Report Title Moorside Road/Roseneath Road, – Proposed Waiting Restrictions – Consideration of Objections

Summary A number of complaints have previously been received about inconsiderate parking on Moorside Road, close to the junction with Roseneath Road. The parking that takes place is considered to be detrimental to road safety as it significantly reduces visibility for motorists exiting Roseneath Road. It was agreed to promote 24-hour waiting restrictions at the junction so as to improve visibility and therefore, reduce the potential for road traffic collisions. The restrictions were advertised in September 2016, and 2 objections were received. These objections are the subject of this report. A

1) That the objections be noted. 2) That, after careful consideration of the objections, authorisation be given to make and introduce the Traffic Regulation Order, with minor modifications to the advertised proposals, and detailed in the schedule to this report as soon as is practicable. 3) That the objectors be informed of the decision taken. 1.0 BACKGROUND

1.1 Following complaints about inconsiderate parking on Moorside Road, close to the junction with Roseneath Road, it was agreed to introduce junction protection markings extending, notionally, 10 metres on either side of the junction and on Roseneath Road itself.

1.2 The proposed waiting restrictions have been advertised and a consultation letter was circulated to local residents in September 2016. Two objections were received and these are the subject of this report.

2.0 OBJECTIONS

2.1 Both of the objections that were received referred to the restrictions that were proposed for Roseneath Road. The objectors support the introduction of waiting restrictions on Moorside Road, but they consider that the demand for parking on Roseneath Road is such that even the loss of 2-3 spaces would have a detrimental effect on residents’ ability to their vehicles close to their homes.

2.2 It is accepted that the residents’ ability to park on Roseneath Road is affected by the proposal, and it is considered that there is an opportunity to reduce the proposed restrictions on Roseneath Road without fundamentally affecting road safety concerns that have previously been raised.

2.3 It is therefore, proposed to make minor modifications to the advertised proposals by reducing the length of restriction on Roseneath Road, so as to maximise parking for residents. The proposed amended waiting restrictions are described in Schedule 1 below.

3.0 COMMENTS

3.1 Chief Constable’s View: GMP have no objections to the proposals.

3.2 Chief Fire Officer’s View: No comments received.

3.3 Transport for Greater ’s View: No comments received.

3.4 Ambulance Services’ View: There are no objections to the proposals.

3.5 Hackney Carriage Driver / Operator Representative’s View: The Taxi Trade has no comments on this report.

3.6 Ward Members’ Comments: Councillor Proctor: I am very much in support of this proposal. Over quite a long period of time, I have been contacted by a number of nearby residents who are very concerned about the dangerous nature of this junction with cars parked at corner of Roseneath and Moorside Roads. So I am pleased that the scheme has now been proposed. Councillor Harding: Can I second Cllr Procter’s response.

Relationship to Policy None Framework/Corporate Priorities Financial The cost of providing the restrictions, estimated to be £1,500, is to be funded from the 2016/17 Integrated Transport Capital budget (Sch 2473 - 9264164). Legal Implications: The proposed Traffic Regulation Order is being progressed in accordance with the Road Traffic Regulation Act 1984 and the Traffic Signs Regulations & General Directions 2016 and if implemented will be enforced by the Council’s Parking Services or be self- enforcing. Staffing/E-Government/Asset None Management Implications Risk Management Implications Risk of challenge to the High Court is low.

Health and Safety Implications Improvements to the highway network will improve safety for all road users.

Other Options

Leaving out the proposed restrictions to which objections have been raised would be detrimental to resident amenity, highway safety and would also lead to obstruction for other road users.

Consultation

In addition to the statutory advertising, the proposals have been the subject of direct consultation with all affected frontages and with local ward councilors. The consultation was also posted on-line during the consultation period.

Reasons for Recommendation

To enable the necessary parking restrictions to be introduced and enforced, to enhance resident amenity, in the interests of highway safety and to discourage obstruction of the highway.
