Each person who uses or authorizes another person to use Online Banking agrees to the following Online Banking Agreement and Electronic Funds Transfer Disclosure.

ONLINE BANKING AGREEMENT 1. In the following Agreement, Electronic Funds Transfer Disclosure and Electronic Records Consent Agreement:

a. the singular includes the plural; b. "Online Banking" means personal computer home banking service; c. "Credit Union" means Pen Air Federal Credit Union d. "You" “Your” and "User" means each person who uses or authorizes use of Online Banking e. "Account" means any and all deposit and share account(s) owned by any of you; f. "Line of Credit" means any and all lines of credit issued by Credit Union to any of you; g. "" means any and all extended by Credit Union to any of you; and h. "Password" means your Online Banking password.

2. To access your Account, Line of Credit or Loan using Online Banking, you must use your Password. First time users will use four zeros plus the last four digits of your Social Security number to complete the sign-up process. This process will include entering a password that you will use to access your accounts going forward.

3. You will hold your Password in strict confidence. You will notify Credit Union immediately of loss or theft of the Password. If Credit Union receives such notice, Credit Union, may, in its discretion, freeze your Account, Line of Credit or Loan to prevent further electronic access. Credit Union may, at its discretion, reissue and reactivate a new Password for your use.

4. Delivering the Password to another person constitutes authorization of that person to conduct any Online Banking transaction or inquiry on your Account, Line of Credit and/or Loan using Online Banking. You shall be liable for all authorized Online Banking transactions. Use of the service is only for your own use and not for future resale, relicense or use by other third parties. Individual (personal) users will use the Services solely for personal, family, or household purposes and not for any business or commercial purposes. Business users may only use the services solely for business or commercial purposes and not for any personal, family or household purpose.

5. Authorized use of the Password for any Online Banking transaction is an order by you for that transaction on your Account, Line of Credit and/or Loan.

6. You may use the Bill Pay feature of Online Banking to pay bills from your Share Draft Checking Account. The payee of a Bill Pay payment order, sent as a check, will not receive payment for as many as ten business days after the payment order is processed by us. Your Share Draft Checking Account must contain sufficient available funds at the time the Bill Pay payment order is initiated for the payment order to be processed. We shall have no liability for any special, indirect or consequential damages arising from any failure of or error in any Bill Pay payment order. You agree that you are responsible for any loss or penalty that you may incur due to lack of sufficient funds or other conditions that may prevent the withdrawal of funds from your account.

7. Except as inconsistent with this Agreement, use of Online Banking is subject to the terms and conditions of your Account agreements, Line of Credit agreements and Loan agreements as amended by Credit Union from time to time, which are incorporated by reference herein. Changes in the terms and conditions of your Account agreements, Line of Credit agreements and Loan agreements may affect the use of Online Banking.

8. This Agreement may be amended by Credit Union at any time in its discretion. You will receive notice of amendments as required by applicable law without restatement of the terms herein.

9. You agree to pay all charges to your Account, Line of Credit and/or Loan made by you and any person authorized by you to use the Password. You agree to pay any fees and charges assessed against your Account, Line of Credit and/or Loan under the terms of this Agreement, the Service Fee Schedule and any other agreement with Credit Union. If you do not pay any amounts owing to Credit Union under this Agreement (including any overdrafts on your Account), you authorize Credit Union, in its sole discretion, to add any amount owing to Credit Union to the balance of any Loan or Line of Credit you have with Credit Union.

10. The Credit Union will use Plaid Inc. (“Plaid”) to gather data from financial institutions. By using our service , you grant the Credit Union the right, power, and authority to act on your behalf to access and transmit your personal financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy policy. https://plaid.com/legal.

11. Online Banking and the Password are the property of Credit Union which may, without liability to you or advance notice (except as required by applicable law), revoke or limit any or all uses of the Password and/or Online Banking. You may not use the Password or Online Banking after Credit Union revokes the Password or your use of Online Banking.

12. You agree to take every precaution to ensure the safety, security and integrity of your account and transactions when using Mobile Banking. You agree not to leave your Device unattended while logged into Mobile Banking and to log off immediately at the completion of each access by you. You agree not to provide your username, password or other access information to any unauthorized person. If you permit other persons to use your Device, login information, or other means to access Mobile Banking, you are responsible for any transactions they authorize and we will not be liable for any damages resulting to you. You agree not to use any personally identifiable information when creating shortcuts to your Account. We make no representation that any content or use of Mobile Banking is available for use in locations outside of the United States. Accessing Mobile Banking from locations outside of the United States is at your own risk.

13. User agrees that Credit Union and Licensor may obtain information regarding Payee accounts to facilitate proper handling and crediting of payments and User expressly agrees that Credit Union and Licensor may use such information to the extent required to provide the Services.

14. You may terminate your Password or your use of Online Banking by calling 1-877- 473-6247 or emailing the Credit Union. However, your notice will be ineffective until Credit Union has a reasonable opportunity to act upon it.

14. Unless caused by our intentional misconduct or gross negligence, you agree to indemnify, defend and hold harmless Pen Air Federal Credit Union, its affiliates, officers, directors, employees, consultants, agents, service providers, and licensors from any and all third party claims, liability, damages, expenses and costs (including, but not limited to, reasonable attorneys' fees, expenses, & court costs ) caused by or arising from (a) a third party claim, dispute, action, or allegation of infringement, misuse, or misappropriation based on information, data, files, or otherwise in connection with the Service; (b) your violation of any law or rights of a third party; or (c) your use, or use by a third party, of Mobile Banking. You also agree to hold the Credit Union harmless for any failure of the Online Banking system due to electronic, mechanical or similar problems beyond the control of the Credit Union.

