On the 27 March 2008 the Department for Communities and Local Government (DCLG) released a comprehensive list of the levels of council tax charged by each local authority in England for 2008/09.

This note contains key statistics on council tax levels in 2008/09 and a limited amount of analysis is provided. The main purpose of this note is to act as a reference document although more detailed analysis is available on request.

The council tax was introduced as the primary source of collecting income from local residents by local authorities in England, Wales and Scotland in April 1993. This system replaced the Community Charge, which had in turn replaced Domestic Rating in April 1990.

There are 408 billing authorities in Great Britain responsible for collecting council tax to meet their own demands and the precepts levied by the lower tier Parish or Community Councils and higher tier County Councils, Joint Boards, Police and Fire Authorities.

The following table shows the property price range of each council tax band and the total number of chargeable dwellings in each band. There are eight valuation bands in England and Scotland and nine in Wales. Band I was introduced in Wales in April 2005 following the revaluation of domestic properties.

Local authorities set council tax levels by dividing the amount of money they aim to raise by the Band D equivalent taxbase. The taxbase is calculated by weighting the number of dwellings in each band by the ratio to Band D. The bills in each band are calculated according to a set ratio to band D.1

The average Band D level of council tax is usually used for comparisons of tax levels set. It is, according to the DCLG, a definition that is widely regarded as a benchmark when comparing council tax levels in different areas or over time.2 It compares the level of tax paid by households in similarly valued properties.

As only a minority of properties in each local authority are in Band D, this measure does not show the average amounts of council tax payable by people in different areas. Figures showing the average council tax per dwelling in each LA are also published.

In different local authority areas the mix of dwellings may be significantly different to the national average giving rise to overall average bills which may vary considerably from the band D average. For example in where 88% of all chargeable dwellings were valued in bands A to C, the average band D bill was £1,613, the highest in England, compared with the average per dwelling of £1,086, the 242nd highest of the 354 billing authorities in England.

B. The national picture

1. England

The average council tax bill in England per dwelling was £1,146 in 2008/09 compared with £1,101 in 2007/08, an increase of 4.0%. Average council tax per dwelling was significantly less than the average for a band D dwelling as two-thirds of dwellings were in bands A-C. The average for a band D household was £1,374, compared with £1,321 in 2007/08, an average increase in council tax of 4.0%.

Average band D council taxes were £1,292 in London, £1,328 in other English metropolitan areas and £1,408 in English shire areas.

The average band D council tax in the North East (£1,429) was higher than in any other Government Office Region (GOR), while London had the lowest average Band D rate (£1,292). The average council tax per dwelling varied from £1,309 in the South East to £999 in Yorkshire and Humber. The chart below shows the average Band D and per dwelling council tax figures for each English GOR.

The following table shows the average Band D tax level by political control of authority. Political control is defined as a party having a majority of councillors after the local elections held in May 2007. In practice a party may control the LA with less than half of the councillors, as members from other parties may vote with the largest party. However for these purposes

4 an authority where the largest party doesn’t have a majority of councillors is considered to be under No Overall Control (NOC).

Due to the fact that some averages have been calculated from very few observations it is hard to draw firm conclusions, however the figures suggest:

• Amongst metropolitan districts, bills were highest in the average Lib Dem LA and lowest in NOC ones. The largest annual percentage increases occurred amongst the average Lib Dem LA. • Average council tax bills in London were highest amongst Lib Dem LAs and lowest in Conservative run councils. • The average Labour controlled council set the highest bills for unitary authorities. The lowest were set by Lib Dem run UAs. • Shire district bills were highest in Labour controlled areas and lowest in Conservative controlled LAs. • Average county council precepts were highest in NOC and lowest in Lib Dem controlled councils.

