaced households were covered in the census and socio-economic survey conducted along with the DMS during preparation of this addendum. Out of 33 affected households 4 are headed by women but none of women headed households are considered as vulnerable because they are better off households with sufficient source of income. Some are also engaged in business, trading and own small enterprises. None of the households may be considered as an ethnic minority or indigenous people based on ADB SPS (2009).

4. Policy Framework and Entitlement Matrix

15. All the affected entities are entitled to various types of compensation and resettlement assistance, irrespective of their land ownership status, to ensure that those affected by the Project shall be at least be restored, if not better off, than they would have been without the Project. The compensation packages shall reflect replacement costs for all losses (such as land, crops, trees, structures etc.).

16. The framework for the Project is based on the ADB requirements on Resettlement as embedded in the Safeguards Policy Statement (2009) and on the ADB Operations Manual F1, the Constitution of the Republic of Tajikistan, and the Land Code of the Republic of Tajikistan. Where differences exist between local law and ADB policies and practices, the resettlement for this Project will be resolved in favor of the later.

17. The withdrawal/ allotment of lands and resettlement is based on the following principles:

i. Compensation for losses incurred by land users or users of other registered rights connected to land when the land plot is withdrawn for state and public need.

ii. The withdrawal of land plots for state and public need from land users and users of other registered rights regarding land may be made after: a. Allocation of a land plot of equal value; b. Construction of housing, ploduction, and other buildings with same purpose and same value, instead of withdrawal, in a new location by the natural persons and legal entities to whom the land plot had been allocated, in accordance with established procedure, or cash payment; c. Full compensation for all other losses, including lost profits, in accordance with the legislation of the Republic of Tajikistan.

18. The affected entities are entitled to various types of entitlements according the Entitlement Matrix used in the LARP of the Project road. Affected communal place will also be eligible for entitlement. For a more detailed discussion on the resettlement policy that has been adopted to the Addendum 5 of LARP, please refer to Chapter 5 (Resettlement Policy, Legal Framework and Entitlements) of LARP II A & B. Table 7 summarizes the entitlements used for preparation of Addendum 5 of the LARP.

5. Consultation Meetings and Stakeholder Participation

19. Three consultation meetings were carried out at the jamoat level from June 11 to 18, 2015. A total of 34 participants attended these consultations. The Minutes and Participant Lists are given in Appendix 7.

20. The objective of the consultation was mainly to talk about the impact on land, structures and temporary stoppage of businesses by limiting access to those businesses and to discuss with the stakeholders, particularly with the affected persons to speak on their problems and expectations. Interaction with the affected persons was mainly on the properties affected by the Project, measurement survey of additional impact and survey results consented by the district authorities (Appendix 2), procedure for assessment of compensation amount of the individual DPs, method of compensation disbursement and possible timing of compensation payment.

21. Consultations at the jamoat level, particularly with the DPs, were dominated by questions and concerns relating to the assessment of compensation amount for the individual DPs. DPs in all the meetings did not express any major disagreement regarding the additional impacts and the process being adopted in the Addendum to address them was based on mutual agreement between DPs and the LAR Commission. Consensus were reached on all the entitlements of the DPs and agreements were made accordingly. However, for the purpose of resolving any future resettlement issue, discussion was also held on grievance redress procedure. At around the same time, the participants responded by anticipating that the Project would lead to improved connectivity, and enhance economic and social services. Table 8 summarizes the consultations conducted for the preparation of LARP Addendum 5. Local Hukumats and Jamoats, Land Committees representatives jointly with the project responsible team were working and consulting with the DPs on a daily basis during the assessment and preparation of this addendum.

6 Disclosure

22. To maintain transparency in planning and for further active involvement of all stakeholders and the general community in the implementation of LARP Addendum 5, the Project information was disseminated through disclosure of the resettlement planning documents. Each DP was given a pamphlet with information regarding the specific entitlements. The pamphlet specifically covers a brief Project description, compensation eligibility and entitlement including the entitlement matrix, schedule of LARP implementation and the Grievance Redress Mechanism (Appendix 1). The finalized Addendum 5 to the LARP, in both English and Russian languages, will be available in the office of the Project Director. The same information will be made available to DPs upon request. A copy of the final Addendum 5 to LARP endorsed by the Government will be disclosed in ADB’s website and the same will be disclosed in the web site of MOT both in English and in Russian.