15. Users are prohibited from impairing or altering the functionality of the Services. Including causing or permitting the reverse engineering, disassembly, translation, adaptation, or de-compilation of the Services, or any attempts to derive source code or algorithms of the Services, and prohibits using the results of such processes. User is prohibited from assigning or transferring the license to use the Services.

16. Statements and notices will be mailed to you at the most recent address you have given Credit Union. Notice to any of you will be notice to all of you.

16. To be effective, any waiver or modification of any term or condition stated in this Agreement must be in writing and signed by an authorized officer of the Credit Union and shall not be considered as a waiver of any future or other obligation or right.

17. In the event that any paragraph of this Agreement or portion thereof is held by a court to be invalid or unenforceable for any reason, the other paragraphs and portions of the Agreement shall not be invalid or unenforceable and will continue in full force and effect.

18. This Agreement is governed by the Bylaws of the Credit Union, federal laws and regulations, the laws and regulations of the State of Florida and local clearinghouse rules, as amended from time to time. Any disputes regarding this Agreement shall be within the jurisdiction of the court of the county in which the Credit Union's principal place of doing business is located.

19. If legal action is necessary to enforce this Agreement or collect any amounts owing to Credit Union or fees or charges assessed under this Agreement, Credit Union has the right, subject to applicable law, to payment by you of all attorney's judgment actions. You agree that such legal action may be filed and heard in the county and state in which Credit Union's principal place of doing business is located, if allowed by applicable law.

20. Telephone Requests: Recording Communications and Consent to Communications from the Credit Union. You agree that funds in any account(s) with us can be transferred, upon the telephone request of any signer on the account, to another account with us or to any other financial institution. Furthermore, we reserve the right to refuse to execute any telephone request or order. You consent that any phone call with us may be monitored or recorded by us or our affiliates. By providing telephone number(s) to us, now or at any later time, you authorize us and our affiliates and designees to contact you regarding your account(s) with the Credit Union and its affiliates at such numbers using any means, including but not limited to placing calls using an automated dialing system to cell, VoIP or other wireless phone number, or by sending prerecorded messages or text messages, even if charges may be incurred for the calls or text messages

Disclaimer of Warranty CREDIT UNION EXPRESSLY DISCLAIMS, AND USER HEREBY EXPRESSLY WAIVES, ALL OTHER WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE SERVICES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR PARTICULAR PURPOSE, ERROR FREE OPERATION, UNINTERRUPTED ACCESS, THAT THE SERVICES ARE SECURE, OR THAT THE SERVICES OR THE SOFTWARE WILL BE AVAILABLE CONSTANTLY AND IN AN UNINTERRUPTED MANNER, OR THATCREDIT UNION OR LICENSOR IS ACTING AS AN ORIGINATING DEPOSITORY FINANCIAL INSTITUTION UNDER THE NACHA OPERATING RULES AND ANY OTHER IMPLIED WARRANTY ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. NEITHER CREDIT UNION NOR LICENSOR SHALL BE LIABLE FOR ANY DAMAGES INCURRED BY USER ARISINGOUT OF A DATA BREACH SUFFERED BY USER THROUGH NO FAULT OF CEDIT UNION OR LICENSOR , INCLUDING BUT NOT LIMITED TO ANY FRAUD-RELATED LOSSES INCURRED BY USER USING THE SERVICES. WITHOUT LIMIKTING THE FOREGOING , IN NO EVENT WILL CREDIT UNION OR LICENSOR BE LIABLE FOR LOSSES ARISING OUT OF RETURNS, CHARGEBACKS AND/OR ANY OTHER UNAUTHORIZED ACTIVITY. Voice Banking Terms and Conditions

The following terms govern your use of the Voice Banking on Amazon’s Alexa service on any Alexa- enabled device (“Alexa”). It applies in addition to, and is not intended to, replace, any other agreement that may apply in connection with your deposit account, investment account, auto loan account, or residential mortgage loan account (“Account”), or the use of Voice Banking.

Your use and/or continued use of Voice Banking constitutes your acceptance of these terms as amended from time to time.

Third-Party Security Settings: Voice Banking is voice activated. Your voice is only used to activate Alexa’s features and is not used to authenticate you are the owner of the account. Once you set up your device with Voice Banking, you are authorizing us to provide information to the device based on the device’s security settings. By enabling Voice Banking on your Alexa-enabled device, you are responsible for how Voice Banking is used (including any communication to or from us from your device). You understand that it is your obligation to utilize the Device safely and correctly. By enabling Alexa you authorize anyone to use your access devices as noted above; and that authority shall continue until you specifically revoke such authority by notifying the Credit Union in writing or as required by applicable laws.

Account(s) Inquiries: Voice Banking provides access for you to request certain information about your Account(s) with us. The inquiries available are the same information you can access through the website or our mobile app. Inquiries may not be available for all Account(s) that you may have with us.

Account(s) Transactions: Voice Banking may enable you to perform certain transactions for your Account(s) with us. You understand that certain transactions will require you to provide a Passcode which must contain six (6) numbers. You must create this Passcode prior to initiating the first transaction. This Passcode is created by you and unique to your Account(s). We will not be able to provide you with your Passcode if you forget it. You understand that it is your responsibility to ensure that your Passcode is kept in a secure location and you do not share your Passcode. When you use Alexa to initiate transactions between your Account(s), you understand that you are authorizing us to initiate transactions on your behalf as if you were initiating a transaction through our website, www.Credit Union.com. We reserve the right to add, discontinue or amend the type of transactions or inquiries permitted through Voice Banking.

