NOTICE OF PESTICIDE: x Registration EPA Reg. Number: 34704-898 Term of Issuance: Conditional Name of Pesticide Product: PDM3.3T&O * ' :, '' This product is conditionaliy registered in accordance with FIFRA section 3(e) (7) (A) provided that you: 1. Submit and/or cite all data required for registration/reregistration of your product when the Agency requires all registrants of similar products to submit such data. 2. Make the following label changes before you release the product for shipment: 34104-W a. Revise the EPA Registration Number to read, "EPA Reg. No, 70SOM1S."

b. Within 18 months of the date of this registration, submit one-year storage stability and corrosion characteristics study for review and acceptance.

c. Under "If Swallovved- First Aid";

Add "Do not give any liquid to person," and delete "Have person sip a glass of water if able to swallow."

d. Under "User Safety Recommendations";

Add the following statemettt;

"Follow manufacturer's instructions for eleanin^maintainingPPE. If no such instructions for washables, use detergent and hot water. Keep and wash PPE separately irom other laundry."

e. Add a paragraph on "Engineering Controls." This is a requirement prescribed in the EPA pendifliethalih Reregistratioji Eligibility Decision (RfiD) document (page 107). It also appears in the BASF label on Pendulum 3 J. 1C herbicide (EPA Reg. No. 241-341). Page 2 EPA Reg. No.-34704*898

f. Under "Environmental Hazards";

Add "or rinsate" at the end of this paragraph

g. Under "Storage and Disposable";'

Change "Storage" to "Pesticide Storage."

h. Add a section on "Spray Drift Control" with the following statements:

* "Do not allow spray to drift from the application site and contact people, structures people occupy at any time and the associated property., parks and recreation areas, nontarget crops, aquatic and wetland areas, woodlands, pastures, rangelands, or animals."

• For ground boom applications, apply with nozzle height no more than 4 feet above the ground or crop canopy and when wind speed is 10 mph or less at the application site as measured by an anemometer. Use (registrant to fill in blank with spray quality, e.g., fine or medium) or coarser spray according to ASAB 572 definition for standard nozzles or VMD for spinning atomizer nozzles.

i. Under "Total Vegetation Control";

ii Delete "Karmex," since it is no longer registered,

j. Under "Warranty and Disclaimer and Notice'1;

Add "To the fullest extent permitted by law," to the beginning of the second and third paragraphs of this section.

k. Change "Down AgroSciences" to "Dow AgroSciences" on page 6,

Submit one copy of the revised final printed label for the record before you release the product for shipment. If these conditions are not complied with, the registration will be subject to cancellation in accordance with F1FRA section 6(e). Your release for shipment of the product constitutes acceptance of these conditions. .