7 Grievance Redress Mechanism

7.1 General

23. The DPs will have the right to file complaints and/or queries on any aspect of land acquisition compensation, and resettlement. MOT will ensure that grievances and complaints on any aspect of the land acquisition, compensation, and resettlement are addressed in a timely and satisfactory manner. All possible avenues are made available to the DPs to air their grievances. Under the adopted grievance mechanism, DPs may appeal any decision, practice or activity connected with the assessment or valuation of land or other assets, acquisition and compensation. All DPs have been fully informed of their rights and of the procedures for addressing complaints. Care will always be taken to prevent grievances rather than going through a redress process. This will be obtained through careful LAR implementation, by ensuring full participation and consultations of all DPs, and by establishing extensive communication and coordination between the affected communities, the MOT, and the local authorities in general.

7.2 Steps for Grievance Redress

24. Complaints and grievances received during the resettlement phase will addressed through the following steps and actions:

Step 1: Complains will be lodged at the jamoats (sub-districts) offices/field level where the responsible Hukumat and Jamoat officers, as representatives of the DPs, will attempt to resolve the issue. A standard grievance registration form was prepared and given for comments and perusal to Hukumats and Jamoats officials. Each complaint will be registered, signed by the displaced person and a representative of the Grievance Redress Committee, and the receipt of the complaint given to the displaced person. The period fixed for resolution of complaints is 30 calendar days.

Step 2: If a grievance is not resolved during a 30-day period, the displaced person (or her/his representative, if chosen) may lodge the complaint to the Resettlement Working Group Committee at the MOT. The Resettlement Working group Committee has an obligation to attempt to resolve the issue within14 calendar days.

DPs can submit their cases to the court of law at any point of time as decided by themselves.

7.3 Formation of Grievances Redress Committee (GRC)

25. One Grievance Redress Committee (GRC) has been established at the rayon level in each district to resolve complaints and grievances informally through community participation. The GRC consist of representatives of the MOT, the local hukumat, APs, women APs (if any), and appropriate local NGOs to allow voices of the affected communities to be heard and to ensure a participatory decision-making process. The GRC decisions will be made by majority of members and will be publicized among the local communities. If the complainants are not satisfied with the GRC decisions, they can always file their cases in court.

26. GRCs has been established at the rayon level, by an office order of the head of districts. The following seven members will constitute each Grievances Redress Committee:

7.4 Grievance mechanism during the construction period

27. All persons living along the Project road, regardless of whether affected by land acquisition and resettlement, may experience some adverse impact during the construction period such as damages or losses to property, caused by direct physical impact of the contractor’s equipment, vibration, contractor’s or employer’s design, or by other activities related to the construction of the road. Under the terms of the civil works contract, the Contractor has the obligation to provide a third party insurance in the joint name of MOT, as the Employer, and the Contractor.

8. Evaluation of Losses for Compensation

28. The evaluation of losses for compensation has been based on the same methodology used for the LARP Phase II and Addendum 4. Reasons to use the same methodology were based mainly stakeholders’ approved entitlement matrix developed for the LAR component of the project. While calculating compensations the current market values have been considered in case of invariance of prices of construction materials while evaluating buildings and agricultural products for the estimation of compensations for agricultural lands, orchards and fruit trees. Price changes in the project area in the past 2 years are negligible. In some cases even drop down in the prices of major construction materials have been observed, which was not considered in the process of valuation of affected structures and buildings Updating the rates for valuation of properties would not have brought a significant change in individual DP’s compensation amounts but even it may decrease volume of compensations and drastically delay preparation of this addendum and increased DPs dissatisfactions and grievances.

29. Compensation for loss of agricultural land is calculated based on the affected entities’ income from the plot. For the land planted with annual crops, compensation is based on 5- year income. Compensation for residential plot has been based on the current land lease rates multiplied by 25 years. For affected structure/other fixed assets, compensation is based on replacement value free of salvageable materials and transaction costs. Calculation of compensation for loss of trees has been based on number of trees, yearly yield, current market price of products and number of years required for the tree to re-grow. Calculation of allowance for severity of impact is equal to the gross market value of the harvest from the affected land for 1 year (inclusive of winter and summer crop), or one cash contribution equal to 6 month’s official average wage equal to 442 TJS (as per data provided by State statistical committee at www.stat.tj ).

30. Each of the affected entity was informed of the degree of impact and valuation details. All the DPs signed the Individual Act on Land Acquisition and Resettlement Case detailing their impact type and size. Details related to compensation amount and entitlements were communicated to every affected entity individually.

8.1 Compensation for Loss of Land Use Rights

8.1.1 Agricultural Land

31. In determining compensation for losing portions of agricultural lands under Addendum 5 of the LARP, consideration was made on the average crops productivity, market price, agreed annual crop value to be compensated and allowance for loss of use rights (5 years gross income for land planted with annual crops and 1 year for orchards/vineyards). Total compensation for the loss of use-rights on agricultural lands under annual crops is computed at 18,792.5 TJS (See Tables 9).

