GLOBAL E-TENDER FORM

The Himachal Pradesh State Civil Supplies Corporation Limited (HPSCSC Ltd.) invites Global E- tenders for the procurement of 1700 MTs per month (Approximately) Free Flow Iodized Salt produced from sea water (ISI Mark) to be supplied for a period of six months from June, to November 2018 in one Kg. (net weight) of low density plastic pack laminated with polyester pack conforming to the provisions of Food Safety and Standards Act,2006 and the Food Safety and Standards ( Packing and Labelling) Regulations, 2011, more particularly Chapter 2 thereof.

The tenders may be uploaded by the bidders upto 29-06-2018 by 17.00 hours whereafter no tender shall be accepted. The tender form can be down loaded directly from portal https://hptenders.gov.in and cost thereof @ Rs. 5000/- per tender form besides processing fee of Rs.15,000/- (Rupees fifteen Thousand only) {Non-refundable} per bidder shall have to be deposited either in cash or bank draft favouring MD HPSCSC Ltd. payable at Shimla in our Head Office or through RTGS/NEFT in our account mentioned in tender form before the submission of tender offers by the party.

The other conditions of tenders are as under: - 1. General:

1 All tenders must be up-loaded on the Portal. The tenders should be uploaded in two covers. The Technical Bids along-with copy of desired documents and earnest money should be uploaded in one cover. The samples of Iodized Salt will be received separately. Financial Bid/BOQ of only those bidder will be opened whose technical bids are found in order. The financial bid/BOQ should be uploaded in a separate cover. 2 The rates of Iodized Salt should be uploaded in the prescribed financial bid/BOQ of the tender document. 3 The interested bidders shall have to provide two samples of Iodized Salt in one kg. pack printed thereon the batch number and brand etc., in the registered office of the HPSCSC Ltd. at Kasumpti, Shimla-9 as per specifications laid down in Food Safety & Standards Act, 2006 and Regulations there under and ISI specifications. Offers without samples shall not be accepted. The successful bidder shall have to provide twelve samples as master samples before starting supply of Iodized Salt. 4 The Bidders from outside India participating in the tender process must have their Registered Office/Agency anywhere in India and profile thereof must be up-loaded. The bids alongwith tender documents must be accompanied by the necessary authorization in this regard duly signed by the Principal. The transactions with such bidders shall be in Indian Currency only i.e. Indian Rupees. The local agent of the foreign bidder duly authorized by his Principal may submit offers, negotiate and sign contracts and other documents. In case of any litigation and/or arbitration between the Corporation and the bidders, summons or any other legal process served on the local agent, shall be admitted and held as valid as if it were served upon the Principal/Bidder. The letter(s) of acceptance will be issued by fax or email or registered post to the successful bidder(s) and or his/their agent(s) in India within the validity of offer. 5 The conditional tender shall not be accepted 6 The HPSCSC Ltd., reserves the right to increase or decrease the quantity of the goods mentioned in the Notice Inviting Tender. The H. P. State Civil Supplies Corporation Limited Ltd., shall have the right to reject any or all the offers without assigning any reason. 7 HPSCSC Ltd. may amend any of the tender condition, as may be desired if such amendment is necessary and the same shall be uploaded as a corrigendum on the portal https://hptenders.gov.in. two days before the closing of the tender.

2. Earnest Money Deposit & Performance Security Deposit:

1 Every bid should be accompanied by documentary proof in token of having deposited the earnest money amounting to Rs.10,00,000/- (Rupees ten Lacs only through RTGS in Corporation’s Current Account No. 10836143047 Of State Bank of India Branch at Shimla (IFS Code No. SBIN0000718) failing which the bid shall be out-rightly rejected. The successful tenderer shall have to deposit an additional security equal to five percent (5%) of the cost of approved salt in the form of account payee demand draft favouring MD HPSCSC LTD; payable at Shimla or duly pledged fixed deposit receipt or bank guarantee from any scheduled bank with the HP State Civil Supplies Corporation in the shape of Performance Security within a week from the issue of supply order. The earnest money of successful bidder will be returned immediately after the submission of Performance Security. No interest shall be payable on such security. The performance security shall remain valid for a period of 60 days from the date of completion of contract including warranty and guarantee period to the best of satisfaction of the Corporation. The earnest money of the unsuccessful bidder will be returned through RTGS within 15 days after the finalization of the tender. 2 EMD is liable to be forfeited in case the tenderer withdraws his offer after filing the tender or after the acceptance of the offer by the HPSCSC Ltd. or fails to deposit the performance security deposit within the specified time, apart from blacklisting the tenderer.

