Now I have been entrusted with updating that chronicle. While obviously the emphasis will be on the events of the last twenty-five years - the most momentous period in the history of rugby union - as a tribute to the founding fathers, the first chapter of the original history will yet again appear. While it would not be practical to include a detailed history of the first 100 years chapter two is a brief resume of the achievements of the first fifty years and likewise chapter three embraces the significant events of the second fifty years in the illustrious history of one of Ireland’s great sporting institutions. There follows the detailed history and achievements, and they were considerable, of the last twenty five years. I owe a considerable debt of gratitude to many people for their help during the compilation of this book.     The long reach of section 216 (prohibited names) Technical Bulletin No: 136 Case Hawkes v Cuddy [2007] EWHC 1789 (also known as Re Neath Rugby Ltd, Cuddy v Hawkes) Synopsis The decision relates to the ownership and management by two successive companies which ran “Neath”, a leading rugby club in Wales: (a) Gowerpark Ltd, which had been known as Neath RFC (Old Neath); and (b) Neath Rugby Ltd, also known as Neath RFC or Neath Rugby (New Neath). C had been a director of Old Neath. Upon the liquidation of Old Neath, the name “Neath” became a prohibited name under s.216(3) in relation to C – i.e. it prevented him from becoming a director of New Neath - and so he installed his wife as his nominee. The other director/shareholder was Mr Hawkes (H). An unfair prejudice (i.e. contributory’s) petition was presented under s.459 CA 1985 by H against C and Mrs C in respect of the affairs of: (i) New Neath; and (ii) Neath-Swansea Ospreys Ltd (Ospreys), a company managing the Welsh regional side now known as the Ospreys (of which New Neath owns 50%). In 1995/6, when Welsh rugby turned professional, the Welsh Rugby Union (“WRU”) established Old Neath to run Neath RFC and appointed C as one of its directors. Although the team performed well on the field, Old Neath ran into financial difficulties. The WRU then re-organised Welsh rugby for the 2003/04 season, forming regional sides.

This case is concerned with the right of the claimant, the Pontypool Rugby Club, a club with a proud history, to continue to play in the Premier Division of Welsh rugby in the 2012/13 season. The defendant is the Welsh Rugby Union, which organises and controls the sport of rugby union in Wales. It is the view of the WRU that as a result of the re-organisation of the Premier Division to reduce the number of clubs playing in it and Pontypool’s position in order of playing meritocracy of the fourteen clubs formerly in the division, the club is now only eligible to play in the Championship, the next division down. The essence of Pontypool’s case is that clubs which are above it on a basis of playing merit have not met the requirements to hold an A licence as required for the Premiership by the WRU’s National League Rules 2011/2012, and so there is a place for Pontypool within the Premiership.