8.1.2 Compensation of Land Used for Residential/Commercial Purposes

32. Allowance for the loss of land use right has been calculated at 11.9 TJS per sq. meter. This rate is based on the same unit rate used under LARP 2 computed based on a 25 years of land rental fee (See paragraph 10.2.2 of LARP 2.). There is only a single AP whose commercial land was additionally affected by the LAR. Table 10 summarizes the cash for land compensation allowance for loss of land use right for the affected land. Overall AP for the loss of 2,700 sq. meter land will receive cash for land compensation, which is computed 32,130 TJS in total.

8.2 Compensation for Loss of Income from Crops

33. Compensation for income losses from annual crops is computed based on 1 year income. Table 11 provides information on volumes of production, market prices of different products and annual income losses of DPs, which will be compensated accordingly. Overall amount of compensation for the loss of income from annual crops estimated 3,758.5 TJS.

8.3 Compensation for Impact on Fruit Trees

34. For fruit trees, compensation is computed based on the number of years it would take the replacement trees to reach comparable production. There are 49 pcs of different fruit trees affected on the RoW adjacent to the plots of DPs. As DPs have made improvement to the lands and invested in growing trees, LAR commission decided to compensate the affected trees although DPs do not have legal rights on lands under trees. Accordingly DPs will receive compensation for the loss of income from fruit trees based on annual fruit production x by current price of fruit x by number of years to re-grow a new tree. The amount of compensations computed 21,686.3 TJS which will be paid to each DPs based on the type and number of affected trees.

8.4 Compensation for Business Losses

35. 13 businesses are affected by Addendum 5 of the LARP out of which 10 are with temporary impact and 3 with permanent impact. The businesses owners of permanent impact are entitled to cash compensation equal to 1 year of net income. The objective of such a compensation arrangement was to help the affected businesses owners in minimizing their losses and restore their activities faster and ensure that they can maintain their livelihood. Other 10 businesses of temporary impact will receive compensations for the period of business stoppage.

36. The assessment of compensation for those who have tax records was based on the actual information on income. Out of 13 businesses 2 business owners do not have registration hence they are compensated according to the average monthly wage of TJS 442 as per the information from State statistical committee website at www.stat.tj. The compensation amounts for different types of businesses are given in the following table. The amounts combine compensation for the DPs with and without the tax declaration that made 313,708 TJS under Addendum 5 of the LARP. (see Appendix 3)

37. The issue of affected unregistered businesses and businesses without tax records was discussed with the relevant district government authorities. The local authorities agreed that regardless of business type, size and legal status, each affected business would receive compensation. List of business owners provided in Appendix 4 information from districts tax committees.

8.4 Compensation for Loss of Structure

38. Compensation for the affected structures was determined by the State Committee on Investment and State Property Management (SCISPM) of the Republic of Tajikistan. Affected quantities and valuation of buildings and compensation rates have been determined for each structure in June 2015. Each given value is based on the structures replacement cost inclusive of transportation and labor. Valuation of buildings and structures is free of deduction of transaction costs or for any material salvaged and depreciation for age. Also location and type of utilization of buildings such as shops, dwelling, outbuildings, were considered by the evaluators. All affected structures and buildings of DPs will be compensated regardless of the registration status of the structure or land on which the structure is located.

39. Methodology of the valuation of buildings applied during LAR phase II planning was used to identify volume of compensation for this addendum. The following tables (14 a & b) summarize the total quantities and agreed compensation for the affected structures. The total compensation value for affected buildings is 756,673 TJS. The total compensation value for walls, fences and miscellaneous structures is TJS 148,875 TJS. Details on compensation for each structure are presented in Appendix 6. Tables 14 (a) provides information on number and area of different affected buildings with total compensation amounts for each type of buildings.

40. Affected walls, fences and other miscellaneous items has been identified and presented in Table 14 (b). According to this table there is additional LAR impact on 25 different types of boundary walls and fences and 9 other miscellaneous structures of the DPs with total volume of 389 cubic meters of different materials such as concrete and mud. Costs of such structures have been calculated according to the sizes and amount of materials used by DPs including labor costs.

