INTRODUCTION

The Western Cape Government (WCG): Department of Transport and Public Works (DTPW) (Road Design) is proposing to upgrade a section of the R43 (also known as Trunk Road 28, Section 1) between Botrivier and Hermanus. The focus area of the proposed project is the section of road that starts ± 600 m from the Lynx Road intersection at Vermont (km 23.00) and ends at the Mussel Road intersection in Hermanus (km 29.46) (see Figure 1). The road section consists of a single carriageway, except for an approximate 2.5 km section of road between the Onrus River bridge and the Mussel Road intersection which is a dual carriageway.

The following works are proposed in order to upgrade the section of road between Lynx Road and : • Dualling of the existing single carriageway road to an Urban Class E (ii) cross-section consisting of 3.7 m lanes with 3.1 m outside shoulders and a 5.0 m paved median; • The provision of bus stops at major intersections and junctions; • The provision of appropriate stormwater channels along the kerbed sections and the widening of the road reserve width by 15 m to a minimum width of 45 m between km 23.0 and km 27.14; • The provision of dedicated turning lanes at main accesses, as appropriate; • The relocation of various services and shifting of an existing 10 m services servitude to the north adjacent to the new road reserve; and • The dualling of the existing road bridge over the Onrus River.

The proposed work also entails works on various culverts along the road and the relocation and provision of new access roads to Amana, Berghof Estate and Kidbrooke Place. A pavement reseal on the road section between km 26.69 (Hemel and Aarde Road) and km 29.46 (Mussel Road) is also proposed.

SLR Consulting (South Africa) (Pty) Ltd (SLR) has been appointed by EFG Engineers (Pty) Ltd to undertake the required Environmental Authorisation (EA) process in terms of the Environmental Impact Assessment (EIA) Regulations, 2014 (as amended) promulgated under the National Environmental Management Act, 1998 (No. 107 of 1998; NEMA).

PURPOSE OF THE REPORT

On 14 May 2020, the Department of Environmental Affairs and Development Planning (DEA&DP) issued a Circular (DEA&DP No. 0012/2020) providing input on the permitted EIA and related licensing services and permitted supporting professional services in terms of the Lockdown Regulations of 29 April 2020 (read with the Department of Environment, Forestry and Fisheries (DEFF) EIA Directions of 31 March 2020). Particular reference is made to Section 18.8 of the Circular which states the following:

“With EIA and related permitting processes and supporting processional services being permitted services under Lockdown Alert Level 4, it should be possible for an EAP, Specialist and other Professionals to meet all the public participation requirements set out in Regulation 41 of the EIA Regulations (e.g. putting up site notices, etc.). To ensure that reasonable notice is given to potential and registered interested and affected parties (“I&APs”), DEA&DP should be approached with a proposed Public Participation Plan setting out all the public participation steps, including the additional measures, proposed. (Note: The intension in terms of the proposed amendments to / replacement of the EIA Directions of 31 March 2020 is to make the submission of a Public Participation Plan, to be agreed to by the relevant authority, compulsory.”

As part of initiation of the Basic Assessment (BA) process for the proposed project, email correspondence was made with DEA&DP on Wednesday, 18 November 2020. DEA&DP confirmed that a Public Participation Plan (PP Plan) would be required to be submitted prior to the commencement of any environmental process. Thus, this PP Plan has been compiled for consideration by DEA&DP and summarises the proposed methods that SLR will use to ensure that:

1. Information containing all relevant facts in respect of the application is made available to potential I&APs; and

2. All potential or registered I&APs are provided with a reasonable opportunity to comment on the application.

Furthermore, the PP Plan considers the effectiveness of the regulatory requirements to bring the proposed project and application to the attention of I&APs under the current COVID-19-related restrictions and identifies additional measures which will be undertaken in this regard. Once agreement with the PP Plan has been reached with DEA&DP, SLR will commence the envisaged public participation process for the above-mentioned project.

PUBLIC PARTICIPATION METHODOLOGY

3.1 PRE-APPLICATION PUBLIC PARTICIPATION PROCESS

The tasks undertaken to date as part of the pre-application public participation process are set out below.

3.1.1 Database

A preliminary I&AP database was compiled consisting of landowners, councillors, authorities (local, regional and national, as applicable), Organs of State, Non-Government Organisations, Community-Based Organisations and other key stakeholders. The database was compiled using databases from previous projects undertaken in the broader study area. To date, 64 I&APs have been registered on the project database.

3.1.2 Meetings with key I&APs

Key I&APs were identified (those from whom portions of land would be expropriated) and meetings were undertaken with directly affected parties in order to afford them the opportunity to discuss key concerns / implications of the proposed project, before finalising designs and notifying the broader public. Meetings were undertaken on 13 and 15 August 2019.

3.1.3 Site Notices

Site notices were placed at three points along the route (at areas where vehicles can pull over safely) on 13 November 2020. Site notices were placed at the approximate start, middle and end points of the route and were placed in order for the notice to be visible to traffic travelling in both directions. Site notices were placed in both English and and provided an opportunity for I&APs to register on the project database prior to distribution of the draft BAR for formal comment.

3.2 APPLICATION PUBLIC PARTICIPATION PROCESS

Tasks envisaged for the public participation process still to be undertaken are set out below.