• Amongst metropolitan districts, bills were lowest in the average Labour LA, with the average Lib Dem LA charging the highest levels. • Average council tax bills in London were highest amongst Lib Dem LAs and lowest in Labour run councils. • The average Conservative controlled council set the highest bills for unitary authorities while the lowest were set by Lib Dem run UAs. • Shire district bills were slightly higher in Conservative controlled areas than in districts controlled by other parties. • Average county council precepts were highest in Conservative and lowest in Labour controlled councils.

2. Wales

The 2005/06 council tax bills in Wales were the first to be issued since the revaluation of Welsh domestic properties by the Valuation Office Agency. The revised list of valuations came into force on 1 April 2005.

In Wales the average band D council tax for 2008/09 was £1,044. This included £884 for local services (county and community council precepts) and £160 for police authorities. The increase in average band D council tax was 3.9%. This was the second lowest increase in Welsh band D council tax since the start of the system in 1993/94. The increase in 2005/06 was lower at 3.8%.

Pembrokeshire authority billed the lowest band D council tax in 2008/09 (£829), this was followed by Newport (£886). The highest council tax was charged in Blaenau Gwent (£1,264) with Neath Port Talbot (£1,243) the next highest.

The highest percentage increase in band D council tax was seen in Ceredigion (4.9%). The rise in Isle of Anglesey was the lowest (3.3%).

7 3. Scotland

Council tax levels in Scotland were frozen by all but one of the 32 councils in 2008/09, while in Stirling there was a 1.1% reduction in council tax.

In four local authority areas council tax levels have been unchanged since 2006/07: Angus, Midlothian, Dundee and Glasgow. In Glasgow council tax levels have not been changed since 2005/06.

The chart below shows the average level of band D council tax in Scotland in each year since the introduction of the system in 1993/94. The average band D council tax bill in Scotland fell from £1,149.31 in 2007/08 to £1,148.89 in 2008/09.

The highest level of band D council tax was charged in Aberdeen (£1,230) and the lowest billing authority was Eilean Siar (£1,024).

8 C. The local picture in England

The following table shows the 20 English billing authorities with the highest levels of average band D council tax in 2008/09. These are the levels charged by the billing authorities and include all precepts. Only five of these authorities were single-tier authorities with the remaining 15 two-tier shire authorities.

Sedgefield, (Labour controlled district and county) and Rutland (Con) had the highest levels of average band D council tax. Of these twenty billing authorities six were Conservative controlled, five were under Labour control, three were Lib Dem and the remaining six had no overall control or were controlled by councillors with no links to the main political parties.

Six of the billing authorities in the list below are districts in Labour controlled Nottinghamshire county council. The combined county council and fire authority precepts in Nottinghamshire were the highest in England.

Wandsworth and Westminster (both Con) had the lowest levels of average band D council tax. Of these twenty authorities, all single-tier, nine were Conservative authorities, three were under Labour control and six had no overall control. The City of London and the were represented by councillors that had no political affiliation.

The seven billing authorities with double digit increases in council tax were all districts in Conservative controlled Lincolnshire county council, although the majority of the increase is due to the 79% increase in the police precept.

Council tax bills in Conservative controlled Hammersmith & Fulham fell by 1.7%. Of the fourteen single-tier authorities shown below six were controlled by the Conservatives, three were Labour authorities and the remaining five had no overall control. The six two-tier authorities were all districts within the Labour controlled county council.

12 D. Capping

Capping is a mechanism by which the Government may limit the budgets of councils and other local authorities (i.e. police authorities and fire and civil defence authorities). It works in most cases by specifying a maximum increase for an authority's budget where the authority is spending above the level specified by the Government. It does not simply specify a maximum increase or level of council tax, and where an authority is spending below its standard budget, a larger increase in council tax may be possible within the capping limits.

The Government can designate an authority – applying to the current year’s budget – or nominate an authority for the following year. The criteria used to decide which councils might be capped are the responsibility of the Secretary of State under the Local Government Act 1999.

