EXECUTIVE SUMMARY The Committee met for two days in Casper. The Committee heard testimony and considered draft legislation regarding veterans skilled nursing facility, adjutant general responsibilities for providing access to forms and records, designating the National Guard Armory in Cheyenne as a museum, allowing the use of cemetery funding for other routine, preventative and deferred maintenance projects and purchases, and clarifying the military code jurisdiction for those in "duty status." In addition, the Committee received reports regarding the Revenue Information System modernization and maintenance, several other Wyoming Department of Transportation (WYDOT) matters and Wyoming Military Department (WMD) update regarding deployments and projects. The Committee also discussed draft legislation sponsored by Senator Meier regarding vehicle registration depreciation.

CALL TO ORDER (OCTOBER 22, 2018) Co-Chairman Anderson called the meeting to order at 9:04 a.m. The following sections summarize the Committee proceedings by topic. Please refer to Appendix 1-01 to review the Committee Meeting Agenda.

2018 FEDERAL INFRASTRUCTURE PLAN REPORT

Bill Panos, Director, WYDOT and Bob Ruwart, Chairman, Transportation Commission, discussed funding, unfunded operating needs and current revenues (Appendix 2-01). Director Panos discussed employee retention, cost of training new employees, specifically troopers and losing employees to the private sector. Chairman Ruwart provides an overview of the role of the Transportation Commission.

Dennis Byrne, Chief Fiscal Officer, WYDOT discussed more in-depth revenue, de-earmarking trends, general fund appropriations and federal funds for WYDOT (Appendix 2-01). The Committee presents questions and received answers regarding WYDOT unfunded operation needs and what qualifies as a need. CFO Byrne stated WYDOT has no new projects, just maintenance but maintenance is falling behind.

Gregg Frederick, Chief Engineer, WYDOT discussed facility needs, maintenance, prioritization of maintenance and taking a holistic look at the needs of buildings. Chief Engineer Frederick discussed briefly the airport improvement program.

Director Panos discussed Wyoming successes as Wyoming being one (1) of twenty-three (23) rural states to qualify for federal aviation funds for airport construction. Director Panos stated the bad news is highway trust fund will be bankrupt by 2020. WYDOT is working to receive money in discretionary and non- formula grants. Director Panos stated WYDOT is working with the federal government about identifying nine (9) transportation projects, one specific mega project is connected vehicles and connected highways. The federal government is providing some funding, with the goal of asset and people protection, stopping multiple truck crashes. Director Panos stated connected vehicles will not eliminate all crashes.

Mark Corthell and Brandon Corthell, Corthell Transportation, LLC, detailed a letter provided to the Committee which expressed concerns regarding enforcement of the multi-piece load provision and measurement of oversize and overweight loads throughout Wyoming’s port of entries. Mark Corthell stated Corthell Transportation is a small family trucking business based out of Rock Springs that specializes in hauling oversized overweight loads throughout the states. Corthell Transportation employees have concerns regarding the inconsistent interactions with enforcement throughout Wyoming’s port of entries, specifically Evanston’s port. Mark Corthell stated the inconsistent interactions are creating a hardship. (Appendix 2-02).

Kebin Haller, Colonel, WHP, discussed enforcement concerns regarding supersized loads, which are complicated with federal regulations. Colonel Haller stated weight load is regulated by the Federal Motor Carrier Safety Administration (FMCA). The Committee presented questions and received answers regarding heavier loads, routes identified to accommodate these types of loads, on and off ramps and revenue generated by permits. The Committee requests WHP provide more information regarding the safety and enforcement of supersized loads.

OTHER REPORTS OR FEDERAL ACTIONS

Director Panos and CFO Byrne, WYOT, provided an overview of the State Transportation Improvement Program (STIP) and how the program is funded (Appendix 3-01). Director Panos stated that federal law requires WYDOT to develop the STIP annually and the plan is reviewed by the Transportation Commission which authorizes preliminary engineering or construction funding. CFO Byrne stated highway improvements are largely funded by federal aid transportation funding authorized through congress based on the Fixing America’s Surface Transportation Act (FAST Act), which provides long-term funding for surface transportation programs through fiscal year 2020. Director Panos stated STIP is organized by county and WYDOT holds a public bid opening each month and the Transportation Commission considers and awards contracts monthly. Director Panos discussed additional funding being needed to maintain the state’s transportation system.