Release of Your Information to Amazon: Your interactions with us via Voice Banking are subject to the Credit Union Privacy Policy. By installing Voice Banking, you are authorizing us to perform the actions and/or share with Amazon the information communicated to us or requested from us.

Changes or Amendments: We may change, suspend, or discontinue Voice Banking, or any part of it, at any time without notice. We may amend any of these terms at our sole discretion by posting the revised terms on our Website. Your continued use of Voice Banking after the effective date of the revised terms constitutes acceptance of the terms.

Termination: Your rights under these terms will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, we may immediately revoke your access to Voice Banking. You must therefore immediately cease all activities available with Voice Banking, and you must immediately delete or remove Voice Banking from all electronic devices.

Technology Support: We do not provide technical or any other support for Voice Banking. If such support is provided in exceptional circumstances, it will be provided in addition to any normal support for your Account(s). You hereby agree to abide by any support rules and policies put into place. You agree that any claims that you may have with respect to Voice Banking, and your usage of Voice Banking, must be brought against Amazon and/or Alexa and not against us.

Disclaimer of Warranty: You acknowledge and agree that all use of Voice Banking is at your sole risk. YOU ASSUME ALL RISK FOR YOUR USE OF VOICE BANKING, THAT IT IS PROVIDED “AS IS”, AND THAT CREDIT UNION MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED. CREDIT UNION EXPRESSLY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CREDIT UNION, OR THROUGH OR FROM VOICE BANKING, WILL CREATE ANY WARRANTY OF ANY KIND.

If you do not comply with these terms, and we incur any costs, loss, claims, expenses and other liabilities which result from your non-compliance, including a resultant breach by us of our obligations to Amazon and/or Alexa, you agree to reimburse us for any such costs, loss, claims, expenses and other liabilities, including any legal costs involved with the defense of any claim brought against us due to your non- compliance with these terms. This is in addition to any other specific remedies that we have in these terms or under the law generally.

We hereby exclude any liability for any direct, indirect, punitive or consequential loss or damage that you may incur in connection with your use or inability to use Voice Banking, Alexa and/or your Account, including, without limitation any damage to electronic devices, any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, and any other loss or damage of any kind, whether foreseeable or not.

Trademark Information: Credit Union trademarks and graphics used in connection with Voice Banking are the property of Credit Union. All other trademarks and graphics used are the property of their respective owners.

Intellectual Property Rights: You acknowledge that all intellectual property rights in Voice Banking and Alexa, the technology, and the Account(s), belong to Credit Union or to our licensors, that rights in Voice Banking are licensed (not sold) to you and that you have no rights in, or to, Voice Banking, or the technology other than the right to use each of them in accordance with these terms. You acknowledge that you have no right to have access to Voice Banking in source code form. You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, Voice Banking or the Alexa Software, whether in whole or in part, or create any derivative works from or of Voice Banking or Alexa Software.

General Terms: We can transfer all or any of our rights and legal responsibilities under these terms without your permission provided any warranties are not affected. Your rights and duties under this Agreement apply only to you and cannot be transferred to any other person without our written permission. If we don’t enforce any part of these terms at any time, this will not stop us from doing so in the future. If any of these terms are found not to be valid or cannot be enforced in full or in part, the rest of the terms will continue to apply as normal.

Business Online Banking Upon approval of your Online Banking Registration, you will have the ability to name Authorized Persons appropriate levels of access to the Online Banking System. It is your responsibility to update the system as necessary. Authorized Persons: The following are persons authorized ("Authorized Person(s)") to establish and act on behalf of the Account Owner with respect to accounts held at the Credit Union.

• If the Account Owner is a sole proprietorship, the business owner and any person designated by the business owner; • If the Account Owner is a partnership, each partner (or general partner in the case of a limited partnership)and any person designated by the partners; • If the Account Owner has any other form of organization or is an unincorporated organization or association, the individuals vested with the power to make decisions concerning the operation of the Account Owner must designate the person authorized to establish accounts at the Credit Union and transact business on such accounts on behalf of the Account Owner.

Authority: Authorized Persons are vested with authority to conduct transactions based on the privileges assigned on such account, to include any of the following:

• Viewing account balances and/or detailed information • Transferring funds into, out of, and between one or more account(s) • Issuing instructions regarding orders for payment or withdrawal, including stop payment requests • Access to Bill Pay • Access to Alerts • Access to enroll and view eStatements • Update account address • Check order requests • Log-in management • And others services based on system functionality

We have no obligation to inquire as to the use of any funds or the purpose of any transaction made on your account by an Authorized Person and are not responsible for any unauthorized transaction by an Authorized Person. Upon changes in authority, it is your responsibility to update the system access as necessary.