9. Resettlement Budget and Financing

41. All funds required for land take and resettlement planned under Addendum 5 of the LARP will be provided by the government. The Ministry of Transport will ensure that adequate funds are available to compensate the DPs. The DPs will be compensated based on the request letter from the head of districts of the project area with the attached list of

DPs which also shows the magnitude of impact together with the compensation amounts. The request letter together with the attachment will be sent to the MOT and the funds will be transferred to the district Amonatbank branches (State Savings Bank). The compensation for the affected HHs covered under the Addendum 5 to the LARP requires 1,298,274.8 TJS. Additional 5% contingencies worth 64,913.7 TJS have been proposed to cover any unexpected costs. Table 15 gives a breakdown of the items. Refer to Appendix 8 for final list of DPs and compensation amounts.

10. Implementation schedule

42. MOT/PIU will be responsible for implementing this Addendum 5. The PIU Resettlement Specialist and PMC IR consultant will intensively travel to the field to ensure adequate implementation of the Addendum 5. During compensation payment, the PIU Resettlement Specialist will coordinate with the National Resettlement Specialist in ADB Tajikistan resident mission and the PMC Resettlement Specialists to get their presence to observe the payment process. The program of compensation payment is planned to be implemented and reported by 15 August 2015. Affected entities will be informed about the date and place of receiving compensation in advance. Table 16 shows the implementation schedule.

11. Monitoring Arrangement

43. Implementation of the Addendum 5 to the LARP will be monitored by PIU/MOT, PMC IR consultant internally. An external monitoring consultant (EMC) will be engaged for this LARP addendum 5. The EMC will prepare a compliance report for PIU and ADB after implementation of the Addendum 5, which will be used as basis for allowing civil works in the sections covered under the Addendum 5 of LARP of the project road. If any significant resettlement issues or any unanticipated impacts are identified the external monitoring consultant will advise on safeguard compliance issues and prepare a corrective action plan to address such issues. Such planning document should be approved and disclosed before proceeding for the implementation of the specific project components for which involuntary resettlement impacts are identified.

(i) Project Description

1. The Republic of Tajikistan is implementing the CAREC Corridor 3 (Dushanbe–Uzbekistan border) Improvement Project under a grant from the Asian Development Bank (ADB) The civil works funded under the Project comprise the upgrading of the existing road section from West Gate to Tursunzade to a 4-lane road including road widening, minor realignment and improvements, upgrading the existing 2-lane Tursunzade to the Uzbekistan border and improvement of facilities at Dusti Border Post. The project aims to improve connectivity and mobility along this road section to facilitate trade and development in Tajikistan and in the region.

2. The Project road is divided into 4 sections. Section 1 (Avicenna-West Gate) involves the rehabilitation of the existing road and structures. This stretch does not require any widening or additional Right of Way (RoW) hence will not entail any land acquisition and resettlement. Widening will take place for Section 2 (West Gate-Gissar Junction), Section 3 (Gissar Junction- Shakhrinav) and Section 4 (Shakhrinav- Tursunzade), this will require additional land acquisition and resettlement. Section 5 (Tursunzade-Uzbekistan border) will comprise rehabilitation and improvement of the existing two lane road, and requires land acquisition and resettlement at certain points. The summary details of various road sections are described in table A1.1.

(ii) Principles for Compensation of the Affected Families

3. Principles for the compensation/rehabilitation of families affected by this Project are:  Involuntary resettlement is to be avoided, if unavoidable, minimized with all viable options.  The AHs should be compensated and assisted, so that their economic and social future would be generally as favorable as it would have been in the absence of the Project.  The AHs should be fully informed/consulted in resettlement and compensation options.  Local socio/cultural institutions should be supported / used to the greater extent possible.  Lack of formal legal land title should not be a bar to compensation or rehabilitation.  Compensation will be provided to the AHs at full replacement cost of the affected assets free of deductions for salvaged materials, depreciation or fees/taxes.  Particular attention should be paid to AHs headed by women and other vulnerable groups, and appropriate assistance provided to help them improve their status.

(iii) Land Acquisition and Resettlement for the Project

4. Following the Project schedule, the Land Acquisition and Resettlement Plan (LARP) for the Project is also being implemented in two phases. Note that civil works will only be allowed to start in road sections where LARP has been fully implemented.

Phase 1 LARP

5. The LARP for phase 1 (LARP 1) was endorsed by the government on 31 Mary 2011. Implementation started in June 2011. The compensation program is handled by the Ministry of Transport Project Implementation Unit (PIU) in close coordination with the jamoats and hukumats with administrative responsibilities in the affected road sections. An External Monitoring Agency (EMA) has monitored implementations. The ADB National Resettlement Specialist/Consultant based at the ADB Tajikistan resident mission also observes the compensation payment process in the field. LARP 1 was completed in September 2011. After the compliance report and review of the implementation of the LARP 1, contractor was mobilized to commence civil works at road sections covered by LARP 1. Civil works started in March 2012.