3. Experience & Information: 1 All the bidders shall have to upload laboratory test report from the Lab. approved by the competent authority alongwith other desired documents. The test report of Iodized Salt must contain brand name, batch number and date of packing and the samples should also be of the same batch number failing which tender shall be rejected. The test report should be as per the standard mentioned in the tender document. The bidder including its group of companies or Directors having share holding of 26% or more or partner (in the case of partnership firms) must not be black-listed by any Central, Union Territory and State Government/Organization or any Govt. Procurement Agency as well as convicted by any court of law and the period of blacklisting should not be in force as on the day of inviting tender. An affidavit duly notarized in respect of information desired under this condition must be uploaded. 2 The supplier will supply a copy of ISI mark certificate / License meant for manufacturing of Iodized Salt by (BIS) Bureau of Indian Standard, with date of validity. 3 All the bidders shall have to upload following documents:- 1. Authorization of the manufacturer in case of distributor/trader, with the Technical Bid. 2. Signed tender document with declaration for acceptance of terms & conditions. 3. Signed Financial Undertaking. 4. Documentary proof in token of having deposited the EMD, Processing Fee & Cost of Tender Document 5. Copy of PAN card of the bidder. 6. Copy of Certificate of registration under GST. 7. Copy of sample analysis report. 8. Copy of approval of laboratory by the competent authority, from whom the sample has been analyzed. 9. Copy of acknowledgement of Income Tax Return for the Assessment Year 2015-16, 2016- 17 & 2017-18 (FY- 2014-15, 2015-16 & 2016-17). 10. Copy of certificate of incorporation/ registration certificate/ partnership deed, of Company/ Cooperative Society/ Firm/ Sole proprietorship. 11. Copy of ISI mark certificate/ license meant for manufacturing of iodized salt by Bureau of Indian Standards (BIS) 12. An Affidavit duly notarized regarding non conviction and black-listing as per condition No: 3(1) above and 3(4) below regarding manufacturing of raw salt from sea water. The affidavit must have been notarized after the date of inviting of tender. 13. Authorization letter by way of resolution of Board of Directors/ Partners/ Proprietor authorizing a person to sign the tender document. 4 Raw salt must be produced from sea water; affidavit/undertaking in this regard must be uploaded in which detail of manufacturing plant and infrastructure is mentioned clearly.

4. Submission of Tender :

Tender should be submitted in two parts i.e. Technical Bid and Financial Bid. The tender schedule would be as under:- 1 Date and time of online publication. 08-06-2018 by 17.00 HOURS (5.00 pm) 2 Downloading of E-tender documents. Upto 29-06-2018 by 17.00 HOURS (5.00 pm) 3 Date of submission of E-tender and sample of Upto 29-06-2018 by 17.00 HOURS (5.00 pm) Iodized Salt in physical form. 4 Submission of earnest money, cost of tender Upto 29-06-2018 by 17.00 HOURS (5.00 pm) documents and tender processing fee. 5 Date of opening of bids. 30-06-2018 at 12.00 Noon 5. Opening of Tenders:

1 The tenders will be opened at 12.00 (Noon) 30-06-2018.

2 Only the bidder qualifying technical bid will be eligible for further consideration.

3 If the date fixed for opening of tender happens to be Govt. holiday, the tenders filed on-line will be opened on the next working day at the same time specified above.

