AGENDA ITEM: Review and take action on Resolution 2018-27, rescinding special assessments for VH-502-1 POLICY ISSUE Should the board approve Resolution 2018-27, rescinding special assessments for VH-502-1?

BACKGROUND INFORMATION As part of the special assessment done for the Shawano Avenue project in 2007, several properties including VH-502-1 were assessed for road and utility improvements. In the case of VH-502-1 a little over $42,000 was assessed on approximately 390 feet of undeveloped Shawano Avenue frontage. The owner of this property had a plat approved to create four lots along Shawano Avenue and to create a lot for the existing home on Westhill Drive. He is asking the village to rescind the special assessment, so he can record the plat. After the plat is recorded, the village will then assess the newly created lots with the original amount of the assessment on a lot-by-lot basis.

Prior Action/Review The board approved the special assessment in 2007 and approved the land division in 2009.

Policy Alternatives The Village Board could take the following actions: • Approve the Resolution • Amend or deny or table the proposed Resolution

Recommended Action: Staff recommends the board approve the resolution rescinding the special assessments, as allowing the plat to be filed and reassessing the newly created lots individually will increase the chance of the village recouping the assessments. If the board agrees with this recommendation an appropriate motion is:

AMENDED REGARDING RESCINDING SPECIAL ASSESSMENTS AGAINST BENEFITTED PROPERTY FOR PUBLIC IMPROVEMENTS PARCEL VH-502-1 IN THE VILLAGE OF HOWARD, BROWN COUNTY, WISCONSIN

WHEREAS, the Village Board of the Village of Howard, Brown County, Wisconsin approved the following Resolutions levying special assessments against Parcels VH-502-1:

Resolution 2007-10 Final Resolution Authorizing Levying of Special Assessments against Benefitted Property for Sanitary Sewer & Laterals, Water Main & Services, Storm Sewer & Laterals, Driveways, Curb & Gutter, and Roadway Reconstruction on Shawano Avenue, Westhill Drive, and Fredrick Court.

WHEREAS, the Village of Howard wishes to enter into a Subdivision Development Agreement with the owners of Parcels VH-502-1 which requires that the special assessments be rescinded and cancelled.

NOW, THEREFORE, BE IT RESOLVED pursuant to Sec. 66.0703(10), Wis. Stats. by the Village Board of the Village of Howard, Brown County, Wisconsin as follows:

1. Final Resolution No. 2007-10 are hereby amended such that the special assessments levied for Parcels VH-502-1 are hereby cancelled and rescinded.

2. In all other respects the special assessments as levied in Final Resolution No. 2007-10 shall remain in full force and effect.

3. The Clerk of the Village of Howard is directed to publish this Resolution as a Class 1 Notice and is further directed to mail a copy of this Resolution to the owners of the properties as described herein.

4. If any section, sentence or clause or any special assessment set forth or referred to herein shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining sections or assessments approved herein, which shall remain in full force and effect.