Phase 2 LARP

6. LARP for Phase 2 (LARP 2) of the project covers remaining segments of the road where Project road design was finalized in March. LARP 2 is based on the final measurements conducted in the period October 2012 to March 2013. The measurements were taken with reference to the fixed road alignments (road centerline and offsets). The LAR survey team comprised of PMC resettlement specialist, PIU RR resettlement specialist, two social assistants, a local engineer, a surveyor and additional field support staff provided by hukumats. Representatives of the responsible hukumats, Inter-district Bureau for Technical Directory (MBTI) and representatives of the Land Committees and the State Committee on Investment and State Property Management of the Republic of Tajikistan worked together with the LAR team.

7. To compensate and/or rehabilitate losses the provisions of relevant Tajikistan laws and of the Asian Development Bank (ADB) Policy on Involuntary Resettlement is being adopted. This has included the preparation of a Land Acquisition and Resettlement Plan (LARP) providing data on impacts and affected families and indicating in detail how the impacts will be compensated or rehabilitated. The LARP in Russian will be available for perusal to anyone interested both at the local and at Dushanbe offices of MT.

8. This Leaflet summarizes the LARP provisions and is provided to all the families whose land, houses, trees, crops or other assets and incomes are affected by this Project. The objective is to inform them of the compensation and rehabilitation policy included in the LARP and of a few basic modalities of implementation of the Compensation and Rehabilitation

(iv) Compensation Policy

9. All families residing in affected areas, holding affected assets or incomes before the eligibility cut-off date, to be the final day of the impacts survey will be entitled to compensation for their losses, as per Table A1-3 below.

(v) Type of Loss Basis of Rate Determination

10. The rate is determined for each individual property, based on the productivity of the affected land. The following formula is applied:

(vi) Grievance Mechanism - Resettlement Period

11. The affected persons have the right to file complaints and/or queries on any aspect of land acquisition compensation and resettlement. To ensure that grievances are properly addressed, a grievance redress mechanism has been established:

Step 1: Complaints can be lodged at the MOTC district offices/field level where resolution will be attempted with the involvement of Hukumat and Jamoat officers as the representatives of the affected households. A standard grievance registration form was prepared and given for comments and perusal to Hukumats and Jamoats officials. Each complaint must be registered, signed by the affected person and the Grievance Redress Committee representative, and the receipt of received complaint given to the affected person. The set period for complaint resolution is 30 calendar days.

13. Step 2: If during the 30 days period the grievance was not resolved, the affected person (or her/his representative if chosen) should lodge the complaint to the Resettlement Working Group Committee at the Project Implementation Unit. The Resettlement Working group Committee has 14 calendar days to try to resolve the issue.

14. Step 3: If no solution is reached within 14 days, the affected person can submit her/his case to the appropriate court of law.

15. One Grievance Redress Committee (GRC) will be established at the rayon level to resolve complaints and grievances informally. The GRC will consist of representative from MOT, the local hukumat, APs, women APs (if any), and appropriate local NGOs. The GRC decisions will be made by majority of the members and will be publicized among the local communities. If the complainants are not satisfied with the GRC decisions, they can always file their cases in court.

Summary of Community Consultation A number of formal and informal consultations with APs with additional impact and other major stakeholders were conducted during assessment and the preparation of the LARP Addendum 5. All APs with additional impact Local Hukumats and Jamoats, Land Committees representatives, were working and consulting with the team on a daily basis during the assessment and preparation of addendum. A brief summary of the major consultations with affected people is given below.

4. Discussion and considerations of reasons and scale of additional impact of LAR on APs 5. Analysis of the estimated compensation payments for the affected land and structures of the APs followed by receiving comments and consent of APs. 6. Other issues and questions raised by the participants.

Consultation meetings started with general information about the project and explanation of the reasons for additional land acquirement following additional impact on some of the households’ agriculture and residential land along the project road.

Although majority of APs were present during assessment, measurements and registration of affected land and structures, once again all type of losses that have been registered, were analyzed with each individual owner during the consultation. Farther methods of identification of costs for each type of losses have been told to APs and samples were given how their land and crops have been evaluated.

It was explained that in case of occurrence of any other extra damage and impact on land and crops created by machinery work that were not compensated, APs can submit their grievance to the GRC committee representative in jamoat and seek compensation for the damages. Also it was explained that contractor may have temporary impact on land of some community members during the construction work. In this case mutual agreement should be made between the land owner and the contractor for temporary impact and compensation should be provided to the owner before acquiring the land.
