Minutes August 27, 2013 Vol. 494

Commissioner Karnofski called the regular meeting to order at 9:00 a.m. Commissioner Misner and Commissioner Weber were present.

Pledge of Allegiance – Led by Commissioner Karnofski.

Approval of Consent Agenda –Commissioner Karnofski noted there were letters back and forth with the legislators talking of the Millennium Coal Hearings. First meeting is September 17 in Longview. We are going to use a process that uses a variety of methods to get citizens input. Commissioner Misner moved to approve the Consent Agenda of August 27, 2013. The motion carried.

Citizens Comments Chelsey Baldwin, Longview; spoke on behalf of funding for Superior Court and Superior Court Clerk. Superior Court is core function of government. In 2012 there were 1700 case filings and 4 judges. Analysis in 2009 said we need 6 judges. A 5th judge was approved, but we have not received. We are least funded and most efficient. Any cut to current funding level will have negative impacts. Many programs would be lost. The truancy project has been a model project for the state and nation. The loss of programs result in being back into the court system. Advocating for a basic core function of government. This branch has been underfunded for 20 years. Ask that you maintain current funding.

Commissioner Karnofski stated they were painfully aware of our courts and justice system. 75 percent of general fund budget goes there. Appreciate that they are very efficient. Try to fund whatever we can to improve that efficiency. Will do our best.

Commissioner Misner appreciated the comments. Superior Court is absolutely a core function in government.

Commissioner Weber stated they are not de-funding the courts. Justice delayed is justice denied. It’s a matter of prioritizing. Need support to specify it’s okay to shift money. Asked everyone to look at ways to be more efficient.

Kevin Jorgensen, Kelso; stated he has worked with the Department of Building and Planning for ten months and hasn’t received any answers. His neighbor is in violation of the county code and nothing is being done. The neighbor cut his bank and caused a slide area. The day the county came out and investigated the neighbor put out hay and no trespassing sings. Believe someone at the county alerted the neighbor to the investigation.

Commissioner Weber stated they are monitoring the progress and following the rules. The department is continuing its efforts. Board of Cowlitz County August 27, 2013 Commissioners’ Minutes Vol. 494 Page 2

Commissioner Karnofski stated it’s unfortunate that the activities take time. They are continuing to work on it. If they determine someone from the department was communicating inappropriately they would be terminated.

Paul Youmans, Pathways 2020, Longview; thanked the Board for support in helping us achieve a healthier Cowlitz County. When you look at the report card there is a lot of good news. It is a community effort. Want to have a community where healthy choice is an easy choice. Where people live and education play a factor. Each section of the report card has call for action. Through collective impact will make a difference. Working together will make a difference.

Commissioner Karnofski appreciated his leadership. Thinks the report card is important. People are impressed we have this report card. Looking at what we have and what we can improve. Encouraged everyone to take that step.

Commission Misner stated we can see what is working and where we need to pay more attention. We get a lot of opportunities for fitness. They are fun and contagious. It’s building momentum now. Part of that is the report card. Evidence speaks for itself.

Commissioner Weber stated the health department presented three goals: early start, healthy living, and economic development. We have a good record for early start. Believes Pathways 2020 was instrumental in that. The second major development is going to unfold this year in kindergarten. In terms of health lifestyles, Pathways 2020 has been very active in garden program, getting fresh fruits and vegetables. Asked if Pathways 2020 was going to be involved in meetings for economic development?

Youmans said Pathways 2020 is aware what Cowlitz Economic Development Council is doing. Pathways 2020 focus is more on education for economic opportunity. If you don’t have an educated workforce can’t attract jobs and increase industry.

Local Agency Agreement Supplement No. 1 with Washington State Department of Transportation for the 2011 Highway Safety Improvement Program/High Risk Rural Road Program Safety Improvement Program; de-obligate $112,592 of the Highway Safety Improvement Program/High Risk Rural Road Program funding – Chris Andrews, Public Works; presented the staff report. In 2010 the county was awarded over one million in safety funds. The first one was $200,000 just to get started on engineering for the projects. Once projects were identified the money was split up. Have to de-obligate money that is left over in projects. Then the money can be put into other projects. Plan to use the left over money in the West Side Highway Project and Hazel Dell Road Project.