On 27 March 2008 the Minister for Local Government, John Healey MP announced in the House that eight authorities had exceeded the criteria for potential capping.3 The authorities designated for action were given 21 days in which to make their case and each exercised their right to challenge the proposed caps. In a Written Statement issued on 26 June the Minister confirmed the Government’s decisions.4

Having carefully considered the representations all authorities have made, both orally and in writing, and having taken into account all relevant information I can now confirm decisions on how the Government intend to proceed in each case. In putting forward their challenges, no authority has, in the Secretary of State’s view, presented strong arguments as to why an excessive increase was necessary. Furthermore, no authority has demonstrated that the pressures identified acted disproportionately upon them to any significant extent compared to other authorities. We intend therefore to take action in all cases.

After careful consideration, taking account of both service and tax impacts on residents in the areas concerned, the Secretary of State has decided on the following actions:

• to ‘designate’ Lincolnshire at £100,638,000 compared to the original proposed cap of £94,926,000. The authority will therefore have to reset its budget and precept;

• to cancel the designation of the police authorities of , Leicestershire and Warwickshire, but nominate all three authorities for 2008-09, designating them in 2009-10 and 2010-11. This ‘designation after nomination’ will provide protection to council taxpayers by limiting the authorities’ capacity to increase council tax in 2009-10, and allow the authorities a phased return to setting non-excessive budget requirements. We intend to limit increases in the budget requirements of these authorities to the equivalent of an increase of 3 per cent. in council tax precept in both 2009- 10 and 2010-11. This firmly protects taxpayers but avoids the need for re-billing; and

13 • to cancel the designation of the police authorities of Bedfordshire, Norfolk and Surrey and of Portsmouth city council, but nominate them with a proposed notional budget requirement for each authority for 2008-09 at the level of the maximum budget requirement originally proposed when they were designated. For Bedfordshire police authority the proposed notional budget requirement is £95,790,000, for Norfolk police authority £137,901,000, for Portsmouth city council £148,530,000, and for Surrey police authority 189,622,000. Nomination and setting a notional budget for Bedfordshire, Norfolk and Surrey police authorities and for Portsmouth city council will limit these authorities’ capacity to set excessive increases in future years by measuring for capping purposes future budget requirement increases against their 2008-09 notional budget requirement. This will provide their council taxpayers with extra protection in future years.

My officials are writing to all authorities today informing them of these decisions. Subject to approval of an order I am laying before the House today, Lincolnshire police authority will need to re-set its budget requirement and precept. This means that its residents will be re-billed for a lower council tax.

The three authorities subject to designation after nomination will have an opportunity to challenge their proposed designation for 2009-10 when they are notified in due course. We intend to start this process at the same time as we commence consultation on the provisional local government finance settlement later this year.

The four authorities nominated in 2008-09 and set a notional budget requirement have 21 days from receipt of the notification in which to challenge their proposed notional budget requirement.

In taking this necessary action, I recognise that local government generally has done a great deal to ensure that they do not place unnecessary pressures on their council taxpayers. More than 98 per cent. of authorities did not set excessive increases—and the average Band D council tax increase in England for 2008-09 is 4.0 per cent., the lowest increase for 14 years and the second lowest ever.

There is no excuse for excessive increases in council tax, and authorities should be in no doubt that the Government will use its full range of capping powers to deal with excessive increases and protect council tax payers in future years.

The Draft Council Tax Limitation (Maximum Amounts) (England) Order 2008 was laid before the House on 26 June and it will be debated in the House of Commons on 9 July, 2008. If the order is approved, it will come into force before the House rises for summer recess.

In 2004/05 capping action was taken against fourteen authorities of whom six were designated and eight nominated. In 2005/06 action was taken against nine authorities and in 2006/07 against two authorities, all of whom were designated. The Government did not exercise its capping power in 2007/08.

Appendix 1 shows average Band D equivalent council tax in England, broken down between the taxes charged to meet an individual authorities own demands and the precepts levied by higher tier County Councils, Police and Fire Authorities where appropriate.
