BACKGROUND AND RATIONALE:

Blanket Student Athletic Insurance: Board Policy 09.312 provides in pertinent part that “all students in grades seven through twelve (7-12) trying out for, participating in or assisting with interscholastic athletics must be covered by school athletic insurance.” The District has historically required that all students be covered by a blanket student athletic policy with limits of $25,000 per injury. This ensures that all middle school athletes will have at least some level of accident insurance and all athletes will have accident insurance to meet the Kentucky High School Athletic Association’s (KHSAA’s) catastrophic deductible. The District renewal rate is flat due to lower than expected losses.

2. RFP 15-15 – Property, Boiler, and Fleet Insurance

BACKGROUND AND RATIONALE: The Board has the fiduciary responsibility to protect its financial assets, including physical assets, such as buildings, equipment, and vehicles. Risk Management and Safety utilizes various types of property and casualty insurance (including property, and vehicle insurance) as one means of assisting the Board in meeting this responsibility. The Model Procurement (45A.365) and (45A. 380) requires a competitive bid process on the property, and vehicles. Kentucky Insurance Group has the current contract, awarded in June 2015.

This extension will be the third year of the contract. The Kentucky Insurance Group/Liberty Mutual services have been excellent. It is recommended that the Board extend the current contract with The Kentucky Insurance Group/Ohio Casualty for one year for the dates of July 1, 2017 through June 30, 2018.

Property insurance is renewing with no rate increase. However, vehicle insurance is increasing by six (6) percent. Due to the increase in the number of vehicles and an increase in number of claims.

3. Workers Compensation and General Liability Insurance

Background and Rationale: The District currently obtains Workers’ Compensation (WC), General Liability (GL) and Educators Legal Liability (ELL) from the Roeding Group/Public Entity Group. Workers’ Compensation coverage is provided through Kentucky Employer Mutual Insurance (KEMI). This is the fourth year with KEMI and the modification factor (MOD) is .97 (a MOD of one (1) is considered standard). Due to an increase in payroll and an increase of our MOD by .04, the WC premium will increase by $102,802.91 for the coming fiscal year.

GL and ELL coverages are being provided through Brit Insurance Services USA, Inc. at a flat rate. The self-insured ELL deductible will remain $100,000 and the GL will be $50,000.

BACKGROUND AND RATIONALE: Plant Operations and Maintenance have several pieces of equipment that are no longer of use. Background/Rationale: KDE regulations required SBDM Councils to approve a purchasing plan for the use of these funds and those plans, in turn, must be approved by the board of education and then kept on file. According to board policy, instructional resource means “any print, non-print, or electronic medium of instruction designed to assist students.” As noted above, the board is required to approve school instructional materials plans before schools can use these state grant funds under 704 KAR 3:455.

Wilburn, Inc. for the construction of Frederick Douglass High School in the amount of $493,301.33 (Four Hundred Ninety-three Thousand, Three Hundred One Dollars and Thirty-three Cents), with an equivalent transfer of funds from Object Code 0840 to 0450, and a corresponding transfer of $22,691.87 (Twenty-two Thousand, Six Hundred Ninety-one Dollars and Eighty-seven Cents) for design consultant fees from Object Code 0840 to 0346, subject to the approval of the Kentucky Department of Education, District Facilities Branch, per the provisions of 702 KAR 4:160.

Background/Rationale: The construction of a new high school to be located on 65 acres at 2000 Winchester Road (formerly 1970 Winchester Road) is listed as priority 1a.5 on FCPS's 2013 District Facility Plan. Tate Hill Jacobs Architects produced final Construction Documents for bidding describing the construction of a new building totaling approximately 285,790 SF to serve 1,800 students. The 21st Century high school program was developed during a series of Building Committee meetings attended by FCPS instructional and administrative leadership, and refined in small group meetings where teachers provided direction related to collaborative teaching and project-based subject matter. The program is consistent with recent new high school projects across the nation and provides new building space that functions and supports current FCPS enrollment growth. Bids were received on May 7, 2015 and construction began in June, 2015. The Office of Facility Design & Construction, the design consultants and the local building code officials have reviewed the progress of the work. Changes to the original plans and specifications have been necessary in order to satisfy the requirements described below. Approval of these changes allows the work to be completed. The description and cost of these items are summarized as follows:

Bid documents were prepared by the architect, Pearson & Peters Architects, for a contract for the renovation of the Tates Creek High School Shot Put and High Jump. The contract in the total amount of $179,000.00, with Hawkins Construction, Inc. was accepted and approved by the Board in a meeting held on January 25, 2016 and construction began immediately thereafter. The Office of Facility Design & Construction, the design consultants Pearson & Peters Architects, and the local building code officials have reviewed the progress of the work. Minor changes to the original plans and specifications have been necessary in order to: resolve unforeseen existing conflicts found during construction; comply with building code requirements; correct deficiencies in the plans; or to provide improvements over the original specification. The Board has simultaneously approved the BG-4 in the amount of $221,182.00. The residual fund balance will be applied to future debt service or to the next District Facility Plan project. At this time the BG-5 Project Closeout Form closing out all construction contracts related to this project is presented for approval.

Background/Rationale: The construction of a new 650-student elementary school to be located on a new site is listed as priority 2a.1 on FCPS's 2013 District Facility Plan. The building construction project will be funded through a bond issue and is subject to the approval of the Kentucky Department of Education. A BG-1 Project Application for the construction, identifying the extent and cost of the work, has been approved by the Board and has been filed with the Kentucky Department of Education. At this time, the Board is required by 702 KAR 4:160 to indicate acceptance of the schematic design represented in the plans prepared by the design consultants EOP Architects. Based on the review of these documents by FCPS staff, the Office of Facility Design & Construction recommends approval of these plans. Upon the Board’s approval, these documents will be submitted to the KDE District Facilities Branch for review and approval prior to the preparation of design development documents.