ELECTRONIC FUND TRANSFERS AGREEMENT AND DISCLOSURE

This Electronic Fund Transfers Agreement and Disclosure is the contract which covers your and our rights and responsibilities concerning the electronic fund transfers (EFT) services offered to you by Pen Air Federal Credit Union (“Credit Union”). In this Agreement, the words “you,” “your,” and “yours” mean those who sign the application or account card as applicants, joint owners, or any authorized users. The words “we,” “us,” and “our” mean the Credit Union. The word “account” means any one (1) or more savings and checking accounts you have with the Credit Union. Electronic fund transfers are electronically initiated transfers of money from your account through the EFT services described below. By signing an application or account card for EFT services, signing your card, or using any service, each of you, jointly and severally, agree to the terms and conditions in this Agreement and any amendments for the EFT services offered. Furthermore, electronic fund transfers that meet the definition of remittance transfers are governed by 12 C.F.R. part 1005, subpart B—Requirements for remittance transfers, and consequently, terms of this agreement may vary for those types of transactions. A “remittance transfer” is an electronic transfer of funds of more than $15.00 which is requested by a sender and sent to a designated recipient in a foreign country by a remittance transfer provider. Terms applicable to such transactions may vary from those disclosed herein and will be disclosed to you at the time such services are requested and rendered in accordance with applicable law. 1. EFT SERVICES — If approved, you may conduct any one (1) or more of the EFT services offered by the Credit Union. a. MasterCard Debit Card. If approved, you may use your card to purchase goods and services from participating merchants. However, you may not use your card to initiate any type of electronic gambling transactions through the Internet. If you wish to pay for goods or services over the Internet, you may be required to provide card number security information before you will be permitted to complete the transaction. You agree that you will not use your card for any transaction that is illegal under applicable federal, state, or local law. Funds to cover your card purchases will be deducted from your checking and/or . For one-time debit card transactions, you must consent to the Credit Union’s overdraft protection plan in order for the transaction amount to be covered under the plan. Without your consent, the Credit Union may not authorize and pay an overdraft resulting from these types of transactions. Services and fees for overdrafts are shown in the document the Credit Union uses to capture the member’s opt-in choice for overdraft protection and the Schedule of Fees and Charges. For other types of transactions, if the balance in your account is not sufficient to pay the transaction amount, the Credit Union may pay the amount and treat the transaction as a request to transfer funds from other deposit accounts, approved overdraft protection accounts, or loan accounts that you have established with the Credit Union. If you initiate a transaction that overdraws your account, you agree to make immediate payment of any overdrafts together with any service charges to the Credit Union. In the event of repeated overdrafts, the Credit Union may terminate all services under this Agreement. You may use your card and personal identification number (PIN) in ATMs of the Credit Union and such other machines or facilities as the Credit Union may designate. At the present time, you may also use your card to: - Make deposits to your savings, checking and Money Market accounts. - Withdraw funds from your savings, checking and Money Market accounts. - Transfer funds from your savings, checking and Money Market accounts. - Obtain balance information for your savings, checking and Money Market accounts. - Make loan payments from your savings, checking and Money Market accounts. - Access your Line of Credit accounts. - Make point-of-sale (POS) transactions with your card and personal identification number (PIN) to purchase goods or services at merchants that accept MasterCard. - Order goods or services by mail or telephone from places that accept MasterCard. The following limitations on MasterCard Debit Card transactions may apply: - You may make 20 MasterCard Debit Card purchases per day. - You may purchase up to a maximum of $3,500.00 per day. - You may withdraw up to a maximum of $510.00 in any one (1) day from an ATM machine, if there are sufficient funds in your account. - You may purchase up to a maximum of $3,500.00 from POS terminals per day, if there are sufficient funds in your account. - For security purposes, there are other limits on the frequency and amount of transfers available at ATMs. - You may transfer up to the available balance in your accounts at the time of the transfer. - See Section 2 for transfer limitations that may apply to these transactions. b. Health Savings Account. If you will be using your debit card to access a Health Savings Account (HSA), portions of this Agreement governed by Regulation E will not apply. A HSA account is defined by the IRS as a trust account, and therefore is not covered under Reg E. But portions of this Agreement such as MasterCard “0” liability for unauthorized use for example, do apply. Funds to cover your card purchases will be deducted from your Health Savings account. The Credit Union reserves the right to refuse any transaction which would draw upon insufficient funds (NSF). If you initiate a transaction that overdraws your account due to NSF fees, you agree to make immediate payment of any overdrafts together with any service charges, as allowed by law, to the Credit Union. In the event of overdraft of your HSA, the Credit Union may terminate all services under this Agreement. At the present time, you may also use your card to: - Make point-of-sale (POS) transactions with your card and to purchase goods or services at merchants that accept MasterCard. - Order goods or services by mail or telephone from places that accept MasterCard. The following limitations on Health Savings Account transactions may apply: - You may make 20 Health Savings Account purchases per day. - You may purchase up to a maximum of $3,500.00 per day. - You may purchase up to a maximum of $3,500.00 from POS terminals per day, if there are sufficient funds in your account. - See Section 2 for transfer limitations that may apply to these transactions. c. Flex-Tone. If we approve Flex-Tone for your accounts, a separate Access Code/personal identification number (PIN) will be assigned to you. You must use your personal identification number (PIN) along with your account number to access your accounts. At the present time, you may use Flex-Tone to: - Withdraw funds from your savings, checking and Money Market accounts. - Transfer funds from your savings, checking, loan, and Money Market accounts. - Obtain balance information for your savings, checking, loan, IRA, Money Market, Club, and certificate accounts. - Make loan payments from your savings, checking and Money Market accounts. - Access your Line of Credit accounts. - Determine if a particular item has cleared. - Obtain tax information on amounts earned on savings and checking accounts or interest paid on loan accounts. - Verify the last date and amount of your payroll deposit. Your accounts can be accessed under Flex-Tone via a touch-tone telephone only. Flex-Tone service will be available for your convenience 24 hours per day. This service may be interrupted for a short time each day for data processing. The following limitations on Flex-Tone transactions may apply: - There is no limit to the number of inquiries, transfers or withdrawal requests you may make in any one (1) day. - See Section 2 for transfer limitations that may apply to these transactions. The