Commissioner Weber moved to execute Local Agency Agreement Supplement No. 1 with Washington State Department of Transportation. The motion carried.

Local Agency Agreement Supplement No. 1 with Washington State Department of Transportation for the 2011 County Wide Guardrail Project No. 1051; de-obligates $86,293 of the Highway Safety Improvement Program/High Risk Rural Road Program funding – Commissioner Weber moved to execute Local Agency Agreement Supplement No. 1 with Washington State Department of Transportation. The motion carried.

Local Agency Agreement Supplemental No. 2 with Washington State Department of Transportation for the West Side Highway Shoulder Widening Project No. 1791; obligates an additional $119,282 of Highway Safety Improvement Program/High Risk Rural Road Program funding – Commissioner Weber moved to Board of Cowlitz County August 27, 2013 Commissioners’ Minutes Vol. 494 Page 3 execute Local Agency Agreement No. 2 with Washington State Department of Transportation. The motion carried.

Local Agency Agreement Supplement No. 2 with Washington State Department of Transportation for the Old 99 South / Rose Valley Road Intersection Improvement Project No. 1131; de-obligate $14,323 of the Highway Safety Improvement Program/High Risk Rural Road Program funding – Commissioner Misner moved to execute Local Agency Agreement Supplement No. 2 with Washington State Department of Transportation. The motion carried.

Local Agency Agreement Supplement No. 2 with Washington State Department of Transportation for the Pacific Avenue N/Lexington Bridge Drive Intersection Project No. 1121; de-obligates $19,774 of the Highway Safety Improvement Program/High Risk Rural Road Program funding – Commissioner Misner moved to execute Local Agency Agreement Supplement No. 2 with Washington State Department of Transportation. The motion carried.

Local Agency Agreement Supplement No. 1 with Washington State Department of Transportation for the South Cloverdale Road and Confer Road Intersection Improvement Project No. 1301; de-obligates $7,500.00 of the Highway Safety Improvement Program/High Risk Rural Road Program funding – Commissioner Misner moved to Execute Local Agency Agreement Supplement No. 1 with Washington State Department of Transportation. The motion carried.

Local Agency Agreement Supplement No. 2 with Washington State Department of Transportation for the Hazel Dell Road Intersection Improvement Project No. 1785; obligates an additional $127,500 of Highway Safety Improvement Program/High Risk Rural Road Program funding – Commissioner Misner moved to execute Local Agency Agreement Supplement No. 2 with Washington State Department of Transportation. The motion carried.

Authorization of a Sole Source Purchase and installation by Siemens Industries, Inc. for the current generation of propriety hardware, firmware and software applications to replace Cabinet #7 and Auxiliary Cabinet #7-1 in the basement of the Hall of Justice; cost $13,133.88 including Washington States sales tax – Commissioner Weber moved to authorize the sole source purchase and installation by Siemens Industries, Inc. The motion carried.

Bid award for the Roof Top Units (RTU) Replacement Project, 2013 to the low bidder, Capital Heating and Cooling, Inc.; cost $97,373.80 including WA State sales tax – Commissioner Misner moved to award the bid for the Roof Top Units Replacement Project, 2013 to the low bidder, Capital Heating and Cooling, Inc. at a cost of $97,373.80 including WA State sales tax. The motion carried.

Modification No. 4 to Agreement No. CIT-SA 11-13 with Cowlitz Indian Tribal Health & Human Services extending contract period, adding additional funds and updating contractual language to continue to provide for chemical dependency prevention, intervention, treatment and ancillary services for the youth clients; maximum amount not to exceed $31,480 for the period July 1, 2011 through June 30, 2012; $31,480 for the period beginning July 1, 2012 through June 30, 2013 and $13,800 for the period beginning July 1, 2013 through June 30, 2014 – Commissioner Weber moved to approve and execute the Modification No. 4 to Agreement No. CIT-SA 11-13 with the Cowlitz Indian Tribal Health and Human Services. Amendment No. 2 to Agreement No. WACares 12-13 with Washington Department of Social and Health Services (DSHS) to provide support activities to Drug Court treatment clients; contract amendment not to exceed $98,000 for the period September 1, 2012 through September 30, 2013 – Commissioner Misner moved to approve and execute County Contract No. WACares 12-13 (2) with Washington Department of Social and health Services. The motion carried.

