In 2012, both Houses were scheduled to meet 74 times with sittings in the Lok Sabha expected to last 6 hours and Rajya Sabha 5 hours. However, only 61% of available time was used for parliamentary work in the Lok Sabha and 66% in the Rajya Sabha. The Monsoon Session was disrupted over the alleged irregularities in the allocation of coal blocks. Around 77% of time was disrupted and both Houses only sat for 51 hours (of the allocated 220). The recently concluded Winter Session stalled over the government's decision to allow 51% FDI in the retail sector and introduction of quotas for SCs and STs for reservation in promotions. More than half-way through the 15th Lok Sabha, productive time is at 70%, significantly lower than previous Lok Sabhas.

In 2012, 22 Bills were passed by both Houses

The government had listed 94 Bills for consideration and passing (some repeatedly) across the three sessions of Parliament. By the end of the Winter Session, only 22 Bills were passed.

At the end of the year, 104 Bills remain pending before Parliament. These include the National Food Security Bill, the Land Acquisition Bill and the GST (115th Amendment) Bill.

In 2012, average attendance in both Houses was 78.5% In the Rajya Sabha, amongst parties with more than 10 seats, members from the Samajwadi Party were the most regular attendees of Parliament (average attendance of 91%). While in the Lok Sabha the most regular attendees were MPs from the Bahujan Samaj Party (89%).

he Govt of Uttarakhand is contemplating measures and mechanisms which may well be categorised to curb provisions of the Right to Information (RTI) law and weaken RTI structure in Tthe state. In a recent decision the state Govt had issued notification to the effect wherein it had changed the provisions of the RTI Act as per article 27(2) of the Act. The RTI Act 2006, gives power to a public authoirity, the State Govt to make changes under article 27(2) of the Act. The art 27(2) empowers a state Govt to make changes on the 06 core issues. Although the RTI Act, 2005 is amply clear that the Information Commission can examine the requisite papers in the hands of the Govt in order to protect the right of the citizen and if need be can summon the officials, the Govt of Uttarakhand’s notification is full of ambiguity as on the one side by sect 9(b)(3) it says that the CIC won’t have the power to investigate and on the other hand vide sec 9(b)(3) it says the CIC would have the power to investigate the issues. The new notification of the Uttarakhand Govt, states that the CIC won’t be able to summon the APIOs, PIOs, 1st Appellate autority. However, it states that the APIOs, PIOs and 1st Appellate authority shall represent their cases voluntarily, to the commission.

The state Information Commisiion, is up in the arms against the Govt’s notification which bars the Information Commission to summon the officials. The Chief Information Commissioner, Uttarakhand NS Naplichyal and State Information Commissioner Vinod Nautiyal, both have termed the Govt notification as ‘against the spirit of the RTI law’. . Noted RTI activist Manoj Dhyani, the President of th RTI Lok Sewa, trust organisation had termed that the ambigous nature of the notification reflects the lack of application of mind in the preparation of the draft notifcation.He further states that the anti-RTI provisions of the notification will be opposed tooth and nail.;The RTI activists in the state have termed the provisions made under the new notification as against the spirit of the law. some organisations had threatened to challenge the provisions of the notification in the court of law. The organisations like RTI Club and RTI Lok Sewa have already taken the cudgels in their hands to defeat the designs of the Govt, which they say would ultimately harm the interest of the citizen.

And S. 24(1) of the ‘RTI Act, 2005’ states that “Nothing contained in this Act shall apply to… intelligence and security organisations specified in the Second Schedule, being organisations established by the Central Government. Or information furnished by such organisations to that Government”.

Recently on 16 August 2011Shehla Masood (a prominent RTI activist in Bhopal, Madhya Pradesh) was murdered. The assaulted and murdered RTI activists lists includes the killed policemen as well. In Uttar Pradesh, on 25 July 2010 a Police Home Guard Babbu Singh was killed, allegedly for seeking information about government funds and work done by his village pradhan in the Katghar in the Bahraich district, Uttar Pradesh. It has become a common strategy of the cartels to perpetrate actions like charging with assaults, social ostracisation and even resorting to murdering those who raise the concern for transparency and accountability in the system.