Credit Union reserves the right to refuse any transaction which would draw upon insufficient funds, exceed a credit limit, lower an account below a required balance, or otherwise require us to increase our required reserve on the account. All checks are payable to you as a primary member and will be mailed to your address of record. The Credit Union may set other limits on the amount of any transaction, and you will be notified of those limits. The Credit Union may refuse to honor any transaction for which you do not have sufficient available verified funds. The service will discontinue if no transaction is entered after numerous unsuccessful attempts to enter a transaction and there may be limits on the duration of each telephone call. d. Preauthorized EFTs. - Direct Deposit. Upon instruction of (i) your employer, (ii) the Treasury Department or (iii) other financial institutions, the Credit Union will accept direct deposits of your paycheck or federal recurring payments, such as Social Security, to your savings, checking and/or Money Market account. - Preauthorized Debits. Upon instruction, we will pay certain recurring transactions from your savings and/or checking account. - See Section 2 for transfer limitations that may apply to these transactions. - Stop Payment Rights. If you have arranged in advance to make electronic fund transfers out of your account(s) for money you owe others, you may stop payment on preauthorized transfers from your account. You must notify us in writing at any time up to three (3) business days before the scheduled date of the transfer. A stop payment request for preauthorized Electronic Fund Transfers will apply to all subsequent transfers, unless you withdraw the request. - Notice of Varying Amounts. If these regular payments may vary in amount, the person you are going to pay is required to tell you, ten (10) days before each payment, when it will be made and how much it will be. You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment or when the amount would fall outside certain limits that you set. - Liability for Failure to Stop Payment of Preauthorized Transfers. If you order us to stop payment of a preauthorized transfer three (3) business days or more before the transfer is scheduled and we do not do so, we will be liable for your losses or damages. e. Electronic Check Conversion/Electronic Returned Check Fees. If you pay for purchases or bills with a check or draft, you may authorize your check or draft to be converted to an electronic fund transfer. You may also authorize merchants or other payees to electronically debit your account for returned check fees. You are considered to have authorized these electronic fund transfers if you complete the transaction after being told (orally or by a notice posted or sent to you) that the transfer may be processed electronically or if you sign a written authorization. f. Online Banking. If we approve Online Banking for your accounts, a separate Access Code/password will be assigned to you. You must use your Access Code/password along with your account number to access your accounts. At the present time, you may use Online Banking to: - Withdraw funds from your savings, checking and Money Market accounts. - Transfer funds from your savings, checking and Money Market accounts. - Transfer funds from your savings, checking and Money Market accounts to accounts at another financial institution. - Transfer funds from another financial institution to your savings, checking and Money Market accounts. - Obtain balance information for your savings, checking, loan, IRA, Money Market, Club, certificate, and HSA accounts. - Make loan payments from your savings, checking and Money Market accounts. - Access your Line of Credit accounts. - Determine if a particular item has cleared. - Obtain tax information on amounts earned on savings and checking accounts or interest paid on loan accounts. - Verify the last date and amount of your payroll deposit. Your accounts can be accessed under Online Banking via personal computer. Online Banking will be available for your convenience 24 hours per day. This service may be interrupted for a short time each day for data processing. We reserve the right to refuse any transaction which would draw upon insufficient funds, exceed a credit limit, lower an account below a required balance, or otherwise require us to increase our required reserve on the account. All checks are payable to you as a primary member and will be mailed to your address of record. We may set other limits on the amount of any transaction, and you will be notified of those limits. We may refuse to honor any transaction for which you do not have sufficient available verified funds. The service will discontinue if no transaction is entered after numerous unsuccessful attempts to enter a transaction and there may be limits on the duration of each access. The following limitations on Online Banking transactions may apply: - There is no limit to the number of inquiries, transfers or withdrawal requests you may make in any one (1) day. - See Section 2 for transfer limitations that may apply to these transactions. g. Mobile Banking. If we approve Mobile Banking for your accounts, you must use your Online Banking Code along with your account number to access your accounts. At the present time, you may use Mobile Banking to: - Transfer funds from your savings, checking, loan, and Money Market accounts. - Obtain balance information for your savings, checking, IRA, Money Market, Club, and certificate accounts. - Make loan payments from your savings, checking and Money Market accounts. - Access your Line of Credit accounts. - Determine if a particular item has cleared. - Make bill payments to preauthorized creditors. Your accounts can be accessed under Mobile Banking via mobile device or other approved access device(s). Mobile Banking will be available for your convenience 24 hours per day. This service may be interrupted for a short time each day for data processing. We reserve the right to refuse any transaction which would draw upon insufficient funds, exceed a credit limit, lower an account below a required balance, or otherwise require us to increase our required reserve on the account. We may set other limits on the amount of any transaction, and you will be notified of those limits. We may refuse to honor any transaction for which you do not have sufficient available verified funds. The service will discontinue if no transaction is entered after numerous unsuccessful attempts to enter a transaction and there may be limits on the duration of each access. The following limitations on Mobile Banking transactions may apply: - There is no limit to the number of inquiries, transfers or withdrawal requests you may make in any one (1) day. - See Section 2 for transfer limitations that may apply to these transactions. h. Bill Pay. We will process bill payment transfer requests only to those creditors the Credit Union has designated in the User Instructions and such creditors as you authorize and for whom the Credit Union has the proper vendor code number. We will not process any bill payment transfer if the required transaction information is incomplete. We will process your bill payment requests by the designated cutoff time on the date you schedule for payment. You must allow sufficient time for vendors to process your payment after they receive a transfer from us. Please leave as much time as though you were sending your payment by mail. We cannot guarantee the time that any payment will be credited to your account by the vendor. The following limitations on Bill Pay transactions may apply: -The maximum amount of bill payments for new accounts (accounts opened less than 1 month) each day is $20,000.00, if there are sufficient funds in the account. The maximum amount of bill payments for all other accounts is $30,000.00, if there are sufficient funds in your account.

