1. ADOPTED BY THE STATES (a) Opticians (Registration) (Amendment No 2) (Jersey) Law 201- (P.120/2016—adopted in 3rd reading, 17.1.17) This Law restricts the supply of cosmetic contact lenses and makes other minor changes to up-date the Opticians (Registration) (Jersey) Law 1962. (b) Public Elections (Amendment No 7) (Jersey) Law 201- (P.124/2016—adopted in 3rd reading, 18.1.17) This Law makes provision to permit voting by certain categories of persons who are in prison on the day of a poll for a public election. (c) Public Elections (Amendment No 8) (Jersey) Law 201- (P.125/2016—adopted in 3rd reading, 18.1.17) This Law makes miscellaneous small scale amendments to the Public Elections (Jersey) Law 2002 and other associated enactments. (d) Sea Fisheries (Amendment No 3) (Jersey) Law 201- (P.128/2016—adopted in 3rd reading, 18.1.17) This Law removes the requirement for the States to consult with and obtain the concurrence of the Secretary of State before making any Regulations under certain articles of the Sea Fisheries (Jersey) Law 1994. (e) Commissioner for Standards (Jersey) Law 201- (P.87/2016—adopted in 3rd reading, 1.2.17) This Law establishes the office of Commissioner for Standards for the purpose of investigating breaches of various codes relating to conduct of elected members of the States of Jersey. (f) Bank (Recovery and Resolution) (Jersey) Law 201- (P.134/2016—adopted in 3rd reading, 14.2.17) This Law implements provisions of Directive 2014/59/EU establishing a framework for the recovery and resolution of credit institutions and investment firms. (g) Criminal Justice (Compensation Orders) (Amendment No 3) (Jersey) Law 201- (P.2/2017—adopted in 3rd reading, 14.3.17) This Law makes provision to increase the maximum amount of compensation paid under a compensation order made by the

(h) Water Pollution (Amendment No 3) (Jersey) Law 201- (P.3/2017—adopted in 3rd reading, 14.3.17) This Law facilitates and simplifies the process for implementing controls on water pollution. (i) Income Support (Amendment No 2) (Jersey) Law 201- (P.5/2017—adopted in 3rd reading, 14.3.17) This Law makes provision to allow care assessments to be considered under the Income Support (Jersey) Law 2007. (j) Referendum (Jersey) Law 201- (P.4/2017—adopted in 3rd reading, 28.3.17) This Law repeals and replaces the Referendum (Jersey) Law 2002 so as to make provision for the establishment of a referendum commission and for regulating referendum campaign spending.

REGULATIONS MADE BY THE STATES (a) Animal Health (Consequential Amendments) (Jersey Regulations 2017 (R&O.3/2017—in force 1.2.17) These Regulations make amendments, as a consequence of the enactment of the Animal Heath (Jersey) Law 2016, to certain Jersey enactments giving effect to EU legislation. (b) Prison (Independent Prison Monitoring Board) (Jersey) Regulations 2017 (R&O.4/2017—in force 18.4.17) These Regulations provide for the establishment, functioning and administration of the new Independent Prison Monitoring Board. (c) States of Jersey Police Force (Chief Officer and Deputy Chief Officer) (Jersey) Regulations 2017 (R&O.24/2017—in force 21.2.17) These Regulations make provision for the appointment, suspension and removal of the Chief Officer and Deputy Chief Officer of the States of Jersey Police and establish procedures for dealing with complaints and conduct which may involve criminal or disciplinary matters. (d) States of Jersey Police Force (Police Negotiating Board) (Jersey) Regulations 2017 (R&O.25/2017—in force 21.2.17) These Regulations make provision for the Police Negotiating Board to continue its function of negotiating with the States Employment Board concerning the terms and conditions of the appointment of police officers. (e) Employment of States of Jersey Employees (Amendment No 8) (Jersey) Regulations 2017 (R&O.41/2017—in force 29.3.17) These Regulations make provision concerning the recruitment to the post of Chief Executive Officer for the States of Jersey. (f) Public Elections (Amendment of Law) (Jersey) Regulations 2017 (R&O.46/2017—in force 25.4.17)

These Regulations change the date on which annual statements of the names of residents are sent out on behalf of the electoral administrator. 5. OTHER SUBORDINATE LEGISLATION OF NOTE (a) Main Roads (Classification) (No 29) Jersey) Act 2017 (R&O.47/2017—in force 18.4.17) This Act declares various roads in the Rue des Près Trading Estate to be main roads under the Loi (1914) sur la Voirie.