Brian Olsen, P.E., Administrator, Aeronautics Division, WYDOT, provided an overview of the aeronautics division and stated the division maintains a statewide system of airport capital improvement projects which are included in the STIP (Appendix 3-02). Administrator Olsen discussed the Wyoming Aviation Capital Improvement Plan (WACIP), highlights for fiscal year 2019 and current aeronautics project in Casper. He also stated federal funds are provided to Wyoming airports in varying percentages based on category.

REVENUE INFORMATION SYSTEM MODERNIZATION AND MAINTENANCE UPDATE

Director Panos and Taylor Rossetti, Support Services Administrator, WYDOT, provided an update of the Revenue Information System (RIS). Mr. Rossetti stated movement of the mainframe to the cloud hosted environment is the preferred solution but is costly. WYDOT must decide to use a stopgap approach that will extend the life of the current RIS system with significant costs or implement a long-term solution that will address system shortcomings and create opportunity for improvements. (Appendix 5-04). The Committee presented questions and received answers regarding RIS interacting with license plates, whether law enforcement will be connected, issues with duplicate numbers on license plates and cost for estimates.

OTHER BUSINESS TO BE PRESENTED TO THE COMMITTEE

Pat Lewis, Chief Technology Officer, WYDOT, provided an update on the status and highlights for each site location regarding WyoLink (Appendix 6-01). Mr. Lewis stated on-site meetings are continuous between WyoLink and local agencies to obtain landowner permissions which would allow for initial site evaluations. Lusk, Orin Junction and Wright studies are done.

Mr. Rossetti provided an overview of driver license/identification card update (Appendix 6-02). Mr. Rossetti stated cards are periodically redesigned for security considerations. The current card was designed in 2009-10 to be compliant with Department of Homeland Security’s guidelines for the REAL ID Act and American Association of Motor Vehicle Administrators (AAMVA) standards. Mr. Rossetti discussed the need for the card to be redesigned and provided the Committee with a sample of the new card.

DIRECTIONS TO LSO STAFF, REQUESTS OF OTHERS

Co-Chairman Ecklund directed LSO to move forward with preparing a draft bill for a new RIS system. LSO will work will WYDOT to prepare the draft legislation. The motion passed by voice vote.

Senator Meier expressed support for the Committee to sponsor a bill regarding vehicle registration- depreciation (Appendix 6-03). Senator Meier provided a review of the 2018 bill draft and expressed support for legislation centered on motor vehicles, extending the depreciation of registration fees through the tenth year of the vehicle’s service.

After Committee discussions, it was decided that the Committee would discuss the bill draft, vehicle registration depreciation draft bill further at their December meeting.

The Committee discussed load requirements for oversized, overweight truck loads. The Committee asked WYDOT and WHP for more specific data regarding load requirements and permitting requirements. Col. Haller stated he will provide the Committee with the requested information at the December meeting.

Senator Meier expressed concerns with rest areas under construction, being closed, or generally falling behind with maintenance on I-80. Director Panos touched on construction projects and repairs of rest areas

Director Panos directed his engineering staff to get a task force together to focus a plan for making rest areas in Wyoming world class.

VIEWING OF THE HISTORIC LICENSE PLATES COLLECTION AND TOUR OF WYOMING DEPARTMENT OF TRANSPORTATION PROJECT

The Committee recessed at 2:57 p.m., to view the historic license plates display (Appendix 7-01) and receive a briefing on the Westwinds Interchange Project, located at the Bar Nunn exit (194) at the intersection of Westwinds Road and Interstate 25 (Appendix 7-02).

Co-Chairman Ecklund called the meeting to order at 9:04 a.m.

MILITARY DEPARTMENT OVERVIEW

Luke Reiner, Colonel, Wyoming Military Department (WMD) provides an overview of agency updates (Appendix 9-01) regarding air guard and army deployments, current projects to include air guard supply building, Regional Training Institute and Laramie Readiness Center and accreditation of WCCA as an education institution. Col. Reiner discussed the Youth Challenge and the program going to two (2) starts a year, this would provide an extra two (2) million dollars in federal funds with 75% federal dollars and 25% state dollars.