2. CONDITIONS OF EFT SERVICES — a. Ownership of Cards. Any card or other device which we supply to you is our property and must be returned to us, or to any person whom we authorize to act as our agent, or to any person who is authorized to honor the card, immediately according to instructions. The card may be repossessed at any time at our sole discretion without demand or notice. You cannot transfer your card or account to another person. b. Honoring the Card. Neither we nor merchants authorized to honor the card will be responsible for the failure or refusal to honor the card or any other device we supply to you. If a merchant agrees to give you a refund or adjustment, you agree to accept a credit to your account in lieu of a cash refund. c. Foreign Transactions. MasterCard. Purchases and cash withdrawals made in foreign currencies will be debited from your account in U.S. dollars. The exchange rate used to convert foreign currency transactions to U.S. dollars is either a government-mandated exchange rate or a wholesale exchange rate and is selected by MasterCard. The rate MasterCard uses for a particular transaction is the rate MasterCard selects for the applicable currency on the day the transaction is processed. This rate may differ from the rate applicable on the date the transaction occurred or was posted to your account. d. Security of Access Code. You may use one (1) or more access codes with your electronic fund transfers. The access codes issued to you are for your security purposes. Any access codes issued to you are confidential and should not be disclosed to third parties or recorded on or with the card. You are responsible for safekeeping your access codes. You agree not to disclose or otherwise make your access codes available to anyone not authorized to sign on your accounts. If you authorize anyone to use your access codes that authority shall continue until you specifically revoke such authority by notifying the Credit Union. You understand that any joint owner you authorize to use an access code may withdraw or transfer funds from any of your accounts. If you fail to maintain the security of these access codes and the Credit Union suffers a loss, we may terminate your EFT services immediately. e. Joint Accounts. If any of your accounts accessed under this Agreement are joint accounts, all joint owners, including any authorized users, shall be bound by this Agreement and, alone and together, shall be responsible for all EFT transactions to or from any savings and checking or loan accounts as provided in this Agreement. Each joint account owner, without the consent of any other account owner, may, and is hereby authorized by every other joint account owner, make any transaction permitted under this Agreement. Each joint account owner is authorized to act for the other account owners, and the Credit Union may accept orders and instructions regarding any EFT transaction on any account from any joint account owner. 3. FEES AND CHARGES — There are certain fees and charges for EFT services. For a current listing of all applicable fees, see our current Schedule of Fees and Charges that was provided to you at the time you applied for or requested these electronic services. From time to time, the charges may be changed. We will notify you of any changes as required by applicable law. If you use an ATM not operated by us, you may be charged a fee by the ATM operator and by any international, national, regional, or local network used in processing the transaction (and you may be charged a fee for a balance inquiry even if you do not complete a funds transfer). The ATM surcharge will be debited from your account if you elect to complete the transaction or continue with the balance inquiry. 4. MEMBER LIABILITY — You are responsible for all transactions you authorize using your EFT services under this Agreement. If you permit someone else to use an EFT service, your card or your access code, you are responsible for any transactions they authorize or conduct on any of your accounts. However, TELL US AT ONCE if you believe your card and/or access code has been lost or stolen, if you believe someone has used your card or access code or otherwise accessed your accounts without your permission, or if you believe that an electronic fund transfer has been made without your permission using information from your check. Telephoning is the best way of keeping your possible losses down. You could lose all the money in your account (plus your maximum overdraft line-of-credit). You are not liable for an unauthorized MasterCard debit card transaction if you can demonstrate that you have exercised reasonable care in protecting your card or access code from loss or theft and, upon discovering the loss or theft, you promptly report the loss or theft to us. For all other EFT transactions involving access devices, your liability for unauthorized transactions is determined as follows. If you tell us within two (2) business days after you learn of the loss or theft of your card or access code, you can lose no more than $50.00 if someone used your card or access code without your permission. If you do NOT tell us within two (2) business days after you learn of the loss or theft of your card or access code and we can prove that we could have stopped someone from using your card or access code without your permission if you had told us, you could lose as much as $500.00. Also, if your statement shows transfers that you did not make including those made by card, access code or other means, TELL US AT ONCE. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money lost after the 60 days if we can prove that we could have stopped someone from making the transfers if you had told us in time. If a good reason (such as a hospital stay) kept you from telling us, we will extend the time periods. RIGHT TO RECEIVE DOCUMENTATION — a. Periodic Statements. Transfers and withdrawals made through any debit card transactions, HSA debit card transactions, audio response transactions, preauthorized EFTs, online/PC transactions, mobile banking device transactions or bill payments you make will be recorded on your periodic statement. You will receive a statement monthly unless there is no transaction in a particular month. In any case, you will receive a statement at least quarterly. b. Terminal Receipt. You can get a receipt at the time you make any transaction (except inquiries) involving your account using an ATM and/or point-of-sale (POS) terminal. c. Direct Deposit. If you have arranged to have a direct deposit made to your account at least once every 60 days from the same source and you do not receive a receipt (such as a pay stub), you can find out whether or not the deposit has been made by calling (850) 505-3200 or (877) 4PENAIR. This does not apply to transactions occurring outside the United States. 6. ACCOUNT INFORMATION DISCLOSURE — We will disclose information to third parties about your account or the transfers you make: - As necessary to complete transfers; - To verify the existence of sufficient funds to cover specific transactions upon the request of a third party, such as a credit bureau or merchant; - If your account is eligible for emergency cash and/or emergency card replacement services and you request such services, you agree that we may provide personal information about you and your account that is necessary to provide you with the requested service(s); - To comply with government agency or court orders; or - If you give us your written permission. 7. BUSINESS DAYS — Our business days are Monday through Friday, excluding holidays. 8. CREDIT UNION LIABILITY FOR FAILURE TO MAKE TRANSFERS — If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we may be liable for your losses or damages. However, we will not be liable for direct or consequential damages in the following events: - If, through no fault of ours, there is not enough money in your accounts to complete the transaction, if any funds in your accounts necessary to complete the transaction are held as uncollected funds pursuant to our Funds Availability Policy Disclosure, or if the transaction involves a loan request exceeding your credit limit. - If you used your card or access code in an incorrect manner. - If the ATM where you are making the transfer does not have enough cash. - If the ATM was not working properly and you knew about the problem when you started the transaction. - If circumstances beyond our control (such as fire, flood or power failure) prevent the transaction. - If the money in your account is subject to legal process or other claim. - If funds in your account are pledged as collateral or frozen because of a delinquent loan. - If the error was caused by a system of any participating ATM network. - If the electronic transfer is not completed as a result of your willful or negligent use of your card, access code, or any EFT facility for making such transfers. - If the telephone or computer equipment you use to conduct audio response, online/PC, or mobile banking transactions is not working properly and you know or should have known about the breakdown when you started the transaction. - If you have bill payment services, we can only confirm the amount, the participating merchant, and date of the bill payment transfer made by the Credit Union. For any other error or question you have involving the billing statement of the participating merchant, you must contact the merchant directly. We are not responsible for investigating such errors. - Any other exceptions as established by the Credit Union. 9. NOTICES — All notices from us will be effective when we have mailed them or delivered them to the appropriate address in the Credit Union’s records. Notices from you will be effective when received by the Credit Union at the address specified in this Agreement. We reserve the right to change the terms and conditions upon which this service is offered. We will mail notice to you at least 21 days before the effective date of any change. Use of this service is subject to existing regulations governing the Credit Union account and any future changes to those regulations. The following information is a list of safety precautions regarding the use of ATMs and night deposit facilities: - Be aware of your surroundings, particularly at night. - Consider having someone accompany you when the ATM or night deposit facility is used after dark. - Close the entry door of any ATM facility equipped with a door. - If another person is uncomfortably close to you at the time of your transaction, ask the person to step back before you complete your transaction. If it is after the regular hours of the financial institution and you are using an ATM, do not permit entrance to any person you do not know. - Refrain from displaying your cash at the ATM or night deposit facility. As soon as your transaction is completed, place your money in your purse or wallet. Count the cash later in the safety of your car or home. - If you notice anything suspicious at the ATM or night deposit facility, consider using another ATM or night deposit facility or coming back later. If you are in the middle of a transaction and you notice something suspicious, cancel the transaction, take your card or deposit envelope, and leave. - If you are followed after making a transaction, go to the nearest public area where people are located.