BAILIWICK OF GUERNSEY 1 January–30 April 2017 A. GUERNSEY 1. LAWS APPROVED BY THE STATES OF DELIBERATION (a) Beneficial Ownership of Legal Persons (Guernsey) Law 2017 (Billet d’État No VIII of 2017. Approved 26.04.17) This Law establishes the Office of the Registrar of Beneficial Ownership of Legal Persons, sets out the powers and functions of the Registrar, imposes new duties on beneficial owners of legal persons and resident agents relating to the provision of information, and makes related provision. The Law also makes appropriate amendments to the “relevant legal person Laws”—i.e. the Companies (Guernsey) Law 2008, the Limited Liability Partnerships (Guernsey) Law 2013 and the Foundations (Guernsey) Law 2012— and makes amendments to other legislation to ensure that the Guernsey Financial Services Commission has appropriate supervisory powers in respect of persons it regulates.

2. ORDINANCES APPROVED BY THE STATES OF DELIBERATION (a) Supplementary Benefit (Residence Conditions) Ordinance 2017 (Billet d’État No V of 2017. Approved 15.02.17—in force 03.04.17) This Ordinance is made under powers contained in the Supplementary Benefit (Guernsey) Law 1971. It provides that a relevant person satisfying the usual conditions for eligibility for a supplementary benefit will not be eligible for that benefit unless he or she has also at any time resided in Guernsey or for a continuous period of 5 years. It also enables the Administrator to direct that the 5 year residence condition shall not apply where he or she is of the view that there are exceptional circumstances that apply in relation to the relevant person concerned. A “relevant person” is defined as a person whose resources are insufficient to meet his or her requirements and who occupies, or is otherwise resident in, a property inscribed in Part D of the Housing Register. (b) Land Planning and Development (Use Classes) Ordinance 2017 (Billet d’État No VII of 2017. Approved 29.03.17—in force 03.04.17) This Ordinance repeals and replaces the Land Planning and Development (Use Classes) Ordinance 2007. Its main purpose is to prescribe use classes for the purposes of the Land Planning and Development (Guernsey) Law 2005 (“the Law”). It also specifies that where a building or other land is used for a purpose of any

numbered use class then its use for any other purpose of the same numbered class shall not be taken to constitute development so that planning permission will not be required. (c) Land Planning and Development (Plans) (Amendment) Ordinance 2017 (Billet d’État No VII of 2017. Approved 29.03.17—in force 29.03.17) This Ordinance amends s 9(4) of the Land Planning and Development (Plans) Ordinance 2007 to remove the requirement that the Development & Planning Authority have to request the Committee for the Environment & Infrastructure to lay proposals for a new development plan or amendments to the same before the States. The result of the amendment is that there will instead be a duty on the Development & Planning Authority to lay such proposals, together with the other documents listed in s 9(4), before the States. (d) Population Management (Guernsey) Law 2016 (Commencement) Ordinance 2017 (Billet d’État No VII of 2017. Approved 30.03.17—in force 30.03.17) This Ordinance brings the Population Management (Guernsey) Law 2016 into force on 3 April 2017, with the exception of para 3 of Schedule 4, which amends the Children (Guernsey and Alderney) Law 2008. Alternative provision in this respect is made in the Population Management (Miscellaneous Provisions) Ordinance 2017. (e) Population Management (Miscellaneous Provisions) Ordinance 2017 (Billet d’État No VII of 2017. Approved 31.03.17—in force 03.04.17) This Ordinance makes provision in respect of the residential status, for the purposes of the Population Management (Guernsey) Law 2016, of minors in fostering, pre-adoptive and similar arrangements, both those accommodated in a dwelling in Guernsey and those who are accommodated outside Guernsey; students from other parts of the Bailiwick accommodated during term time in a dwelling in Guernsey; persons receiving medical treatment outside Guernsey; and prisoners, including persons remanded in custody before trial. (f) Population Management (Guernsey) Law 2016 (Amendment) Ordinance 2017 (Billet d’État No VII of 2017. Approved 31.03.17—in force 03.04.17) This Ordinance amends the transitional provisions in the Population Management (Guernsey) Law 2016 set out at s 6. The purpose of the amendments is primarily to ensure that all persons resident in Guernsey on the coming into force of the Population Management

