RESOLUTIONS

23 Welcome and Apologies

The Chair welcomed everyone to the meeting and apologies were received from Councillor Hardman.

24 Minutes of the Last Meeting held on 24th May 2007 were confirmed and signed as a correct record.

25 Declarations of Interest

Councillor Rigby declared a personal and prejudicial interest (voted for approval at West Pennine Area Management Committee) in agenda item 17 (Proposed Bridleway at Sunnyhurst Woods) and left the meeting during discussion and decision on the item.

26 Petition : Proposed Erection of 120 Static Lodges, Manmade Lakes, Leisure/Restaurant Building, Maintenance Workshop and Associated Works including Landscaping and Car Parks and Servicing at Land Off Brokenstone Road, Feniscowles,

The Committee received a report advising of the receipt of a petition on 17th May 2007 with 183 signatures objecting to the proposed erection of 120 static lodges, manmade lakes, leisure/restaurant building, maintenance workshop and associated works including landscaping and car parks and servicing at land off Brokenstone Road, Feniscowles, Blackburn.

The report further advised that a planning application was submitted on the 31st January 2007. The grounds of objection were outlined in the report and a decision on the application was still pending.

RESOLVED – That the report and petition be noted and that the lead petitioner be informed that their views would be taken into account when a decision is made on the application and they would be informed of the decision.

Planning & Highways Committee Tuesday, 26th June 2007 27 Petition : Change of Use and Extension from Dwelling to 3 Shop Units with Living Accommodation at 21 New Bank Road, Blackburn

The Committee received a report advising of the receipt of a petition on 30th May 2007 with 32 signatures objecting to the proposed change of use and extension from dwelling to 3 shop units with living accommodation at 21 New Bank Road, Blackburn.

The report further advised that a planning application was submitted on the 16th April 2007, which was subsequently refused under delegated powers on 11th June 2007. The grounds of objection were outlined in the report.

RESOLVED – That the report and petition be noted and that the lead petitioner be informed of the final decision on the application.

29 Traffic Regulation Orders Monitoring

The Committee received a report detailing the current position on progress of various traffic regulation orders approved by the Committee.

Planning & Highways Committee Tuesday, 26th June 2007 Members requested that the column ‘Complete & Checked on Site’ be filled in and any finished works be removed from the list. Officers responded that the report would be updated accordingly.

30 Proposed Traffic Regulation Orders

The Committee received a report containing details of requests for Traffic Regulation Orders at the following locations:

Attached to the report were schedules and plans in respect of the 12 requests.

The report recommended that officers investigate proposals 1, 4 and 6 to 12 and report back to the next meeting the results of those investigations.

For proposals 2 and 3 it was recommended that the Director of Legal Services be authorised to advertise the proposal as detailed in the attached schedules and plans.

With proposal 5 it was reported that parking was extremely busy in the Whalley Range area and properties 103-151 had requested extra parking. Officers had investigated the area and found no restrictions could be removed to provide further parking and also advised that due to the area having traffic calming it would be difficult to provide the extra parking, therefore it was recommended that the proposal be abandoned.

1) That the Committee supports officers’ recommendations to investigate proposals 1, 4 and 6 to 12 and report back to the next meeting of the Committee the results of those findings.

2) That the Committee supports officers’ recommendations to authorise the Director of Legal Services to advertise proposals 2 and 3.

3) That proposal 5 be abandoned.

4) That the report be noted.

31 Results of Preliminary Consultations on Proposed Traffic Regulation Orders

The Committee received a report outlining the results of preliminary consultations on the following proposed traffic regulation orders:

1. West View Place, Blackburn Proposed Prohibition of Waiting 2. George Street West, Blackburn Proposed Prohibition of Waiting 3. Back Britten Street, Darwen Proposed Revocation of Prohibition of Waiting 4. Preston Old Road, Blackburn Proposed Partial Revocation of Limited Waiting 5. Back Reservoir Street, Darwen Proposed Prohibition of Driving

The report recommended that Committee support officers’ proposals 1, 2 and 5 and therefore the traffic regulation orders be now formally advertised as detailed in the schedules and plans attached to the report.

With regard proposal 3 it was reported that due to the area being included in the HMR project, officers recommended that the proposal be deferred to undertake an investigation to establish how the request would fit in to the larger HMR scheme.

Members pointed out that proposal 4 Preston Old Road, Blackburn comes under the Meadowhead Ward and not as reported with . Members agreed that proposal 4 be abandoned.

RESOLVED –

1) That the Director of Legal Services be authorised to advertise proposals 1, 2 and 5 as detailed in the schedules and plans attached to the report.

The Committee received a report outlining the results of advertising the following proposed traffic regulation orders :

Attached to the report were schedules and plans relating to the 17 respective schemes.