VETERANS' SKILLED NURSING FACILITY REPORTS

Stephen Kravitsky, Director, Veterans Commission and Franz Fuchs, Policy Analyst, Wyoming Department of Health (DOH) discussed in the veteran’s skilled nursing facility by providing specifics on background, mission, capacity, location criteria and trade-offs, estimated costs, operations and next steps. Director Kravitsky and Analyst Fuchs also discussed the Level I and II feasibility studies (Appendix 10- 01 and 10-02). The Committee asks questions and received answers regarding the funding model, waiting list, notional floorplan, whether a site is shovel ready, public feedback received, location scores and estimated construction costs. Analyst Fuchs also discussed the DOH updated needs analysis (Appendix 10-03) and stated that the conclusions of the analysis is to allow Wyoming veterans access to a financial long-term care benefit, in the form of per diem payment from the VA, the facility will serve all veterans and high needs veterans who cannot be served in private nursing homes. Director Kravitsky discussed the proposed bill draft: veterans’ skilled nursing facility (Appendix 10-05) and stated the facility would provide skilled nursing care for veterans and their spouses, authorizes Level III construction plans and application for federal funding, designates administration, operation, loan and repayment requirements, establishes an account and provides for rulemaking.

Delbert McOmie, Director, Wyoming State Construction Department, discussed funding for the project and requests that the reporting requirement which requires the state construction department to report quarterly for the first three (3) years of the veteran’s skilled nursing facilities operation to be changed to the DOH.

Thomas Forslund, Director, Department of Health (DOH) expressed his support for the veterans skilled nursing facility but noted his concerns with priorities. Director Forslund stated he thought the veterans skilled nursing facility would take priority over the Veteran’s Home of Wyoming, in Buffalo, Wyoming. Director Forslund asked the Committee not to forget about the Buffalo facility as it needs repairs and serves many veterans.

Director Kratvisky stated if the Veteran’s Home of Wyoming in Buffalo had lifesaving beds it would be a priority. The Committee asked questions and received answers regarding the facility in Buffalo, the grant process, projected profit and loss for the proposed veterans skilled nursing facility.

The Committee discussed the findings and recommendations of the Joint Labor, Health and Social Services Committee report (Appendix 10-04).

PUBLIC COMMENT

A representative from the American Legion Department of Wyoming, Disabled American Veterans Department of Wyoming, Military Order of the Purple Heart Wyoming Chapter and the Veterans of Foreign Wars Department of Wyoming expressed support for the proposed bill draft and provided a letter of support to move forward with the Level III construction (Appendix 10-07).

Eric Boley, President, Wyoming Hospital Association, expressed support of the bill draft and urged the Committee to take a critical look at the workforce shortages issues. Mr. Boley stated shortage of CNA’s and nurses and contracting with CNA’s and nurses will only worsen with the aging population.

Director Forslund, DOH, stated that millions of dollars are spent every year contracting out for CNA’s and nurses because they can’t raise wages. The Committee discusses with Director Forslund private care vs. state care.

Ron Nading, Jr., retired Navy Petty Officer, expressed his support for the location of the veterans’ skilled nursing facility to be Casper. Mr. Nading stated Casper is the largest medical provider in state, has life flight and many other services. Mr. Nading stated he used to be a resident of Cody and driving over to Sheridan in winter months was difficult.

Nicole Hobbs, Brenda Gorm, Director of Nursing, Dr. Mark Schueller and Mary Mary Litzel, Johnson County Healthcare Center (JCHC), all expressed concerns with placing home in Buffalo. Ms. Hobbs stated the JCHC is nearly full every day, reimbursement does not cover daily care and the facility struggles daily to find staff. Ms. Hobbs stated they have seen CNA’s leave for higher pay and they are not sure how they will compete with a new facility that will be able to reimburse double. Ms. Hobbs and the others expressed support for the veterans’ skilled nursing facility but urged the Committee to not consider Buffalo as a location.

Terry Wilkinson, retired Army Guard, expressed his support for the veterans’ skilled nursing facility at any location.

Emily Quarterman Genoff, Director of Business Development, Wyoming Behavioral Institute (WBI), expressed her support for Casper as the location for the veterans’ skilled nursing facility. Ms. Genoff stated there is a shortage of long term care in Wyoming and Casper has the resources. The WBI is a training facility for nursing students.

Marge Christiansen, Director of Nursing, Casper College, expressed support for Casper as the location for the veterans’ skilled nursing facility. Ms. Christiansen stated CNAs programs are available at Casper College and the facility would create a new place for CNA students to train.

CONTINUE VETERANS SKILLED NURSING DISCUSSION AND NEXT STEPS

Bill Novotny and Michael Johnson, Commissioners, Johnson County, Michael Johnson, Mayor and Scott Madsen, Councilman, Buffalo, Wyoming, expressed support for Buffalo as the location for the veterans’ skilled nursing facility. Commissioner Novotny stated Buffalo is expanding and urged the Committee to look at the Level I and II studies. Mayor Johnson stated the Buffalo community can offer continuity of care. Councilman Madsen reminded the Committee that locating the veterans’ skilled nursing facility in Buffalo would save two (2,000,000.00) million dollars in construction costs and Buffalo has room for expansion.