(Guernsey) Law 2016 are able to benefit properly from the shorter qualification periods introduced by the new regime. The Ordinance also makes a minor amendment to s 57 of that Law (another transitional provision), and amends s 83 to ensure that the time spent outside Guernsey by the spouse/partner of a person serving with HM Forces is treated as ordinary residence in Guernsey where appropriate. (g) Open Market Housing Register Ordinance 2017 (Billet d’État No VII of 2017. Approved 31.03.17—in force 03.04.17) This Ordinance makes provision in respect of the form of the Open Market Housing Register, and in respect of requirements to notify the Committee for the Environment & Infrastructure of proposed alterations to inscribed dwellings. (h) Open Market Housing Register (Guernsey) Law 2016 (Commencement) Ordinance 2017 (Billet d’État No VII of 2017. Approved 31.03.17—in force 31.03.17) This Ordinance brings the Open Market Housing Register (Guernsey) Law 2016 into force on 3 April 2017. (i) Open Market Housing Register (Part D Cap) Ordinance 2017 (Billet d’État No VII of 2017. Approved 31.03.17—in force 03.04.17) This Ordinance prescribes the “Part D Cap”—that is, the maximum number of properties that may be inscribed in Part D of the Open Market Housing Register. (j) Image Rights () (Amendment) Ordinance 2017 (Billet d’État No VII of 2017. Approved 31.03.17—in force 01.04.17) This Ordinance amends the Image Rights (Bailiwick of Guernsey) Ordinance 2012 so as to insert a power enabling the Registrar to issue, after consultation with the Committee for Economic Development and other interested parties, Codes of Practice giving guidance as to procedures and best practice in relation to registered image rights, including standards of conduct to be observed by registered image rights agents. The provisions of such codes and any breach thereof may be taken into account by the Registrar in exercising his functions and in any legal proceedings. An amendment is also made to the Image Rights (Bailiwick of Guernsey) Regulations 2012 so as to enable the Registrar to obtain information from agents regarding standards of practice, etc., in order to assist him in exercising his functions under the Ordinance. (k) Same-Sex Marriage (Consequential and Miscellaneous Amendments and Contrary Provisions) (Guernsey) Ordinance 2017

(Billet d’État No VIII of 2017. Approved 26.04.17—in force 02.05.17) This Ordinance is made under sections 5(2) and 12 of the Same-Sex Marriage (Guernsey) Law 2016 (“the 2016 Law”). It makes consequential and miscellaneous amendments to various enactments. The majority of the amendments arise from the introduction of the possibility that the parties to a marriage might be of the same sex (e.g. terminology such as “husband and wife” amended to read “spouses”). A further category of amendments extends various provisions relating to cohabiting couples to same-sex cohabiting couples (e.g. the extension of the provisions in the Domestic Proceedings and Magistrate's Court (Guernsey) Law, 1988 relating to domestic violence orders). The Ordinance also disapplies, in respect of certain enactments, the general principle of “equivalence” set out in the 2016 Law; that the law of Guernsey shall have the same effect in relation to same- sex marriage as it does in relation to opposite-sex marriage, and that existing Guernsey legislation will be interpreted in this way. (l) Protection of Investors (Limitation of Liability) (Bailiwick of Guernsey) (Amendment) Ordinance 2017 (Billet d’État No VIII of 2017. Approved 26.04.17—in force 26.04.17) This Ordinance amends the Protection of Investors (Limitation of Liability) (Bailiwick of Guernsey) Ordinance 2014, by substituting references to the Securities Exchange Authority Limited with references to The International Stock Exchange Authority Limited (Guernsey company registration number 57527). (m) Access to Neighbouring Land (Guernsey) Law 2016 (Commencement) Ordinance 2017 (Billet d’État No VIII of 2017. Approved 26.04.17—in force 26.04.17) This Ordinance brings the Access to Neighbouring Land (Guernsey) Law 2016 into force on 1 May 2017. (n) Same-Sex Marriage (Guernsey) Law 2016 (Commencement) Ordinance 2017 (Billet d’État No VIII of 2017. B. ALDERNEY 1. LAWS APPROVED BY THE STATES OF ALDERNEY (a) Beneficial Ownership of Legal Persons (Alderney) Law 2017 (Approved 19.04.17) This Law makes provision in Alderney largely equivalent to and consistent with the Beneficial Ownership of Legal Persons (Guernsey) Law 2017 (see item A.1.(a)). It establishes the Register of Beneficial Owners of Legal Persons in Alderney, and provides that the Registrar shall be the Alderney . The Law also amends the Companies (Alderney) Law 1994.
