Billings City Administration Weekly Report

March 1, 2019 1) Residential Snow Plowing – The contract for residential snow plowing with Firstmark was anticipated to run out of funds on Saturday, March 2nd. I approved an amendment to the contract to continue residential plowing for the near future. Council will see an additional amendment at the 03/11/2019 council meeting to meet residential snow plowing needs if weather persists or if necessary.

2) OBSD Legislation – a great deal of staff time was used this week to further the OBSD draft legislation. A very productive meeting with Sen. Webb and the strategy partners was conducted on 02/28/2019. The draft bill should be introduced next week with a scheduled hearing the week of 03/11/2019.

3) Capital Improvement Plan (CIP) Public Meeting – Assistant Public Works Director Jennifer Duray conducted a second public meeting reviewing the capital improvement plan for FY20 at Will James Middle School. Unfortunately the weather was bad and public attendance was low. Council will receive a presentation of the Capital Improvement Plan at the 03/18/2019 work session.

4) SBURA – We hired Moulton Bellingham to review the overpayment of a contract with SBURA. We should see a report of the results of the investigation in late March or early April.

5) Legislation and Lobbyist – Several bills were worked on this week with staff traveling to Helena. In particular HB 462 Revise Administration of TIF Districts, HB 567 Establish Montana school marshal program and SB 315 Revise laws on public defender assignments related to local ordinances, were of importance, along with many others. Our lobbyists, Greg and Aimee have provided a synopsis of the session to date along with a list of attached bills and status. We are in daily contact with our lobbyists and interns to monitor and react to information as it becomes available.

The is at the halfway point of the 90 day session and are officially on the Transmittal break tomorrow through March 7th. The Senate left Wednesday and comes back on the 7th at 4p.m. to gavel in. The House leaves March 1st and comes back on Monday, March 11th. By the joint rules of the Montana legislature if either body (House or Senate) is gaveled in session then it counts as a legislative day. When the Legislature returns they will focus on passing a budget and other pivotal policy measures in the remaining 45 legislative days. Many bills in drafting will automatically die since they were not introduced and passed before the transmittal deadline of March 1st. Additionally, bills that were introduced but failed to pass from one house to the other died, unless the bills are deemed appropriation, revenue or proposing referenda and then these bills have until the 67th day- April 1, 2019 to pass from one house to the other.

To give an overview of the work the Legislature has completed to date there have been 3,292 bill drafts requested to Legislative Services. This is 800 more than last legislative session. Of this number 1043 bills have been introduced. (This is 10 less than last session.) Breaking it down into houses there have been 637 House Bills introduced, 321 Senate Bills introduced, 45 House and Senate Joint Resolutions introduced and 2 House Resolutions and 38 Senate Resolutions introduced.

The Legislature will now be focusing on passing a state budget (the only Constitutional requirement of the Montana Legislature), infrastructure funding (bonding bills and specific and general infrastructure bills), tax issues (increases, cuts and refunds), continuing Medicaid Expansion which is set to sunset in July 2019. The Governor and the Republican Leadership in the Legislature have differing opinions on all of the above topics.

In his last legislative session, Governor Bullock has a more limited legislative agenda than in past legislative sessions and is focused publicly on funding and keeping Medicaid Expansion, Pre-Kindergarten funding, passing infrastructure funding with some bonding component and leaving enough money in an ending fund balance account that is at a level higher than what the Legislature wants to leave in this ending fund. We will be paying close attention to these areas of discussion, taxes, appropriations and issues list above the second half of the Legislative Session.
