Authority to Work Application Conditions

General Conditions: 1) The signatory warrants that he/she is authorised to sign on behalf of the Applicant. 2) In this Authority to Work Application, Group means Holdings Pty Limited, and an entity which is, for the purposes of section 50AA of the Corporations Act 2001 (Cwlth), under the “control” of Queensland Motorways Holdings Pty Limited or any subsidiary to Queensland Motorways Holdings Pty Limited within the meaning of the Corporations Act 2001 (Cwlth) but extended so that: a) a trust or other entity may be a “subsidiary”, for the purposes of which any units or other beneficial interests will be deemed shares; and b) a company, trust or other entity may be a “Subsidiary” of a trust or other entity if it would have been a Subsidiary if that trust or other entity were a company. 3) Transurban Queensland provides tolling services to other members of the Transurban Queensland Group and acts on behalf of those members. All representations made, and indemnities provided, by the Applicant to Transurban Queensland are also made, and provided for, the benefit of the other members of the Transurban Queensland Group. 4) No activities shall commence until an approved signed Authority to Work Permit is issued and received by the Applicant. 5) The Applicant shall indemnify Transurban Queensland, and any relevant member of the Transurban Queensland Group, against any claims, loss or damage arising out of any activity associated with this Authority to Work Application Form and any Authority to Work Permit. 6) Transurban Queensland will hold the Applicant responsible for any damage caused to Transurban Queensland’s assets or the assets of any relevant member of the Transurban Queensland Group, by the Proposed Activities. 7) Transurban Queensland does not accept any responsibility for damage to property or injury to any person or repair work resulting from the Proposed Activities or any other activities carried out by the approved Applicant or a person acting on behalf of the approved Applicant. 8) The Applicant is responsible for all aspects of site control and safety. 9) The Applicant will be responsible for reinstating the work site to the satisfaction of Transurban Queensland. 10) If the Proposed Activities include traffic control: a) a traffic guidance scheme detailing the traffic control devices to be implemented must be submitted to Transurban Queensland (Traffic Guidance Scheme). It must be produced in accordance with the Manual Uniform Traffic Control Devices (MUTCD) Part 3 Works on Road (current edition) as published by the Department of Transport and Main Roads (DTMR) and Work Health and Safety Act 2011. If any traffic diversion is required, detour signage and detour map/s will be provided as part of the Authority to Work Application. All traffic control measures and devices must comply with the Traffic Guidance Scheme/s; b) the Applicant must engage a Traffic Management Company currently registered with DTMR. All traffic controllers must be suitably qualified to assist in traffic control; c) the Applicant or its contractor must monitor the surrounding traffic flow and should there be any significant queuing (i.e. the queue extends to the first set of roadworks signs), the Applicant or its contractor shall clear the area and allow traffic queues to clear before resuming work. In these circumstances, the Applicant or its contractor must phone the Transurban Queensland’s Traffic Management Centre (ph. 3182 2469) and advise when the site is cleared and when the works resume; and d) all lane closures are subject to weather conditions. 11) The Applicant must notify any other interested agency (including and without limitation DTMR, Queensland Police Service, Department of Environment and Heritage Protection, Emergency Services and local authorities) of the proposed work and obtain, and ensure that its contractors obtain, any other required permit and/or approval before any road activity commences. 12) Public liability insurance cover must be in place, and sufficient evidence provided to Transurban Queensland by the Applicant if requested, prior to the activity commencing, as follows: a) for construction/maintenance contractors (major/medium risk) an amount not less than $20million; b) for facility tradespeople (minor risk) an amount not less than $5 million. 13) The Applicant must inform its nominated Transurban Queensland Representative of any change in the operating conditions (operating times, dates, duration) and of any requirements to adjust the approval. A re-submission of and approval of the Authority to Work Permit may be required. 14) All contractors and workers of the Applicant involved in the activity must complete Transurban Queensland’s safety induction training course and attain the required competency levels to enable them to perform their duties safely when working at the Location.

15) The Applicant/Contractor must advise the relevant Transurban Queensland Traffic Management Centre (TMC): a) One hour before starting any activity; b) Upon completion of the proposed activity or after all traffic control devices are removed; and c) Immediately in the event there is any incident/ accident or unexpected disruption to traffic at or near the work site. The Transurban Queensland Traffic Management Centre phone numbers are as follows: – 07 3182 2469 Gateway Extension Motorway – 07 3182 2469 – 07 3182 2469 Tunnel – 07 3228 7500 Go Between Bridge – 07 3228 7500 Airportlink Tunnel – 07 3246 4622 Clem Jones Tunnel – 07 3250 1311 16) Any amendments to the Authority to Work Permit and Traffic Guidance Schemes are to be provided to the Authority to Work Coordinator for approval at least 2 working days prior to commencement of any work/activity. 17) The Proposed Activity must not cause, or be likely to cause, environmental harm, whether from release of waste, contaminant, weed, pest, dust, noise, sediment; or through the disturbance of native flora / fauna or heritage item. Any detrimental events resulting from such activities will be promptly and appropriately responded to and immediately notified to Transurban Queensland’s Traffic Management Centre. Transurban Queensland reserves the right to claim or withhold expenses incurred for remedial works deemed necessary to mitigate environmental harm from parties responsible. 18) The Authority to Work Permit must be present at the Location at all times. 19) The Applicant agrees that it is its responsibility to provide the contractor(s), subcontractor(s) or any agent responsible for performing work under the Authority to Work Permit, with a copy of the Authority to Work Permit, including these ‘Conditions of Permit’ and the attached Traffic Guidance Schemes. The Authority to Work Permit and supporting documentation, such as Traffic Guidance Scheme/s and Safe Work Method Statements, shall be available at the Location at all times when work is in progress, and presented to a Transurban Queensland Representative upon request. 20) The Applicant agrees it has read, understands and agrees to comply with, and must ensure that its contractors will read, understand and agree to comply with, the Authority to Work Permit and ‘Conditions of Permit’. 21) Upon the issue of the Authority to Work Permit, further specific conditions (Applicant Specific Conditions) may be imposed on the Applicant. The Applicant, its contractors and workers must comply with any such Applicant Specific Conditions as set out in the approved Authority to Work Permit. 22) The Authority to Work Permit may be immediately revoked or cancelled for the convenience of Transurban Queensland. Any breach of these ‘Conditions of Permit’, including any Applicant Specific Conditions, may result in the immediate revocation or cancellation of the Authority to Work Permit. 23) In the event of cancellation or revocation of the Authority to Work Permit, the Applicant and its contractors must immediately cease all operations, restore traffic (if applicable) and return to the Traffic Management Centre all keys and other devises (including swipe cards) that access the Location.  Please allow 10 working days to process an Authority to Work Application.  By submitting this Authority to Work Application, the Applicant is consenting to agree to the ‘Conditions of Permit’ identified above. Such conditions will apply and the Applicant agrees to comply with these conditions if the Authority to Work Application is approved and Transurban Queensland issues the Applicant an Authority to Work Permit. The Applicant can appeal any of these conditions in writing. The appeal is to be attached to the Authority to Work Application.