- Do not write your personal identification number (PIN) or access code on your ATM card. - Report all crimes to law enforcement officials immediately. If emergency assistance is needed, call the police from the nearest available public telephone. 10. BILLING ERRORS — In case of errors or questions about electronic fund transfers from your savings and checking accounts or if you need more information about a transfer on the statement or receipt, telephone us at the following number or send us a written notice to the following address as soon as you can. We must hear from you no later than 60 days after we sent the first statement on which the problem appears. If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days. We will determine whether an error has occurred within ten (10)* business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45** days to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10)* business days for the amount you think is in error so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not credit your account. We will tell you the results within three (3) business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation. * If you give notice of an error within 30 days after you make the first deposit to your account, we will have 20 business days instead of ten (10) business days to investigate the error. ** If you give notice of an error within 30 days after you make the first deposit to your account, notice of an error involving a point-of-sale (POS) transaction, or notice of an error involving a transaction initiated outside the U.S., its possessions and territories, we will have 90 days instead of 45 days to investigate the error. 11. TERMINATION OF EFT SERVICES — You may terminate this Agreement or any EFT service under this Agreement at any time by notifying us in writing and stopping your use of your card and any access code. You must return all cards to the Credit Union. You also agree to notify any participating merchants that authority to make bill payment transfers has been revoked. We may also terminate this Agreement at any time by notifying you orally or in writing. If we terminate this Agreement, we may notify any participating merchants making preauthorized debits or credits to any of your accounts that this Agreement has been terminated and that we will not accept any further preauthorized transaction instructions. We may also program our computer not to accept your card or access code for any EFT service. Whether you or the Credit Union terminates this Agreement, the termination shall not affect your obligations under this Agreement for any electronic transactions made prior to termination. 12. GOVERNING LAW — This Agreement is governed by the bylaws of the Credit Union, federal laws and regulations, the laws and regulations of the state of Florida, and local clearinghouse rules, as amended from time to time. Any disputes regarding this Agreement shall be subject to the jurisdiction of the court of the county in which the Credit Union is located. 13. ENFORCEMENT — You are liable to us for any losses, costs or expenses we incur resulting from your failure to follow this Agreement. You authorize us to deduct any such losses, costs or expenses from your account without prior notice to you. If we bring a legal action to collect any amount due under or to enforce this Agreement, we shall be entitled, subject to applicable law, to payment of reasonable attorney’s fees and costs, including fees on any appeal, bankruptcy proceedings, and any post-judgment collection actions.

