5. No visual barrier shall be provided along the easterly, westerly and northerly lot line along the boundary of a residential district instead of a visual barrier with not less than 1.2 metres in height and not greater than 2.0 metres in height. NOTES:

1. This property is subject to Site Plan Control; to date, no formal site plan application has been submitted and a full zoning review has not been conducted for the proposed development. Further variances may be required at such time that a formal zoning review is conducted on the proposed development.

2. The placement of the accessory structure (trailer without wheels) is subject to the issuance of a building permit in the normal manner.

Upon the lands merging in title, the legal non-conforming status was lost and lands became non-conforming respecting both the use and the zone regulations. AND IN THE MATTER OF AN APPLICATION by the agent DeFilippis Design on behalf of the owner Mark Berman, for relief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O. 1990, c. P. 13, so as to permit a lot to be conveyed (shown as Part 1) and a lot retained (shown as Part 2) and to permit construction of a new single family dwelling on each lot notwithstanding that:

1. A minimum Iot width of 10.0m shall be provided for the lands to be conveyed (Part 1) and the lands to be retained (Part 2) instead of the minimum 'required 12.0m lot width; -

2. A floor area ratio factor of 0.55 shall be provided for the lands to be conveyed (Part 1) and a floor area ratio factor of 0.53 shall be provided for the lands to be retained (Part 2) instead of the maximum permitted floor area ratio factor of 0.45 of the lot area;

3. Two (2) pai-king, spaces shall be provided for both the lot to be conveyed (Part 1) and the lot to be retained (part 2) instead of the minimum required three (3) parking spaces for a single family dwelling containing a total of ten (10) habitable rooms;

4. A minimum parking space length of 5.9m shall be provided for the parking spaces in the garage of the lands ,to be conveyed (Part 1) and the lands to be retained (Part 2) instead of the minimum required parking space length of 6.0m;

5. A minimum access driveway width of 2.7m shall be provided at thegarage door entrance for the parking spaces in the garage of the lands to be conveyed (Part 1) and the lands to be retained (Part 2) instead of the minimum required access, driveway width of 2.8m; and,

6. A miriimum of 49% of the.gross area of the front yard shall be landscaped for the lands to be conveyed (Part 1) instead of the requirement that no less than 50% of the gross area of the front yard shall be used for a landscaped area.

NOTE: i) The variance is to facilitate consent application HM/B-14:74 which is scheduled .to be heard .in conjunction with the minor variance application. ii) The existing single family dwelling and detached garage are intended to be demolished. iii) The applicant's agent has advised that the intended use of each building is a single family dwelling. A lodging house is not permitted. iv) The finishedgrade level of the garage shall be 0.3m above grade.

8. No manoeuvring on site shall be provided for the parking space #2 abutting Whitney Avenue instead of the minimum required of 6.0 m;

9. A minimum of 5.6 m manoeuvring space shall be provided for parking space # 1 instead of the minimum required of 6.0 m; and,

10. The manoeuvring space and accessibility to the parking spaces located on the south- east side lot line may be obstructed by another vehicle whereas the By-Law, requires a minimum 6.0 m wide manoeuvring aisle width and an unobstructed access to the parking space.

Notes: The maximum gross floor area as indicated in the submitted site statistic is 45.9 %; however, variance hasbeen written as requested by the applicant.

The maximum permitted height is 9.0 m as per site specific By-Law 95-02 (S-1335).
