1.1 Suggestons of Report No.1

Suggestions have been given in Resettlement Report No.1:

(1) Wuhan Urban Construction Utilization of Foreign Investment Project Management Office should further work with the governments of Dongxihu and for the two sub-projects in the districts. (2) The IAs should further accelerate the transaction of acquired land and resettlemen progress according to the requirement of the Project implementation. (3) The IAs should further strengthen the public participation of the land acquisition and resettlement.

2.2 Results of monitoring

According to the on-site monitoring results showed:

(1) Wuhan Urban Construction Utilization of Foreign Investment Project Management Office and Sub-project Office have established reporting system contacting each other. Wuhan Urban Construction Utilization of Foreign Investment Project Management Office are being assisting Caidian Distric Sub-project Office to handle the procedures of acquiring construction land. This has played a certain role in the sub-project progress. (2) The procedures of land acquired are being handled, but little progress. As for the land requisition procedure has not ended, there is some impact of paying the land acquisition and resettlement compensation funds. Three Gates Connection Sub-project construction has started, This will accelerate the progress of the whole project. (3) The public participation of the land acquisition and resettlement has payed enough attention. In the progress of implementation Three Gates Connection Sub-project, the project unit had a full consultation with the owners and the affected people of the land, which makes the resettlement progress smoothly.

Monitoring and evaluation agency comment:

As the land acquisition and resettlement work are under way, the related IAs should carry out the land acquisition procedures of sub-project as soon as possible according to domestic regulation, ensuring land acquisition and resettlement work carried out smoothly. compared to June 2007, some sub-projects have some progress, such as Three Gates Connection Sub-project, Nantaizi Lake Sub-project IA has been in consultation with relevant units, land acquisition and resettlement work has begun.Three Gates Connection Sub-project IA has payed the compensation to the affected people. But the relevant departments also need to speed up their work, make sure the IAs complete the legal procedures of land acquisition as soon as possible.

The actual land requisition amount of Three Gates Connected component has a bigger change with the RP’s. The main component of this sub-project is the construction of the network, most land is temporary land occupation. The land will be use as green space after construction. Between the two years of preparating of RP (2005) and implementatiing of the project, the number of residential houses and trees in the scope of the project land has changed largerly. Project implementation units payed the compensation in accordance to the relevant regulation.

The remaining component is not yet begining, no land acquisition and resettlement compensation payed.

5 Resettlement Implementation by WMDC

(1) Hanyang Nantaizi Lake Sub-project

Land requisition procedures of Nantaizi Lake Sub-project are being processed. At present, the statement and certificate have being acquired. 89,000 square meters (133 mu) of land will be occpuied in plan for Nantaizi Lake WWTP Expansion & Collection System Project, including the demolition of houses. The acquisition land located in Jiangdi Street, , which belongs to Wuhan Taizi Lake Co..Statistics Bureau of Hanyang district issued that the average agriculture production value of this region is 30,900 yuan per mu. Wuhan Taizi Lake Co. rented the land to Wuhan Huanhu Construction Engineering Co. Ltd. in 2006. Wuhan Huanhu Construction Engineering Co. Ltd. demolited the original 4,000 square meters houses for expanding production, in the preparating of constructing the new plants, Wuhan Municipal Drainage Company consulted with Jiangdi Street Office of Hanyang District for the Nantaizi Lake WWTP land acquisition. The street office demand Wuhan Huanhu Construction Engineering Co. to stop the construction of new plant. Wuhan Municipal Drainage Company consulted with Wuhan Huanhu Construction Engineering Co. for houses compensation.

The planed land compensation rates of Nantaizi Lake WWTP Expansion Project is 352,000 yuan/mu decided by Wuhan Municipal Drainage Company. The compensation rates for building are according to the replacement cost of the building in the region. Young crops and attachments compensation rates are 12,000 yuan/mu.

Comment: The site of Nantaizi Lake Sub-project is consistent with the RP’s. Because there are two years between preparating of RP (2005) and implementatiing of the project, the number of land attachments has changed largerly compared to the RP’s. Wuhan Municipal Drainage Company has consulted with Hanyang District Government, Wuhan Municipal Investment Company and Jiangdi Street Office of Hanyang District many times, and has brought a solution to solve the land acquisition problem. The agreement has been reached basically. Wuhan Municipal Drainage Company should complete the land acquisition procedures after the land acquisition compensation agreement subscribed as soon as possible.

(2) Huangpu Road WWTP Sub-project

Huangpu Road WWTP Upgrade Sub-project plans to upgrad the existing treatment technics, not new land needed.

Comment: Huangpu Road pumping stations is a one-level wastewater treatment pumping

station which has been built, located in the River levee. The location of the pumping station is not in line with the state river management regulation.

The relevant departments should choose other construction site to build a new pumping station.

6 Resettlement Implementation by WJICC

Wuhan Jianxing Infrastructure Construction Company (WJICC) is responsible for the resettlement implementation of the Storm Water Management Component. Wuhan Urban Construction Utilization of Foreign Investment Project Management Office is responsible for paying of land acquisition and resettlement funds, and inspection of land acquisition and resettlement.