Objections had been received for proposals 4, 13 and 14.

The report recommended that proposals 2 to 12, 14, 15 and 17 be forwarded to the Executive Member for Regeneration to approve as advertised and detailed in the attached schedules.

With regard proposal 1 it was reported that vehicles are experiencing

Planning & Highways Committee Tuesday, 26th June 2007 difficulties accessing and existing Gate Street due to traffic parking close to the junction of Copy Nook. As further representations had been received officers recommended that the proposal be deferred to hold a site meeting to propose one scheme for the area.

For proposal 13 it was reported residents had requested the closure of Hollin Bridge Street as it was being used as a rat run. Previously, the route had remained open for emergency vehicles to access the hospital, however this was no longer necessary as the hospital had now closed. Objections to the closure had been received from 3 local businesses which were detailed in the report. Officers recommended that the grounds for closure were not necessary on the basis of recorded accidents for this stretch and recommended the proposal be abandoned.

For proposal 16 it was reported that vehicles were parking too close to the junction with the A666 which was causing safety problems when vehicles entered or exited Falcon Avenue. To resolve the matter it was recommended to revoke the existing single yellow line and support the advertising of 5 metres of no waiting at any time restrictions on both sides of Falcon Avenue.

RESOLVED

1) That the Committee supports the implementation of proposals 2 to 12, 14, 15 and 17 and that they be forwarded to the Executive Member for Regeneration to approve as advertised and detailed in the attached schedules.

2) That the Committee support the deferral of proposal one.

3) That the Committee support the advertising of proposal 16.

4) That the Committee supports the abandonment of proposal 13.

5) That the report be noted.

33 Petition : Clarendon Road, Blackburn – Request for Residents Parking

The Committee received a report informing of the receipt of a petition with 6 signatures from local residents requesting residents parking to resolve parking difficulties due to growing business on the opposite side of Clarendon Road.

It was recommended that the report be noted and the lead petitioner be informed of the proposed course of action.

34 Petition : East Park Road, Blackburn – Request for Residents Only Parking

The Committee received a report informing of the receipt of a petition with 44 signatures from local residents requesting residents only parking as driveways and footpaths are being obstructed mainly by people attending St Mary’s College. This is causing difficulties for emergency services and refuse wagons accessing the street.

It was pointed out that the area concerned was East Park Avenue and not East Park road as shown in the report.

It was recommended that the report be noted and the lead petitioner be informed of the proposed course of action.

35 Petition : Norwich Street, Blackburn – Request for Residents Parking

The Committee received a report informing of the receipt of a petition with 7 signatures from local residents requesting residents parking to resolve parking difficulties due to growing businesses on the opposite side of Norwich Street, Blackburn.

It was recommended that the report be noted and the lead petitioner be informed of the proposed course of action.

36 Petition : Walter Street, Blackburn – Request to Remove Double Yellow Lines

The Committee received a report informing of the receipt of a petition with 10 signatures from local residents requesting the removal of a loading bay on Walter Street, Blackburn, which had not been used for some years due to the closure of businesses. This would increase the number of parking spaces in the area.

It was recommended that the report be noted and the lead petitioner be informed of the proposed course of action.

37 Public Rights of Way Diversions Monitoring Report

The Committee received a report updating on the progress of public rights of way matters since the last report that was submitted to the Committee on 26th April 2007.

RESOLVED – That the report be noted.

38 Request to Stop-Up Footway linking Heys Lane and Arkwright Fold, Blackburn

The Committee received a report informing of the request to close the footway which links Arkwright Fold to Heys Lane to the front of 17/19 Arkwright Fold and the gable of 19/21 Arkwright Fold and to request permission to set up a magistrate’s court hearing date for the application to stop-up the footway.

It was reported that the land the footway runs over is in the ownership of 17, 19 and 21 Arkwright Fold and closure of the footway would revert the maintenance of the land to the frontages removing the duty from the Council. Consultations had been undertaken with 31 properties on Arkwright Fold resulting in 21 replies, 19 for the closure and 2 against the closure.

RESOLVED – That the report be noted and that the Director of Legal Services be authorised to set up a magistrate’s court hearing and arrange the advertising process.

39 Sunnyhurst Woods – Request for Bridleway

The Committee received a report informing of the content of two petitions regarding a proposed bridleway through Sunnyhurst Woods.

It was reported that the petitioners requesting the bridleway had put forward a route to upgrade the definitive footpath on the northern edge of the woods to bridleway. The petitioners against the proposal gave objections relating to issues of safety, destruction of woodland, fauna and flora. Appendix one of the report detailed all points for and against the proposal.

Members raised the point that bye laws state no person shall ride a horse or pony in any part of the pleasure ground. Members also raised concerns over safety of horses and no monies being available to upgrade the route.
