THE FLORIDA HOUSING COALITION SB 998/HB 1339- Housing

• SB 998/HB 1339 have both passed two committees.

• Recent amendments: • ADUs are no longer required in single-family districts (SB 998; still required in HB 1339) • Compromise on the manufactured housing language between park owners and lot owners (both) • Added language allowing local governments to grant ad valorem tax exemptions for certain affordable housing projects (SB 998) • Option for FHFC to hold back 5% of SAIL Funding for youth aging out of foster care (SB 998; HB 1339 – from LGHT)

THE FLORIDA HOUSING COALITION Amendment to HB 1339 – 2/19/20

In House Ways & Means on Feb. 19, amendments were filed that did the following:

• Each SHIP jurisdiction’s selection criteria “must provide priority to applicants who need less assistance so as to maximize the total number of applicants that may receive an award under the program.” • Under SAIL, FHFC may not “require a sponsor to have prior experience with the corporation to qualify for financing under the program.”

THE FLORIDA HOUSING COALITION Senate Bill 998- Housing Senator (R., District 7- St. Johns, Flagler and part of Volusia)

• Allowing affordable housing in commercial/industrial districts • Changes to Affordable Housing Advisory Committees (AHACs) & Catalyst • Requires one locally elected official to be on each AHAC • Requires AHAC to do annual review of housing polices (instead of triennially) • Requires Catalyst Program to convene regional, biannual information sharing workshops of locally elected officials on the AHACs • Requires each LHAP to include number of affordable housing applications submitted, approved, and denied. • Allows local governments to provide ad valorem tax exemptions for certain affordable housing projects

THE FLORIDA HOUSING COALITION HB 349/SB 580 – Uniform Partition of Heirs Property Act

• Heirs’ Property: a home or land that passes from generation to generation without a legally designated owner, usually without a will. • Owners of heirs property are tenants in common which means each tenant: • Has equal rights of possession • May transfer their interest in the property to another heir or outsider • May seek a partition of the property • The Issue: if one co-tenant sells their share to an investor/speculator, that that investor/speculator can seek a partition action to divide up the property • In some instances, property will go through a forced sale at below market value and destroys wealth creation and ownership of long-held family owned land. • By passing a Budget Bill also known as the Appropriations Act • There is no “housing bill” for appropriations • There is an Appropriations Committee in the House and an Appropriations Committee in the Senate • When the Senate and House Appropriations Committees agree on the amounts of money to allocate for the state and local housing programs (SAIL and SHIP, primarily), it becomes law (after signed by the Governor)

THE FLORIDA HOUSING COALITION Kudos and kicks: Local champions honored; Another raid on affordable housing money A kick to the Florida House of Representatives, which appears poised, again, to take money from the state’s affordable housing trust fund and divert it to other uses. Over the past 20 years, the Legislature has “swept” more than $2 billion from the Sadowski Affordable Housing Trust Fund to pay for other areas of government. During that time, the state has experienced a shortage of housing for people of low and even moderate income. The Sadowski Fund was created in 1992 and raises money via a tax on real estate transactions. - Feb. 5, 2020 THE FLORIDA HOUSING COALITION Amid affordable housing shortage, Florida lawmakers could divert housing funds again Lawmakers are poised to divert more funds intended for affordable housing programs this year, despite pleas from housing and homeless advocates, developers, unions and environmental groups to keep the funds intact amid a growing need for cheaper housing in Orlando and other areas of the state.

Orlando has the greatest shortage of affordable housing among the top 50 metro areas in the country, according to a report released last year by the National Low Income Housing Coalition. - Jan. 30, 2020 THE FLORIDA HOUSING COALITION Legislative raiding of affordable housing fund THE ISSUE: Fixing the affordable housing mess. THE FLORIDA HOUSING COALITION Home of bad decisions Yet Florida has an innovative program to provide those subsidies called the Sadowski Fund. When a home is sold, a proportion of the revenue from documentary tax stamps go into a special trust fund. Those revenues are shared on a pro rata basis with each of Florida’s counties.

The program has worked brilliantly as a partnership among government, business and nonprofits.

Importantly, the Sadowski Fund creates jobs in the hard-hit construction industry.

Yet nearly every year, the sweeps many of these funds into the general budget.

News reports indicate that both Gov. Ron DeSantis and the want to fully fund the Sadowski Fund with $387 million.