6.1 Adopted resettlement principles

(1)Compensation policy for temporary land acquisition

The first phase of this project temporary land occupation belong to Wuhan Wujiashan Taiwan Investment Zone Jinyinhu Ecological Garden Management Committee and Wuhan Jinyinhu Ecological Business Town Management Committee.

Compensation expenses for ownerships of the land has been payed according to the compensation rates for temporary land acquisition by Wuhan [2005] 11th document. Compensation rates of temporary use of land were shown in table 9. Compensation rates of temporary use of land for land ownerships were shown in table 10.

Because the ownership of the land acquisition is state farm, the policy adopted is the affected people returned the land to the farm, then the farm handed over the land to the project unit to use. Compensation rates of temporary use of land for land ownerships were shown in table 10.

11 households of 60 affected households by temporary land acquisition were selected as sample households to monitoring. Affected sample households of temporary land acquisition were shown in table 11. 14

Monitoring has been taken to the 4 households which houses were demolited. The compensation details were shown in table 12.

Wuhan Dongzheng Real Estate Appraisal Company Limted appraised the houses which should be demolited according to the related policy of Wuhan and ADB.

6.2 Interview Record

December 24, 2007 Wuhan Jinyinhu Ecotourism Development Co., Ltd. Peng Fubin

Our company has signed the agreement with Wuhan Urban Construction Utilization of Foreign Investment Project Management Office. Land which occupied by the project is temporary, it belongs to the farm. Land acquisition compensation standard is 18,681 yuan/mu. Compensation standards of land usufruct are: 1,500 yuan/mu for vegetable field (higher than policy standards 50 per cent), 3,500 yuan/mu for fish ponds. Land which occupied temporarily is managemented by farm workers by contract. 60 households are affected by land acquisition, they all received the compensation according to the standard. Housing demolition area is 124.99 square meters, of which four are plants. There are 30 workers in the four factories. The four enterprises decide disposal manner by themselves after they received the compensation. If the farmers who lose their land are willing to work in Wuhan Jinyinhu Ecotourism Development Co., Ltd., they will be arranged to have jobs, such as yardman, dustman and etc., they will be payed more than 800 yuan erery month. After affected households lose use right of land, part of endowment insurance and medical insurance will be payed by the company, and every people will receive 300 to 480 yuan / month income.Farm workers have their income sources, land income is a small part of total income. the affected poeople will not reduce their income after they received the current land requisition compensation.

December 24, 2007 Xinqiao Village Huang Qingliang

Compensation standard for saplings is 8,000 yuan / mu, vegetable land is 1500 yuan / mu. We all signed the agreements after the land acquisition scope investigation. About 12 to 13 September (2007), land acquisition survey was done. My family has received total 120,000 yuan compensation fees. We have endowment insurance and income will not reduce. Now I plant the saplings in other village. My family has five people, three sets of housing. Living standard is higher than ever. I am satisfied with the land requisition compensation.

December 24, 2007 Xinqiao Village Huang Chengzhi

My family has received total 24,000 yuan compensation. There are three people in my family. We all have endowment insurance, have a worry-free life, but still continue to engage in the original work to getting the corresponding income. There are two sets of housing. I am satisfied with the land requisition compensation.

Xinqiao Village Cai Guozhen

Compensation of my family is 3,200 yuan, was received last week. There is no negative impact my family about the temporary land acquisition. I am satisfied with the land requisition compensation affirmatively. There are five people and two sets of housing of my family.

December 24, 2007 Xinqiao Village Luo Mulan (female)

Compensation of my family is 3,600 yuan, was received last week. Now the company pays me 300 yuan salary every month. I also work outside, earn 1,000 yuan income every month. Land requisition has not effect of our lives. My family has five people and two sets of housing.

December 24, 2007 Xinqiao Village Village Pan Cuijiao (female)

Compensation of my family is 3,100 yuan, was received last week. Now the company pays me 300 yuan salary every month. I also work outside, earn 1,000 yuan income every month. Land requisition has not effect of our lives. My family has five people and two sets of housing.

Comment: The project is located in the suburb of Wuhan City, and the area is developing uninterruptedly, so the income from the land is only about 5 percent of the farm workers’ whole income. These workers can receive corresponding compensation as they have social insurance. They can still do the original work. There is no negative impact to their people about the temporary land land requisition. The income of these people has increased by the compensation in the year.

7 Resettlement Implementation by WDKWPMC

Wuhan Dongxihu Kaidi Wastewater Pipeline Management Co. ltd. is the implement unit of Dongxihu Wastewater Collect System Sub-project. The company were established by Kaidi Water Services Company and Dongxi Lake Subsidiary Company of Wuhan Municipal Drainage Company. Person is arranged to responsible for the land acquisition and resettlement work of the project. Land demolition work of this project has not yet been carried out. ADB loans total of three pumping stations which need to requisition land, the location of two pumping stations have been identified, the other pumping station has not been determined. The character of pumping station land acquisition has not investigated. Construction of the project required temporary 5.7 km land occupied. All the land is green space, which has been acquisited. Now the implementation unit has not consulte with the current usufruct unit about the temporary land acquisition. There is one housing need be demolited. There will be 2.6 kilometers Pipe Jacking construction in the pipeline network engineering, which avoid the demolition of residents’ houses and trees.