Michelle Craig, Administrator and Keith Wilson, Green House Living for Sheridan, expressed their support for Sheridan as a location for the veterans’ skilled nursing facility. Ms. Craig stated the Level II study is very thorough and clearly stated that the facility should operate as a green house. Ms. Craig answered questions from the Committee regarding the financing for the Green House Living in Sheridan.

Chet Lockard, AIA, Principal-in-charge, MOA Architecture, discussed the design, cost and longevity of the veterans’ skilled nursing facility.

Keith Davidson, Chairman, Wyoming Veteran’s Commission, expressed his appreciation to the Committee for considering the proposed bill draft and agreed with Director Forslund that the Veteran’s Home of Wyoming, in Buffalo needs to be remembered.

Miles Harting, retired veteran and Patriot Guard Rider member, expressed support for Casper as the location for the veterans’ skilled nursing facility.

Glenn Catchpole, retired veteran, applauded the Committee’s effort and expressed support for Casper as the location for the veterans’ skilled nursing facility. Mr. Catchpole stated he supports Casper because it has the workforce and would serve the most Wyoming veterans.

Representative Joe MacGuire, expressed his appreciation to the Committee for its effort and stated he supports Casper as the location for the veteran’s skilled nursing facility. Representative MacGuire stated he supports Casper because of all the amenities it offers and that it is centrally located.

Steve Adami, Agape Manor Assisted Living, Buffalo, expressed opposition to Buffalo as the location for the veterans’ skilled nursing facility. Mr. Adami stated he is in favor for a facility but believes Buffalo does not have the workforce.

Representative Pat Sweeney and Carter Napier, City Manager for Casper, expressed their support for Casper as the location for the veterans’ skilled nursing facility. Representative Sweeney stated the Casper land was donated to the state.

Director Forslund offers insight into Casper proposition. He stated Casper donated to land to state for the Wilson School and Orphanage, then state donated back to Casper to be used as cemetery, but now Casper is offering to donate back to the state.

Kilty Brown, Central Wyoming Hospice & Transitions, expressed her appreciate to the Committee and supported Casper as the location for the veteran’s skilled nursing facility because of all the services Casper can offer.

Senator Bruce Burns expressed his desire for the facility to be in Sheridan. Senator Burns offered three (3) points for consideration: 1) Sheridan College already has a CNA program in place for the Green House Living for Sheridan, 2) Sheridan has the Sheridan VA Medical Center, the largest psychiatry hospital and 3) Casper may have more people but Sheridan has more veterans and is more convenient for veterans.

The Committee discussed a Level III study. Co-Chairs Ecklund and Anderson told the Committee they both will be attending the JAC meeting in Thermopolis.

Co-Chair Anderson moved the Committee to sponsor 19LSO0-241. The motion passed by voice vote. The Committee also approved the following amendments to the bill draft:

(19LSO-0014 v0.2) Colonel Chris Smith, Wyoming Military Department (WMD) provided an overview of the bill draft, adjutant general responsibilities-access to forms and records (Appendix 13-01), which specifies electronic forms and record keeping required of the Adjutant General.

After Committee discussion, Representative Blackburn moved the Committee sponsor 19LSO-0014 and the motion was seconded. The Committee adopted the following amendments:

Veterans cemetery-use of funds. (19LSO-0016 v0.5) Colonel Chris Smith, WMD, and Director Kravitsky provided an overview of the bill draft, veterans cemetery-use of funds (Appendix 13-03), which designates the historic Wyoming national guard armory as a museum.

After Committee discussion, Representative Brown moved the Committee sponsor 19LSO-0016 and the motion was seconded. The motion to sponsor the bill passed by roll call vote. (Senator Meier, Representatives Edwards, Loucks and Piiparinen voting no).

Military code jurisdiction. (19LSO-0017 v0.4) Colonel Chris Smith, WMD provided an overview of the bill draft, military code jurisdiction (Appendix 13-04), which clarifies the Wyoming military code’s application to service members.

After Committee discussion, Senator Meier moved the Committee sponsor 19LSO-0017 and the motion was seconded. The motion to sponsor the bill passed by roll call vote. (Representatives Blackburn, Blake, Crank, Edwards and Loucks voting no).