3.2.1 Advertisements

Advertisements notifying the public of the proposed project and availability of the draft BAR for comment would be placed in the Cape Times (in English), Die Burger (in Afrikaans) and the Hermanus Times (in English).

3.2.2 General I&AP notifications

A notification letter (in English and Afrikaans) and Executive Summary (in English) would be sent to all registered I&APs on the project database to inform them of the availability of the draft BAR for a 30-day public review and comment period. The notification letter would be sent via e-mail and courier / hand delivery (where e-mail addresses are not available). The notification letter would also contain a link to the SLR website (www.slrconsulting.com) that I&APs can use to access and download the full draft BAR. In line with the current more relaxed COVID-19 restrictions, public libraries are now open in the Hermanus area. It is thus proposed to place a hard copy of the draft BAR in the Hermanus library for the duration of the comment period.

Should any I&AP contact SLR to indicate that they are not able to access any of the online project documentation due to lack of internet connectivity, SLR will implement suitable alternative means of providing the requested project information to these stakeholders. Such measures may include (but are not limited to) the following:

• Sending hard copies of the comprehensive Executive Summary of the reports; and

• Having a telephonic discussion to answer any queries that I&APs may have regarding the proposed project.

All comments received in response to the draft BAR would be collated and responded to in a BAR Comments and Responses Report, which would be appended to the final BAR. The comments would be duly taken into consideration in the process of updating the draft BAR. A copy of the final BAR would be submitted to the competent authority for decision-making. Thereafter, a notification letter (in English and Afrikaans) would be sent to all registered I&APs on the project database to inform them of the submission. The notification letter would be sent via e-mail and courier / hand delivery (where e-mail addresses are not available). The notification letter would also contain a link to the SLR website that I&APs can use to access the full final BAR.

3.2.3 Authority notifications

A notification letter and Executive Summary would be sent to all commenting authorities on the project database to inform them of the availability of the draft BAR for a 30-day authority review and comment period. The notification letter would be sent via e-mail and courier / hand delivery (where e-mail addresses are not available). The notification letter would also contain a link to the SLR website (www.slrconsulting.com) that I&APs can use to access and download the full draft BAR.

A notification letter, a soft copy (via AMS MFT software) and hard copies (if required) of the full draft BAR would be provided to the competent authority, DEA&DP, for review and comment via email and courier / hand delivery, respectively.

Table 1 below lists all authorities on the project database that would be consulted as part of the proposed public participation process.

3.2.4 Project Schedule

The currently envisaged key I&AP consultation dates are provided in Table 2 below.

PRESCRIBED TIMEFRAMES

SLR intends to undertake the actions associated with the BA process within the prescribed timeframes as set out in the EIA Regulations, 2014 (as amended). The only exception is that an additional three weeks will be provided for comment on the draft BAR. Given that the project is located within a popular holiday area, it is proposed to extend the draft BAR comment period across the holiday period.

As key I&APs affected by the project have already been directly engaged with, it is not currently planned to release a pre- application draft BAR. The first formal contact with the broader public will thus be the distribution of the draft BAR when the formal Application process commences.

The proposed public participation process (as set out in Sections 3.1 and 3.2 above) is considered to be sufficient to provide I&APs with a reasonable opportunity to comment on the proposed application.

SLR believes that the above-mentioned measures will provide I&APs with a reasonable opportunity to comment on the application. Notifications to I&APs will thus include a request that submissions be made within the prescribed timeframes (albeit the draft BAR comment period) as set out in the EIA Regulations, 2014 (as amended).

CONCLUSION

In light of the relaxation on COVID-19-related restrictions, SLR has devised a PP Plan to ensure that the proposed project would sufficiently be brought to the attention of potential I&APs. SLR is of the opinion that the public participation methodology presented in this PP Plan is adequate and would allow for the proposed project to be advertised in a manner that is reasonable, fair, just and acceptable.

Triggere d Listed Activities: A Basic Assessment (BA) process is required as part of an Application for EA for the proposed project as it triggers Listed Activity 19 of Government Notice (GN) R. 983, as amended (Listing Notice 1) – (19) The infilling or depositing of any material of more than 10 cubic metres into, or the dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock of more than 10 cubic metres from a watercourse;…; and Listed Activities 12 and 18 of GN R. 985, as amended (Listing Notice 3): - (12) The clearance of an area of 300 square metres or more of indigenous vegetation except where such clearance of indigenous vegetation is required for maintenance purposes undertaken in accordance with a maintenance management plan; and (18) The widening of a road by more than 4 metres, or the lengthening of a road by more than 1 kilometre.

The process would also entail registering of water uses in terms of the National Water Act, 1998 (No. 36 of 1998 ).

Opportunity to participate: A draft Basic Assessment Report (BAR) has been compiled for the proposed project and made available for a 30-day review and comment period from 17 March 2021 to 20 April 2021. Notice is hereby given, in terms of the National Environmental Management Act (No. 107 of 1998; NEMA) and the Environmental Impact Assessment (EIA) Regulations, 2014 (as amended), that the draft BAR prepared for the proposed upgrade of Trunk Road 28, Section 1 – Lynx Road, Vermont to Mimosa Street, Hermanus has been made available for a 30-day public and authority review and comment period from 17 March to 20 April 2021. A copy of the Executive Summary of the draft BAR is enclosed with this letter and a copy of the full report is accessible at the SLR website: www.slrconsulting.com/public-documents/R43-Upgrade.