8 Resettlement Implementation by WCMIDC

Wuhan Caidian Municipal Investment Development Co., Ltd. is responsible for implementating of this Cadian component’ resettlement work. At present the project is still preliminary design stage, and land acquisition procedures are being processed. At the same time, the pipeline disposal is being planed. Engineering Department of Wuhan Caidian Municipal Investment Development Co., Ltd. is responsible for land acquisition and resettlement work. The workgroup has three people, and has professional land acquisition and resettlement experience.

WWTP construction is a good thing, we should support it.

The Government has consulted with us for requisition our village’s land. 120 mu land will be requisitioned, third group and fifth group of our village are affected. 70 to 80 households are affected, the detail number can be known after the construction red line was determined. Involving about 200 people. Our village is a outskirts one, fewer land and more people, less than 0.3 mu per capita. Agricultural production is not he main income source for the villagers. There are 150 graves within the scope of land requisition need be moved. Our village has specialized relocation of graves place.

There is no house demolition in the scope of land requisition.

Compensation for land requisition is according to relevant policies and regulations of Wuhan City and Province. We implement policies in the process of land requisition. The affected households get compensation mainly, and they can participate in endowment insurance. Our village has many employee opportunities. Our village has the experience that a highway construction site had requisitioned land. The living standard of affected people will not fall after they received reasonable compensation.

Our village has 926 people, divides into five villager groups. Villagers’ average income is 5,800 yuan per year. There are three private enterprises in our village. Many villagers of our village work in these enterprises, their income are 8000 to 10,000 yuan per year.

In order to make landless villagers find jobs, the District Labor Department organizes

specialized training to enhance their employment capability.

9 Conclusion and Suggestion

9.1 Conclusion

(1) The land acquisition and resettlement has made significant progress after the first monitoring and evaluation.

(2) Wuhan Urban Construction Utilization of Foreign Investment Project Management Office has payed attention on the land acquisition and resettlement work of thish project.

(3) Each sub-project implement unit has designated person to deal with land acquisition and resettlement work.

(4) Resettlement implemented by Wuhan Jianxing Infrastructure Construction Company (WJICC) is in line with ADB resettlement plan’s requirements.

(5) The land acquisition and resettlement work of this prject is behind the schedule which ADB approved.

9.2 Suggestion

(1) Wuhan Urban Construction Utilization of Foreign Investment Project Management Office

(a)Strengthen the consultation with each sub-project for the land requisition procedures, especially the land requisition procedures progress of Caidian District, Nantaizi Lake, and the site of Huangpu Road pumping station.

(b)Deliver the related policy and RPs of land acquisition and resettlement which ADB approved to each sub-project to implement compliedly. Contact ADB for the change of implementation in time.

(c)Feed back the report of ADB resettlement specialist and external independent resettlement monitoring and evaluation agency to each sub-project IA.

(d)Request each sub-projec IA to strengthen the information management of land acquisition and resettlement, establish land acquisition and resettlement database. Strengthen the document management of land acquisition and resettlement.

(2) Wuhan Municipal Drainage Company

(a)Accelerate land acquisition and resettlement agreement signing of Nantaizi Lake sub-project. Investigate the affected workers and residents, make sure the affected people will receive the corresponding compensation, and their living standard will not fall through the coordination of the government departments.

(b)Suggest Huangpu Road WWTP to select other site for construction. The location will be determined by Wuhan Municipal Planning departments.

(3)Wuhan Dongxihu Kaidi Wastewater Pipeline Management Co. ltd.

(a)Identify the land usufruct unit in the progress of acquiring the temporary land occupied procreducres, pay compensation according with the policy and regulations of ADB and Wuhan.

(b)Implement the house demolition according to the RP’s policy and the will of the resident when deal with the one house which need be demolited.

(c)Pay attention to the safety of residents’ houses when doing the pipe-jacking construction. This issue shoud be considered when transacting the construction insurance.

(4)Wuhan Caidian Municipal Investment Development Co., Ltd.

(a)Speed up the procedures of land acquisition, construct of the project as soon as possible.

(b)Organize the staff who are responsible for the land acquisition and resettlement to learn ADB resettlement policy.

(5)Wuhan Jianxing Infrastructure Construction Company

(a)Wuhan Jinyinhu Ecotourism Development Co., Ltd. should track the employment problem of the affected workers by the plants demolition. If the affected property ownerships still want to do the same business, the government departments should help them to find the appropriate production site. If the affected workers still want to have jobs, they should be arranged, earn corresponding wage income.

(b)Speed up the progress of the procedures for land acquisition, implement the work according to the resettlement policy approved by ADB.
