Main Issue: The Inspector considered that the proposal would have a greater impact on the openness of the Green Belt than the existing development on site and therefore would be inappropriate in the Green Belt. The proposal would also have had an adverse impact on the character and appearance of the surrounding area. In accordance with the NPPF, substantial weight was given to the harm to the Green Belt. However, the Inspector accorded significant weight to the fact that the proposal would provide much needed housing to assist in addressing the Council's 5 year supply shortfall and gave some weight to the potential reduction in traffic generated by the site. Nonetheless, these considerations do not clearly outweigh the harm to the Green Belt and the other harm such that very special circumstances exist and the appeal was dismissed.

Main Issue: The proposal is not inappropriate development in the Green Belt and would not appear unacceptably prominent or incongruous in what would remain a sylvan setting. There would be a noticeable change to the appearance of the site frontage but there is no reason why an acceptable level of screening and attractive planting should not be established within a relatively short timescale. As there is no street lighting in Warren Row the concerns about external lighting are understood but this can be controlled by condition. The proposal would not unacceptably impact upon the existing character and appearance of the area. With regard to the living conditions of the occupiers of plots 4 and 5, the Inspector accepted the evidence presented by the appellant (which was contended by the Council with evidence despite the Inspector's comment) and concluded that the proposal would not result in unacceptable living conditions for future occupiers through overshadowing. The Inspector found that there would be no harm to nearby existing residents, including from vehicle lights exiting the site or from noise and disturbance. The proposal would not adversely affect the integrity, health or amenity value of the ancient woodland or other trees on the site. The proposal performs well against the three dimensions of sustainable development as set out in the NPPF and having regard to the issues raised, including the shortfall in deliverable supply of housing land, the Inspector concluded it to be acceptable and allowed the appeal.