6. Rate Offered:

1 For the supply of Iodized Salt, the lowest rates quoted must be uploaded including all applicable taxes (GST and Market Fee etc.) along-with freight F.O.R. for all the whole sale godowns of the Corporation as mentioned in the Annexure-A, in the financial bid / BOQ for six months supply. The single F.O.R. rate shall be applicable in respect of Iodized Salt for all the Stations. The bids with different rates shall not be accepted. No conditional bid shall be accepted. 2 Loading at station of despatch will be the responsibility of the firm and un-loading and stacking at consignee’s end will be arranged by the concerned consignee / Indenting Officers 3 In case of inter-state, supplies of iodized salt then IGST provisions under GST Act & Provisions thereunder shall be applicable and billing shall be made accordingly by mentioning the GSTIN number of First Part (GSTIN No: 02AABCH4054K1ZV), so that Input Tax Credit (ITC) can be availed. In case, of iodized salt supplies within the State of Himachal Pradesh, the billing shall be made under the provisions of GST Act. & Provisions there under and shall have to mention the GSTIN number of First Part, so that Input Tax Credit can be availed. 4 The supplies of iodized salt are to be made under overall provisions of GST Act and rules made thereunder. In case of any mismatch, leading to non-availability of Input Tax Credit (ITC ) to HPSCSC, the HPSCSC shall have the right to deduct the amount on account of loss of tax credit from the due payments of supplier.

7. Negotiation:

1 The SLPC reserves the right to conduct negotiations with successful tenderer, if necessary, before finalizing the tender. No tenderer shall have right to insist on negotiation by the Corporation at any time. 2 During negotiations the tenderer should attend either personally or through their authorized representative. The authorized persons should produce authorization letter duly attested by his principal, authorizing the said person to participate in the said process of tender. 3 The Corporation shall inform the tenderer about the date and time of negotiations through e-mail and also by fax (as per the decision). 4 The HPSCSC Ltd., reserves the right to reject any or all the tenders without assigning any reasons whatsoever and the decision of the H.P. State Civil Supplies Corporation Limited in this regard is final and binding on all the tenderers and cannot be called into question. In the event of cancellation of tender, a speaking order will be passed by the Corporation and the bidders shall be informed accordingly. 5 The rates accepted are for the supply of contracted quantity in all respects for the quantity tendered. Any question for the revision of the rate accepted due to price fluctuation in international and domestic market or for any other reason during the contract period will not be entertained and stand rejected.

8. Agreement:

1 Successful tenderer shall execute an agreement within seven days of the issue of supply order as per the terms and conditions on Rs. 100/- non-judicial stamp paper. In the event of failure to execute the agreement the Performance Security Deposit or EMD, as the case may be, shall stand forfeited apart from cancellation of supply contract besides blacklisting of the tenderer, and Corporation is entitled to collect liquidated damages, if any, from the tenderer for his failure to comply with the terms and conditions of the Tender.

9. Supply: 1 Supply of Iodized Salt shall have to be arranged in HDPE Bags containing 25 Pkts. of One Kg pack whereon the word “ H.P. State Govt. supply on subsidized rates” and net weight, One Kg. when packed” and “MRP per Kg. with all taxes as per rates conveyed by the Corporation should be super-scribed. In addition to this all information as per the Standards of Weights & Measures Act, 1976 & the Standards of Weights & Measures (Packaged Commodities) Rules, 1977 and Food Safety & Standards Act, 2006 and Regulations thereunder, e.g. name and full address of the manufacturer / packer, name of commodity, Net Weight, MRP including all taxes and month & year of the packing of the commodity should be super scribed. The plastic used for the packaging of item should be of non-toxic material as well as of high quality conforming to the provisions of Food Safety and Standards Act,2006 and the Food Safety and Standards (Packing and Labelling) Regulations, 2011, more particularly Chapter 2 thereof, declaration in this regards must be printed in each pack. 2 The approved supplier will be held responsible for the purity and quality of the Iodized Salt. 3 The successful bidder shall have to supply the ordered Iodized Salt on monthly basis for 6 months and the supply orders will be issued on month to month basis. The supplier shall have to ensure that the supply of each month as mentioned in the supply order is made strictly in accordance with the time schedule (phases) given below:-

I Phase) 25% quantity of each phase within first twelve days after the receipt of supply order. II Phase) Next 35% quantity of each phase within next seven days. III Phase) Remaining 40% quantity of each phase within next six days. 10. Penalty for delayed supply: 1 In case of non supply/delayed supply as per the above given delivery schedule liquidated damage for delay in supply shall be recovered to be computed @ 1% for 1st week, @ 3% for 2nd week, @ 5% for 3rd week and @ 10% for 4th week, of the quantity of delayed supply from the approved supplier. In case the supplier still fails to supply the Iodized Salt the SLPC shall have the right to cancel the supply order and make arrangements for the supply of Iodized Salt at the risk and cost of the approved supplier and the incidental charges incurred thereon on this account shall be deducted from the due payments of the supplier as well as from the security deposit. In addition to this the SLPC shall also have the right to forfeit the security deposit of the supplier besides blacklisting the firm. 11. Furnishing Information: 1 Tenderer shall furnish daily report to the HPSCSC Ltd. on dispatch of Iodized Salt truck-wise and destination-wise to various godowns of HPSCSC Ltd. through e-mail/fax.