Pen Air Federal Credit Union Electronic Records Consent Agreement

Agreement: By selecting the "I Agree" box, you agree to be bound by the terms and conditions of this Agreement. Pen Air Federal Credit Union ("Credit Union" or "we") may modify this Agreement from time to time in its sole discretion, and such modifications shall be effective immediately upon delivery to you in either electronic or paper format.

You specifically consent and agree that we may, in our sole discretion, provide all disclosures, agreements, contracts, periodic statements, receipts, modifications, amendments, and all other evidence of our transactions with you or on your behalf electronically (hereinafter all such documentation is referred to as "electronic record(s)"). You understand that electronic records may include information about you and your account, including, but not limited to, your name, address, account numbers, check numbers and balance information. We may provide you any or all electronic records by secure email at the email address provided to us by you or we may post any or all electronic records at our home banking site, www.penair.org which you will need to provide login information to access. If we post electronic records on our website, we may send a notice to you at the e-mail address provided to us or within Online Banking alerting you of the posting of such records. If we send a notice to you within Online Banking, you will not receive a separate e-mail outside Online Banking alerting you of the posting of such records; you must log in to Online Banking from time to time to receive such notices. You agree that you will log in to Online Banking at least once every 30 days to ensure you receive such notices. If we post electronic records on Online Banking, the electronic records will remain available for at least ninety (90) days. We reserve the right to send any or all records to you in paper form to your current postal mailing address in our file.

You have a right to receive a paper copy of any of these electronic records if applicable law specifically requires us to provide such documentation. You may withdraw your consent and revoke your agreement to receive records electronically. To request a paper copy or to withdraw your consent and agreement to receive electronic records, you may withdraw consent for e-statements through the Online Banking member portal. You may also contact us at: Pen Air Federal Credit Union, Attn: Operations Support, 1495 East Nine Mile Road, Pensacola, FL 32514. A fee to cancel this service or to request paper copies of these electronic records may be imposed as set forth in your Service Fees Schedule.

EXCLUSION OF WARRANTIES. CREDIT UNION IS PROVIDING EACH ELECTRONIC RECORD "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON INFRINGEMENT AND TITLE. CREDIT UNION DOES NOT WARRANT THAT ELECTRONIC RECORDS ARE ERROR-FREE, OR THAT ACCESS TO AND USE OF ELECTRONIC RECORDS WILL BE UNINTERRUPTED OR ERROR-FREE.

LIMITATION OF LIABILITY. EXCEPT AS REQUIRED BY APPLICABLE LAW, IN NO EVENT SHALL CREDIT UNION BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES) ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF ELECTRONIC RECORDS, WHETHER INCURRED BY YOU OR ANY THIRD PARTY, EVEN IF CREDIT UNION HAS BEEN ADVISED OR MAY OTHERWISE KNOW OF THE POSSIBILITY OF SUCH DAMAGES. IF ANY LIABILITY IS IMPOSED ON CREDIT UNION, CREDIT UNION’S TOTAL LIABILITY TO YOU OR ANY THIRD PARTY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR ELECTRONIC RECORDS. THE FOREGOING SHALL CONSTITUTE CREDIT UNION’S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY HEREUNDER.

You may not assign this Agreement to any other party. Credit Union may assign this Agreement in its sole discretion without your consent. Credit Union may also, in its sole discretion and without your consent, assign or delegate certain of its rights and responsibilities under this Agreement to independent contractors or other third parties.

This Agreement is governed and shall be construed in accordance with the laws of the State of Florida, excluding its choice of law rules. In the event legal action is necessary to enforce this Agreement, the prevailing party has the right to payment by the other party of reasonable attorney’s fees and costs, including any appeal and post-judgment actions, as applicable. Except as prohibited by applicable law, you and Credit Union agree that such legal action shall be filed and heard in Escambia County, Florida. Any disputes regarding this Agreement shall be within the jurisdiction of the courts of Escambia County, Florida. Failure or delay in enforcing any right or provision of this agreement shall not be deemed a waiver of such provision or right with respect to any subsequent breach or a continuance of an existing breach. If any provision of this Agreement shall be held to be unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions of this Agreement will remain in full force and effect.

Equipment and Software Requirements: To receive electronic records, you need a computer internet access using Microsoft’s Internet Explorer version 10.0 or higher or Edge, the latest version of Mozilla’s Firefox, the latest version of Google’s Chrome, or Apple’s Safari version 12 or higher. By requesting any electronic funds transfers, internet banking, other electronic records, services or transactions, by submitting any application or agreement to us electronically or by e-mailing us, you represent that you have such equipment and software and that you can download, access, read, review, print and store the electronic records we provide to you.

"E-mail" Communication: You acknowledge and agree that the Internet is considered inherently insecure. Therefore, you agree that we have no liability to you whatsoever for any loss, claim for damages arising or in any way related to our response(s) to any e-mail or other electronic communication which we in good faith believe you have submitted to us. We have no duty to investigate the validity or to verify any e-mail or other electronic communication. We may respond to an e-mail communication provided by you to either the address provided with the communication or the e-mail address set forth.

Any e-mail returned to us as undelivered may be re-sent to you at any other e-mail address that we have in your file, unless you have previously informed us through electronic or written notice that an e-mail address is no longer valid.

Although we have no obligation to do so, we reserve the right to require authentication of e-mails or electronic communications. The decision to require authentication is in the sole discretion of the Credit Union. We will have no obligation, liability or responsibility to you or any other person or company if we do not act upon or follow any instruction to us if a communication cannot be authenticated to our satisfaction.

Electronic Signature: By selecting the "I Agree" button, you consent and agree that your Account Number and authorized Online Banking Password which were used to access this page constitute your signature, acceptance and agreement to the terms and conditions provided on this page, as if actually signed by you in writing. Further, you agree that no certification authority or other third party verification is necessary to the validity of your electronic signature. You agree that the lack of such certification or third party verification will not in any way affect the enforceability of your signature or any resulting contract between you and the Credit Union.