Professional Services Contract with Sue Batson to provide various professional services related to the Community Protection Act, Consolidated Juvenile Services, and Evidence Based Expansion funding Cowlitz County receives – Commissioner Weber moved to approve the contract with Sue Batson. The motion carried.

Agreement between Educational Service District No. 112 and the Cowlitz County Juvenile Department for the purpose of maintaining a community resource intervention program for truant Cowlitz County youth, pursuant to BECCA legislation for the period of August 27, 2013 to June 30, 2014; compensation not to exceed $92,000 – Commissioner moved to approve the Agreement with Educational Service District No. 112. The motion carried.

Resolution No. 13-077 - Reimbursable Work Request and Agreement for vegetation control by the County Corrections Crews for the Silver Lake Flood Control District; total cost not to exceed $3,000 – Commissioner Weber moved to approve the Reimbursable work Request and Agreement at a cost not to exceed $3,000. The motion carried.

Bid award for the Inmate Commissary Services Request for Proposal to Consolidated Food Management and National Commissary Services, Inc. (CFM)/Turnkey Corrections Northwest; 32.5% commission paid on gross revenue. The vendor will be responsible for all startup costs – Capt. Chris Moses presented the staff report. Analysis determined CFM is the most advantageous. Brings Cowlitz County up to date with other counties. Currently have a brown bag that is delivered once a week. The ordering will change. The inmates will have a kiosk and be able to order from. Will free up their paperwork. Will help with compliance that is coming up. This company also supplies booking area with kiosk that allows officers to key in funds that come in from inmates. It will alleviate the exchange of monies. Commissioner Misner moved to award the inmate Commissary Services RFP to CFM/Turnkey NW at commission rate of 32.5%. The motion carried.

Agreement between Cowlitz County and Educational Service District 105 Contract No. 9003000011 for Northwest High Intensity Drug Tracking Area Drug Court Project in the amount of $30,000 – Commissioner Weber moved to approve the agreement between Cowlitz County and Educational Service District No. 105. The motion carried.

Commissioner Karnofski excused himself from the hearing room.

Appointment of H. F. "Butch" Brenaman to the office of the Silver Lake Flood Control District, Director Position 1. The term for this position will expire on February, 2016 – Commissioner Misner stated one application was received. Butch Brenaman was present. Stated he has lived a couple blocks from the lake for the past 29 years. Very concerned about the water, what goes in it and near it. He is involved with the Toutle Valley Community Council. Needs to be carried on with interest by someone that lives there.

Ken stone, Asset Management; was present. The meetings are generally the first Thursday of the month at 6:30 p.m. in the library at the Toutle School. The next meeting is on the 19th because of conflicts. Normally meet ten times a year. Each year they come up with schedule and once in a while it is modified. There is a radio gate inspected once a year; maintain vegetation; authority to expend revenues on water quality; meet requirements with state agencies.

Commissioner Weber stated he appreciates passion on water quality of the lake. Commissioner Weber moved to appoint H. F. "Butch" Brenaman to the office of the Silver Lake Flood Control District, Director Position 1. The term for this position will expire on February, 2016. The motion carried.

Approved - Final Plat - Case No. 1170.02 - Crown Estates Urban Subdivision, 2000 block of 42nd Ave., Longview – Nick Little, Department of Building and Planning presented the staff report. The subdivision is off the 2000 block of 42nd Avenue. It contains a total of 26 lots. Each lot is about 6,000 to 13,000 square feet. Includes curbs, gutters, and sidewalks. Was previously approved then plat expired in 2007. In 2011 it was picked up again and preliminary approval was granted in winter, 2011. Stormwater was redesigned to current standards. It is a unique subdivision, because when constructing was on-going they worked with Public Works and eliminated the need for homeowners association. Public Works accepted the storm water facility.

Adrian Maithland, Brush Prairie; stated at this time it is a builder build out. Planning on building the homes, but if anyone comes in and is interested in buying a lot it would entertain.

Commissioner Weber moved to approve subdivision plat Case No. 1170.02 based on testimony provided and recommendations from Planning Commission. The motion carried.