2 Tenderer should furnish the complete details for the ordered quantity and its delivery by mentioning Order No. & Date, Truck No., GR No. & date, Purchase Bill No. & date, name of the godown, dated of delivery in HPSCSC godown to HPSCSC on the phase-wise completion ordered quantity.

12. Receipt of material and quality: 1 Against every supply order, at least six random samples shall be drawn by the representatives of the Corporation/Food, Civil Supplies and Consumer Affairs Department from different godowns of the all the Areas for analysis after receipt of stock at any time. The laboratory testing charges for the same shall be deducted from the running payment /dues of the tenderer. If quality is found below the prescribed standards, specifications of FSS Act, 2006 and approved sample, the concerned supplier shall be directed to replace the un-sold stock within a week’s time positively. In case of non-replacement of the stock the amount equal to the value of such quantity shall be deducted from the payment of his bills. In addition to this penalty equal to 20% of the value of the consignment which have not been found as per approved sample or is not as per the standards laid down in FSSA shall be recovered from the party. In addition to this, against every supply order, if quality is found below the prescribed standards and approved samples in 10 cases, the supplier will be issued a warning and in case of failure of 30% samples out of the total samples drawn in a tender period, the supplier shall not be allowed to participate in the next three tenders of Salt, whereafter the State Level Purchase Committee shall have the right to black-list the supplier.

13. Payment:

1 The Corporation will release 95% payment against the supplies made on phase-wise basis within a week after the completion of phase on receipt of confirmation from the Area Managers, as per the prescribed format and submission of original bill and original GR at the point of receipt (Godown). Balance 5% payment shall be released after the completion of monthly supply on the confirmation of dispatch and after proper verification of all documents submitted, analysis report of testing laboratory after deducting any penal amount or liquidated damages or any other outstanding dues. The payment to the approved supplier, billing from outside the State of Himachal Pradesh shall be made after deducting Market Fee etc.

14. Area of Jurisdiction: 1 All disputes shall be subject to the civil jurisdiction of competent court of law at Shimla (HP) only.

15. Indemnity: 1 The Corporation as well as the State of Himachal Pradesh shall remain at all times indemnified and the supplier/tenderer shall keep every concerned Department duly indemnified against any analyses or statutory inspections/check during the contractual period of the tender. It is made clear that no suit, prosecution or any legal proceedings shall lie against the HPSCSC Ltd./Department of Food, Civil Supplies & Consumer Affairs, HP for anything that is done in good faith or intended to be done in pursuance of the tender.

2 The tenderer shall indemnify the HPSCSC Ltd. against all claims that may arise for supply of inferior and low quality Iodized Salt and to any violation of applicable act/rules and not conforming to prescribed standards as stated earlier.

16. Force majeure: 1 The terms and conditions hereof shall be subject to force majeure. Neither HPSCSC Ltd. nor the contractor shall be considered in default in the performance of their respective obligations herein above if such performance is prevented or delayed because of act of God, War, Flood, Hostilities, Revolution, Civil Commotion, Official Strike, Epidemic, Accident or Fire, or because of Law & Order Proclamation, Regulation or Ordinance of any Govt. of any Subdivision thereof or local authority. The tenderer shall be entitled to the benefit of this clause only if he informs in writing of the circumstances amounting to force majeure to HPSCSC Ltd. for each consignment/dispatch separately within 48 hours of the happening thereof by fax/e-mail immediately, followed by a confirmatory letter sent by Registered Post with Acknowledgment due. In the event of the contractor pleading any ground as constituting force majeure, the opinion of the SLPC on that behalf alone shall prevail and, if in the opinion of the SLPC, the grounds pleaded by the tenderer do not amount to force majeure, then the tenderer shall not be entitled to plead the same and or claim any relief under this clause.
